SUBJECT: CUP 15-09 (DEV120004) -GUNTHER GUNS SHOOTING RANGE -3RD EXTENSION The Planning Division has completed its review of your application for the third extension of Conditional Use Permit CUP 15-09 -GUNTHER GUNS SHOOTING RANGE, submitted on February 8, 2022. The Conditional Use Permit, which allows for a 16-lane indoor shooting range and 1,680 square foot retail gun store in an existing 13,932 square foot stand-alone building at 2717 Loker Avenue West and-within the Carlsbad Airport Business Center Specific Plan, was approved on September 27, 2016, and was due to expire on September 27, 2018. On August 7, 2018, the City Planner granted the first two-year extension of CUP 15-09 from September 27, 2018, to September 27, 2020; and on September 21, 2020, the City Planner granted the second two-year extension from September 27, 2020 to September 27, 2022. After careful consideration of the circumstances surrounding this request, it has been determined that (1) the third extension of Conditional Use Permit CUP 15-09 -GUNTHER GUNS SHOOTING RANGE was submitted in a timely manner prior to the expiration date, and (2) that the findings required for granting a Conditional Use Permit extension can be made; therefore, the City Planner APPROVES the third extension of Conditional Use Permit CUP 15-09 -GUNTHER GUNS SHOOTING RANGE for two (2) years from September 27, 2022, to September 27, 2024, based on the following findings and conditions. Findings: 1. All the findings contained in City Council Resolution No. 2016-201 dated September 27, 2016 for CUP 15-09, and referenced in Planning Commission Resolution No. 7190 dated August 17, 2016, apply to this extension and are incorporated herein by reference and remain in effect. 2. That the third two-year extension of Conditional Use Permit CUP 15-09 remains consistent with the General Plan, all titles of the Carlsbad Municipal Code and growth management program policies and standards in place at this time. 3. That the City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Existing Facilities -Section 15301, and Infill Development Projects -Section 15332 of the state CEQA Guidelines. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. This third extension of Conditional Use Permit CUP 15-09 is granted from September 27, 2022, to September 27, 2024. If building permits for this project are not obtained within this time period, the Conditional Use Permit will expire on September 27, 2024, unless extended per Sections 21.58.040 and 21.201.210 of the Carlsbad Municipal Code. 2. All of the conditions contained in the second extension of Conditional.
