AGENDA OF:April 6, 2022 Project Planner: Don Neu Project Engineer: N/A SUBJECT: PLANNING COMMISSION WORK PLAN FOR FISCAL YEAR 2022-2023 – Request for a recommendation to accept the Fiscal Year 2021-2022 Work Plan Annual Report and approve the Planning Commission Work Plan for fiscal year 2022 - 2023. The proposed action does not constitute a “project” pursuant to the California Environmental Quality Act. I.RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 7446 RECOMMENDING ACCEPTANCE of the Fiscal Year 2021-2022 Work Plan Annual Report and RECOMMENDING APPROVAL of the Fiscal Year 2022-2023 Work Plan. II.PROJECT DESCRIPTION AND BACKGROUND In 2018 the City Council revised the Carlsbad Municipal Code to create uniform policies and procedures related to boards and commissions, requiring each board or commission to provide the City Council for its approval an annual work plan of activities to be undertaken in the coming year and to provide a subsequent report of its accomplishments. Attached for Planning Commission consideration is a report of the Fiscal Year 2021-2022 Planning Commission Work Plan accomplishments and the proposed Fiscal Year 2022-2023 Planning Commission Work Plan. The responsibilities and corresponding work of the Planning Commission is well defined in state law and Titles 19 (Environment), 20 (Subdivisions), and 21(Zoning) of the Carlsbad Municipal Code. As such many of the items on the workplan are projects undertaken to comply with state laws, City Council direction, or those submitted by private applicants or city departments. Some items in the work plan are multi-year efforts that will carry over into future years. Projects in addition to those listed in the annual report and work plan have been and will be considered by the Planning Commission. Staff is recommending that the Planning Commission Review both documents and provide a recommendation. The Planning Commission’s recommended action on the annual report and work plan will be considered by the City Council at a public meeting. IV.ENVIRONMENTAL REVIEW Pursuant to Public Resources Code Section 21065, this action does not constitute a “project” within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. 5 Staff Report 0 PLANNING COMMISSION WORK PLAN FOR FISCAL YEAR 2022-2023 April 6, 2022 Page 2 Exhibits: 1.Planning Commission Resolution No. 7446 with attachments Fiscal Year 2021-22 Planning Commission Work Plan Annual Report Annual Report Attachment A I.Mission Statement The Planning Commission holds regularly scheduled public hearings to consider land use matters, such as the general plan, local coastal program, growth management program, specific plans, master plans, amendments to the zoning ordinance, zone changes, special studies, and discretionary development permits for public and private projects. For some actions, the Planning Commission acts in an advisory role and provides a recommendation to the City Council. In many cases the City Council has delegated to the Planning Commission the authority to take a final action on the item subject to appeal to the City Council. Prior to an item being considered by the Planning Commission the Planning Division staff complete its review of a proposed project for compliance with all applicable plans, policies, and laws and provides a written recommendation. Planning Commissioners also serve on special committees or task forces as requested by the City Council. II.Composition The Planning Commission consists of seven members appointed by the City Council to a four-year term. There are also three ex officio members who shall be the City Planner, Assistant City Attorney, and City Engineer. III.Fiscal Year 2020-21 Goals & Tasks The City of Carlsbad Planning Commission has selected to focus on the following goals and tasks: GOAL/TASK STATUS COMMENTS/RECOMMENDATION Long Range Planning Projects Housing Element Update Phase 2 – Implement Land Use Changes Pending On February 15, 2022 the City Council considered public input and provided direction on what sites/alternatives to study. City Council gave direction for two map alternatives to study. Next step is initiating preparation of a Supplemental Environmental Impact Report and holding a Public Scoping Meeting. GOAL/TASK STATUS COMMENTS/RECOMMENDATION Zoning Code Update Inactive Project was put on hold so staff could focus on other priority projects. An administrative draft of the updated Zoning Code has been prepared. Capital Improvements Project Permit Process Amendment Inactive Project was put on hold so staff could focus on other priority projects. Objective Design Standards and Streamlined Permitting for Multi-Family Residential Structures Outside of the Village and Barrio Master Plan area Pending A consultant was selected and a contract approved by the City Council. The consultant has completed a review of standards. The public engagement plan is being prepared. Village & Barrio Master Plan Amendments directed by the City Council including Objective Design Standards and Streamlined Permitting for Multi-Family Residential and Mixed-Use Structures Pending The City Council has appointed members to the committee. The first meeting of the committee is scheduled for April 2022. Permit-Ready Accessory Dwelling Unit Program Pending A community survey and public outreach plan is being prepared. Following the survey draft guidelines and plans will be prepared. Private Development Projects Newage Carlsbad Resort (CDP 2019-0025) Pending Project is under review by staff. GOAL/TASK STATUS COMMENTS/RECOMMENDATION North County Plaza Mixed-Use Redevelopment (Amend 2018-0014) Pending The project is under review by staff. Legoland Plan Amendment Update (Amend 2021-0001) Pending The project is under review by staff. Toyota Carlsbad (CDP 2020-0024) Completed On July 9, 2021 the Planning Commission approved a Coastal Development Permit and Site Development Plan for the demolition of the existing dealership buildings and the construction of a new 24,381 square-foot automobile dealership at 5424 Paseo del Norte. BMW Ancillary Facilities (CUP 2020-0008) Completed On June 16, 2021 the Planning Commission approved a Conditional Use Permit to allow the change of use of three existing vacant automobile dealership buildings from automobile dealership use to auto repair and auto rental and leasing uses at 5215 and 5245 Car Country Drive. Chick-Fil-A (Amend 019-0004) Completed On Dec. 6, 2021 the Planning Commission recommended approval of legislative actions and discretionary permits to demolish a 10,600 square- foot office building and construct a 3,932 square- foot Chick-fil-A restaurant at 5850 Avenida Encinas. City Capital Improvement Projects Orion Center (Maintenance & Operation Building) Pending Project is under review by staff. Project requires approval by the Planning Commission of a Conditional Use Permit and Mitigated Negative Declaration. Veterans Memorial Park Pending Project is under review by staff. Project requires approval by the Planning Commission of a Conditional Use Permit and Mitigated Negative Declaration. Training Receive Updates on New State Laws and City Council Actions applicable to the commission Pending An update will be provided to the City Council and Planning Commission prior to June 30, 2022.
