I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 6508 APPROVING Coastal Development Permit CDP 07-28 based on the findings and subject to the conditions contained therein. II. INTRODUCTION The applicant, Leucadia Wastewater District (LWD), is requesting approval of a Coastal Development Permit (CDP) to allow the replacement of an existing sewer generally located within the Carlsbad Boulevard right-of-way within the West Batiquitos Lagoon segment of the City's Local Coastal Program (LCP). III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: The Batiquitos Sewer Replacement project is being carried out by the Leucadia Wastewater District, which provides sewer service to portions of northern Encinitas and southern Carlsbad. Project work will occur in both Encinitas and Carlsbad. However, this CDP application covers only that portion of the project within Carlsbad. A separate permit will be obtained from the City of Encinitas for that portion of the project within their jurisdiction. The project area that is the subject of this CDP is located both within the existing Carlsbad Boulevard right-of-way from the southern City boundary to the Batiquitos sewer pump station approximately 600 feet north and within an easement on part of the Batiquitos Lagoon property to the east. The project area is located within the appeal jurisdiction of the California Coastal Commission. The project ensures that the sewer line remains operational and prevents a failure of the existing line. The project also creates additional needed capacity. Proposed Construction: The project will consist of constructing a new 24 inch and 30 inch PVC pipeline and manholes using traditional open-cut trench methods. The existing pipe and manholes will be abandoned and filled. As shown on Exhibits "A - F" attached, the work will occur mostly CDP 07-28 - BATIQUITOS SEWER REPLACEMENT November 5, 2008 Page 2 within the Carlsbad Boulevard right-of-way and partially on the Batiquitos Lagoon property to the east. Impact on Coastal Resources: The project will replace the existing sewer line mostly within the Carlsbad Boulevard right-of-way and partly on the Batiquitos Lagoon property where the pump station is currently located. No permanent project related impacts to sensitive upland or wetland habitats will occur provided that construction and maintenance of the project is accomplished in accordance with the required mitigation measures. IV. ANALYSIS The project is subject to the following regulations and requirements: A. General Plan; B. O-S (Open Space) Zone (Chapter 21.33 of the CMC); and C. Coastal Development Permit Regulations for the West Batiquitos Lagoon Local Coastal Program (LCP) Segment, Coastal Resource Protection Overlay Zone, (Chapters 21.201 and 21.203 of the Zoning Ordinance). The recommendation for approval of this project was developed by analyzing the project's consistency with the applicable city regulations and policies. The project's compliance with each of the above regulations is discussed in detail in the sections below. A.General Plan One of the purposes of the General Plan Open Space land use designation is to protect natural resource areas such as the lagoons and their surrounding environments. The City's Habitat Management Plan (HMP) is the key tool to implementing the resource protection objectives of the General Plan and the project will be carried out consistent with the provisions of the HMP because the area is included in the City's habitat preserve. As required in the Mitigation Monitoring and Reporting Program for the MND prepared by the LWD as lead agency, the sewer replacement project will utilize construction methods and procedures that will minimize risk of damage to sensitive resources. Therefore, the open space will not be significantly affected by the project. The project is also consistent with the General Plan's Goals and Objectives as listed in Table A. PROPOSED USES & IMPROVEMENTS The project will follow the City's Stormwater Best Management Practices (BMPs) to maintain water quality. The project replaces an existing sewer line which helps to protect the environmentally sensitive land by minimizing the chances of a failure. The proposed maintenance will be conducted without impacts to sensitive areas. The project design and methodology avoids impacts to scenic, cultural, and historic values associated with Batiquitos Lagoon. CONSISTENT? Yes Yes Yes B. Coastal Development Permit Regulations for the West Batiquitos Lagoon Local Coastal Program (LCP) Segment and the Coastal Resource Protection Overlay Zone. 1. West Batiquitos Lagoon LCP Segment The project site is located within the West Batiquitos Lagoon Segment of the Local Coastal Program and is in the appeal jurisdiction of the Coastal Commission. The proposed sewer replacement is consistent with the policies and implementing objectives of the City's coastal development procedures and provisions of the West Batiquitos Lagoon Local Coastal Program segment since it protects and preserves the existing open space areas in and around the project area. Additionally, the project will not obstruct views of the lagoon, nor otherwise damage the visual beauty of the coastal zone. Impacts to sensitive coastal resources will be minimized to levels of insignificance by implementing the project's Mitigation Monitoring and Reporting Program. Public access to the coastal areas will be maintained during project construction by maintaining one open lane to traffic on northbound Carlsbad Boulevard. No beach access will be restricted by this project. 