AGENDA OF: July 20, 2011 Application complete date: November 22, 2010 Project Planner: Pam Drew Project Engineer: John Maashoff SUBJECT: CDP 10-06/SUP 10-01 - CARLSBAD BOULEVARD RIPRAP EXTENSION- Request for approval of a post emergency Coastal Development Permit and a Special Use Permit to: 1) install additional riprap along an approximately 280-foot long, 3 5-foot wide and 15-foot high (11-feet above grade and 4-feet below grade) section of shoreline for slope protection; 2) relocate a section of 6 inch sewer force main; and 3) construct a protective steel casing over an existing 48 inch diameter sewer outfall pipeline within the City's Coastal Zone located on southbound Carlsbad Boulevard, approximately 0.7 mile south of Palomar Airport Road and 1 mile north of Poinsettia Lane, within Local Facilities Management Zone 22. I.RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolutions No. 6788 and 6789 APPROVING Coastal Development Permit (CDP 10-06) and Special Use Permit (SUP 10-01) based upon the findings and subject to the conditions contained therein. II. INTRODUCTION The project is a post emergency Coastal Development Permit (CDP) and Special Use Permit (SUP) for the installation of riprap to stabilize and protect the eroding southbound Carlsbad Boulevard roadway embankment, relocate a section of the State Parks Department's exposed 6 inch diameter sewer force main, and to protect the Encina Waste water Authority's (EWA) 48 inch diameter sewer outfall pipeline located under an area where the riprap was installed. Emergency repairs, which occurred in an area south of the Encinas Creek Bridge, became necessary when the area along southbound Carlsbad Boulevard was undermined by severe storms, flooding and destructive tidal-surge wave action in January 2010 (see Attachment 4). This permit would permanently authorize the improvements that were completed by the City of Carlsbad and EWA under the emergency CDP (10-05). No further work is proposed. The project complies with all applicable city standards and staffs recommendation of approval with conditions is supported by the analysis as follows. III. PROJECT DESCRIPTION AND BACKGROUND Background: On February 2, 2010, during a routine inspection, City of Carlsbad staff determined that the roadway along southbound Carlsbad Boulevard, south of the Encinas Creek Bridge, had beeno CDP 10-06/SUP 10-01 - CARLSBAD BOULEVARD RIPRAP EXTENSION JULY 20, 2011 PAGE 2 State Parks Department's 6 inch sewer force main were exposed by the storm events, exacerbating the unsafe conditions of this area. Staff closed the western most lane by installing cones to redirect traffic to the eastern lane to ensure the safety of the motoring public, bicyclists, and pedestrians. The City Manager declared a local emergency on February 5, 2010 and the City Council ratified and subsequently extended the emergency declaration until the project was completed on May 28, 2010. On March 17, 2010 the Planning Director issued an emergency CDP (10-05) to install riprap to stabilize and protect the eroding southbound Carlsbad Boulevard roadway embankment, relocate a section of the State Parks Department's 6 inch sewer force main and sewer lift station, and protect EWA's sewer outfall pipeline located under the area in which riprap was planned. City of Carlsbad Municipal Code Section 21.201.190(D)(1) authorizes the Planning Director to issue an emergency coastal development permit if the Director finds, in part, that, "An emergency exists that requires action more quickly than permitted by the procedures for minor coastal permits or for regular permits and the work can and will be completed within thirty days unless otherwise specified by the terms of the permit," and the proposed emergency CDP is consistent with the provisions of the City's Mello II Segment of the Local Coastal Program (LCP). The Planning Director granted the emergency CDP to be valid through May 28, 2010. The timing of the emergency permit was intended to coincide with the scheduled reopening of southbound Carlsbad Boulevard to through traffic as required by the CDP (09-08) issued for the Encinas Creek Bridge Replacement project. Emergency CDPs are considered temporary permits and are conditioned to require the application for a follow-up regular CDP. The regular CDP is required to permanently authorize the installation of the riprap and concrete sewer outfall pipeline protection. The emergency permit includes work that was completed by the City of Carlsbad, State Parks Department, and EWA. However, this permit only includes work performed by the City of Carlsbad and EWA due to the proximity and similarity of the two projects. The State Parks Department has applied for a separate post emergency CDP (10-24) for the relocation of their 6 inch sewer force main, located in an east west direction, (a small section of 6 inch sewer force main, located in a north south direction, was removed by the City of Carlsbad during the riprap repair work), demolition of their