DEFINITIONS Sign Backing A sign component which is an opaque-facedJ dimensional form to which illuminated or non-illuminated dimensional graphic elements are attached. Copy Area The area determined by boxing around individual wordsJ logos or decorative elements of the sign copyJ including ascenders and descendersJ exclusive of marginsJ and calculating the total of the combined areas. Logo An image composed of a collection of symbolsJ figures, design elementsJ and letters which together form a distinct and unique identifying mark. SUBMITTALS AND APPROVALS FOR RETAIL TENANT SIGNS 1. All signs shall be consistent with the Poinsettia Village Sign Guidelines as approved by the City Planner of the City of Carlsbad. 2. There is a formal process for the creationJ review and approval of tenant signs. The tenant shall submit to the Owner or his managing agent (hereinafter referred to as "OwnerH) for required tenant signs and obtain his/her written approval prior to sign fabrication. Approval or disapproval shall remain the sole right and discretion of Owner. Tenant must continue to revise and resubmit rejected designs until approval is obtained. 3. Prior to sign fabricationJ Tenant shall submit for Owner approval three (3) sets of complete and fully-dimensioned shop drawings reflecting the sign design approved by the Owner. Shop drawings are to be submitted to Owner within twenty (20) calendar days after design has been approved. Two (2) separate submittals will be required prior to implementation of signage: a. Design Review Tenant shall submit all designs to Owner and obtain his/her written approval prior to sign fabrication. Approval or disapproval shall remain the sole right and discretion of Owner. Tenant must continue to revise and resubmit rejected designs until approval is obtained. Concept design submittal shall include: 1. NameJ address and phone number of tenant / user. 2. NameJ address and phone number of Sign ContractorJ Designer. 3. Elevation of structure showing front and side views of all proposed signs indicating sign typeJ designJ locationJ overall dimensions, method of attachment, colors, materials and lighting treatments. b. Tenant must continue to revise and resubmit rejected designs until approval is obtained. The shop drawing submittal shall include: 1. Name, address and phone number of tenant / user 2. Name, address and phone number of Sign Contractor, Designer. 3. Elevation of structure showing all proposed signs indicating sign type, design, location, size and layout of sign drawn to scale and indicating dimensions, attachment devices and construction details, colors, materials and lighting details. 4. Section detail of letters and/or sign element showing the dimensioned projection of the face of letters, method, color and intensity of illumination. 5. Color board with sample colors (11" x 13" format) on actual materials. 6. Fully dimensioned site plan showing property lines, buildings, location and dimensions from public right of way. 4. Within ten (10) working days after receipt of Tenants working drawings, Owner and The City of Carlsbad shall either approve the submittal contingent upon any required modifications or disapprove Tenants sign submittal, which approval or disapproval shall remain the sole right and discretion of the Owner. The Tenant must resubmit rejected plans until approval is obtained. A full set of final plans must be approved and stamped by the Owner prior to permit application or sign fabrication. 5. Following Owner's approval of proposed signage, Tenant or his agent shall submit to the City of Carlsbad Owner-approved shop drawings and applications for all permits for fabrication and installation by Sign Contractor. Tenant shall furnish Owner with a copy of said permits prior to installation of Tenant's sign(s). 6. Fabrication and installation of all signs shall be performed in accordance with the standards and specifications outlined in these guidelines and in the final approved plans and working drawings. Owner may perform an in-shop inspection and buy-off of the signage prior to installation. Signs shall be inspected upon installation to assure conformance. Any work deemed unacceptable shall be rejected and shall be corrected or modified at the Tenant's expense as required by the Owner or his agent. 7. Tenant shall install the minimum required signage within 60 calendar days after receipt of permit from the City of Carlsbad. If signage is not in place by that date, Owner may order fabrication and installation on Tenant's behalf. Tenant shall reimburse Owner for these costs. PROHIBITED SIGNS Only those sign types provided herein and specifically approved in writing by the Owner will be allowed. The following signs are prohibited: 1. Outdoor advertising. 2. Outdoor advertising structures. 3. Roof signs. 4. Freestanding signs, except as provided in this text. 5. Advertising devices and advertising displays. 6. Rotating, revolving, flashing or moving signs. All other signs prohibited by CMC 21.41. 