2. Coastal Resource Protection Overlay Zone The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the City's CDP 07-28 - BATIQUITOS SEWER REPLACEMENT November 5, 2008 Page 4 Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water Mitigation Plan (SUSMP) and Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased urban runoff, pollutants and soil erosion. No development is proposed in areas of steep slopes (coastal bluff) and only a small amount of native vegetation located on the subject property will be temporarily impacted. Temporary impacts to disturbed Diegan coastal sage scrub and disturbed mulefat scrub shall be mitigated in place at a 1:1 ratio following construction through re-vegetation consisting of potted plants and hydro seed, which is consistent with the City's HMP. The site is not located in an area prone to landslides, or susceptible to accelerated erosion or liquefaction. While the area may be subject to flooding, the project is compatible with periodic flooding and no new structures are being constructed in this area. V. ENVIRONMENTAL REVIEW Pursuant to the California Environmental Quality Act (CEQA), the Leucadia Wastewater District, as Lead Agency, has conducted an environmental impact assessment for the Batiquitos Sewer Replacement project to determine if the project could have any potentially significant impact on the environment. The environmental impact assessment identified potentially significant impacts to nesting birds, sensitive vegetation, sensitive habitat, and cultural resources. Mitigation measures have been incorporated into the design of the project or have been placed as conditions of approval for the project such that all potentially significant impacts have now been reduced to below a level of significance. Consequently, a Mitigated Negative Declaration (MND) and Mitigation Monitoring and Reporting Program (MMRP) were sent out for public agency review and after minor changes, adopted by the LWD Board of Directors on October 8, 2008. For this project, the City of Carlsbad is a Responsible Agency under CEQA since it has coastal development permit authority over the project. As a Responsible Agency, the City is not obligated to prepare its own environmental document, but rather must "consider the environmental effects of the project as shown in" the document adopted by the Lead Agency (CEQA Guidelines 15096(f)). Planning Department staff was consulted by the LWD during the preparation of the MND and MMRP, and the LWD incorporated the City's comments into the final document. The project is proposed by the Leucadia Wastewater District to improve the reliability and efficiency of an existing 18-inch gravity sewer main by replacing it with a new 24-inch diameter PVC sewer main within Carlsbad Boulevard/North Coast Highway 101. The new pipeline would be located approximately 15 feet west of the existing pipeline and would extend approximately 900 feet, from the intersection of La Costa Avenue to the District's existing Batiquitos Pump Station (Figure 3). The existing 18-inch diameter pipeline would be abandoned in place. The project includes all trench resurfacing and site restoration, including fencing and landscaping at the Batiquitos Pump Station, to return the project site to its original condition. Construction is proposed outside the bird breeding season and is tentatively Final Mitigated Negative Declaration for Batiquitos Gravity Sewer October 2008 -2- scheduled for December 2008 through February 2009, a period of approximately 12 weeks. The Leucadia Wastewater District covers a total service area of 16 square miles and provides services to 60,000 residents in a boundary that includes the original service area in Leucadia as well as the La Costa area in Carlsbad and northern Encinitas. 9. Surrounding land uses and setting: The project is for the most part proposed within a northbound travel lane of Carlsbad Boulevard, also know as the Coast Highway, U.S. 101, and San Diego County S-21. The subject section of Carlsbad Boulevard is immediately east of South Carlsbad State Beach and the California Coastal National Monument and immediately west of Batiquitos Lagoon. The beach and Pacific Ocean to the west are a prime recreation area while the Batiquitos Lagoon provides habitat for many sensitive and threatened species. The District maintains the existing Batiquitos Pump Station on the east side of Carlsbad Boulevard, south of the opening of the Batiquitos Lagoon to the ocean. The southern portion of the pipeline alignment is with the Leucadia community of the City of Encinitas. Carlsbad Boulevard becomes Old Coast Highway 101 upon crossing the Carlsbad/Encinitas city boundaries. The San Diego Northern Railroad (SDNR) is located a short distance to the east, running parallel to the coast and Carlsbad Boulevard. The California Southern Railroad Line (now SDNR) was constructed in 1881 and the Pacific Coast Highway was constructed in 1912. The City of Carlsbad annexed the Batiquitos Lagoon in 1984. The Batiquitos Lagoon underwent a $57 million restoration project that was officially completed on December 7, 1996. The restoration project as undertaken by the Port of Los Angeles in partnership with the City of Carlsbad, California Department of Fish and Game, California State Lands Commission, U.S. Fish and Wildlife Service, and the National Marine Fisheries Service. The lagoon is managed today by the California Department of Fish and Game as the Batiquitos Lagoon Ecological Reserve. Ongoing maintenance includes the dredging of sand from the western end of the lagoon every two years and depositing the sand on the beach. This is necessary because the Carlsbad Boulevard, the train tracks, and Interstate 5 all greatly restrict tidal flow into and out of the lagoon and sediment has been accumulating. The Batiquitos Pump Station is located on the east side of Carlsbad Boulevard, adjacent to what is now the southwest corner of Batiquitos Lagoon. Surfer's Point Resort has been proposed for construction on the bluff at the northeast corner of La Costa Avenue and North Coast Highway 101. Construction of this oceanfront vacation destination resort has not yet begun. Final Mitigated Negative Declaration for Batiquitos Gravity Sewer October 2008 -3- The developer, however, has begun to accept reservations to purchase time- share ownership of the private units. The District recently completed improvements to the Batiquitos Pump Station. The improvements were made to protect the Batiquitos Lagoon and the neighboring ocean from sewer spills. Because South Carlsbad State Beach is a prime recreation spot, odor control is essential too. The recently completed upgrades to the pump station included rehabilitation of the existing three pumps and the addition of a fourth pump for redundancy and reliability, incorporation of a new electrical/instrumental system, installation of an odor- control system, aesthetic enhancements, and landscaping improvements with native plants west of the fence line. 10. Other public agencies whose approval is required (e.g., permits, financing approval, or participation agreement.) The City of Carlsbad must approve a Coastal Development Permit (CDP) and is therefore considered a Responsible Agency pursuant to CEQA. A CDP application has been filed for the proposed project (Application No. CDP-07- 28). The City of City of Carlsbad and the City of Encinitas must issue Encroachment Permits for work within Carlsbad Boulevard and North Coast Highway 101 within each jurisdiction. 11. ENVIRONMENTAL FACTORS POTENTIALLY AFFECTED: The environmental factors checked below would be potentially affected by this project, involving at least one impact that is a "Potentially Significant Impact" as indicated by the checklist on the following pages. A MITIGATED NEGATIVE DECLARATION will be prepared. I find that the proposed project MAY have a significant effect on the environment, and an ENVIRONMENTAL IMPACT REPORT is required. EVALUATION OF ENVIRONMENTAL IMPACTS: 1) A brief explanation is required for all answers except "No Impact" answers that are adequately supported by the information sources a lead agency cites in the parentheses following each question. A "No Impact" answer is adequately supported if the referenced information sources show that the impact simply does not apply to projects like the one involved (e.g., the project falls outside a fault rupture zone). A "No Impact" answer should be explained where it is based on project-specific factors as well as general standards (e.g., the project will not expose sensitive receptors to pollutants, based on a project-specific screening analysis). 2) All answers must take account of the whole action involved, including off-site as well as on-site, cumulative as well as project-level, indirect as well as direct, and construction as well as operational impacts. 3) Once the lead agency has determined that a particular physical impact may occur, then the checklist answers must indicate whether the impact is potentially significant, less than significant with mitigation, or less than significant. "Potentially Significant Impact" is appropriate if there is substantial evidence that an effect may be significant. If there are one or more "Potentially Significant Impact" entries when the determination is made, an EIR is required. 