AGENDA OF: July 20, 2011 Application complete date: June 8, 2011 Project Planner: Pam Drew Project Engineer: Mark Biskup SUBJECT: CDP 10-24 - SOUTH CARLSBAD STATE BEACH - Request for approval of a post emergency Coastal Development Permit to 1) demolish an existing sewer lift station, located at the north end of North Ponto Day Use parking lot; 2) construct a new sewer lift station, located at the north end of South Carlsbad State Beach campground; 3) abandon in place approximately 1,300 feet of 6 inch sewer force main pipe; and 4) install approximately 345 feet of 6 inch sewer force main from the new sewer lift station eastward to tie into an existing City of Carlsbad sewer manhole located on Surfside Lane, within the City's Coastal Zone located on southbound Carlsbad Boulevard and Surfside Lane, just north of Island Way, within Local Facilities Management Zone 22. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 6790 APPROVING Coastal Development Permit (CDP 10-24) based upon the findings and subject to the conditions contained therein. II.INTRODUCTION The project is a post emergency Coastal Development Permit (CDP) to: 1) demolish an existing sewer lift station, located at the north end of North Ponto Day Use parking lot; 2) construct a new sewer lift station, located at the north end of South Carlsbad State Beach campground; 3) abandon in place approximately 1,300 feet of 6 inch sewer force main pipe; and 4) install approximately 345 feet of 6 inch sewer force main from the new sewer lift station eastward to a new manhole, located in the median between northbound Carlsbad Boulevard and Surfside Lane, and then continue east a short distance with a 6 inch gravity sewer main and tie into an existing City of Carlsbad sewer manhole located within the public right-of-way on Surfside Lane. Emergency repairs, which occurred in an area south of the Encinas Creek Bridge, became necessary when the area along southbound Carlsbad Boulevard was undermined by severe rainfall, flooding and destructive tidal-surge wave action in January 2010 (see Attachment 3). The winter storms exposed the State Parks Department's 6 inch sewer force main and sewer pump station footings. This permit would permanently authorize the improvements that were completed by the State Parks Department under the emergency CDP (10-05). The project complies with all applicable city standards and staffs recommendation of approval with conditions is supported by the analysis as follows. PROJECT DESCRIPTION AND BACKGROUND Background: On February 2, 2010, during a routine inspection, City of Carlsbad staff determined that the roadway along southbound Carlsbad Boulevard, south of the Encinas Creek Bridge, had been compromised and the integrity of the roadway was at risk due to previous tidal action and severe storms which started around January 17, 2010. Additionally, staff discovered that portions of the State Parks Department's 6 inch sewer force main were exposed by the storm events and the bluff was eroding adjacent to their existing sewer lift station, exacerbating the unsafe conditions of this area. Staff closed the western most lane by installing cones to redirect traffic to the eastern lane to ensure the safety of the motoring public, bicyclists, and pedestrians. The City Manager declared a local emergency on February 5, 2010 and the City Council ratified and subsequently extended the emergency declaration until the project was completed on May 28, 2010. On March 17, 2010 the Planning Director issued an emergency CDP (10-05) to install riprap to stabilize and protect the eroding southbound Carlsbad Boulevard roadway embankment, relocate a section of the State Parks Department's 6 inch sewer force main and sewer lift station, and protect EWA's sewer outfall pipeline located under the area in which riprap was planned. City of Carlsbad Municipal Code Section 21.201.190(D)(1) authorizes the Planning Director to issue an emergency coastal development permit if the Director finds, in part, that, "An emergency exists that requires action more quickly than permitted by the procedures for minor coastal permits or for regular permits and the work can and will be completed within thirty days unless otherwise specified by the terms of the permit," and the proposed emergency CDP is consistent with the provisions of the City's Mello II Segment of the Local Coastal Program (LCP). The Planning Director granted the emergency CDP to be valid through May 28, 2010. The timing of the emergency permit was intended to coincide with the scheduled reopening of southbound Carlsbad Boulevard to through traffic as required by the CDP (09-08) issued for the Encinas Creek Bridge