SUBJECT: CDP 2021-0035/HMP 2021-0005 (DEV 2020-0283) - SOUTHERN CALIFORNIA GAS
COMPANY MAINLINE PIPE REPAIR - Request for approval of a post-emergency Coastal
Development Permit and a Habitat Management Plan Permit for the repair of a segment
of a Southern California Gas Company (SoCal Gas) mainline pipe generally located north
of Avenida Encinas and between Carlsbad Boulevard and Ponto Drive, within a SoCal Gas
maintenance easement and within the city’s right of way. The project is located within
the Mello II Segment of the city’s Local Coastal Program and within Local Facilities
Management Zone 9. The project site is within the appealable area of the California
Coastal Commission. The City Planner has determined that the project belongs to a class
of projects that the State Secretary of Resources has found do not have a significant effect
on the environment, and it is therefore categorically exempt from the requirement for
the preparation of environmental documents pursuant to Section 15302, Replacement or
Reconstruction, of the state California Environmental Quality Act (CEQA) Guidelines.
I.RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 7445 APPROVING a post
emergency Costal Development Permit (CDP 2021-0035) and Habitat Management Plan Permit (HMP
2021-0005) to permit the completed emergency repairs that were conducted under Emergency Coastal
Development Permit (CDP 2020-0049) based upon the findings and subject to the conditions contained
therein.
II.PROJECT DESCRIPTION AND BACKGROUND
Project Site/Setting: The segment of mainline pipe repairs is located along and on either side of Ponto
Drive, north of Avenida Encinas and east of Carlsbad Boulevard. It is on vacant land within a maintenance
easement managed by SoCal Gas and entirely within the public right of way as shown on the attached
location map (Attachment 2). The topography of the site is a relatively flat and its vegetation includes
non-native and native plants. Table “A” below identifies the General Plan designations, zoning and current
land uses of the project site and surrounding properties.

Project Background:
Southern California Gas Mainline 1026, a portion of which was the subject of the emergency repair,
traverses from Orange County and extends south through Carlsbad to San Diego. In the project vicinity,
the gas line bisects Ponto Drive to the north of Avenida Encinas and to the east of Carlsbad Boulevard.
The gas line is entirely within public right of way.
During the 1930’s the gas line was installed and a maintenance easement established. SoCal Gas has
monitored and conducted regular maintenance on the line since its installation. In 2020, during one of its
routine maintenance procedures, the utility discovered a leak in a segment of main line 1026. This
segment extends from just north of the Avenida Encinas/Carlsbad Boulevard intersection to a point about
1,000 feet north where Ponto Drive turns sharply west. The leak was determined to need an urgent
response and thus an emergency permit was requested, which the city granted in November 2020.
Emergency work, which included excavation of 1,000 feet of pipeline, was completed in March 2021.
Project Description:
The subject Coastal Development Permit (CDP) application is the follow-up application to make
permanent the work conducted under the emergency permit. The basis for a follow-up, “regular” CDP is
found in Carlsbad Municipal Code Section 21.201.190(D). A Habitat Management Plan Permit is also
required due to the project’s temporary impacts to 0.66 acre of Diegan Coastal Sage Scrub.
On Nov. 12, 2020, SoCal Gas notified the city (Attachment 4) of an immediate need to access and repair a
gas leak in their mainline pipe that is generally located north of Avenida Encinas between Carlsbad
Boulevard and Ponto Drive. Because the repair work is located within the Coastal Zone, an emergency
coastal development permit was required.
On November 19, 2020, the City Planner approved the request for the Emergency Coastal Development
Permit (CDP), determining an emergency existed that required action more quickly than possible under
the regular permitting process (Attachment 5). The approval conditioned that a regular CDP application
be submitted to the city for the emergency work completed and any follow up permanent repairs. The
necessary repair work on the mainline pipe occurred between November 10, 2020 and March 15, 2021.
The remedial, protective work required to deal with the emergency included performing an immediate
pressure reduction. Due to the leak, it was determined that pressure control fittings would need to be
installed to isolate the mainline instead of going to the next mainline valve which would have caused