8. Vehicles or other signs or devices in the public right-of-way when used as advertising or displays. 9. Vehicles or other signs or devices not permitted by this section when used as advertising devices or displays. 10. Advertising signs on bus benches, within or outside of the public right-of-way. 11. Off premise signs (other than directional signs) installed for the purpose of advertising a project, event, person or subject not related to the premises upon which said sign is located, except as provided in the approved Sign Criteria for the project. 12. Cabinet signs are prohibited. 13. Neon tube signs or lighting. 14. Low-voltage bud lights. DESIGN GUIDELINES 1. Lighting In keeping with the character of the project, identity sings for tenants must be illuminated using at least two lighting techniques as outlined in the exhibits for sign type. The following treatments are considered appropriate: • reverse channel neon with silhouette illumination • internal illumination • front lighting • area lighting All front lighting should be baffled and obscured in channels where possible. Where fixtures, shades, or other elements are exposed, they should contribute to the design of the storefront. The following shall be prohibited: • exposed conduits and raceways not integrated as an intentional component of the sign design • front lighting fixtures that compete with the storefront design • exposed neon • neon surrounding windows, forming frames or multiple rules 2. Tvpestvles The use of logos and distinctive typestyles is encouraged for all tenant signs. Tenants may adapt established typestyles, logos and/or images that are in used on similar buildings operated by the tenant, provided that said images are architecturally compatible and approved by the Owner. Type may be arranged in one two lines of copy and may consist of upper and/or lower case letters. SIGN TYPE CRITERIA a. Only those sign types outlined herein will be allowed unless specifically approved in writing by the Owner. Signage shall conform to the criteria specific to each sign type, as well as to any general guidelines and provisions for the sign treatment, colors and lighting as outline herein. Gas station signage is subject to provisions in associated Conditional Use Permit. b. A minimum of one suspended/projecting sign and one Wall or Fascia sign will be required for each tenant. c. Notwithstanding the maximum square footage specified for copy area allowances, adequate amounts of visual open space shall be provided around wall signs and graphic elements so that signs appear balanced and in scale in relation to their backgrounds. d. Signs shall adhere to the guidelines for Sign Area as specified per individual sign types (see exhibits). Except for normal repair and maintenance and any modification required for NEC compliance, no nonconforming sign shall be expanded, structurally or electrically altered (not including a change in sign face or sign copy), moved or relocated, unless it is brought into conformance with all current provisions of this chapter. B. When a sign, which was in compliance with all applicable laws in effect at the time it was originally erected, is physically damaged, whether by vandalism, forces of nature or other causes, the sign may be repaired or restored to its original size, shape, height, orientation and message; however, the repair or restoration must be done in a manner which complies with current building and electrical codes and/or the requirements of any applicable sign program. (Ord. CS-226 § I, 2013) ILLEGAL SIGNS: Any sign that is deemed not to be in conformance with the approved guidelines or erected without City of Carlsbad approval or permits is considered an illegal sign. The Owner may, as its sole discretion, correct, replace or remove any illegal signs. The City of Carlsbad may require removal of illegal signs. ABANDONED SIGNS: An abandoned sign is one whose use is discontinued because the premises upon which it is located becomes vacated and unoccupied for a period of more than 90 days. The Owner may, at its sole discretion, replace or remove any abandoned sign. GENERAL PROVISIONS 1. Signs shall be designed in a manner that is not only imaginative but also of high graphic quality. In addition, signs should be compatible with and complementary to adjacent facades. 2. Only those tenant sign types provided for in the Tenant Sign Criteria and/or specifically approved in writing by the Owner will be allowed. All sign colors must conform to the Owner's established color palette, if any, and are subject to review and approval by the Owner as part of the tenant sign submittal. 3. A variety of graphic styles, logos, and scripts shall be encouraged. 4. Notwithstanding the maximum square footage and dimensions specified for copy area allowances, signs and typography in all cases shall appear balanced an in scale within the context of the sign space and the building as a whole. All signs shall fit comfortably into designated architectural spaces, leaving sufficient margins and negative space on all sides. Thickness, height, and color of sign lettering shall be visually balanced and in proportion to other signs on the building. 5. Dimensional letters and plaques shall be affixed without visible means of attachment, unless attachments make an intentional design statement. 6. All sign locations, including placement of signs on storefronts, building facades, or beneath overhangs subject to owner approval and as shown on sign program. 7. Details of finished signage shall match the exact specifications of the Owner-approved shop drawings. All sign fabrication work shall be of excellent quality. All logo images and typestyles shall be accurately reproduced. Lettering that approximates typestyles shall not be acceptable. The Owner reserves the right to reject any fabrication work deemed to be below standard. 9. The Tenants shall, upon termination of his lease and at his own expense, remove all signs associated his lease space and repair, patch, and repaint building walls to match their original condition. CONSTRUCTION REQUIREMENTS 1. Signs must be made of durable rust-inhibited materials that are appropriate and complementary to the building. 2. All formed metal, such as letter forms, shall be fabricated using full-weld construction. 3. All ferrous and non-ferrous metals shall be separated with non-conductive gaskets to prevent electrolysis. In addition to gaskets, stainless steel fasteners shall be used to secure ferrous to non-ferrous metals. 4. Threaded rods or anchor bolts shall be used to mount sign letters which are spaced out from background panel. Angle clips attached to letter sides or the use of the trim cap will not be permitted for figures less than three (3) feet high. 5. Paint colors and finishes must be reviewed and approved by the Owner. Color coatings shall exactly match the colors specified on the approved plans. 6. Surfaces with color mixes and hues prone to fading (e.g., pastels, fluorescent, complex mixtures, and intense reds, yellows and purples) shall be coated with ultraviolet-inhibiting clear coat in a matte, gloss, or semi-gloss finish. 7. Joining of materials (e.g., seams) shall be finished in such a way as to be unnoticeable. Visible welds shall be continuous and ground smooth. Rivets, screws, and other fasteners that extend to visible surfaces shall be flush, filled, and finished so as to be unnoticeable. 8. Finished surfaces of metal shall be free from canning or warping. All sign finishes shall be free of dust, orange peel, drips, and runs and shall have a uniform surface conforming to the highest standards of the industry. 9. Reverse channel letters shall have a clear lean back and pinned 2" off building wall. Return depth shall be no greater than 3". Signs to be illuminate with white LEDs. 10. Depth of open channel letters shall not exceed 3". All hardware and neon tube supports inside open channel letters shall be painted to match interior letter color. Neon tubing shall be sufficient to make letters read "solid" and shall be installed so that top surface of neon is flush with front edges of open channel. 11. Letter returns shall be painted to contrast with color of letter faces and background plaque, if used. 12. Sign illumination to be White LEDs with proper power supplies. All lighting must match the exact specifications of the approved shop drawings. 13. Surface brightness of all illuminated materials shall be consistent in all letters and components of the sign. Signs should be constructed so as to baffle weep holes to avoid light leaks. Light leaks will not be permitted. 14. Exposed conduits and raceways shall be prohibited. All conduit, raceways, crossovers, wiring, ballast, boxes, transformers, and other equipment necessary for sign connection shall be concealed or integrated as an intentional component of the sign design. No black iron materials will be allowed. 15. Underwriter's Laboratory-approved labels shall be affixed to all electrical fixtures. Fabrication and installation of electrical signs shall comply with all national and local building and electrical codes. 16. Penetrations into building walls, where required, shall be approved by Owner and made waterproof. 17. Location of all openings for conduit sleeves and support in sign panels and building walls shall be indicated by the sign contractor on drawings submitted to the Owner. Sign contractor install same in accordance with the approved drawings. 18. In no case shall any manufacturer's label be visible from the street from normal viewing angles. 