AGENDA OF:March 2, 2022 Project Planner: Jessica Evans Project Engineer: Emad Elias SUBJECT: SDP 2020-0005 (DEV2019-0244) – CHILDREN’S PARADISE – Request for the approval of a Site Development Plan to construct an approximately 11,930-square-foot, one-story building to accommodate a child daycare center generally located on the south side of Marron Road and east of Cienaga Place (APN: 167-040-49-00) within Local Facilities Management Zone 25. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15332 – In-fill Development Projects of the state CEQA Guidelines. I.RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 7440 APPROVING Site Development Permit SDP 2020-0005 based upon the findings and subject to the conditions contained therein. II.PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: The approximately 2.1-acre project site is generally located south of Marron Road and east of Cienaga Place (APN: 167-040-49-00), as shown on the attached location map. The project site is a previously graded undeveloped lot. The surrounding neighborhood is developed with multi-family residences across Marron Road to the north, and a commercial center located within the city of Oceanside to the east. Directly west and south of the project site is designated open space. The project would require minor grading and no removal of native vegetation. Table “A” below includes the General Plan designations, zoning and current land uses of the project site and surrounding properties. TABLE “A” Location General Plan Designation Zoning Current Land Use Site CF – Community Facilities P – C – Planned Community Vacant North R – 23 – Residential P – C – Planned Community Multi-family residential South OS – Open Space P – C – Planned Community Open space East N/A N/A Commercial – city of Oceanside West OS – Open Space P – C – Planned Community Open space 1 SDP 2020-0005 (DEV2019-0244) – CHILDREN’S PARADISE March 2, 2022 Page 2 Background/Site Plan: The applicant is requesting approval of a Site Development Plan to allow the construction of an approximately 11,930-square-foot, one-story, child daycare center within Planning Area P – 2 of the Quarry Creek Master Plan (QCMP). The QCMP requires Planning Commission approval of a Site Development Plan prior to development within any planning area. The intent of the QCMP is to incorporate clustered development, convenient access to a diversity of uses, and the efficient use of land. Planning Area P – 2 is designated as a community facilities area to provide nearby residents convenient access to community-oriented uses. As such, the child daycare land use is a community-oriented use and is permitted for the site. Access to the site will be provided via Marron Road. On-site parking is provided with an open parking lot on the north side of the property, along Marron Road. The proposed building is approximately 25 feet and eight inches in height and provides for varied roof heights. The architecture of the building is consistent with the Spanish Colonial theme of the QCMP and building materials include porcelain tile, clay roof tiles, arches, wood trellis structures, vertical windows, and columns. The project includes two fully fenced-in play yard areas, with one located on the east side of the building and one on the west side. In addition, outdoor seating areas are directly adjacent to the south side of the building. As shown on Exhibits “A” – “FF,” dated March 2, 2022, the building will include three offices adjacent to the main entry of the building, a kitchen and laundry area, six pre-school classrooms, two infant rooms, and one toddler room. The proposed daycare use will be contained within the proposed one-story building with the exception of the use of the outdoor play yard areas. The daycare will have an enrollment of a maximum number of 198 students with 26 staff members, and the proposed hours of operation are from 6:00 am to 10:00 pm Monday through Thursday, 6:00 am to 12:00 am, Friday through Saturday, and closed on Sunday. The center is an after-hours facility to serve the needs of the community that is in close proximity to the retail and medical facilities for parents working extended hours. To minimize potential noise impacts to adjacent properties, a condition of approval is proposed to limit the hours of operation for the outdoor play areas to 7:00 am to 8:00 pm, Monday through Saturday. There will also be various evening and weekend events such as graduation, fall festival, reading fairs, and fundraisers onsite. Proposed Grading: Estimated grading quantities include 531 cubic yards (cy) of cut, 531 cy of fill with 100 cy remedial. A grading permit will be required for this project. III. ANALYSIS The project is subject to the following regulations and requirements: A. Community Facilities (CF) General Plan Land Use Designation; B. Master Plan 10-01(B) – Quarry Creek Master Plan; C. Planned Community (P – C) Zoning Designation (CMC Chapter 21.38) D. Community Facilities (C – F) Zone (CMC 21.25) E. Child Care (CMC Chapter 21.83) The recommendation for approval of this project was developed by analyzing the project’s consistency with the applicable city regulations and policies. The project compliance with each of the above regulations is discussed in detail in the sections below. A. Community Facilities (CF) General Plan Land Use Designation SDP 2020-0005 (DEV2019-0244) – CHILDREN’S PARADISE March 2, 2022 Page 3 The project site has a Community Facilities (CF) General Plan Land Use designation. The CF designation is intended to provide community-serving facilities, such as child daycare centers, places of worship, youth and senior centers, and other community-oriented uses. Children’s Paradise is consistent with the applicable policies and goals of the General Plan. Particularly relevant to the daycare project are: Land Use, Mobility, Open Space and Conservation, Noise, Public Safety; Arts, Culture, History and Education, and Sustainability. Table “B” below identifies General Plan goals and objectives relevant to the proposed project and describes the compliance of the proposal. TABLE “B” - GENERAL PLAN COMPLIANCE ELEMENT GOALS AND POLICIES PROJECT CONSISTENCY COMPLY Land Use Goal 2-G.2 Promote a diversity of compatible land uses throughout the city, to enable people to live close to job locations, adequate and convenient commercial services, and public support systems such as transit, parks, schools, and utilities. Goal 2-G.3 Promote infill development that makes efficient use of limited land supply, while ensuring compatibility and integration with existing uses. Ensure that infill properties develop with uses and development intensities supporting a cohesive development pattern. The proposed child daycare center will enhance the diversity of compatible land uses within the existing neighborhood because the location of the daycare is conveniently located near multi- family residences. The location and the use allow for nearby residents to have convenient access to daycare services. Furthermore, the construction of the building promotes infill development that makes efficient use of the limited land supply, while ensuring compatibility and integration with existing uses as the daycare is consistent with the CF General Plan Land Use designation, and provides for a service that is compatible with the surrounding multi-family residences and open space areas. Yes Mobility Goal 3-G.2 Improve connectivity for residents, visitors, and businesses. Goal 3-G.4 Manage parking to support all modes of transportation and ensure efficient use of land. Policy 3-P.5 Require developers to construct or pay their fair share toward improvements for all travel modes consistent with the Mobility The project is conditioned to make public improvements to improve connectivity including the installation of a new driveway approach, restriping the existing median on Marron Road to include a new westbound left turn pocket, pay a fee for the installation of a traffic signal controller, and repair any existing or caused damage to the decomposed granite walkway path adjacent to the project site. Furthermore, the proposed on- Yes SDP 2020-0005 (DEV2019-0244) – CHILDREN’S PARADISE March 2, 2022 Page 4 Element, the Growth Management Plan, and specific impacts associated with their development. site parking accommodates vehicle and bicycle parking, and the applicant will be required to pay traffic impact fees prior to issuance of building permit that will go toward future road improvements. Open Space and Conservation Goal 4-G.3 Protect environmentally sensitive lands, wildlife habitats, and rare, threatened or endangered plant and animal communities. Policy 4-P.9 Maintain and implement the city’s Habitat Management Plan (HMP), including the requirement that all development projects comply with the HMP and related documents. Require assessments of biological resources prior to approval of any development on sites with sensitive habitat. The project protects the adjacent environmentally sensitive, hardline preserve area by complying with the Adjacency Standards of the HMP such as fire management, landscaping restrictions, fencing and lighting. The project includes a 60-foot fire management zone, the installation of native and nonnative plant species that will not displace native species, fencing surrounding the project site which protects sensitive species, and lighting is strategically placed in order to eliminate light spillover into the hardline preserve area. Yes Noise Goal 5-G.2 Ensure that new development is compatible with the noise environment, by continuing to use potential noise exposure as a criterion in land use planning. Pursuant to the Noise Impact Analysis report prepared for the project (Eliar Associates, Inc., August 27, 2020), the project is consistent with the Noise Element of the General Plan and no noise mitigation measures are required. Yes Public Safety Goal 6-G.1 Minimize injury, loss of life, and damage to property resulting from fire, flood, hazardous material release, or seismic disasters. Policy 6-P.6 Enforce the requirements of Titles 18, 20, and 21 pertaining to drainage and flood control when reviewing applications for building permits and subdivisions. The proposed 11,930-square-foot building is designed to be in conformance with drainage, flood control and seismic design standards through grading and building permit review. Fire sprinklers are included throughout the building per the National Fire Protection Association 13 standards and the project will maintain a 60-foot brush management zone. The project will meet all required Building, Zoning, and Fire codes. Yes SDP 2020-0005 (DEV2019-0244) – CHILDREN’S PARADISE March 2, 2022 Page 5 Policy 6-P.34 Enforce