customer impacts during the isolation. All work remained within the existing easement. Without this
repair, service to customers would have been affected.
Pursuant to Carlsbad Municipal Code Section 21.201.190(E)., the City Planner is required to report to the
California Coastal Commission through its executive director and to the City Council at the first scheduled
meeting after the emergency CDP has been issued, the nature of the emergency and the work involved.
The Coastal Commission and the City Council were both informed of the nature of the emergency and the
scope of the emergency work involved. The Coastal Commission was mailed the notice of emergency on
Nov. 19, 2020 and the City Council received a memorandum report on Aug. 26, 2021 (Attachment 6).
The proposed CDP 2021-0035 and HMP 2021-0005 would permanently authorize the improvements that
were completed by the SoCal Gas under the emergency CDP 2020-0049. No further work is proposed. The
project complies with all applicable city standards and staff’s recommendation of approval with conditions
is supported by the analysis as follows. Unless the permit is appealed, the Planning Commission’s action
will be final.
III.ANALYSIS
The proposed project is subject to the following plans, ordinances, standards, and policies:

21.201) and the Coastal Resource Protection Overlay Zone (Chapter 21.203)

Requirements
The recommendation for approval for this project was developed by analyzing the project’s consistency
with the applicable regulations and policies. This section discusses compliance with each of these
regulations/policies utilizing both text and tables.
A.General Plan
The project is within public with right of way and bordered by streets and vacant and underutilized land
designated for residential and commercial uses. As the table below demonstrates, repair of the pipeline
is consistent with General Plan objectives and will not interfere with overall development of the area.

B.Local Coastal Program (Mello II and West Batiquitos Lagoon/Sammis Properties segments),
Coastal Development Permit Regulations and the Coastal Resource Protection Overlay Zone
The project site straddles the boundary between the Mello II and West Batiquitos Lagoon/Sammis
Properties segments of the Local Coastal Program. All Coastal Zone properties are also within the Coastal
Resource Protection Overly Zone, which in part provides standards to help protect the city’s lagoons.
Further, the portion of the project closest to the Carlsbad Boulevard/Avenida Encinas intersection is
within the appeal jurisdiction of the California Coastal Commission.
The project was authorized, and the emergency work was completed pursuant to emergency CDP 2020-
0049 as authorized by the city’s Coastal Development Permit regulations. Consistent with those
regulations, the applicant is requesting an after-the-fact approval through a regular Coastal Development
Permit to make permanent the work conducted under that emergency.
The project is consistent with the relevant policies of the Mello II and West Batiquitos Lagoon/Sammis
Properties segments and the Coastal Resource Protection Overlay Zone as the following demonstrate:
•As a repair to an existing pipeline in the public right of way, the project does not conflict with
Coastal Zone land use and zoning designations which are the same as the city General Plan
designations and zoning listed in Table A above.
•As a repair to an underground pipeline, the project does not obstruct views of the coastline as
seen from public lands or the public right-of-way nor otherwise damage its visual beauty.
•No agricultural uses exist on the site.
•Since the site does not have frontage along the coastline, no public opportunities for coastal
shoreline access are available from the subject site. Furthermore, the project does not preclude
such potential opportunities in the future.
•Removal of native vegetation due to the emergency repair will be mitigated through on-site
restoration, ensuring no net loss of habitat in the Coastal Zone.