Replacement project. Emergency CDPs are considered temporary permits and are conditioned to require the application for a follow-up regular CDP. The regular CDP is required to permanently authorize the work completed with the emergency CDP. The emergency permit covered work that was completed by the City of Carlsbad, State Parks Department, and Encina Wastewater Authority (EWA). However, this permit only covers work performed by the State Parks Department. The City of Carlsbad and EWA have applied for a separate post emergency CDP (10-06). The project began on April 12, 2010 and the major components of the project were completed by May 28, 2010, the start of Memorial Day weekend. All work was completed while southbound Carlsbad Boulevard was closed for the replacement of the Encinas Creek Bridge. The new sewer lift station is operational and the old lift station located on the bluff has been demolished. CDP 10-24 - SOUTH CARLSBAD STATE BEACH JULY 20, 2011 PAGE 3 Project Description: Approximately 1,030 feet of existing 6 inch sewer force main, located between the existing and proposed sewer lift stations, was abandoned in place. An additional 980 feet of 6 inch sewer force main, located from the existing sewer lift station running east to the EWA's facility was also abandoned in place since the new sewer lift station is operational. Furthermore, approximately 210 feet of the 6 inch sewer force main that was exposed during the storms was removed by the City of Carlsbad's contractor in order for the city to install riprap to protect Carlsbad Boulevard from further damage (CDP 10-06). Since this sewer force main was in use at the time, the city installed a temporary by-pass sewer pipeline, below grade on the east side of southbound Carlsbad Boulevard prior to the removal of this section of pipeline, and reconnected to the existing sewer lift station approximately 15 feet south of the supplemental riprap installed by the city. The existing sewer lift station was demolished once the new sewer lift station became operational. Approximately 345 feet of 6 inch sewer force main has been constructed via horizontal directional drilling (HDD) underneath northbound and southbound Carlsbad Boulevard from the new sewer lift station east and ties into the City of Carlsbad's existing manhole located in the public right-of-way on Surfside Lane. The project is not located on the beach and therefore there are no jurisdictional issues with other agencies. However, the project is within the California Coastal Commission appeal jurisdiction. IV. ANALYSIS A. General Plan; and B. Coastal Development Permit Regulations for the Mello II Local Coastal Program (LCP) Segment, the Coastal Resource Protection Overlay Zone, and the Coastal Shoreline Development Overlay Zone (Chapters 21.201, 21.203, and 21.204 of the Zoning Ordinance). The recommendation for approval for this project was developed by analyzing the project's consistency with the applicable City regulations and policies. The project's compliance with each of the above regulations is discussed in detail in the sections below. Review of Required Coastal Findings A. General Plan The project consists of demolishing an existing sewer lift station, constructing a new sewer lift station, abandoning in place approximately 1,300 feet of 6 inch sewer force main pipe, and installing approximately 345 feet of 6 inch sewer force main from the new sewer lift station eastward to tie into an existing City sewer manhole located on Surfside Lane. The new pipeline was installed under south and northbound Carlsbad Boulevard via HDD. Carlsbad Boulevard is designated by the City of Carlsbad General Plan (City of Carlsbad 1994) as Major Arterial Street. The area directly to the east and west of the project site is designated as Open Space. The area to the east of Surfside Lane is designated Travel/Recreation Commercial (TR), CDP 10-24 - SOUTH CARLSBAD STATE BEACH JULY 20, 2011 PAGE 4 The General Plan contains goals and policies including open space, land use, and public safety in Carlsbad. Compliance with relevant goals of the General Plan is outlined in Table A below: TABLE A: GENERAL PLAN COMPLIANCE ELEMENT STANDARD PROJECT COMPLIANCE? Open Space & Conservation To control storm water pollutants (Water Quality Protection - Goal A.I). The project conformed to all NPDES requirements. The removal of the existing above grade sewer lift station on the bluff enhances the aesthetics of the area and improved the view of the beach and ocean. Project would relocate the exposed 6 inch sewer force main and lift station away from the eroding bluff to prevent future pipeline breaks and the release of hazardous