existing sewer lift station, and the construction of a new sewer lift station. The project began on April 12, 2010 and was completed by May 28, 2010, the start of Memorial Day weekend. All work was completed while southbound Carlsbad Boulevard was closed for the replacement of the Encinas Creek Bridge. Project Description: Riprap: The project includes the installation of riprap to protect the road and EWA's 48-inch diameter reinforced concrete sewer outfall pipeline from wave action during extreme high tides. Existing CDP 10-06/SUP 10-01 - CARLSBAD BOULEVARD RIPRAP EXTENSION JULY 20, 2011 PAGE 3 riprap was reconfigured and supplemented with an additional 1,434 cubic yards of 4-ton riprap, 1,174 cubic yards of 2-ton riprap, and 673 cubic yards of !/4-ton riprap on the west side of the roadway. The northern end of the riprap started approximately 149 feet south of the Encinas Creek Bridge, which is where the southern end of the riprap was installed under the Encinas Creek Bridge replacement project and extends south an additional 280 feet, just north of the State's existing sewer lift station. The riprap design is the same as the design, color and shape used for the Encinas Creek Bridge replacement project. The riprap does not extend beyond the existing footprint of the riprap. To minimize impacts to the beach, all riprap was placed by equipment that was located on the roadway above. 6 inch Sewer Force Main: The project included relocating a section of 6 inch sewer force main that was exposed during the storms. The sewer force main delivers sewer from the State Parks Department's campground to the Encina Wastewater Treatment Plant and ties into the city's sewer line on the east side of southbound Carlsbad Boulevard. Prior to installing the riprap the city's contractor removed approximately 210 feet of the 6 inch sewer force main in order to be able to install the riprap (the rest of the sewer pipeline was abandoned in place). Since this sewer force main was in use at the time, the city installed a temporary by-pass sewer pipeline, below grade on the east side of southbound Carlsbad Boulevard prior to the removal of this section of pipeline, and reconnected to the existing sewer lift station approximately 15 feet south of the supplemental riprap installed by the city. The permanent pipeline has been constructed by the State Parks Department project (CDP 10-24); therefore, the by-pass line has since been abandoned in place. Sewer Outfall Pipeline: A new protective concrete casing was constructed over the existing 48 inch sewer outfall pipe. The casing extends from the end of an existing 92 inch steel casing approximately 15 feet from the western edge of southbound Carlsbad Boulevard seaward to the edge of the riprap and east (landward) of the High Tide Line (HTL) line (7.65 feet as measured from the Mean Low Low Water line). The protective casing was constructed as follows: temporary sheet piles were installed on the north and south side of the sewer outfall pipe to allow for excavation. Four eight inch diameter pipe piles were installed on each side of the sewer outfall pipe and a concrete footing was constructed on top of the pipe piles. A corrugated steel arch was place over the outfall supported on the new footings. A reinforced concrete casing was constructed over the corrugated arch to complete the protective shell. The excavation was backfilled over and around the new protective casing to match the sub grade of the adjacent shore protection. The temporary sheet piles were removed and riprap protection was installed over and beside the protective casing to match the profile of the adjacent riprap that was installed by the city. Staging Area & Sheet Piles: The closed southbound lanes of Carlsbad Boulevard, just south of the Encinas Creek Bridge Replacement project site, was used for all construction staging, including parking for contractors' equipment and vehicles. Excavation and backfill equipment was stationed on the roadway above the bluff and not on the beach. Sheet piles were required on the beach just west of the bluff and CDP 10-06/SUP 10-01 - CARLSBAD BOULEVARD RIPRAP EXTENSION JULY 20, 2011 PAGE 4 _ east of the Mean High Tide Line (MHTL) to prevent wave action in the area where the riprap was installed (the MHTL is the average of the high tides observed over a 19 year period). The crane was in the area completing work on the Encinas Bridge Repair project and did not have to be brought to the area. The contractor was not allowed to have any equipment west of the westerly sheet piles, nor store any material or equipment on the beach. Beach activity was limited to installation of sheet piling, replacement and supplement of riprap, installation of EWA's concrete casing for the sewer outfall pipeline, and the removal of a section of the State Parks Department's sewer force main. Jurisdictional Authority: Although the City of Carlsbad has a certified LCP, the CCC retains permitting jurisdiction within the Coastal Zone for any