C.Habitat Management Plan and Chapter 21.210 Habitat Preservation and Management
Requirements
Pursuant to CMC Chapter 21.210, a Habitat Management Plan Permit is required for any development
project which indirectly or directly impacts natural habitat. To approve the permit, findings must be made
to demonstrate project consistency with applicable standards.
Neither the public right of way in which the project is located nor adjacent property are part of the city’s
existing or future habitat preserve system. The long, narrow project site that encompasses the portion of
excavated and repaired pipeline and its surroundings are identified as “developed” by the Habitat
Management Plan. Nevertheless, repairs to fix the gas leak resulted in the temporary removal of 0.66 acre
of Diegan Coastal Sage Scrub in a long narrow strip following the pipeline and in between Ponto Drive and
the Carlsbad Boulevard/Avenida Encinas intersection. Though temporary, this removal is subject to
replacement. Besides habitat impacts, the project also impacted 0.41 acre of disturbed or developed land
cover, which includes features such as dirt roads and ornamental vegetation.
Impacts to the Diegan Coastal Sage Scrub are considered temporary because the area disturbed will be
restored at a 1:1 ratio, resulting in no loss of habitat. As conditioned, SoCal Gas will submit a restoration
plan for approval by the city prior to its implementation. The restoration plan will detail planting
specifications, maintenance activities, monitoring methods throughout the establishment period, success
criteria, and contingency actions to ensure a successful on-site restoration program.
HMP findings for the project can be found within the Planning Commission Resolution (Attachment 1).
IV.ENVIRONMENTAL REVIEW
The California Environmental Quality Act (“CEQA”), and its implementing regulations (“CEQA Guidelines”)
adopted by the Secretary of the California Natural Resources Agency, list classes of projects that have
been determined not to have a significant effect on the environment and as a result are exempt from
further environmental review under CEQA. City staff completed a review of the project and its potential
environmental impacts pursuant to CEQA and concluded that the project qualified for an exemption
pursuant to CEQA Guidelines section 15302(c) – replacement or reconstruction of existing utility systems
and/or facilities involving negligible or no expansion of capacity. The proposed project meets the criteria
of the Section 15302(c) exemption because the project involves no expansion of the utility system’s
capacity and instead replaces habitat temporarily disturbed as part of emergency repairs.
A notice of intended decision regarding the environmental determination was advertised on February 3,
2022 and posted on the city’s website. The notice included a general description of the project, the
proposed environmental findings, and a general explanation of the matter to be considered. The findings
and determination contained in that notice were declared as final on the date of the noticed decision,
unless appealed as provided by the procedures commencing in Chapter 21.54 (Procedures, Hearings,
Notices, and Fees) of the Zoning Ordinance.
During the 10-day public review period, the city received no comment letters from the public regarding
the prospective environmental determination. Since no appeal was filed and no substantial evidence was
submitted that would support a finding that the exemption requirements would not be satisfied, the

project was determined by the city planner to be an project exempt from CEQA. The CEQA Determination
letter is attached to this staff report as Attachment 7 and demonstrates that the project is categorically
exempt from environmental review. The city planner’s written decision is final and the CEQA
determination is not within the Planning Commission’s purview. With the appropriate environmental
clearances in place, all of the city’s procedural requirements and relevant aspects of CEQA have been
satisfied.

City of Carlsbad Planner.
SoCalGas is providing notification to the City of Carlsbad Planning Department of an Emergency Coastal Development
Permit request.
While conducting repair and maintenance valve work near the intersection of Ponto Dr and Ponto Rd with City Street
Row, SoCalGas detected a leak on the mainline (pipe). The Southern Tie‐in excavation was conducted yesterday and will
continue into the weekend. The 1000 + ft of replacement will begin Monday November 16th, 2020.
The vegetation that will be disturbed is mainly invasive plant species such an mustard, ice plant, Pampas grass and some
native vegetation such as coyote bush.
Construction crew have already notified the City Inspector Alison Luetkde of the emergency work.

team to excavate further South along the pipeline to find suitable pipe to transition into.

a.Due to the emergency leak, it was determined that the pressure control fitting would need to
be installed further South to isolate the mainline in lieu of going to the next main line valve
which will cause customer impacts during our isolation. This location is at the intersection of
the northbound Carlsbad Blvd and Avendia Ecinas.