materials onto the beach and into the Pacific Ocean. Mello II LCP Segment The project site is located entirely within the Mello II Segment of the Local Coastal Program and within the California Coastal Commission appeal jurisdiction as stated previously. The site is also located within and subject to the Coastal Resource Protection Overlay Zone (Chapter 21.203), and the Coastal Shoreline Development Overlay Zone (Chapter 21.204) of the Carlsbad Municipal Code. The new pipeline has been installed below northbound and southbound Carlsbad Boulevard and the existing sewer lift station was demolished and therefore will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. The new sewer lift station is located within the parking lot of South Carlsbad State campground and does not block coastal views. Furthermore, the new sewer lift station is mostly underground. Therefore, the visual beauty of the coastal zone will not diminish with the project. The project started while southbound Carlsbad Boulevard was closed to traffic for the Encinas Creek Bridge Replacement project (CDP 09-08), so there was no impact to the beach area during the summer months. Furthermore, most of the work was either completed in the public right-of- way or within the campground parking lot and did not impact the beach. The existing sewer lift station was demolished without the use of heavy equipment and, therefore, no impact occurred on the beach. With these project design elements the project minimized impacts to coastal resources and public access. No agricultural uses currently exist on the site or within the area. The project is not located in an area of known geologic instability. 2. Coastal Resource Protection Overlay Zone The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter 21.203 of the Zoning Ordinance) in that the project adhered to the City's Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water Mitigation Plan (SUSMP) and Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased urban run-off, pollutants and soil erosion. The zone is intended to protect sensitive resources. It requires preservation of steep slopes with vegetation (dual-criteria slopes) with some exceptions. No development occurred in areas of steep coastal bluffs. There are no prime agricultural lands near the site. A small area of vegetation (approximately 400 square feet of disturbed vegetation and approximately 200 square feet of coastal sage scrub (CSS)), was impacted for the construction of the manhole between northbound Carlsbad Boulevard and Surfside Lane. However, the small area of CSS is not considered an environmentally sensitive habitat area (ESHA) because the CSS is not rare or especially valuable to the ecosystem as the vegetation is situated in a series of small, fragmented, isolated patches adjacent to northbound Carlsbad Boulevard, and surrounded by an urbanized environment. As a result of these factors, the project does not impact ESHA. Nevertheless, the disturbed area (approximately 600 square feet) will be re-vegetated by hand seeding with a native seed mix. Coastal Shoreline Development Overlay Zone The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter 21.204 of the Zoning Ordinance) in that no development was proposed in areas of steep slopes (coastal bluff). As stated above, a small area of disturbed vegetation and CSS was impacted as a result of the new manhole located between to northbound Carlsbad Boulevard and Surfside Lane; however, the area will be reseeded with native seeds. The site is not located in an area prone to landslides, or susceptible to accelerated erosion or liquefaction. V. ENVIRONMENTAL REVIEW The issuance of an emergency CDP for the project is exempt from CEQA review. CEQA does not apply to actions necessary to prevent or mitigate an emergency. Per CEQA Section 15269 "emergency" includes such occurrences as fire, flood, earthquake, or other soil or geologic movements. The rerouting of the exposed 6 inch sewer force main and the construction of a new sewer lift station constituted an emergency. The City filed a Notice of Exemption for the emergency CDP (10-05) project with the County of San Diego on March 22, 2010. The issuance of a follow-up regular CDP for the 6 inch sewer force main, demolition of the existing sewer lift station, and the construction of the new sewer lift station, is not a "project" within the meaning of CEQA and does not require CEQA review. That is, the permit does not cause either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment as the construction of the project has already been completed under the emergency CDP and is not proposed to be changed with the issuance of the regular CDP.
