PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION:
City Attorney Celia Brewer announced that the City Council voted 4/0/1 with Council Member
Bhat-Patel abstaining, to authorize initiation of litigation against property located at 939 Begonia
Court, Carlsbad, for public nuisance of repeated code violations.

Mike B. expressed his concerns regarding COV1D-19 vaccine mandates.
Katie Taylor expressed her concerns regarding a COV1D-19 vaccine requirement for new hires with
the City of Carlsbad.

1.ANNEXATION OF THE MARJA ACRES DEVELOPMENT TO STREET LIGHTING AND LANDSCAPING
DISTRICT NO. 2 — Adoption of Resolution No. 2022-033 declaring the intention, approving the
engineer's report, ordering the initiation of assessment ballot procedures and setting April 5,
2022, as the date for the public hearing to annex the Marja Acres Development to Street
Lighting and Landscaping District No. 2. (Staff contact: Roxanne Mu hlmeister, Administrative

2.FISCAL YEAR 2020 STATE HOMELAND SECURITY GRANT PROGRAM — Adoption of Resolution
No. 2022-034 authorizing grant program standard assurances and accepting and
appropriating funds in the amount of $87,623 for public safety through Fiscal Year 2020 State

3.AWARD OF CONTRACT TO AMERICAN ASPHALT SOUTH, INC. FOR THE 2021 SLURRY SEAL AND

accepting bids and awarding a contract to American Asphalt South, Inc. for construction of

4.ORDINANCE NO. CS-413 — ORDINANCE PROHIBITING THE UNLAWFUL POSSESSION OF
CATALYTIC CONVERTERS IN THE CITY OF CARLSBAD — Adoption of Ordinance No. CS-413
amending Carlsbad Municipal Code Title 8, Chapter 8.28 by adding Section 8.28.060 —
Unlawful Possession of Catalytic Converters. (Staff contact: Faviola Medina, City Clerk's

5.ORDINANCE NO. CS-414 — ADJUSTING ANNUAL CITY COUNCIL COMPENSATION —Adoption of
Ordinance No. CS-414 adjusting City Council compensation by the amount established by the

DEPARTMENTAL AND CITY MANAGER REPORTS:
6. DETERMINATION TO CONTINUE VIRTUAL PUBLIC MEETINGS OR RESUME IN-PERSON PUBLIC
MEETINGS BEGINNING FEB. 11, 2022 — Discuss how to proceed with public meetings until
March 10, 2022, and take one of the following actions: 1) Consider adoption of a resolution
making findings in accordance with AB 361 to continue virtual public meetings until March
10, 2022; or
2) Direct staff to resume in-person public meetings beginning Feb. 11, 2022. (Staff contact:
Sheila Cobian, City Manager's Department)
City Manager's Recommendation: Discuss how to proceed and consider options.
Fire Chief Michael Calderwood presented the report and reviewed a PowerPoint presentation
(on file in the Office of the City Clerk).
The following individuals called into the City Council Meeting and voiced their comments for
the record:
Erwin A. expressed his support for returning to in-person meetings.
Mike B. urged the City Council to research more statistics regarding COVID-19 and the vaccine.
In response to an inquiry from Council Member Bhat-Patel, City Manager Scott Chadwick
explained that if the City Council chooses, in-person meetings would resume on March 1,
2022, and would apply to all board and commission meetings.
In response to an inquiry from Council Member Bhat-Patel, City Manager Chadwick explained
that if the City Council chooses, the first City Council in-person meeting would be March 8,
2022.
In response to an inquiry from Council Member Bhat-Patel, Fire Chief Calderwood explained
that appropriate social distancing modifications have been made in the City Council
chambers.
In response to an inquiry from Council Member Bhat-Patel, City Manager Chadwick explained
that the City Council meeting start times would be moved from 3 p.m. to 5 p.m.

In response to an inquiry from Council Member Bhat-Patel, City Manager Chadwick explained
that there is a plan to conduct hybrid City Council meetings in the future to include public
comments via telephone. He added that staff is currently working to purchase specialized
equipment for the Council Chamber to allow this process to be established, but the
equipment is now back-ordered from the supplier.
City Attorney Brewer announced that when in-person City Council meetings resume, the
meetings will default back to procedural rules contained in Carlsbad Municipal Code Chapter
1.20, which sets the rules to govern public meetings. She added that if the City Council decides
to adopt hybrid technology, the City Council will likely need modifications to the code to
account for the dual forms of public input.
Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to resume in-
person public meetings beginning March 2, 2022. Motion carried unanimously, 5/0.
7. WORK PLANS FOR FISCAL YEAR 2021-22 FOR THE PARKS & RECREATION COMMISSION,
SENIOR COMMISSION AND BEACH PRESERVATION COMMISSION — 1) Adoption of Resolution
No. 2022-036 approving the Parks & Recreation Commission Work Plan for Fiscal Year 2021-
22 and;
2)Adoption of Resolution No. 2022-037 approving the Senior Commission Work Plan for
Fiscal Year 2021-22; and;
3)Adoption of Resolution No. 2022-038 approving the Beach Preservation Commission Work
Plan for Fiscal Year 2021-22. (Staff contact: Mike Pacheco, Margaret Hamer and Michael
Tully, Parks & Recreation)
City Manager's Recommendation: Adopt the resolutions.
Recreation Services Manager Mike Pacheco, Recreation Area Manager Margaret Hamer and
Park Planner Michael Tully presented the report and reviewed a PowerPoint presentation (on
file in the Office of the City Clerk).
The following individuals called into the City Council Meeting and voiced their comments for
the record:
Mary Lucid expressed her concerns regarding the Senior Center and some Parks & Recreation
staff.
Katie Taylor expressed her concerns over the homeless in parks and beach areas.
Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt
Resolution Nos. 2022-036, 2022-037 and 2020-038. Motion carried unanimously, 5/0.
8. ECONOMIC AND FINANCIAL UPDATE FOR THE SECOND QUARTER OF FISCAL YEAR 2021-22
AND MID-YEAR REVIEW WITH STAFFING AND OTHER FUNDING REQUESTS — 1) Receive a