The City Planner has completed a review of the application for an Emergency Coastal Development Permit to repair
a leak on the mainline pipe by excavating the southern tie-in and replace approximately 1,000 feet of pipe; the leak
was detected about November 10. construction will include excavating over the existing pipeline alignment with a
back hoe and installing the new pipe with a side boom. Other equipment to be brought to the project site includes
crew trucks and welding truck rigs. There will be ground disturbance and removal of non-native vegetation and some
native vegetation as a result of this project. This project is expected to take place entirely within the existing pipeline
easement within City's public right-of-way.
The City Planner APPROVES this request for an Emergency Coastal Development Permit based upon the following:
Findings:
1.An emergency exists that requires action more quickly than permitted by the procedures for minor coastal
development permits or for regular permits and the work can and will be completed within thirty days unless
otherwise specified by the terms of the permit;
2.Public comment on the proposed emergency action has not occurred because time did not allow; and
3.The work proposed will be consistent with the requirements of the certified land use plan.
Conditions:
1.The Emergency Coastal Development Permit is granted subject to completion of the emergency repair work
within 30 days.
2.Submit a formal application for a regular Coastal Development Permit to the City of Carlsbad within 30 days of
this letter for the repair work completed on the interceptor sewer manhole and for any follow up permanent
repair work for the project.

This memorandum provides a status update on the Vallecitos Water District manhole repair
and SoCal Gas repair and maintenance emergency projects conducted in 2020.
Background
In 2020, there were two utility projects that required emergency repair of facilities within the
Coastal Zone. Per the city's local Coastal Program and Municipal Code, there are certain
conditions when emergency work is allowed through issuance of an emergency Coastal
Development Permit (CDP) by the City Planner. An emergency CDP was issued for each of the
two maintenance projects as described below:
•Vallecitos Water District (District 3)
On May 18, 2020, the Vallecitos Water District submitted a letter to city staff formally
notifying of an immediate need to access and repair a sewer manhole within the district's
easement and requesting an emergency CDP. The work to repair the manhole, located on
the south side of Palomar Airport Road and east of Costco, was begun and completed that
month. On June 25, 2020, the city approved the request for the emergency CDP (CDP
2020-0030).
•SoCal Gas (District 4)
On Nov. 13, 2020, SoCal Gas sent a request to the city for an emergency CDP for an
emergency repair to a gas line that was located within a right of way maintenance
easement beginning at Avenida Encinas 1,000 feet north to Ponto Drive. On
Nov. 19, 2020, the city issued an emergency CDP (CDP 2020-0049).
Requirements for emergency CDPs are listed in Section 21.201 of the Carlsbad Municipal Code,
including requirements for notification to the City Council following issuance of an emergency
CDP. However, following permit issuance, staff reviewed and discussed with the California
Community Services Branch

Coastal Commission if CDPs were needed for one or both of the maintenance projects. Coastal
Act Section 30610 provides that no coastal act permits are required for repair or maintenance
activities; however, the same code section allows the Coastal Commission authority to make a
final determination. The Coastal Commission determined that CDPs were necessary because in
their opinion there was a "risk of substantial adverse environmental impact" (Public Resources
Code§ 30610 [d]). Since this determination occurred after the work was completed,
Community Development Department staff requested that the Vallecitos Water District and
SoCal Gas submit applications for CDPs and Habitat Management Plan (HMP) Permits for
processing and consideration by the Planning Commission. The Planning Commission would
approve these CDPs, unless an appeal is filed with the City Clerk's Office.
Discussion
Staff remained in communication with the Vallectios Water District and the SoCal Gas
representatives to provide guidance for the appropriate follow up permits. Staff has
continuously advised both agencies regarding the type of permits necessary, and the
documents required to submit complete applications. Staff has also responded to inquiries
from the public about the projects.
Next Steps
On July 15, 2021, Recon Environmental, on behalf of Vallectios Water District, submitted their
application and supplemental materials. On July 13, 2021, SoCal Gas submitted their application
and supplemental materials. Staff is reviewing both applications and related materials for
compliance with the local codes and ordinances. After reviewing both applications, staff will
present the projects to the Planning Commission for review and consideration, anticipated by
the end of 2021.

2021-0005 (DEV 2020-0283) -Southern California Gas Company Mainline Pipe Repair.
Upon review of the location, the North County Transit District (NCTD) has determined that
there is a bus stop on Carlsbad Blvd & Avenida Encinas (ID: 22442) on the northbound
BREEZE Route 101 that may be impacted by construction.
NCTD requests that you or your contractor provide notice two (2) weeks prior to starting
work so that we may send a supervisor to meet with your construction crew to determine if
your traffic control methods affect NCTD's stops. Notice should be provided via e-mail to