the Uniform Building and Fire codes, adopted by the city, to provide fire protection standards for all existing and proposed structures. Arts, Culture, History & Education Policy 7-P.32 Encourage a range of childcare facilities, including family day care homes, public and private centers, preschool programs, and before and after school programs. The proposed child daycare use will encourage a range of childcare facilities by providing a private daycare center for residents of the community. Yes Sustainability Goal 9-G-2 Undertake initiatives to enhance sustainability by reducing the community’s greenhouse gas (GHG) emissions and fostering green development patterns- including buildings, sites, and landscapes. Goal 9-G.3 Promote energy efficiency and conservation in the community. Policy 9-P.1 Enforce the Climate Action Plan as the city’s strategy to reduce greenhouse gas emissions. The proposed project complies with the requirements set forth in the city’s Climate Action Plan (CAP). CAP ordinances have requirements related to energy efficiency, photovoltaic and electric vehicle charging systems. The project proposes new electric vehicle charging systems and a photovoltaic system. Yes B. Master Plan 10-01(B) – Quarry Creek Master Plan The project site is located in Planning Area P – 2 of the QCMP. Planning Area P – 2 is intended as the main community node for the master plan area and is designated for community facility uses. Allowed uses in Planning Area P – 2 include a commercial child daycare center and other similar uses such as adult or senior daycare, religious facilities, or social clubs. The QCMP requires the approval of a site development plan to develop the 11,930-square-foot daycare center. As demonstrated in Planning Commission Resolution No. 7440, all the required site development plan findings can be made. Furthermore, the QCMP community facilities designation is subject to the requirements of CMC Chapter 21.25 which is outlined in the Section “D” below. C. Planned Community (P – C) Zoning Designation (CMC Chapter 21.38) The underlying zoning designation of the project site is P – C, Planned Community. In accordance with the designation, the QCMP was created to implement the zoning. No specific development standards or design criteria exist in the P – C zone; however, all applicable standards and criteria are contained within, SDP 2020-0005 (DEV2019-0244) – CHILDREN’S PARADISE March 2, 2022 Page 6 or referenced by the master plan. Therefore, conformance with the master plan requirements also indicates conformance with the P – C zone. D. Community Facilities (C – F) Zone (CMC 21.25) As described in Section “B” of the analysis, the project site is subject to the requirements of CMC Chapter 21.25, Community Facilities Zone. All uses under the C – F zone provisions require that all uses be conducted wholly within a building except outdoor play areas. As conditioned, the daycare will operate indoors with the exception of the use of the fenced, outdoor play areas located on the east and west side of the building. In addition, the only applicable development standard is building height, which is limited to 35 feet when a roof pitch is greater than 3:12, or 24 feet if the roof pitch is less than 3:12. The proposed building is approximately 25 feet and eight inches with a 5:12 roof pitch, which meets this requirement. E. Child Care (CMC Chapter 21.83) All child daycare centers must comply with the development standards contained within Chapter 21.83 which include the following: 1. The applicant has or will obtain all licenses and permits required by the state law for operation of the facility. The applicant shall keep all state licenses or permits valid and current. The operator of the Children’s Paradise daycare will obtain all required state licenses and permits to operate the facility after the final building and fire department inspections are complete and the operator receives occupancy for the building. Once this is complete, the state performs an on- site inspection to ensure state health and safety regulations are met. When all requirements are satisfied, a license is issued by the state. Licenses issued by the state must remain in place and in compliance at all times during the operation of the childcare center. 2. The center shall meet all zoning standard otherwise applicable to the project site. The daycare center meets all applicable zoning standards such as building height and parking. 3. Indoor and outdoor play areas which satisfy the County of San Diego daycare licensing agency shall be provided. The outdoor play area shall be adjacent to the center and accessible through the center itself. The outdoor play area shall be enclosed by a natural barrier, wall, or fence a minimum of five feet in height. If located adjacent to residentially zoned property, the separating barrier, wall or fence shall be of solid construction. Said outdoor play area shall not be allowed in any required front, side or rear setbacks and shall be located and designed so as to reduce noise impacts on adjacent properties. The project proposes two outdoor play areas, directly adjacent to the building that meets the county and state’s daycare licensing requirements. Both outdoor play areas are enclosed by a six- foot high wrought iron fence and are not located adjacent to residentially zoned properties; and therefore, are not required to be of solid construction. The nearest residentially zoned property is approximately 185 feet away and is buffered by the parking lot, Marron Road, masonry block SDP 2020-0005 (DEV2019-0244) – CHILDREN’S PARADISE March 2, 2022 Page 7 walls, and landscaping. The master plan and zoning code do not specify required front, side or rear setbacks. One outdoor play area is located on the east side of the building, adjacent to the commercial use located in the city of Oceanside. This play area is approximately 245 feet away from the loading zone of the commercial building and is located in an area that will not create noise impacts to the adjacent property. The second and larger outdoor play area is located on the west of the of building, which is directly adjacent to an open space area. 4. The outdoor play space shall be viewable directly from the interior of the structure by having windows at strategic points so that the yard area can be seen from the inside of the childcare center. As demonstrated in Exhibits “A” – “FF,” dated March 2, 2022, the floor plan shows each room is designed with at least one window that is visible to the outdoor play areas. 5. Each child daycare center shall have a direct source of natural light which shall be located so as to maximize the ability for children to see out of windows. The floor plan shows each room will have at least one window that provides a direct source of natural light and maximizes the ability for children to see out of the windows. 6. The following parking requirements shall apply: a. Parking shall be provided consistent with CMC Chapter 21.44, unless otherwise specified in this section. CMC Chapter 21.44 requires one space per employee, and one space for each 10 children. The daycare center proposes a maximum number of 198 students and 26 staff members. Therefore, the use is required to have 46 spaces and proposes 46 parking spaces on-site. b. Parking shall not be located in any required front yard setback. The project is not subject to a required front yard setback; therefore, the parking spaces proposed along Marron Road are permitted. c. An adequate on-site loading/unloading area shall be provided which can be easily accessible from the child daycare center without crossing any driveways or streets. This area may be counted toward required parking. As required by the daycare center, parents must park and walk their child or children upon arrival or pick-up. As designed, parents and children will not have to cross driveways or streets to access the site. SDP 2020-0005 (DEV2019-0244) – CHILDREN’S PARADISE March 2, 2022 Page 8 d. Clearly designated pedestrian walkways shall be provided. The project is conditioned to repair any damaged sections of the decomposed granite walkway that is off-site, adjacent to the project site. There are designated walkways on-site, between the parking lot and building provided for safe pedestrian travel. 7. Signs shall be permitted in accordance with the underlying zone as provided in CMC Chapter 21.41. Signs are not part of this request as signs are reviewed under a separate permit. At the time of application for a sign permit, staff will ensure all propose signs are consistent with CMC Chapter 21.41. 8. Any additional conditions regarding safety and access deemed necessary or desirable by the city engineer, or community development director. Additional conditions regarding safety and access are not proposed because the project will meet all required building, fire, land development engineering and zoning regulations which ensures adequate safety and access. IV. ENVIRONMENTAL REVIEW The California Environmental Quality Act (“CEQA”), and its implementing regulations (“CEQA Guidelines”) adopted by the Secretary of the California Natural Resources Agency, list classes of projects that have been determined not to have a significant effect on the environment and as a result are exempt from further environmental review under CEQA. City staff completed a review of the project and potential environmental impacts associated with the project pursuant to CEQA and concluded that the project qualified for an exemption pursuant to CEQA Guidelines section 15332 – In-fill Development Projects. The project is consistent with all applicable General Plan goals and policies as well as applicable zoning regulations and is located on a project site that is less than five acres, surrounded by urban uses. The site is a previously graded site that has no value as habitat for endangered, rare or threatened species. Furthermore, the project will not result in any significant effects relating to traffic, noise, air quality or water quality and the site can be served by all required utilities and public services. In particular, there are no traffic impacts as the Vehicle Miles Traveled (VMT) Analysis prepared by LOS Engineering, Inc, dated October 4, 2021 finds the project is a Local-Serving Public Facilities and is presumed to have a less than significant transportation impact because the characteristic are very similar to local-serving retail that serves the community and either produce very low VMT or divert existing trips from established local facilities such as other daycare uses. The project is conditioned to submit a Tier 1 Traffic Demand Management Plan which will implement strategies to improve traffic such as providing bicycle parking racks and distributing transportation options information to new hires. The project is also conditioned to pay the fee for the installation of one traffic signal controller, which is a hardware that operates the traffic signal and coordinates signal timing with other signals along the corridor. The traffic signal controller will meet the Transportation System Management strategies to improve traffic signal coordination and improve transit service. In addition, the project is conditioned to restripe the existing median on Marron Road to include a new westbound left-turn pocket and repair any existing or caused damage to the decomposed granite walkway path adjacent to the project site which will improve connectivity. SDP 2020-0005 (DEV2019-0244) – CHILDREN’S PARADISE March 2, 2022 Page 9 A notice of intended decision regarding the environmental determination was advertised on January 13, 2022 and posted on the city’s website. The notice included a general description of the project, the proposed environmental findings, and a general explanation of the matter to be considered. The findings and determination contained in that notice was declared as final on the date of the noticed decision, unless appealed as provided by the procedures commencing in Chapter 21.54 (Procedures, Hearings, Notices, and Fees) of the Zoning Ordinance. During the 10-day public review period, the city received no comment letters from the public regarding the prospective environmental determination. Since no appeal was filed and no substantial evidence was submitted that would support a finding that the exemption requirements would not be satisfied, the project was determined by the city planner to not have a significant effect on the environment. The CEQA Determination letter and notice of intended decision are attached to this staff report as Attachment 4 and demonstrates that the project is categorically exempt from further environmental review. The city planner’s written decision is final and the CEQA determination is not within the Planning Commission’s purview. With the appropriate environmental clearances in place, all of the city’s procedural requirements and relevant aspects of CEQA have been satisfied. The City of Carlsbad (City) is required to implement all adopted mitigation measures. In order to ensure compliance, the following mitigation monitoring program has been fo1mulated. This program consists of a checklist followed by a detailed description of the mitigation measures. A mitigation checklist has been prepared for the project. Table 1 summa1izes the mitigation measures for the project. Info1mation contained within the checklist clearly identifies the mitigation measure, delineates the monito1ing schedule, and defmes the conditions required to verify compliance. All revegetated slopes will be maintained by the project proponent until success criteria have been met before being added to the preserve to be managed by the preserve manager. Impacts to 0.2 acres of coastal sage chaparral scrub and 0.1 acres of southern mixed chaparral shall be mitigated at a 1:1 ratio (0.3 acres) through on-site preservation of 0.2 acres of coastal sage chaparral scrub and 0.1 acres of southern mixed chaparraL Impacts to 24.6 acres of non-native grassland shall be mitigated at a 0.5:1 ratio (12.3 acres). The applicant shall include preservation of 10_0 acres of non-native grassland and either payment of the in lieu fee or restoration of 2.3 acres of grassland habitat on-site. Topsoil and plant materials salvaged from the impacted areas (including live herbaceous shrub and tree species) shall be transplanted to, and/or used as a seed/cutting source for, the riparian/wetland creation and enhancement areas to the maximum extent practicable as directed by the City of Carlsbad and Resource Agencies. Planting and irrigation shall not be installed until the City and Resource Agencies have approved of the mitigation-site grading. All plantings shall be installed in a way that mimics natural plant distribution, and not in rows; Planting palettes (plant species, size, and number/acres) and seed mix {plant species and pounds/acres) The multitude of plant palettes proposed in the draft plans shall include native species specifically associated with the habitat type(s). The USACE and CDFG require no net loss of wetlands. The proposed project would cause impacts to 0.21 acres of USACE jurisdictional areas and 0 47 acres of CDFG jurisdictional areas. The following mitigation is required for impacts to USACE and CDFG jurisdictional areas. BI0-3 Prior to the issuance of a grading permit, a mitigation plan shall submitted to the City for approval that provides mitigation for the permanent and temporary impacts to 0.23 acres of USACE jurisdictional areas and 0.55 acres of CDFG jurisdictional areas Mitigation shall be accomplished through on-site mitigation at a 3:1 mitigation to impact ratio through a combination of habitat creation at a 1:1 ratio and restoration/enhancement at a 2:1 ratio; resulting in 0.69 acres of USACE mitigation, including at least 0.23 acres of creation; impacts to CDFG jurisdictional areas shall require 1.39 acres of mitigation, including at least 0.55 acres of creation. The riparian creation shall (0.55 acres) shall occur on-site, and the remaining 0.84 acres of mitigation would occur with enhancement