This memorandum provides an update to the Council Memorandum dated Sept. 30, 2021,
(Attachment A) regarding the transition activities with Allied Waste Systems, Inc. dba Republic
Services of San Diego (Republic). Republic is the new franchise waste hauler that recently began
providing trash, recycling and organics services in the city.
Additionally, this memorandum provides an update on the Sustainable Materials Management
Implementation Plan (SMMIP). The SMMIP outlines the city's approach to comply with new
statewide environmental regulations as well as build upon and adopt additional city laws or
ordinances that increase sustainable habits across the city.
Background
On April 6, 2021, the City Council adopted Resolution No. 2021-075, approving the city's new
waste hauling agreement with Republic. This new franchise agreement, which started on
July 1, 2022, was developed to ensure compliance with recent solid waste legislation including
organics recycling.
On Dec. 14, 2021, the City Council adopted Resolution No. 2021-291, accepting the SMMIP,
which outlines the city's approach to reduce plastic pollution and hard-to-recycle waste from the
landfill. The SMMIP calls for the city to go above and beyond state law requirements with new
ordinances to reduce single-use plastics and improve our local environment.
Discussion
City staff are working closely with Republic staff to ensure the transition from the former waste
hauler, Waste Management, to Republic, is properly completed and new services to residents
and businesses are being provided, as required, by Republic's franchise agreement.
The following summary provides some of the transition activities to date:

o City staff held monthly meetings with Republic's leadership team to review the
transition plan and discuss progress. Items of concern include:
■ Republic's Municipal Administrator changed three times during the
transition period resulting in a delay in continuity and follow-up on items
in the transition plan.
■ Republic opted to solely rely on Waste Management's residential data
instead of performing route audits to accurately identify residents' number
and size of bins.
• Republic started to exchange residential bins during the week of
March 28, 2022, with an estimated 13-week exchange timeline.
However, because of incorrect data, this process experienced a
one-week delay.
■ Republic had difficulty exchanging the three types of residential carts:
green for organics, blue for recycling and gray for landfill, due in part to the
lack of a documented cart exchange plan that city staff requested but was
not provided.
■ Few businesses had existing green bins prior to the transition but all
businesses are now required to have green bins or carts to comply with
regulations. Though Republic did not provide technical assistance to
businesses before the delivery of green bins or carts as outlined in their
proposal, there was no reported delay in the delivery of landfill and
recycling bins to businesses.
■ Republic's inventory of carts and bins in different sizes became insufficient
to meet customer demand because of supply chain shortages and
incorrect residential data of number and size of bins.
o City staff held bi-weekly meetings with Republic's Municipal Administrator to
share updates and progress reports.
o Though Republic previously provided options of where they plan to process
recyclable materials, they informed city staff that they will use the EDCO Materials
Recovery Facility in Escondido to process all recyclable materials collected
throughout the city.
o Republic initially informed city staff that they would use their Otay Organics
Composting Facility to process all organic material collected throughout the city.
However, because of the lack of pre-processing capacity at the Otay facility,
Republic will now process all commercial organic material at their Anaheim
facility, which is preferable due to their new facility for treatment and processing
at that location. The Anaheim facility is approximately 10 miles further from the
Palomar Transfer Station compared to the Otay facility so there is not a significant
difference regarding vehicle miles traveled. Residential organic material will be
processed at the Otay facility.

► Republic Drivers
o Republic hired a majority of former Waste Management drivers who drove
Carlsbad collection routes. Sixteen of 18 residential drivers and 11 of 14
commercial drivers remained on their existing Carlsbad routes.
► Republic Outreach
o Republic and city staff worked on outreach and education material, such as fliers,
guides and newsletters, about the transition to Republic's services. These items
can be accessed by residents and businesses at:

o Republic mailed a newsletter to city residents and businesses about the transition
to Republic's services during the week of June 20-24, 2022.
o On June 26, 2022, Republic started providing residential kitchen caddies for pick-
up by residents at various locations.
o Republic plans to mail the Residential Guide to residents the week of
July 18-22, 2022.
o Republic plans to begin delivering multi-family outreach kits, which include a bag
for recyclables, a kitchen caddy and outreach materials, the week of July 25, 2022.
o Republic is developing a Commercial Guide to be distributed to businesses once
completed.
► Republic Customer Service
o Republic's customer service was available to assist city residents as soon as the
cart exchange process began on March 28, 2022.
o Republic's customer service quickly became overwhelmed with calls and was
unable to properly assist residents because of the numerous calls they received
from residents experiencing a cart exchange problem.
o Since the residential cart transition has now been completed, Republic's customer
service provides a minimum of two local representatives to assist customers.
Sustainable Materials Management Implementation Plan:
► In Spring 2022, the City Council approved and adopted the following ordinances:
o CS-420: requiring food service providers to offer only reusable or other eco-
friendly food packaging and accessories, such as certified compostable or marine
degradable packaging
o CS-422: prohibiting distribution of plastic bottled beverages at city-affiliated
events, regardless of whether the event is private or public
o CS-424: prohibiting retail stores and restaurants from using disposable plastic bags
o CS-426: prohibiting the intentional release of any balloon or balloons filled with a
gas lighter than air

► Environmental Sustainability and Communications staff have collaborated to create
various outreach material for businesses to comply with the SMMIP and the newly
adopted ordinances.
► Environmental Sustainability and Special Events staff have collaborated to update the
Special Events application form and Memorandums and Special Events reference book to
comply with the SMMIP and the newly adopted ordinances.
► Environmental Sustainability staff have started visiting food service establishments on
July 11, 2022, to inform these establishments of the new regulations. During these visits,
staff will provide businesses the Business Sustainability Checklist flier (Attachment B) to
inform businesses about these new regulations and answer any questions.
o Staff will also use these visits to confirm that businesses have received all correct
solid waste services from Republic.
► Environmental Sustainability staff have started rolling out a new Municipal Sustainability
Program to implement all new City Council Policies and required organics recycling across
city departments and facilities.
Next Steps
Staff will continue working collaboratively with Republic on this transition of solid waste services
and will monitor contract requirements and assess penalties, if necessary, for failure to meet
performance measures under the new agreement. Additionally, staff will continue to implement
the outreach associated with the new SMMIP ordinances.

This memorandum provides an update on the transition activities with Allied Waste Systems,
Inc. dba Republic Services of San Diego (Republic) to provide trash, recycling and organics
services to the city's residential and commercial customers.
Background
On June 30, 2022, the city's solid waste management franchise agreement with Coast Waste
Management, Inc. (Waste Management) for collection and recycling processing will expire. On
April 6, 2021, the City Council adopted Resolution No. 2021-075, approving the city's new
hauling agreement with Republic, which will go into effect on July 1, 2022.
This new franchise agreement was developed to ensure compliance with recent solid waste
legislation from the State of California. One new service to be provided includes food waste
recycling. Commercial customers and multi-family complexes will receive bundled waste service
for trash, recycling and organics. This is much like the existing residential service, in which
separate trash, recycling and organics containers will be provided to customers. Also, kitchen
caddies will be provided to all residential customers to collect and transfer food scraps from the
kitchen to the organics bin.
Discussion
City staff are working closely with Republic staff to ensure transition from Waste Management
to Republic is as smooth as possible and with minimal disruption of services to the community.
Below are some of the transition activities that have been completed to date or are ongoing:
• . Transition kick-off meeting with Waste Management, Republic and city staff
• Development of a Republic Transition Plan with action items and target dates
• Monthly meetings with the Republic leadership team and city staff to review the
transition plan and discuss any progress

Staff will continue.to work collaboratively with Republic to ensure a smooth transition of solid
waste services. Staff will continue to provide updates to the City Council during the transition
period, including an update from Republic in January 2022.

Organic waste recycling

SB1383 is a State of California law that builds on the state's
commitment to reduce greenhouse gas emissions and air pollution.
The law requires all businesses and residents to divert organic
materials, like food waste, yard waste and food soiled paper, from
the landfill. This law also requires the state to increase edible food
recovery by 20% by 2025.
Single-use foodware
AB 1276 / CS-420
AB 1276 expands the plastic straws upon request law to include other
single-use food items like utensils, containers and condiment packets.

CS-420 is the city's ordinance requiring food service providers to only offer REUSABLE
reusable or other eco-friendly food packaging and accessories, such as IS BEST
certified compostable or marine degradable packaging.
Plastic bag ban
CS-424
CS-424 is the city's plastic bag ban prohibiting retail stores and
restaurants from using disposable plastic bags. Enforcement will be
phased in, beginning July 1, 2023, for retail establishments, and
July 1, 2024, for food-service providers.