19. Sign permit stickers shall be affixed to the bottom edge of signs, and only that portion of the permit sticker that is legally required to be visible shall be exposed. TENANT CRITERIA OBJECTIVE The Tenant Criteria has been established as a guideline to assist the tenant with the implementation of tenant signage and to insure tenant signs be carefully designed and executed to exceed the standards and quality normally associated with commercial retail signage. TERMS AND CONDITIONS FOR SIGNAGE IMPLEMENTATION In signing the lease for store space, each tenant acknowledges and agrees to the following requirements with regards to signage: 1. Each tenant shall provide a minimum of one identification sign per store frontage with a public entrance. 2. In establishing signage for his/her lease space, the tenant shall conform to the Sign Guidelines and the Tenant Criteria for sign sizes and locations designated for his particular storefront. 3. There is a formal process for the creation, review and approval of tenant signs which is outlined in the Sign Guidelines. Tenant sign submittals shall be reviewed by the Owner and/or his/her agent for conformance with the Sign Guidelines and Tenant Criteria. 4. Only pre-qualified sign contractors shall be allowed to bid, build, and install signs. 5. The Owner shall approve or designate sign fabricators who are well-qualified in the techniques and processes required to implement the intent of the concept design. 6. If signage is not in place by the date, the Landlord may order sign fabrication and installation on the tenant's behalf. The tenant shall reimburse the Owner for these costs in an amount up to $15,000.00. 7. The tenant agrees to abide by all the provisions, guidelines, and criteria contained within the City of Carlsbad-approved Sign Guidelines, the Tenant Criteria and applicable City of Carlsbad sign regulations. 8. Only those sign types provided for and specifically approved in writing by the Owner will be allowed. 9. All signs shall be consistent with the Poinsettia Village Sign Guidelines as approved by the City Planner of the City of Carlsbad. TENANT RESPONSIBILITY Tenant shall be responsible for the following expenses relating to signage for his/her store: • tenant sign design • 100% of permit processing costs and application fees • 100% of costs for sign fabrication and installation including review of shop drawings and patters • electrical connection from tenant panel or stub-out provided by owner to sign • all costs relating to signage removal, including repair of any damage to the building Tenant shall also be responsible for maintaining the appearance of operating condition of all signs once they are installed. Owner, may at his/her sole discretion and at the Tenant's expense, replace, refurbish or remove any sign that has become deteriorated. The Tenant shall, upon termination of this lease and at his own expense, remove all signs associated with this lease building walls to their original condition. SIGN CONTRACTOR RESPONSIBILITIES Tenant shall require his sign contractor to do the following: 1. Provide to the Owner, prior to commencing fabrication, an original certificate of insurance naming the Owner as an additional insured for liability coverage. 2. Obtain approved sign permits from the proper City of Carlsbad agency prior to sing fabrication and deliver copies of same to Owner. 3. Prepare for approval prior to fabrication complete and fully-dimensioned shop drawings along with items listed under "Submittals and Approvals" section. INSTALLATION 1. Schedule: a. All dates for sign installation must be approved a minimum of 48 hours in advance with Owner. 2. Locations for each ground sign shall be staked by the Sign Contractor. Staked locations must be approved by the Owner or his designated representative. 3. Installation Conditions: a. Working areas are to be left clean and orderly every day during the period of installation. All work is to be coordinated with the Owner. b. In case of damage to landscaping material, irrigation lines, or other underground or above-ground equipment, the Owner and/or General Contractor shall be notified and the repairs shall be made to his satisfaction. All damaged material shall be repaired and left in the same condition as it was found. All grades are to be restored to the original condition. CLEANING Prior to final inspection and acceptance by the Owner, the Sign Contractor shall remove all protective coatings and stickers, clean metal and painted surfaces in accordance with manufacturer's recommendations, and remove debris from the work site. GUARANTEE AND/OR WARRANTY The Sign Contractor shall agree to bring all portions of work to entire completion free of all defects in materials and workmanship for a period of one (1) year from the date of final acceptance of the completed work by the Owner. The Sign Contractor also guarantees, within a reasonable time after receipt of written notice thereof, to make good any defects in materials and/or workmanship which may develop within such period for materials and workmanship are guaranteed, and to pay or cause to be paid for any damage to other work resulting therefrom, which may develop during the period of one (1) year from the date of final acceptance of the completed work by the Owner.
