Executive Summary/Discussion The California Legislature passed a handful of housing bills that bring many changes to the housing permitting process, density bonus applications, and accessory dwelling units, among other housing issues. Margaret and Tyson Sohagi of the Sohagi Law Group PLC will be presenting information on this legislation and responding to questions. These recently passed Senate bills focus on increasing the housing stock and streamlining housing development to implement the state’s housing goals. The presentation will include a discussion of the following: •Senate Bill 9, the Housing Opportunity and More Efficiency Act, or HOME Act, requires ministerial approval (meaning without discretionary review or hearing) of duplexes and/or urban lot splits on single-family zoned parcels if the proposed project meets certain requirements. •SB 10 gives local governments the option to increase the density of the zoning on certain parcels to allow up to ten housing units. •SB 8 updates the Housing Crisis Act of 2019, which limits local discretion in approving housing projects. •AB 1174 updates the Housing Accountability Act, which streamlines the ministerial approval process for multifamily housing projects. •AB 345 requires local governments to allow the sale or conveyance of accessory dwelling units separately from the primary residence. •Updates to the state’s Density Bonus Law that encourage greater housing density. The law enables developers to obtain more favorable development standards and include more total units in a project than would otherwise be allowed by local zoning in exchange for providing affordable or senior units. Environmental Evaluation This action does not require environmental review because it does not constitute a project within the meaning of the California Environmental Quality Act under California Public Resources Code Section 21065 in that it has no potential to cause either a direct physical change or a reasonably foreseeable indirect physical change in the environment. Public Notification This item was noticed in keeping with the state's Ralph M. Brown Act and available for public viewing and review at least 72 hours before the scheduled meeting date.