of wetlands on-site or immediately off- site along Buena Vista Creek. Background noise (e.g., State Route 78 [SR-78)) shall be excluded from the 60 dBA calculation_ If grading activities are not completed prior to the breeding season, and any of these species are present, and noise levels exceed this threshold, noise barriers shall be erected to reduce noise impacts to occupied habitat to below 60 dBA hourly Leq and/or the activities shall be suspended. The proposed project may result in significant edge effects (including effects from human activity) along the western boundary of the project site, as well as along the developmenU open space boundaries. To reduce edge effects, on-site human activity, and potential impacts related to the introduction of exotic and domestic animals, the following mitigation is required Quarry Creek Master Plan Final EIR Type PC 0.4 Mitigation Monitoring and Reporting Program Monitor Schedule City of Carlsbad Prior to Planning Division construction 0.4-12 Compliance Action Prior to construction activities, a qualified biologist shall conduct pre-construction surveys in the adjacent habitat for coastal California gnatcatcher, least Bell's vireo, southwestern willow flycatcher, and nesting raptors_ The on-site biologist shall provide a written report to the City Planning Division stating whether species were observed within 500 feet of proposed grading activities. The applicant shall submit to the City, and the resource agencies (i.e., USACE, USFWS, and CDFG), for approval at least 30 days prior to initiating project impacts and the final plans for initial clearing and grubbing of sensitive habitat and project construction. These final plans shall include photographs that show the fenced limits of impact and all areas (including riparian/wetland or coastal sage scrub) to be impacted or avoided. If work occurs beyond the fenced or demarcated limits of impact, all work shall cease until the problem has been remedied to the satisfaction of the City and the resource agencies. Any riparian/wetland or upland habitat impacts that occur beyond the approved fence shall be mitigated at a minimum 5:1 ratio. Temporary construction fencing shall be removed upon project completion. A monitoring biologist approved by the resource agencies shall be on-site during clearing and grubbing of habitat that occurs within 200 feet of the grading limits. The monitoring biologist shall conduct weekly site visits during rough grading to ensure that the grading limits have been respected. The biologist must be knowledgeable of gnatcatcher, least Bell's vireo, and flycatcher biology and ecology. The applicant shall submit the biologist's name, address, telephone number, and work schedule on the project to the City and the resource agencies at least seven days prior to initiating project impacts. A final report shall be submitted to the City and the wildlife agencies within 60 days of project completion. • The clearing and grubbing of sensitive habitats shall occur outside of the bird breeding season (February 15 to September 15), unless a qualified biologist demonstrates to the satisfaction of the City and the wildlife agencies that all nesting is complete. The qualified biologist would need to be federally permitted for species such as the least Bell's vireo ( Vreo be/Iii pusil/us) and coastal California gnatcatcher (PoliopUia califomica califomica) if the habitat being cleared has the potential to support these species. BI0-6 Prior to construction activities, the applicant shall complete the following tasks: • • A conservation easement shall be placed over those portions of the property required to meet project mitigation obligations (a conservation easement already exists over the open space previously set aside as part of the quarry reclamation effort). The applicant shall prepare and implement a perpetual management, maintenance, and monitoring plan (PMP) for all on-site biological conservation easement areas (a perpetual management, maintenance, and monitoring plan already exists over the open space previously set aside as part of the quarry reclamation effort). All food-related trash items shall be enclosed in sealed containers and regularly removed from the site. Pets of project personnel shall not be allowed on the project site during grading. Disposal or temporary placement of excess fill, brush, or other debris shall not be allowed in waters of the U.S. or their banks. Cultural Resources CR-1 Prior to initiating any grading or construction activities, temporary construction fencing shall be erected around Locus 1 at site SDI-5651. Erecting fencing around Locus 1 will ensure no disturbance to the area occurs during earth work activities_ Fencing around Locus 1 shall be established in consultation with the Luisefio Native American monitor and the archaeological monitor. Both a Native American monitor and archaeological monitor shall be present when the protective fencing is erected. Specific measures required of the Plan include: • Consultation with the San Luis Rey Band of Mission Indians regarding any work within the limits of the management plan area; • Native American monitoring of all work within the plan area; • Designation of a site manager; • Measures to prevent unlawful entry and trespass; • Access to the El Saito Falls by Luisefio tribal members; • Security monitoring of the