HomeMy WebLinkAboutCD 2022-0001; VIASAT BLOOM ENERGY FUEL CELL VIA003; Admin Decision LetterApril 28, 2022 Jennifer Horta 4353 N ist Street San Jose, CA 95134 Ccityof Carlsbad 8FILE COPY IYJ~,' /-e/ f.//2'!/22- SUBJECT: CD 2022-0001 (DEV2016-0015) -VIASAT BLOOM ENERGY FUEL CELL VIA003 The City Planner has completed a review of your application for a Consistency Determination, CD 2022- 0001, (APN: 213-260-10-00) which is a modification to Site Development Plan SDP 16-17 (related permits include MP 178K, PUD 16-05, SUP 16-01, and MS 16-04), a request for adding a skid mounted bloom energy server enclosed within an eight-foot screened wall. After careful consideration of the request, the City Planner has determined that the request meets all of the findings below and APPROVES this request. The proposed modifications include: • The addition of an equipment shelter incasing energy efficient servers within an eight-foot screened wall located on APN 213-260-10-00. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1} No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the proposed equipment shelter, that'll encase energy efficient servers, are essential to the site and complies with the original approval of SDP 16-17. 2} The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that the proposed revisions to the facade result in an architectural design that will complement the existing building design. 3) The proposed revision does not change the density or boundary of the subject property. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit in that the addition of an equipment shelter is consistent with the permitted uses as allowed per SDP 16-17 onsite and does not require any modifications to the land use. 5) The proposed revision does not rearrange the major land uses within the development in that no additional buildings or uses are proposed beyond the scope of what was approved for the original Site Development Plan, SDP 16-17. Community Development Department Planning Division I 1635 Faraday Avenue I Carlsbad, CA 92008 I 442-339-2600 CD 2022-0001 (DEV2016-0015) -VIASAT BLOOM ENERGY FUEL CELL VIA003 April 28, 2022 Pa e 2 6) The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code in that there are no changes to parking, landscaping, setbacks, or coverage. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation in that the proposed equipment shelter is a negligible change to the approved project. The proposed revision will not result in any additional impacts to noise, air quality, average daily traffic or water quality and the site can be adequately served by all utilities and public services. B) The proposed change would not result in any health, safety or welfare impacts. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10} The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved as the proposed revisions to the facade result in an architectural design that will complement the existing buildings. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35.
