TRANSFER OF FUNDS FOR TRANSPORTATION ART PROJECT AT THE CHESTNUT AVENUE INTERSTATE 5 UNDERPASS, CIP PROJECT NO. 6098 -Adoption of Resolution No. 2022-030 approving the appropriation and transfer of $150,000 in existing public art funds from the General Fund to Capital Improvement Program Project No. 6098 in the General Capital Construction Fund to be utilized for transportation art at the Chestnut Avenue Underpass Community Enhancement Project. (Staff contact: Suzanne Smithson and Richard Schultz, Library & Cultural Arts) 2. CONTRACT WITH LC PAVING & SEALING INC. FOR THE EL CAMINO REAL AND CANNON ROAD INTERSECTION IMPROVEMENTS PHASE II PROJECT, CIP PROJECT NO. 6042 -Adoption of Resolution No. 2022-031 accepting bids and awarding a contract to LC Paving & Sealing, Inc. for construction of Phase II of the El Camino Real and Cannon Road Intersection Improvements Project, Capital Improvement Program Project No. 6042. (Staff contact: Brandon Miles and Hossein Ajideh, Public Works) ORDINANCES FOR INTRODUCTION: 3. ORDINANCE PROHIBITING THE UNLAWFUL POSSESSION OF CATALYTIC CONVERTERS IN THE CITY OF CARLSBAD -Introduction of Ordinance No. CS-413 amending Carlsbad Municipal Code Title 8, Chapter 8.28 by adding Section 8.28.060 -Unlawful Possession of Catalytic Converters. (Staff contact: Christie Calderwood, Police Department and Allegra Frost, City Attorney Department) City Manager's Recommendation: Introduce the ordinance. Police Captain Christie Calderwood and Deputy City Attorney Allegra Frost presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). City Attorney Celia Brewer titled the ordinance. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to introduce Section 8.28.060 of Ordinance No. CS-413. Motion carried unanimously, 5/0. 4. ANNUAL CITY COUNCIL COMPENSATION REVIEW -Conduct annual review of City Council compensation and either 1) Introduction of Ordinance No. CS-414 adjusting City Council compensation by the amount established by the San Diego Regional Consumer Price Index; or 2) Introduce an ordinance permanently waiving City Council compensation adjustments for 2022. (Staff contact: Silvano Rodriguez and Judy von Kalinowski, Administrative Services Department) City Manager's Recommendation: Discuss City Council compensation review and introduce one of the ordinances. Jan.25,2022 Carlsbad City Council Regular Meeting Page 3 City Manager Scott Chadwick discussed the compensation review and explained that the full fiscal impact considering benefits and additional compensation for a full fiscal year would be approximately $9,300. Mayor Pro Tern Blackburn, Council Member Norby and Council Member Acosta expressed support for introducing the ordinance to adjust the City Council compensation by the amount established by the San Diego Regional Consumer Price Index. City Attorney Brewer titled the ordinance. Motion by Mayor Pro Tern Blackburn, seconded by Council Member Acosta, to introduce Ordinance No, CS-414. Motion carried unanimously, 5/0. ORDINANCES FOR ADOPTION: None. PUBLIC HEARINGS: None. DEPARTMENTAL AND CITY MANAGER REPORTS: 5. UPDATE ON THE TRANSITION OF THE CITY'S FRANCHISE AGREEMENT FOR SOLID WASTE RECYCLING AND ORGANICS SERVICES -Receive a report from Republic Services, the city's new franchise waste hauler, on the new agreement for recycling, organics and solid waste collection and organic materials processing services. (Staff contact: James Wood, Public Works) City Manager's Recommendation: Receive the report. Environmental Management Director James Wood and Republic Services representatives Mike Celaya and Jim Groen presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). The following individuals called into the City Council Meeting and voiced their comments for the record: A speaker requested that staff review the contract with Republic Services and report back at a future City Council meeting if any part of the contract violates the government code. Kris Wright spoke against Republic Services and requested that the city consider reopening the bidding process to allow Waste Management to submit a bid. A speaker expressed her concerns with the previous City Council decision to approve the agreement with Republic Services. Karen expressed her interest and support of the services offered by Republic Services. Jan.25,2022 Carlsbad City Council Regular Meeting Page4 In response to an inquiry from Mayor Pro Tern Blackburn, Republic Services representative Groen explained that Republic Services would be adding 39 vehicles powered by compressed natural gas and these vehicles will have the sole purpose of serving the City of Carlsbad. He added that Republic Services would be absorbing approximately 40 current Waste Management drivers. In response to an inquiry from Mayor Pro Tern Blackburn, Republic Services representative Celaya explained that Republic Services has proper precautions in place to ensure continued service to the City of Carlsbad and that circumstances of the strike that took place in other cities are not likely to occur in the City of Carlsbad. City Attorney Brewer explained that City of Carlsbad's contract provisions are different than other cities who have experienced work stoppage with Republic Services. In response to an inquiry from Council Member Norby, Republic Services representative Groen explained that Republic Services has prototype electric vehicles running though they are still finalizing details of operation. · In a response to an inquiry from Mayor Hall, Republic Services representative Groen explained that the Republic Services bargaining group that will be servicing the City of Carlsbad will consist of 45-50 employees and their contract will run through Oct. 2023. In a response to an inquiry from Mayor Hall, Environmental Management Director Wood explained that the City of Carlsbad will not be purchasing any new waste vehicles. In a response to an inquiry from Mayor Hall, Republic Services representative Groen explained that the vehicles Republic Services will be purchasing will be powered by natural ·gas. In a response to an inquiry from Mayor Hall, City Attorney Brewer explained that the contract between the city and Republic Services involves additional considering factors. In a response to an inquiry from Council Member Acosta, Republic Services representative Groen explained the community outreach and education process. In a response to an inquiry from Council Member Bhat-Patel, Republic Services representative Groen explained that Republic Services does not currently have concerns with the acquisition of vehicles, distribution of containers, or staffing and that they are confident in their partnership with the City of Carlsbad to ensure adequate service by July 1, 2022. City Attorney Brewer explained that the City of Carlsbad does have the ability to terminate the contract with Republic Services in the case of default of performance. Council receive_d the report. Senior Engineer Nestor Mangohig and Transportation Director Tom Frank presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Traffic and Mobility Commission Chair Brandon J>erez expressed his appreciation for staff and provided a report. In response to an inquiry from Mayor Hall, Chair Perez explained that Traffic and Mobility Commission meetings are held the first Monday of the month, currently held via Zoom. Deputy City Manager, Public Works Director Paz Gomez added that the next Traffic and Mobility Commission meeting is Feb. 7, 2022 at 3 p.m. In response to an inquiry from Mayor Pro Tern Blackburn, Senior Engineer Mangohig explained that city staff are currently working on the high-speed fiber-optic communication cabinets and hope to have them complete by the next semiannual report. In response to an inquiry from Mayor Hall, Senior Engineer Mangohig explained that some corridors have already been synchronized. He further explained that the city is currently following a synchronization plan with Caltrans to complete the remaining corridors once their technology is updated. Mayor Hall and the City Council Members expressed their appreciation for staff and the Traffic and Mobility Commission. Council received the report. 7. MAYORAL APPOINTMENT OF ONE MEMBER TO THE PARKS & RECREATION COMMISSION Adoption of Resolution No. 2022-032 appointing one member to the Parks & Recreation Commission. (Staff contact: Tammy McMinn, City Clerk's Department) City Manager's Recommendation: Adopt the resolution. The following individuals called into the City Council Meeting and voiced their comments for the record: Robert Winston expressed his interest and qualifications to serve on the Parks & Recreation Commission.