development "proposed or undertaken on any tidelands, submerged lands, or on public trust lands, whether filled or unfilled" (Public Resources Code 30519(b)). This generally has been interpreted to refer to lands below the elevation of MHTL, which is 4.60' as measured from the Mean Low Low Water (MLLW = 0) line using National Geodetic Vertical Datum of 1929 (NGVD 29). Accordingly, the CCC jurisdiction ends at the MHTL and the City's LCP permitting authority begins east of the MHTL. The City has designed the project and temporary impact area to remain outside (easterly) of the mean high tide line, and thus outside of the Coastal Commission's retained permit jurisdiction. The project does, however, remain within the Coastal Commission appeals jurisdiction. On March 17, 2010 the City mailed a certified letter and Notice of Determination to the Executive Director of the California Coastal Commission (CCC) pursuant to Municipal Code Section 21.201.190E, informing the CCC, through its Executive Director, about the nature of the emergency. In response, the City received a letter from the CCC, dated March 22, 2010, (Attachment 8) indicating their belief that the project is at least partially located below the MHTL and therefore within the Coastal Commission's retained permit jurisdiction. City staff maintains, however, that the City has CDP authority over the entire project and recommends that the Planning Commission may act on the entire project. Floodplain/Special Use Permit The project requires a city-issued Special Use Permit (SUP) per CMC 21.110 because a portion of the work occurred in a flood hazard area. The roadway area is identified as being within Zone A, and the beach area is identified as being within Zone VE with a base flood elevation of 9 feet above Mean Sea Level (MSL). The sites are identified on the Flood Insurance Rate Map Number 06073C1027 F, dated June 19, 1997. Zone A is outside the 500-year flood and Zone VE is within a "special flood hazard area (SFHA)," which means an area having special flood or flood- related erosion hazards. Because the addition of riprap and the concrete protective casing for the existing sewer outfall pipe occurred within Zone VE, processing of a SUP is required. In addition to local CDP and SUP permitting requirements, other agencies retain permitting authority to the west of the project, including U.S. Army Corps of Engineer (USAGE) Section 404 and Section 10 jurisdiction and Regional Water Quality Control Board (RWQCB) 401 jurisdiction. USAGE Section 404 jurisdiction along the coastline extends up the beach to the High Tide Line (HTL) and seaward 3 miles. The HTL is 7.65' as measured from the MLLW line using NGVD 29 Datum and is the maximum high tide elevation collected from the NOAA La CDP 10-06/SUP 10-01 - CARLSBAD BOULEVARD RIPRAP EXTENSION JULY 20, 2011 PAGES ___ Jolla Station (No. 9410230). The HTL is located along the western boundary of the temporary impact area. USAGE Section 10 jurisdiction includes all navigable Waters of the U.S. which begins at the Mean High Water Line (MHWL) and extends seaward 3 miles (the MHTL is the same elevation as the MHWL). This line falls west of the temporary impact area and is therefore not impacted by the proposed project. Onsite the RWQCB jurisdiction is similar to the 404 boundaries in that it extends to the outer banks of Encinas Creek and the adjacent wetlands but ends at the ocean interface. On April 1, 2010 Nolte Associates, Inc. completed a survey for the project. The survey confirmed that the westernmost boundary of the project (sheet piles) was approximately 8 feet east (landward) of the HTL and even further landward of the MHTL/MHWL; therefore, the project did not extend into other agencies' jurisdictions. However, the USAGE requested that the City amend the USAGE permit and RWQCB certificate that was issued for the Encinas Creek Bridge project to include the emergency work. The City complied so the emergency work could be completed by May 28, 2010 when southbound Carlsbad Boulevard would reopen. No other permitting was required. IV. ANALYSIS A. General Plan; B. Coastal Development Permit Regulations for the Mello II Local Coastal Program (LCP) Segment, the Coastal Resource Protection Overlay Zone, and the Coastal Shoreline Development Overlay Zone (Chapters 21.201, 21.203, and 21.204 of the Zoning Ordinance); and C. Floodplain Management Regulations (Chapter 21.110) and Special Use Permit Procedures (Section 21.110.130). The recommendation for approval for this project was developed by analyzing the project's consistency with the applicable City regulations and policies. The project's compliance with each of the above regulations is discussed in detail in the sections below. Review of Required Coastal Findings A. General Plan The project consists of additional riprap and a concrete casing around an existing 48 inch sewer outfall pipe located on southbound Carlsbad Boulevard, approximately 149 feet south of Encinas Creek Bridge, which is designated by the City of Carlsbad General Plan (City of Carlsbad 1994) as Major Arterial Street. The area to the east and west of the project site is designated as Open Space. The General Plan contains goals and policies on regional circulation considerations, streets and traffic control, and improving automobile and pedestrian circulation and safety in Carlsbad. Compliance with relevant goals and objectives of the General Plan is outlined in Table A below: CDP 10-06/SUP 10-01 -CARLSBAD BOULEVARD RIPRAP EXTENSION JULY 20, 2011 PAGE 6 TABLE A: GENERAL PLAN COMPLIANCE ELEMENT STANDARD PROJECT COMPLIANCE? Circulation A City with an adequate circulation infrastructure to serve the projected population (Streets and Traffic Control - Goal A.2) A City with a circulation system that promotes alternative transportation such as walking, bicycling and public transportation (Streets and Traffic Control - Goal A.8). Project would improve the flow on Carlsbad Boulevard by installing riprap revetment to protect the road. Carlsbad Boulevard is a main north/south corridor. The road is highly used especially in the summer months. Yes Circulation Project would help protect the existing bike lane on the west side of Carlsbad Boulevard. Yes Public Safety A City which minimizes injury, loss of life, and damage to property resulting from hazardous materials disaster occurrence (Hazardous Materials -Goal A.I). Project would help protect the existing 48 inch sewer outfall pipeline to prevent future pipeline breaks and the release of hazardous materials onto the beach and into the Pacific Ocean. Yes Public Safety A City which minimizes injury, loss of life, and damage to property resulting from the occurrence of floods (Flood Hazards - Goal A. 1). Project would help protect the existing bike lane and roadway on the west side of southbound Carlsbad Boulevard from future erosion caused by floods and wave action. Yes Circulation To design streets for the safe and efficient movement of people, goods and services in the most environmentally sound manner possible (Streets and Traffic Control-Objective B.2). Project would improve traffic flow on Carlsbad Boulevard by shoring up and preventing more erosion on the western lane. This allowed both southbound lanes to remain open. Mello II LCP Segment The project site is located entirely within the Mello II Segment of the Local Coastal Program but is within the California Coastal Commission appeal jurisdiction as stated previously. The site is also located within and subject to the Coastal Resource Protection Overlay Zone (Chapter 21.203), and the Coastal Shoreline Development Overlay Zone (Chapter 21.204) of the Carlsbad Municipal Code. The installation of riprap and the sewer outfall pipeline casing were installed below the southbound Carlsbad Boulevard grade and therefore will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. Furthermore, the color and size of the riprap is the same as what was previously approved and installed for the replacement of the Encinas Creek Bridge just to the north of the project site. Therefore, the visual beauty of the coastal zone will not diminish with the project. The riprap replacement has improved traffic flow and maintains a bike lane which has facilitated pedestrian and vehicular coastal access. The northern end of the riprap started approximately 149 feet south of the Encinas Creek Bridge, which is where the southern end of the riprap was installed under the Encinas Creek Bridge replacement project that started construction in January 2010 (CDP 09-08, SUP 09-03, and HMP 09-06). Placement of riprap extended southward an additional 280 feet, terminating just north of the California Department of Parks & Recreation's existing sewer lift station. The supplemental riprap stabilized the then eroding roadway embankment. The new riprap does not extend beyond the footprint of the existing riprap. Southbound Carlsbad Boulevard was reopened in time for the Memorial Day weekend; therefore there was no impact to beach access during the summer months. In addition, the contractor was not allowed to have any equipment west of the sheet piles, nor store any material or equipment CDP 10-06/SUP 10-01 - CARLSBAD BOULEVARD RIPRAP EXTENSION JULY 20, 2011 PAGES on the beach. With these project design elements and schedule the project minimized impacts to coastal resources and public access. The riprap is located within a flood hazard area; however, according to the Wave Run-up study completed by West Consultants, Inc, dated May 26, 2010, the riprap was sized to withstand wave activity based on coastal wave height per the USACEs' Coastal Engineering Manual (2006). No agricultural uses currently exist on the site or within the area. The proposed project is not located in an area of known geologic instability. 