4) "Negative Declaration: Less Than Significant With Mitigation Incorporated" applies where the incorporation of mitigation measures has reduced an effect from "Potentially Significant Impact" to a "Less Than Significant Impact." The lead agency must describe the mitigation measures, and briefly explain how they reduce the effect to a less than significant level (mitigation measures from Section XVII, "Earlier Analyses," may be cross-referenced). 5) Earlier analyses may be used where, pursuant to the tiering, program EIR, or other CEQA process, an effect has been adequately analyzed in an earlier EIR or negative declaration. Section 15063(c)(3)(D). In this case, a brief discussion should identify the following: a) Earlier Analysis Used. Identify and state where they are available for review. b) Impacts Adequately Addressed. Final Mitigated Negative Declaration for Batiquitos Gravity Sewer October 2008 -19- DISCUSSION OF POTENTIAL ENVIRONMENTAL IMPACTS I. Aesthetics The proposed project site is located within a very scenic stretch of Carlsbad Boulevard/North Coast Highway 101, stretching north from the intersection with La Costa Avenue for a distance of approximately 900 feet. Although Carlsbad Boulevard is not designated as an official scenic highway at this location, South Carlsbad State Beach is located on the opposite side of the highway and is visited by many local residents and tourists each year, with summer being the busiest time of year. The City of Carlsbad considers all lagoons and beaches within the city to be important visual resources. Therefore, development adjacent to these areas is subject to review for aesthetic impacts. Figure 4 provides the location of Key Observation Points (KOPs) and Figures 5-8 provide photographs of the proposed pipeline alignment. Within the City of Encinitas, the project is within North Coast Highway 101. The City of Encinitas has applied a Scenic/Visual Corridor Overlay Zone to the properties on either side of the highway in this location. The proposed project will require trenching within the pavement of the intersection of La Costa Avenue and along the northbound lanes of Carlsbad Boulevard. The pavement and striping would be restored following pipeline installation. Therefore, all visual impacts associated with installation of the pipeline would be temporary. The pipeline would make a 75-degree turn from the pavement into the fenced Leucadia Wastewater District Batiquitos Pump Station, passing through a narrow dirt strip and a chain link fence that is screened with irrigated native plants. Aesthetic impacts will be short term as the pavement and fencing will be repaired and the landscaping will be replaced/restored to pre- construction conditions per contract specifications. With the replacement of the landscaping in front of the chain link fence, no significant impacts to aesthetics would result from construction of the proposed project. No mitigation measures would be required for aesthetics. II. Agriculture Resources No agricultural resources are present within the project area. The project site is not located in an area designated as prime, unique, or farmland of statewide importance. The proposed project would be constructed entirely within a road right-of-way and fenced and developed sewer pump station property. The proposed project could not have an adverse effect on agriculture. No mitigation measures would be necessary. Final Mitigated Negative Declaration for Batiquitos Gravity Sewer October 2008 -20- III. Air Quality The proposed project would result in short-term emissions from gas and diesel construction vehicles and equipment as well as dust from excavation (PMio). However, at a length of approximately 900 feet, with the alignment within a paved roadway, the amount and duration of emissions would not be substantial. Construction equipment would be required to meet current heavy equipment emissions standards and be maintained in good running condition. As with virtually all human activity, the proposed project would emit carbon dioxide (CCh), which has been demonstrated to contribute to Global Climate Change (GCC). No thresholds have been established to determine the significance of a project's impacts to GCC. In the case of the Batiquitos Gravity Sewer Project, the short duration of the impact and the small size of the project indicate that impacts to air quality and GCC would be less than significant. No mitigation measures would be necessary for air quality. IV. Biological Resources With the exception of several native plant species that have been planted in a very narrow strip of dirt between the pavement of Coast Highway and the chain link fencing of the Batiquitos Pump Station, the proposed project would not result in any direct impacts to biological resources. The Coast Highway does pass through a biologically-sensitive area at this location, with South Carlsbad State Beach located on the west side of the highway and the Batiquitos Lagoon on the east side of the highway. Starting at the intersection of La Costa Avenue and the Coast Highway, the project alignment passes a bluff that slopes down towards the Coast Highway. This slope has been planted with non-native ornamental plant species such as ice plant and sea lavender. North of the bluff, at the southern edge of the Batiquitos Lagoon, the slope drops away from the Coast Highway towards the lagoon. The vegetation along the road shoulder and on the slope that drops away from the road towards the lagoon, is covered with disturbed Diegan coastal sage scrub. The disturbed Diegan coastal sage scrub consists of California bush sunflower (Encelia californicd), California everlasting (Gnaphalium bicohr), California sagebrush (Artemisia californicd), Fountain Grass (Pennisetum setaceurri), Castorbean (Ricinus communis), Radish (Raphanus sativus), Coast goldenbush (Isocoma menziesii), Wild cucumber (Marah macrocarpus), Coyotebush (Baccharis pilularis), Toyon (Heteromeles arbutifolid), Sea lavender (Limonium perezii), Buckwheat (Eriogonum fasciculatum), Western ragweed (Ambrosia psilostachyd), Black sage (Salvia melliferd), Myoporum (Myoporum laetum), Golden wattle (Acacia pycnantha), and Scarlet pimpernel (Anagallis arvensis). A very small patch of disturbed mulefat scrub has developed within the irrigated native plants within a narrow strip of landscaping between the Coast Highway and the Batiquitos Pump Station. The mulefat scrub consists of mulefat (Baccharis salicifolia) and rock rose (Cistaceae sp.}. Figure 9 provides a map of the habitat types found along the proposed pipeline alignment, adjacent to Carlsbad Boulevard/North Coast Highway Final Mitigated Negative Declaration for Batiquitos Gravity Sewer October 2008 -21- 101. Impacts to biological resources would be limited to the removal of several native plants that were planted by the Leucadia Wastewater District to screen views of the Batiquitos Pump Station. These plants are within the area mapped as disturbed mulefat scrub and would be replaced following the extension of the proposed pipeline from the roadway into the fenced Batiquitos Pump Station. The Batiquitos Lagoon is home to several threatened or endangered species of shorebirds, such as the snowy plover, least tern, lightfooted clapper rail and Belding's savannah sparrow. Therefore, it is recommended that construction activities be avoided during the bird breeding season (March 15 - September 30). Should construction activities occur during the bird breeding season, a pre-construction survey and biological monitoring would be required as identified below. Mitigation Measures The following mitigation measures would reduce potential impacts to sensitive biological resources to below a level of significance: • Site grading shall commence between October 1st and March 14th, to avoid the nesting season of federally and state protected shorebirds; or • A pre-construction survey (within seven days prior to work) shall be conducted by a qualified biologist to determine the presence or absence of active nests within or adjacent to the project site. The purpose of the survey is to avoid impacts to nesting birds. If no breeding or nesting activities of shorebirds are detected within 500 feet of the proposed work area, construction may proceed during the nesting season (March 15 - September 30). A biological monitor shall conduct a survey for species/nesting birds of the site and vicinity on a weekly basis to ensure that specimens do not appear onsite during construction and that all activities are restricted to the authorized project impact area. If breeding or nesting activity is confirmed, work within 500 feet of the active nest shall be delayed until the young birds have fledged and left the nest. A permitted biologist shall be required for surveying and monitoring of the lightfooted clapper rail. • Temporary impacts to disturbed Diegan coastal sage scrub and disturbed mulefat scrub shall be mitigated in place at a 1:1 ratio following construction through revegetation consisting of potted plants and hydro seed. V. Cultural Resources Final Mitigated Negative Declaration for Batiquitos Gravity Sewer October 2008 -22- A records and literature search for the project was conducted at the South Coastal Information Center (SCIC), at San Diego State University, of the California Historical Resources Information System(CHRJS). The records search included a one-mile radius of the project area to provide background on the types of prehistoric or historic archaeological sites that would be expected in the region. No sites have been previously recorded within the project area. The record search was received on July 18, 2008 and resulted in 57 previous surveys within the project area. Thirteen resources were recorded, consisting largely of prehistoric campsites and collections of shell midden. Further, a letter was sent to Mr. David Singleton at the NAHC to request a search of the sacred lands in regards to the project area. Mr. Singleton responded on June 30, 2008, that no cultural resources were known to be on the project area. He included a list of 12 groups or individuals associated with local Native American Tribes for which project notification letters were to be sent. These contacts received said letters and information pertinent to the project area. No responses have been received from any of the persons contacted providing further information. The known historical use of the area surrounding the Batiquitos Lagoon and the high density of cultural sites that have been discovered during cultural resource surveys for other projects in the area indicates that there is a high potential for buried cultural deposits in the area. All work will occur within the western end of La Costa Avenue, Old Coast Highway 101, Carlsbad Boulevard, or the grounds of the Batiquitos Pump Station. The first approximately 200 feet from La Costa Avenue to the north would require the excavation of native soils beneath the roadbed as the road has been cut into a coastal bluff. While unlikely, it is possible that cultural resources would be encountered during this excavation. The remainder of the roadbed to the north is fill that was likely cut from the bluffs to the south. Any artifacts in the fill are unlikely to be of significant value. It is possible that the required excavation associated with the placement of the 24-inch diameter pipeline within the roadway may result in disturbance of undiscovered archaeological resources or human remains. This would be considered a significant impact and mitigation would be required. Mitigation Measures The following mitigation measures would reduce potential impacts however to sensitive cultural resources to below a level of significance: • A qualified archaeologist and Native American monitor shall evaluate the material removed from the trench for cultural resources. During the original cutting of previously undisturbed deposits beneath the roadway, the archaeological monitor and Native American monitor shall be present. The archaeologist shall contact the District at the time of discovery. The archaeologist, in consultation with the District, shall determine the significance of the discovered resources. The District must concur with the evaluation before construction activities will be allowed to resume in the affected area. For significant cultural resources, a Data Recovery Program to mitigate impacts shall be prepared by the archaeologist and approved by the District, then carried out using professional archaeological methods. • If any human bones are discovered, the archaeologist shall contact the City Coroner. In the event that the remains are determined to be of Native American origin, the Most Likely Descendant, as identified by the Native American Heritage Commission, shall be contacted in order to determine proper treatment and disposition of the remains. • Before construction activities are allowed to resume in the affected area, the artifacts shall be recovered and features recorded using professional archaeological methods. The archaeological monitor shall determine the amount of material to be recovered for an adequate sample for analysis. • In the event that previously unidentified cultural resources are discovered, all cultural material collected during the project shall be processed and curated according to current professional repository standards. The collections and associated records shall be transferred, including release of title, to be permanently curated at a qualified repository as defined by the "State of California Guidelines for the Curation of Archaeological Collections." All curation activities shall be completed within six months of project completion. • In the event that previously unidentified cultural resources are discovered, a report documenting the field and analysis results and interpreting the artifact and research data within the research context shall be completed by the District within six months of project completion. VI. Geology and Soils As is noted above, the southerly portion of the pipeline alignment passes through native soils while the remainder to the north passes through fill material used to construct the Coast Highway Final Mitigated Negative Declaration for Batiquitos Gravity Sewer October 2008 -24- in the 1920's. The 24-inch diameter pipeline will be backfilled with imported gravel and excavated soils from the trenching operation. Excess soils will be trucked from the site for use elsewhere. There are no known faults in the project area. As with all of Southern California, the project site is subject to periodic seismic activity. The project alignment is not subject to liquefaction, landslides, or other types of geologic activity outside of a significant nearby seismic event. Proposed earthwork and construction of the project will be performed in accordance with the recommendations contained within the Geotechnical Report prepared by Ninyo & Moore for the proposal project, the applicable requirements of governing agencies, and the Typical Earthwork Guidelines included in Geotechnical Report. No significant geology or soils impacts are anticipated. No mitigation measures are necessary. VII. Hazards and Hazardous Materials There is no evidence of potential hazards or hazardous materials along the proposed alignment. All work will be within Carlsbad Boulevard/North Coast Highway 101, and the Batiquitos Pump Station site. All existing utilities within the road will be marked and avoided during construction in coordination with Dig Alert. No hazards or hazardous materials are anticipated. Hazards and hazardous materials impacts would be less than significant. No mitigation measures are necessary. VIII. Hydrology and Water Quality The proposed project could result in short-term impacts to water quality through runoff from Carlsbad Boulevard into Batiquitos Lagoon if heavy rainfall were to occur during construction. The contractor, however, will be required to implement Best Management Practices (BMPs) to avoid the runoff of sediment into storm drains and Batiquitos Lagoon. These measures would include the use of gravel bags, silt curtains, and street sweeping. The proposed project would not require the use of groundwater as the limited amounts of water needed for construction would be obtained from a municipal source (nearly all of which is imported from outside San Diego County) and would be delivered by tank truck. The proposed project would improve the capacity and reliability of the Batiquitos Gravity Sewer, which would reduce the potential for the accidental discharge of wastewater following construction to levels even lower than they are today. There would not be any change in the existing drainage patterns of Carlsbad Boulevard or the Batiquitos Pump Station site. The project site is not located within a 100-year flood zone. Implementation of standard BMPs during construction would reduce potential impacts however to hydrology and water quality to below a level of significance IX. Land Use and Planning The project site is located in the southwestern corner of the City of Carlsbad, along Carlsbad Final Mitigated Negative Declaration for Batiquitos Gravity Sewer October 2008 -25- Boulevard, with the southern end of the project reaching into the northwestern corner of Leucadia, a beach community within the City of Encinitas, where Carlsbad Boulevard becomes North Coast Highway 101. The portion of the project within the City of Carlsbad is zoned as Open Space as South Carlsbad State Beach is on the west side of the road and Batiquitos Lagoon is located on the east side of the road. The southern end of the pipeline, within the City of Encinitas, is zoned Visitor Serving Commercial. There are also several overlay zones on the properties to the east and west of North Coast Highway 101, including Scenic/Visual Corridor Overlay Zone. The proposed project does not include any aboveground structures. The sewer line would parallel an existing sewer line within Carlsbad Boulevard. There would not be any land use or planning issues or impacts other than the avoidance of other utilities within the roadway. All work would be within the Carlsbad Boulevard right-of-way or the Leucadia Wastewater District's Batiquitos Pump Station Site. No new rights-of-way are necessary for the proposed project. There are no potential land use or planning issues associated with the proposed project. The Leucadia Wastewater District does not have a habitat management plan. The project site is located within the City of Carlsbad, which has its own Habitat Management Plan. The proposed project is within a roadway that is adjacent to areas mapped as urban/disturbed by the City of Carlsbad and just west of the Batiquitos Lagoon. Because the proposed project is within a roadway, it would not have an adverse impact on sensitive plants, animals, or habitats. Further, in conformance with the City of Carlsbad Habitat Management Plan for Natural Communities and as described in Section IV, Biological Resources, above, mitigation will be required to reduce impacts to sensitive animals and disturbed habitats that occur onsite to a level below significance. Therefore, there will not be any adverse impact to the adopted Habitat Management Plan. The project is located within the Coastal Zone and would require a Coastal Development Permit from the City of Carlsbad in conformance