management plan area; and • Guidelines for maintenance and cleanup of the management plan area. The applicant shall be required to comply with the final management plan's provisions until and unless the plan is superseded by a development and management plan. Any revisions or modifications to the final falls management plan shall continue to implement the falls management plan primary objectives of: (1) (2) (3) • Cleaning and securing the El Saito Falls area, Ensuring protection of the falls management area, and Minimizing the potential for urban development pressures on the El Saito Falls area. Such protective measures may include establishment of an environmental buffer and a planning buffer as contemplated in the Master Plan. All other sites will have controlled grading performed using a rubber-wheeled backhoe with a nat-edged blade. Notes directing this process will become notes on the grading plans and will be included in the monitoring agreement. If unique archaeological resources and/or sacred sites are inadvertently discovered during ground disturbing activities, the lead agency will consult with the San Luis Rey tribe regarding possible treatment options, including preservation. If preservation in place is not a feasible option, data recovery excavation may be completed as mitigaUon of impacts to the resource. Data recovery will require collection of an adequate artifact sample using professional archaeological collection methods. Excavation as mitigation shall be restricted to those parts of the unique archaeological resource that would be damaged or destroyed by the project (PRC Section 21083.2 (d)). Recovered artifactual materials shall be cataloged and analyzed. Geology and Soils GS-1 Prior to approval of final engineering and grading plans for each phase of development within the project site, the City shall verify that all recommendations contained in the fiR-Level Soil and Geologic Reconnaissance (October 20, 2011) and the Preliminary Geotechnical Investigation (May 11, 2012) prepared by GEOCON have been incorporated into all final engineering and grading plans. The City's soil engineer and engineering geologist shall review grading plans prior to finalization, to verify plan compliance with the recommendations of the report. All future grading and construction of the project site shall comply with the geotechnical recommendations contained in the geotechnical Quarry Creek Master Plan Final EIR Type PD& PC 0.4 Mitigation Monitoring and Reporting Program Monitor Schedule City of Carlsbad Prior issuance of Engineering grading permits Division 0.4-24 Compliance Action Prior to issuance of grading permits, the City's soil engineer and engineering geologist shall review grading plans prior to finalization, to verify plan compliance with the recommendations of the report. Such permits include the National Pollution Discharge Elimination System (NPDES) permit from the Regional Water Quality Control Board. Erosion control measures shall be provided to the satisfaction of the City Engineer in accordance with the City's grading and erosion control requirements (Municipal Code §15.16. et seq.). The locations of all erosion control devices shall be noted on the grading plans. All grading permits issued authorizing grading during the rainy season (November 16 of any year to April14 of the following year), shall require the installation of all erosion and sedimentation control protective measures in accordance with city standards. Erosion and runoff control measures shall be designed and bonded prior to approval of grading permits by the City. All permanent slopes shall be planted with erosion control vegetation, drained and properly maintained to reduce erosion within 30 days of completion of grading. Additionally, residential buildings shall provide a space for recharge of batteries for both small (handheld) and large (e.g., electric lawnmower or car) equipment (laundry rooms and garages). The requirements for proper transport and disposal of the FCS shall be included on the grading plans and permits for the proposed project Additionally, the construction contractor shall be required to follow all additional federal, state and local regulations that included but are not limited to the California Water Code; California Code of Regulations Titles 22, 23, and 27; RWQCB Resolution No_ R9-2007 -0104 Conditional Waiver No. 8, specifically Sections 8.LA and 8.1LD and E; and 29, 40, and 49 Code of Federal Regulations. Hydrology and Water Quality WQ-1 Prior to issuance of a grading permit for any phase of the development, the applicant shall prepare and submit for review and approval of the Carlsbad City Engineer, a Storm Water Pollution Prevention Program (SWPPP) to demonstrate that pollutants will be controlled through compliance with the City of Carlsbad Standard Urban Stormwater Mitigation Plan (SUSMP}, General Construction Stormwater Quarry Creek Master Plan Final EIR Type PC PD& PC 0.4 Mitigation Monitoring and Reporting Program Monitor Schedule City of Carlsbad Prior to issuance Planning Division of a grading permit City of Carlsbad Prior to issuance Engineering of a grading Division permit for any phase of the development 0.4-27 Compliance Action Prior to the issuance of grading permits. all grading plans and permits shall include the requirements for proper transport and disposal ofthe FCS.
