Diaz, Utilities Senior Engineer, Public Works Shelley Glennon, Associate Planner Eric Lardy, Principal Planner Ccityof Carlsbad Via Re: EA 2022-0021 EL FUERTE & MAERKLE MOTORIZED VALVES PROJECT Thank you for submitting an Early Assessment for the El Fuerte & Maerkle Motorized Valves Project, Capital Improvement Project (CIP) Nos. 5050, 5009, 5007, to install three motorized valves and related structures and cathodic protection improvements on existing water transmission mains at two sites, on El El Fuerte Street (6400-6649 Blocks) between Rancho Pancho and Alga Road and at the Maerkle Water Reservoir (APN 760-166-86-00). In response to your application, the Planning Division has prepared this comment letter. Please note that the purpose of an Early Assessment is to provide you with direction and comments on the overall concept of your project. This Early Assessment does not represent an in-depth analysis of your project. It is intended to give you feedback on critical issues based upon the information provided in your submittal. This review is based upon the plans, policies, and standards in effect as of the date of this review. Please be aware that at the time of a formal application submittal, new plans, policies, and standards may be in effect and additional issues of concern may be raised through a more specific and detailed review. Planning: General 1. General Plan and zoning designations for the property are as follows: a. The El Fuerte Street project site is located primarily within the road right-of-way; however, a portion of the proposed new improvements will be at APN 222-600-01 and an easement is required. Therefore, please clearly delineate the easement area within the site plan when submitting the proposed PEIR addendum and provide staff with the most current easement docu·mentation. Since the project requires an easement, the easement may need to be evaluated within the proposed PEIR addendum as part of the proposed project. 3. Neither of the two project sites are located within the Coastal Zone. 4. The El Fuerte Street project requires no Planning permits. However, prior to any discretionary action on the project, such as a City Council authorization to bid or award a contract, the proposed addendum should be approved. This can occur as part of permitting required for the Reservoir site project, discussed below. 5. The Maerkle reservoir project requires a minor Habitat Management Plan (HMP) permit. The Reservoir site is located adjacent to an existing hardline preserve of the Habitat Management Plan (HMP). Based on the project's potential impact to sensitive habitat and species, a minor Habitat Management Plan (HMP) permit will be required for approval. See CMC Chapter 21.210 "Habitat Preservation and Management Requirements" for more information. 6. Prior to the approval of the minor HMP permit, the proposed second addendum to the Sewer Master Plan and Carlsbad Municipal Water District Master Plans Update Program Environmental Impact Report (EIR) must be approved by the City Planner in accordance with Section 15164 of the California Environmental Quality Act (CEQA) Guidelines. Please submit the applicable environmental documents with the proposed project application including the appropriate technical studies and/or surveys. Consistent with the addendum, the project will need to implement any applicable mitigation measures. To aid their implementation, these mitigation measures should be incorporated into project plans and specs. 7. A letter from the Native American Heritage Commission (NAHC) dated April 26, 2022, to the applicant, indicated a positive record search result of the NAHC Sacred Lands File (SLF) and that the La Jolla band of Luiseno Indians and the San Luis Rey Band of Mission Indians should be contacted (see attachment). Neither the addendum nor the cultural resources report reference or respond to this letter. Please revise them accordingly. 8. While the project as proposed (including the proposed addendum) is not subject to Native American consultation pursuant to AB 52 or SB 18 notifying the two tribes of the proposed project may be required to ensure the consistency with previous cultural resources mitigation and to allow them the EA 2022-0021-EL FUERTE & MAERKLE MOTORIZED VALVES PROJECT June 9, 2022 Pa e 3 opportunity to identify any additional Native American resources that may or may not be included in the records. If these tribes have already been notified and/or provided comments prior to submitting your application, please provide that documentation for staff to review and evaluate. Public Works (Environmental): Comment letter dated May 24, 2022, from Rosanne Humphrey, Habitat Management Plan Manager is attached. Land Development Engineering: Comment letter dated May 10, 2022, from Jennifer Horodyski, Project Engineer is attached.
