A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING THE SALE OF ELEVEN CITY OWNED AFFORDABLE
UNITS TO LOWER INCOME QUALIFIED HOUSEHOLDS SELECTED PURSUANT
TO THE AFFORDABLE HOUSING RESALE PROGRAM GUIDELINES FOR THE
PROPERTIES LOCATED AT MULBERRY IN BRESSI RANCH OFF GATEWAY
ROAD AND ROSE BAY IN THE BAY COLLECTION OFF POINSETTIA LANE AND
AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS
NECESSARY TO COMPLETE THE TRANSACTIONS
WHEREAS, the City Council of the City of Carlsbad, California has determined that it desires to
resell the city owned affordable housing units to eligible lower income buyers at a lower price to
implement the city's affordable housing goals and policies; and
WHEREAS, on December 8, 2020 the City Council approved the City Council Policy Statement
No. 73 amendments and the Affordable Housing Resale Program Guidelines by Resolution No. 2020-
234; and
WHEREAS, a 15-day public notice prior to the application period opening began November 4,
2021 and concluded on November 18, 2021; and
WHEREAS, the application period began on November 19, 2021 and concluded on January 17,
2022; and
WHEREAS, priority consideration was given to qualified applicants whose total household
income is less than or equal to 50% of area median income and applicants who currently have a high
housing cost burden, which is 50 percent or more of monthly household income, consistent with the
Affordable Housing Resale Guidelines; and,
WHEREAS, at the conclusion of the application period eleven households were evaluated and
selected consistent with the Affordable Housing Resale Guidelines; and
WHEREAS, the revenue generated from the sale of the property will be deposited into the
Community Development Block Grant fund as program income or into the Housing Trust Fund,
depending on which funding source was used for the purchase of each specific unit, with the sales
proceeds then being available to create more affordable housing opportunities.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the City Manager, or his designee, is hereby authorized to act on behalf of the City
of Carlsbad in all future decisions and actions necessary to implement the sale and
disposition of the eleven units to eleven selected lower income households for the city
owned affordable units located in the Mulberry and Rose Bay developments in the City
of Carlsbad identified in Attachment A, and to do so in full compliance with City Council
Policy No. 73 and the Affordable Housing Resale Guidelines, and to the satisfaction of
the City Attorney.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 8th day of March, 2022, by the following vote, to wit:
