Motion carried 5/0/2 (Commissioners Lafferty and Luna abstained). PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA: None PLANNING COMMISSION PUBLIC HEARING: Chair Meenes directed everyone's attention to the slide on the screen to review the procedures the Commission would be following for that evening's public hearing. Chair Meenes opened the public hearing for Item 1. 1. CDP 2020-0010 (DEV2020-0057)-BOX RESIDENCE -Request for approval of a Coastal Development Permit to allow for the addition and remodel of an existing single-family residence within the Mello II Segment ofthe city's Local Coastal Program located at 5380 Los Robles Drive within Local Facilities Management Zone 3. The project site is not within the appealable area of the California Coastal Commission. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Existing Facilities -Section 15301(e) of the state CEQA Guidelines! City Planner Neu introduced Agenda Item 1 and stated Associate Planner Danna would make the staff presentation (on file in the Planning Division). DISCLOSURES: Commissioners Merz, Stine and Chair Meenes disclosed they drove by and visited the property. PUBLIC COMMENTS: Chair Meenes asked if there were any members of the public who wished to speak on the project, seeing none, he opened and closed public testimony at 3: 12 pm. ACTION: Motion by Chair Meenes, Seconded by Commissioner Stine, to adopt Resolution 7436. Motion carried, 7/0. Planning Commission Minutes Feb. 16, 2022 Page 2 2. CDP 2021-0024 (DEV2021-0095) -BLAUVELT RESIDENCE -Request for approval of a Coastal Development Permit to allow for the demolition of an existing single-family residence and construction of a new 3,107-square-foot single family residence with an attached 770-square- foot accessory dwelling unit with an attached 470-square-foot two-car garage within the Mello II Segment of the city's Local Coastal Program located at 3259 Lincoln Street within Local Facilities Management Zone 1. The project site is not within the appealable area of the California Coastal Commission. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15303(a) construction of a single family residence of the state CEQA Guidelines. City Planner Neu introduced Agenda Item 2 and stated Principal Planner Danna would make the staff presentation (on file in the Planning Division). DISCLOSURES: Commissioners Merz, Stine, Kamenjarin and Chair Meenes disclosed they visited the property. Commissioner Lafferty disclosed she reviewed the historic preservation and Geotechnical reports. QUESTIONS OF STAFF: Commissioner Sabellico asked if there is any requirement to have a pitched roof. Associate Planner Danna responded that a pitch roof element has a maximum of 30 feet and a flat roof has a maximum of 24 feet. He added that the project complies with both heights. Commissioner Lafferty asked if the historic preservation committee has seen a report on this property. Associate Planner Danna responded that city code currently doesn't require a historical preservation study and the Historic Preservation Committee has not seen a report on the property. Commissioner Luna asked what might be expected if the site was reviewed by the Historic Preservation Committee. Commissioner Lafferty responded that developments to the site may be required to maintain certain criteria. PUBLIC COMMENTS: Chair Meenes asked if there were any members of the public who wished to speak on the project, he opened public testimony at 3: 40 pm . Tony Lee stated support for the project as the addition of an ADU creates affordable housing opportunities. Chair Meenes asked if there were any additional members who wished to speak on the project seeing none, closed public testimony at 3:42 p.m. Planning Commission Minutes Feb. 16, 2022 Page 3 COMMISSION DISCUSSION: Chair Meenes asked whether any public improvements will be required for the property. Engineering Manager Ge Ide rt responded that the property owner will be required to make improvements that will be determined during the grading permit application. Commissioner Stine noted that the existing building is decaying, and the proposed project will be an improvement. He stated support for the project. Commissioner Merz stated support for the project. ACTION: Motion by Chair Luna, Seconded by Chair Meenes, to adopt Resolution 7437. Motion carried, 6/1 (Commissioner Lafferty no). 