report on the economic and financial update for the second quarter of fiscal year 2021-22;
and
2)Receive a report on the results of the mid-year budget review; and
3)Adopt Resolution No. 2022-039 approving fiscal year 2021-22 mid-year requests and the
related new full-time staff positions and transfers of funds between departments in the
General Fund; and
4)Adopt Resolution No. 2022-040 approving the appropriation and transfer from the General
Fund, Recycled Water Fund, Wastewater Fund and Solid Waste Fund Reserves to the Carlsbad
Municipal Water District Water Fund to eliminate an existing liability. (Staff contact: Laura

City Manager's Recommendation: Receive the reports and adopt the resolutions.
Deputy City Manager Administrative Services Laura Rocha, Economic Development Manager
Matt Sanford, Assistant Finance Director Roxanne Muhlmeister and Finance Manager Brigid
Drury presented the report and reviewed a PowerPoint presentation (on file in the Office of
the City Clerk).
In response to an inquiry from Council Member Acosta, Communications and Engagement
Director Kristina Ray explained that there has been an increase in community engagement in
past years. She further explained that the Communications Department has often used
contractors and consultants for some community engagement projects. She added that the
new positions funded would replace some of those consultants and contractors and be
further used to fulfill community engagement roles.
In response to an inquiry from Council Member Acosta, Communications and Engagement
Director Ray explained that there would be a cost-savings to funding these positions as the
budget for contractors and consultants would be decreased.
In response to an inquiry from Council Member Acosta, Communications and Engagement
Director Ray explained there would also be additional savings in printing and designing costs
as more of the community outreach would be conducted online.
In response to an inquiry from Council Member Acosta, Fire Chief Calderwood explained that
the reclassification of the Battalion Chief - Administrative Assignment to Division Chief has a
slight salary increase. He further explained that it also allows for a more hierarchical reporting
structure.
In response to an inquiry from Mayor Hall, Finance Manager Drury explained that the Fire
Department staff additions and reclassifications will not change budget costs for this year but
will increase in the next fiscal year budget year due to increased salary and benefits.
In response to an inquiry from Mayor Hall, Fire Chief Calderwood explained that the budget
changes are being requested now because it would allow the Emergency Medical Technicians
to have a higher medical authority when it comes to COVID-19 and homeless related issues.

In response to an inquiry from Mayor Hall, City Manager Chadwick explained that there are
continued needs that the city must meet. He further explained that most of the increases in
staff needs have been due to City Council's desire to meet specific goals. He also added that
due to the COVID-19 response, many staff members have had to take on other duties outside
of their classifications, and staff needs to be increased to alleviate these burdens.
In response to an inquiry from Mayor Hall, Deputy City Manager Administrative Services
Rocha explained that staff is looking into continuous revenue streams in the 10-year forecast
requested by the City Council.
In response to an inquiry from Mayor Hall, City Manager Chadwick explained that all
operational departments have received a 2% cut request to maximize budget savings.
Council received the reports.
Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt
Resolutions No 2022-039 approving the full-time staffing requests and fund transfers for the
Fire, Communications & Engagement, and Library & Cultural Arts Departments and
Resolution No. 2020-040. Motion carried unanimously, 5/0.
9. CONSIDERATION OF APPROVAL OF 2022 PRIMARY AND GENERAL ELECTION VOTE CENTER
LOCATIONS — Adoption of Resolution No. 2022-041 authorizing the use of the Calavera Hills
Community Center Activity Room and the Pine Avenue Community Center Gym as vote
centers for the 2022 Primary and General Elections and waiving any associated facility use
fees. (Staff contact: Faviola Medina, City Clerk's Department)
City Manager's Recommendation: Adopt the resolution.
City Clerk Services Manager Faviola Medina presented the report (on file in the Office of the
City Clerk).
Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt
Resolution No. 2022-041. Motion carried unanimously, 5/0.
COUNCIL REPORTS AND COMMENTS: Mayor Hall and the City Council Members reported on
activities and meetings of some committees and subcommittees of which they are members.