with the City's Certified Local Coastal Program (LCP). The City's LCP is implemented through the City's General Plan and Zoning regulations. As a public utility within a paved public right-of-way, the only land use and planning issues associated with the proposed project would be the maintenance of public access to the coastal zone during construction. The proposed project would not preclude access to or use of the coastal zone. No mitigation measures are necessary for land use and planning. X. Mineral Resources Construction would be limited to Carlsbad Boulevard, which is not a suitable location for the mining of mineral resources. The proposed sewer line would parallel an existing sewer line within an existing easement. Therefore, there would not be an impact to a mineral resource. No mitigation measures are necessary. Final Mitigated Negative Declaration for Batiquitos Gravity Sewer October 2008 -26- XL Noise The proposed project would result in short-term noise impacts during construction. Noise generating sources in the City of Carlsbad are regulated under the Carlsbad Municipal Code, Chapter 8.08, Noise Abatement and Control. Under Section 8.08.040 of this rule, average hourly noise in residential areas is limited to 40 to 50 dB(A) from 7 a.m. to 10 p.m., and to 40 to 45 dB(A) from 10 p.m. to 7 a.m. In high density residential zones the noise limit from 7 a.m. to 7 p.m. is 55 dB(A). Section 8.08.100 (Construction Equipment) prohibits construction equipment operation between the hours of 7 p.m. of any day and 7 a.m. of the following day, and limits average noise levels to 75 decibels for more than 8 hours during this period. This section also regulates construction activities on Sundays and holidays. All proposed construction would be done in compliance with the City's noise ordinance. In addition, there are no sensitive receptors located along the proposed pipeline alignment. Surfer's Point Resort has been proposed on the bluff at the intersection of La Costa Avenue and the Coast Highway, but as of April 2008 construction had not begun. Therefore, potential noise impacts would be less than significant. No mitigation measures are necessary. XII. Population and Housing The proposed project would not have any impact on existing housing opportunities nor would it encourage an increase in the population or the construction of additional housing. The proposed project is designed to increase the reliability and efficiency of the existing Batiquitos Pump Station. There would not be any impacts to population or housing. No mitigation measures are necessary. XIII. Public Services The proposed project would not have any effect on public services other than the increased reliability and efficiency of the Leucadia Wastewater District's wastewater collection system. No mitigation measures are necessary. XIV Recreation The proposed project would require the closure of one northbound travel lane within Carlsbad Boulevard, opposite Carlsbad State Beach and the routing of the bike lane around the construction site. A Traffic Control Plan would be prepared to facilitate the flow of traffic through the construction zone. It is recommended that construction avoid the busiest summer months so as to not interfere with beach and coastal traffic. No mitigation measures are necessary. Transportation/Traffic The proposed project includes a traffic control plan for Carlsbad Boulevard/North Coast Highway 101. The traffic control plan would specify the lane closures, signal timing, alternative lanes, and signage for general information and safety. One northbound travel lane would remain open at all times. Sections of the bicycle lane would be closed during construction. With the incorporation of a traffic control plan, short-term transportation/traffic impacts would be less than significant. There would be no long-term transportation/traffic impacts. No mitigation measures are necessary. XVI. Utilities and Service Systems The proposed project is the upgrade of the existing sewer system to improve reliability and efficiency of the sewer main. Impacts to all other utilities would be avoided during excavation. No new services or service systems would be necessary. This potential impact would be less than significant. No mitigation measures are necessary. XII. Mandatory Findings of Significance Because the proposed project is a belowground pipeline within an existing utility easement, there would not be any long-term surface impacts. Therefore, the proposed project would not degrade the environment, have adverse impacts to sensitive plants, animals, or cultural resources, have cumulatively considerable impacts, or have substantial adverse impacts on human beings. With the incorporation of standard construction practices for the installation of utility lines and the mitigation measures listed above, potential short-term impacts would be less than significant.