3. CDP 2021-0037/HMP 2021-0004 (PUB 2020-0002) -VALLECITOS INTERCEPTOR SEWER MANHOLE REPAIR -Request for approval of a post emergency Coastal Development Permit and Habitat Management Plan Permit for the repair of a tie-in sewer manhole within a Vallecitos Water District maintenance easement located south of Palomar Airport Road, west of Hidden Valley Road, east of Armada Drive. The project is located within the Mello II Segment of the city's Local Coastal Program and within Local Facilities Management Zone 5. The project site is within the appealable area of the California Coastal Commission. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15301(d) restoration or rehabilitation of deteriorated structures of the state CEQA Guidelines. City Planner Neu introduced Agenda Item 3 and stated Associate Planner Bustamante would make the staff presentation (on file in the Planning Division). QUESTIONS OF STAFF: Commissioner Lafferty asked who evaluated the mitigation measures surrounding the creek. Associate Planner Bustamante responded that city staff reviewed the mitigation measures and consulted with various wildlife agencies and the California Coastal C~mmission. She added that no issues were brought up as a result. ACTION: Motion by Commissioner Luna, seconded by Commissioner Merz, to adopt Resolution 7438. Motion carried, 7 /0. Planning Commission Minutes Feb. 16,2022 Page4 4. CDP 2021-0027 (PUB 2021-0007) -CARLSBAD BOULEVARD AT ENCINAS CREEK -Request for approval of a Coastal Development Permit to replace two existing corrugated metal pipe storm drains. The project site is located on both sides of the northbound lanes of Carlsbad Boulevard at the intersection of Encinas Creek and is entirely within the existing right-of-way. The project is located within the Mello II Segment of the city's Local Coastal Program and within Local Facilities Management Zone 22. The project site is within an area of the city's local coastal zone that is appealable to the California Coastal Commission. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15302 (c) restoration or rehabilitation of deteriorated structures of the state CEQA Guidelines. City Planner Neu introduced Agenda Item 4 and stated Associate Planner Bustamante would make the staff presentation (on file in the Planning Division). DISCLOSURES: Commissioners Merz and Kamenjarin disclosed they drove by the site. COMMISSION DISCUSSION: Chair Meenes asked if the replacement material used on the pipe will be the same as the current material. Associate Engineer and Applicant Jason Evans responded that the current material of the pipe is corrugated metal. However, the pipe will be replaced with a reinforced concrete pipe. PUBLIC COMMENTS: Chair Meenes asked if there were any members of the public who wished to speak on the project, seeing none, he opened and closed public testimony at 4:07 pm. ACTION: Motion by Commissioner Stine, seconded by Commissioner Kamenjarin, to adopt Resolution 7439. Motion carried, 7 /0. 5. DEPARTMENTAL REPORT-ELECTION OF OFFICERS-Elect a Chairperson and Vice Chairperson for the calendar year 2022 . City Planner Neu introduced Agenda Item 5 and provided a brief staff presentation. ACTION: Motion by Commissioner Merz, Seconded by Commissioner Kamenjarin, to appoint Commissioner Stine as Chairperson. Motion carried, 6/1 (Commissioner Lafferty no). Motion by Commissioner Luna, Seconded by Commissioner Kamenjarin, to appoint Commissioner Lafferty as Vice Chairperson. Motion carried, 7 /0. PLANNING COMMISSION REPORTS/COMMENTS: Planning Commission Minutes Feb. 16,2022 Page 5 Chair Meenes noted that City Council will begin public meetings at 5 pm and proposed that the Planning Commission align with that hour and also begin meetings at 5 pm. City Planner Neu stated that the meeting time can be added to a future agenda to propose an amendment to the Planning Commission procedures resolution. Chair Meenes polled the Planning Commission asking if the proposal to change future meetings start times to 5 pm should be added to the next meeting agenda. The Planning Commission voted to add the item to the next meeting. Commissioner Lafferty provided an overview of the January 14, 2022 Historic Preservation Commission meeting. Commissioner Sabellico proposed the Planning Commission begin recommending more discussion items to future meeting agendas in order to be proactive in their advisory capacity. Commissioner Luna stated that a structured rotation in appointing Chai rperson and Vice Chairperson be implemented and asked that it be discussed as part of a future agenda item. The Planning Commission voted to add the item to a future agenda. CITY PLANNER REPORTS: City Planner Neu stated that the City Council took an action to discuss sites that will be studied in the environmental impact report process for the housing element site changes.
