PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: City Attorney Celia Brewer announced there was no reportable action. APPROVAL OF MINUTES: None. PRESENTATIONS: Presentation in recognition of the Independent Redistricting Commission. Mayor Pro Tem Blackburn presented the Commissioners with certificates of appreciation. Chair Fabiano shared a few words of appreciation. PUBLIC COMMENT: Ruby spoke about mental health issues in the community and potential resources and solutions. Maya urged the city to take greater action on E-bike safety and behavior. Emely Guiterrez urged the city to act on limiting greenhouse gas and carbon emissions through transportation improvements. Tara Cruden spoke about homelessness and urged the community to treat them with kindness and respect. Kathryn Parker urged the City Council to direct staff to generate building electrification ordinances for new construction. ADVERTISE FOR BIDS FOR THE LEO CARRILLO RANCH ROOF REPAIR PROJECT (CIP PROJECT NO. 4748) – Adoption of Resolution No. 2022-068 approving the plans, specifications and contract documents and authorizing the City Clerk to advertise for bids for the Leo Carrillo Ranch Roof Repair Project. NEW CITY COUNCIL DISTRICT BOUNDARIES – Introduction of Ordinance No. CS-418 amending Carlsbad Municipal Code Section 2.04.070, Subdivision (A), to include the City Council District Boundary Map approved by the Independent Redistricting Commission. CS-416 – POLITICAL AND NONCOMMERCIAL SIGNS IN THE PUBLIC RIGHT- OF-WAY– Adoption of Ordinance No. CS-416 amending Carlsbad Municipal Code Section 11.44.070 – Temporary Political and other noncommercial signs in the public right-of-way. ORDINANCE NO. CS-417 – POSITION OF THE CITY CLERK – Adoption of Ordinance No. CS-417 amending various sections of and adding a section to the Carlsbad Municipal Code regarding the position of City Clerk to take effect only if the voters at the municipal election on June 7, 2022 approve making the Office of City Clerk appointive. (Staff contact: Faviola Medina, City Clerk’s Department) City Manager’s Recommendation: Adopt Ordinance No. CS-417. City Attorney Celia Brewer titled the ordinance. Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt Ordinance No. CS-417. Motion carried unanimously, 5/0. PUBLIC HEARINGS: None. DEPARTMENTAL AND CITY MANAGER REPORTS: 8. DIVERSITY, EQUITY AND INCLUSION WORK PLAN – Adoption of Resolution No. 2022-071 approving the Diversity, Equity and Inclusion Work Plan. (Staff contact: Nancy Magpusao Burke, Lori Shonley and Judy von Kalinowski, Administrative Services Department) City Manager’s Recommendation: Adopt the resolution. Senior Program Manager Nancy Magpusao Burke, Principal Librarian Andrea Hilliard and Management Analyst Esther Lan presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Katie Taylor expressed her concerns with the city’s current priorities and urged the City Council to focus on homelessness issues. Tamara Dixon expressed her concerns with diversity, equity and inclusion plans and critical race theory in school curriculum. In response to an inquiry from Mayor Pro Tem Blackburn, Senior Program Manager Magpusao Burke and City Manager Chadwick explained that there are no hiring quotas involved in this work plan. In response to an inquiry from Mayor Hall, Senior Program Manager Magpusao Burke explained that the Diversity, Equity and Inclusion Work Plan includes asking for proclamations March 15, 2022 Carlsbad City Council Regular Meeting Page 4 and cultural awareness with culturally relevant holidays such as Juneteenth, Caesar Chavez Day and Indigenous Peoples Day. In response to an inquiry from Mayor Hall, City Manager explained that the discussion of flying different flags would be brought back at a future City Council meeting. Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2022-071 amending Attachment A, Goal 4.2, bullet 3, to add the language “pending future City Council action”. Motion carried unanimously, 5/0. 