HomeMy WebLinkAboutPUD 16-05; VIASAT BRESSI RANCH CAMPUS - FIRST EXTENSION; Admin Decision LetterJune 1, 2022 Travis Golliver ViaSat, Inc. 6155 El Camino Real Carlsbad, CA 92009 ('Cityof Carlsbad [3FILE COPY fV!,._,J-fJ 6/;/22 SUBJECT: PUD 16-05/SDP 16-17/SUP 16-01/MS 16-04 (DEV2016-0015) -VIASAT BRESSI RANCH CAMPUS -FIRST EXTENSION The Planning Division has completed its review of your application for the first extension of Non- Residential Planned Development Permit PUD 16-05, Site Development Plan SOP 16-17, Scenic Corridor Special Use Permit SUP 16-01, and Tentative Parcel Map MS 16-04 -VIASAT BRESSI RANCH CAMPUS, submitted on May 2, 2022. Said permits, which cover the re-subdivision of eight industrial lots to three on 23.1 acres of land, the development of 477,000 square feet of planned industrial/office and manufacturing space within five, two-and three-story buildings, a 7,500-square-foot cafe, a 9,140- square-foot conference center, and three parking structures, is generally located north of Town Garden Road, south of Gateway Road, east of El Camino Real, and west of Alicante Road within Local Facilities Management Zone 17. The project was approved on October 5, 2016, by Planning Commission Resolution No. 7197, was issued building permits for phases one and two on May 3, 2017 and was due to expire on May 3, 2022. After careful consideration of the circumstances surrounding this request, it has been determined that (1) the first extension of Non-Residential Planned Development Permit PUD 16-05, Site Development Plan SOP 16-17, Scenic Corridor Special Use Permit SUP 16.:01, and Tentative Parcel Map MS 16-04 -VIASAT BRESSI RANCH CAMPUS, was submitted in a timely manner prior to the expiration date, and (2) that the findings required for granting a Non-Residential Planned Development Permit extension, Site Development Plan extension, Scenic Corridor Special Use Permit extension, and Tentative Parcel Map extension can be made; therefore, the City Planner APPROVES the first extension of Non-Residential Planned Development Permit PUD 16-05, Site Development Plan SOP 16-17, Scenic Corridor Special Use Permit SUP 16-01, and Tentative Parcel Map MS 16-04 -VIASAT BRESSI RANCH CAMPUS, for two (2) years from May 3, 2022, to May 3, 2024, based on the following findings and conditions. Findings: 1. All the findings contained in the Planning Commission Resolution No. 7197 dated October 5, 2016, for Non-Residential Planned Development Permit PUD 16-05, Site Development Plan SOP 16-17, Scenic Corridor Special Use Permit SUP 16-01, and Tentative Parcel Map MS 16-04 -VIASAT BRESSI RANCH CAMPUS, apply to this extension and are incorporated herein by reference and remain in effect. That the first two-year extension of Non-Residential Planned Development Permit PUD 16-05, Site Development Plan SOP 16-17, Scenic Corridor Special Use Permit SUP 16-01, and Tentative Parcel Mar, MS 16-04 remains consistent with the General Plan, all titles of the Carlsbad Municipal Code and growth management program policies and standards in place at this time. 3. The extension request is the first two-year extension the city planner may grant for the approval of Non-Residential Planned Development Permit PUD 16-05, Site Development Plan SOP 16-17, Scenic Corridor Special Use Permit SUP 16-01, and Tentative Parcel Map MS 16-04, and that the extension requested will extend the approval for two years from May 3, 2022, to May 3, 2024. 4. The city planner finds that: a. The project is a subsequent activity of the Bressi Ranch Master Plans (MP178), a project for which a program EIR was prepared, and a notice for the activity has been given, which includes statements that this activity is within the scope of the program approved earlier, and that the program EIR adequately describes the activity for the purposes of CEQA; and b. That the project is consistent with the Master Plan cited above; and c. The Bressi Ranch Master Plans Final EIR 98-04 was certified by the City Council on July 9, 2002, in connection with the prior project or plan; and d. The project has no new significant environmental effect not analyzed as significant in the prior EIR; and e. None of the circumstances requiring a Subsequent EIR or a Supplemental EIR under CEQA Guidelines Section 15162 or 15163 exist. Conditions: 1. This first extension of Non-Residential Planned Development Permit PUD 16-05, Site Development Plan SOP 16-17, Scenic Corridor Special Use Permit SUP 16-01, and Tentative Parcel Map MS 16-04 is granted from May 3, 2022, to May 3, 2024. If building permits for the third phase of the project is not obtained within this time period, the Non-Residential Planned Development Permit, Site Development Plan, Scenic Corridor Special Use Permit and Tentative Parcel Map will expire on May 3, 2024, unless extended per Sections 21.58.040 of the Carlsbad Municipal Code. 2. All of the conditions contained in Planning Commission Resolution No. 7197 dated October 5, 2016, apply to this first extension and are incorporated herein by reference and remain in effect, except condition No. 10, which is hereby superseded by Condition No. 1 of this approval letter.