2. Coastal Resource Protection Overlay Zone The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter 21.203 of the Zoning Ordinance) in that the project adhered to the City's Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water Mitigation Plan (SUSMP) and Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased urban run-off, pollutants and soil erosion. The zone is intended to protect sensitive resources. It requires preservation of steep slopes with vegetation (dual-criteria slopes) with some exceptions. No development occurred in areas of steep coastal bluffs. There are no prime agricultural lands near the site. There are disturbed sensitive vegetation communities to the east of the roadway; however, no impacts to biological resources occurred with the project. 3) Coastal Shoreline Development Overlay Zone The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter 21.204 of the Zoning Ordinance) in that no development was proposed in areas of steep slopes (coastal bluff). Native vegetation located on the east side of the road was not impacted during construction. The site is not located in an area prone to landslides, or susceptible to accelerated erosion or liquefaction. C. Floodplain Management Regulations (Chapter 21.110) and Special Use Permit Procedures (Section 21.110.130) The road is identified as being within Zone A, and the beach area is identified as being within Zone VE with a base flood elevation of 9 feet above Mean Sea Level (MSL). The site is identified on the Flood Insurance Rate Map Number 06073C1027 F, dated June 19, 1997. Zone A is outside the 500-year flood and Zone VE is within a "special flood hazard area (SFHA)," which means an area having special flood or flood-related erosion hazards. Because work occurred on the beach within Zone VE, processing of a Special Use Permit is required. The permit is required to review the project for protection of public health, safety and welfare and to minimize public and private losses due to flooding. The project improved the health and safety hazards that existed with the road being undermined by the previous storms and high tides. CDP 10-06/SUP 10-01 - CARLSBAD BOULEVARD RIPRAP EXTENSION JULY 20, 2011 PAGE 9 V. ENVIRONMENTAL REVIEW The issuance of an emergency CDP for the project is exempt from CEQA review. CEQA does not apply to actions necessary to prevent or mitigate an emergency. Per CEQA Section 15269 "emergency" includes such occurrences as fire, flood, earthquake, or other soil or geologic movements. The repairs to the embankment supporting southbound Carlsbad Boulevard, relocation of a section of 6 inch exposed sewer force main, and the installation of a concrete protective casing over the existing 48 inch sewer outfall pipe, which was created by severe storms, produced substantial rainfall, flooding and destructive extreme high tides, constituted an emergency. The City filed a Notice of Exemption for the emergency CDP project with the County of San Diego on March 22, 2010. The issuance of a follow-up regular CDP and SUP for the installation of riprap and protection of the sewer outfall pipe, as required by the emergency CDP, is not a "project" within the meaning of CEQA and does not require CEQA review. That is, the permit does not cause either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment as the construction of the project has already been completed under the emergency CDP and is not proposed to be changed with the issuance of the regular CDP and SUP. City staff indicated that due to recent astronomical tides and storm waves, the existing force main sewer pipe, bluff, and Carlsbad Boulevard are no longer adequately protected by the existing revetment. As such, an emergency permit is currently being reviewed by the City and is scheduled for a City Council meeting on March 23rd, 2010. The emergency work will include moving existing dislodged rock into alignment with the revetment, importing additional rock to supplement the existing revetment, and importing additional rock to create a new portion of revetment that does not currently exist. While it looks like there may be justification for an emergency permit, we do not agree with the City's position relative to permit jurisdiction. While we have not reviewed scaled plans, it appears that portions of the proposed repairs will occur below the Mean High Tide Line within the Coastal Commission's original permit jurisdiction. Recently, the Commission asserted jurisdiction over revetment maintenance activities directly north, and in line with the existing revetment (reference Coastal Development Permit # 6- 09-051), thus it can be expected that the Commission will also be asserting jurisdiction over the revetment work currently proposed. However, because the work is proposed under an emergency permit, the Commission will address the jurisdictional question when the City reviews/approves the required follow-up Regular Coastal Development Permit. Additionally, because the work proposed is considered temporary work to address an emergency situation,, it would be diligent of the City to limit the proposed emergency repairs to che minimal necessary and eliminate any work that cannot by modified in the future.