9. MOBILE CRISIS RESPONSE TEAM – Receive a report on the partnership with San Diego County Behavioral Health Services and Exodus Recovery for Mobile Crisis Response Team services within the City of Carlsbad. (Staff contact: Ryan Opeka, Police Department) City Manager’s Recommendation: Receive the report. Police Lieutenant Ryan Opeka and Exodus Recovery Program Director Megan Patrick- Thompson presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In response to an inquiry from Council Member Bhat-Patel, Program Director Patrick- Thompson explained that school districts will be involved in the next phase of this program roll out and when a minor is involved in a case, additional steps are taken to involve the minor’s family. In response to an inquiry from Council Member Bhat-Patel, Program Director Patrick- Thompson explained that the diversion programs are in place to assist with placing individuals in crisis to the right level of care. In response to an inquiry from Council Member Bhat-Patel, Program Director Patrick- Thompson explained that the term 51/50 is referring to a person who is a danger to themselves, a danger to others or greatly disabled. In response to an inquiry from Council Member Bhat-Patel, Program Director Patrick- Thompson explained that the average response time for a Mobile Crisis Response Team service is under an hour, with case by case exceptions. In response to an inquiry from Council Member Bhat-Patel, Program Director Patrick- Thompson explained that the vehicles used are well equipped for safe transports. In response to an inquiry from Mayor Pro Tem Blackburn, Lieutenant Opeka explained that since their inception, the Police Department utilizes Exodus as frequently as possible as their primary response to 51/50 calls. March 15, 2022 Carlsbad City Council Regular Meeting Page 5 In response to an inquiry from Mayor Pro Tem Blackburn, Lieutenant Opeka explained that utilizing Exodus for 51/50 transports allows police officers to quickly return to the field and remain in service. In response to an inquiry from Mayor Pro Tem Blackburn, Lieutenant Opeka explained that the Police Department is not notified when someone is released from a hospital after transport, and they do frequently encounter the same individuals multiple times. In response to an inquiry from Mayor Pro Tem Blackburn, Program Director Patrick- Thompson explained how Exodus’s follow up process works with out-patient services. Council received the report. 10. APPOINT ONE MEMBER TO THE CARLSBAD TOURISM BUSINESS IMPROVEMENT DISTRICT ADVISORY BOARD – Adoption of Resolution No. 2022-072 appointing one member to the Carlsbad Tourism Business Improvement District Advisory Board. (Staff contact: Tammy McMinn, City Clerk’s Department) City Manager’s Recommendation: Adopt the resolution. Motion by Mayor Hall, seconded by Mayor Pro Tem Blackburn, to adopt Resolution No. 2022- 072 appointing Randy Zupanski to the Carlsbad Tourism Business Improvement District Advisory Board. Motion carried unanimously, 5/0. 11. MAYORAL APPOINTMENT OF ONE MEMBER TO THE BEACH PRESERVATION COMMISSION – Adoption of Resolution No. 2022-073 appointing one member to the Beach Preservation Commission. (Staff contact: Tammy McMinn, City Clerk’s Department) City Manager’s Recommendation: Adopt the resolution. Motion by Mayor Hall, seconded by Mayor Pro Tem Blackburn, to adopt Resolution No. 2022- 073 appointing Michael Corrigan to the Beach Preservation Commission. Motion carried unanimously, 5/0. 12. MAYORAL APPOINTMENT OF ONE MEMBER TO THE TRAFFIC & MOBILITY COMMISSION – Adoption of Resolution No. 2022-074 appointing one member to the Traffic & Mobility Commission. (Staff contact: Tammy McMinn, City Clerk’s Department) City Manager’s Recommendation: Adopt the resolution. Edward Newlands III expressed his interest and qualifications to serve on the Traffic & Mobility Commission. Motion by Mayor Hall, seconded by Mayor Pro Tem Blackburn, to adopt Resolution No. 2022- 074 appointing Edward Newlands III to the Traffic & Mobility Commission. Motion carried unanimously, 5/0. DISTRICT 1 APPOINTMENT OF ONE MEMBER TO THE DESIGN REVIEW COMMITTEE FOR A TERM ENDING IN MARCH 2023, OR UPON COMPLETION OF THE COMMITTEE’S WORK – Adoption of Resolution No. 2022-075 appointing one member to the Design Review Committee. (Staff contact: Tammy McMinn, City Clerk’s Department) City Manager’s Recommendation: Adopt the resolution. Mayor Hall recused himself at 6:39 p.m. due to a potential conflict of interest. Motion by Council Member Norby, seconded by Mayor Pro Tem Blackburn, to adopt Resolution No. 2022-075 appointing Ginger Rabe to the Design Review Committee. Motion carried unanimously, 4/0/1 (Hall – Recused). Mayor Hall returned to the dais at 6:40 p.m. PUBLIC COMMENT: Tamara Dixon expressed her concerns with state legislation regarding COVID-19 vaccines and the mandate for new City of Carlsbad staff. COUNCIL REPORTS AND COMMENTS: Mayor Hall and the City Council Members reported on activities and meetings of some committees and subcommittees of which they are members. ANNOUNCEMENTS: Mayor Hall announced that the City Council will have a Strategic Planning Workshop on Wed., March 16, 2022 at 9 a.m. at the Faraday Center, 1635 Faraday Ave. CITY MANAGER COMMENTS: None.
