AGENDA OF: October 17,2012 Item No. 8 Application complete date: November 2, 2011 Project Planner: Christer Westman Project Engineer: Jeremy Riddle SUBJECT: CDP 11-10/HDP 11-02/SUP 11-03/HMP 11-04 -EL CAMINO REAL SOUTHBOUND WIDENING - Request for the adoption of a Mitigated Negative Declaration and Mitigation Monitoring and Rep01i ing Program and the approval of a Coastal Development Pennit, Hillside Development Pennit, Special Use Pennit, and Habitat Management Plan Pe1mit for improvements to portions of the existing southbmmd side of El Camino Real between Kelly Drive and Crestview Drive to its ultimate buildout condition of three southbound lanes, a bicycle lane, curb, gutter, 5 foot sidewalk, and street lights within a 63 foot southbound right-of-way for a distance of approximately 1,600 lineal feet in the Mello II Segment of the Local Coastal Program and within Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 6915 ADOPTING a Mitigated Negative Declaration and Mitigation Monitoring and Rep01i ing Program, and ADOPT Planning Commission Resolutions No. 6916 and 6917 APPROVING Coastal Development Pennit (CDP 11-10), Hillside Development Pennit (HDP 11-02), Special Use Pennit (SUP 11-03), and Habitat Management Plan Pe1mit (HMP 11-04) based on the findings and subject to the conditions contained therein. II. INTRODUCTION The project scope is to widen and improve a section of El Camino Real from Kelly Drive south to Crestview Drive for a total of approximately 1,600-feet in length. El Camino Real is a major n01ihlsouth roadway serving as a vital parallel circulation element to Interstate 5 (1-5). The project proposes to widen southbound sections of El Camino Real to full prime alierial standards. These sections of roadway, from Kelly Drive south to Crestview Drive, are some of the few remaining sections of El Camino Real that have not been widened to the full width of 6 travel lanes with 3 northbmmd and 3 southbound lanes. The proposed roadway improvements would include a st01m water outlet, sidewalk, bike lane, and traffic lane. The project is subject to a Coastal Development Pe1mit (CDP) since the project is in the Coastal Zone. A Hillside Development Pe1mit (HDP) is required due to existing steep slopes on the west side of El Camino Real that exceed a height of fifteen feet. A Special Use Pe1mit (SUP) is required because the project falls within Areas 2 and 3 of the El Camino Real Conidor Development Standards. The standards affect development on both public and private prope1iy, including on land within the public right-of-way. Primarily, the project is subject to the grading and landscaping provisions of the standards. A Habitat Management Plan Pe1mit (HMP) is CDP 11-10/HDP 11-02/SUP 11-03/HMP 11-04 – EL CAMINO REAL SOUTHBOUND WIDENING October 17, 2012 Page 2 required because the project will have impacts to 0.14 acres of sensitive riparian scrub habitat due to the installation of storm drain energy dissipaters on the west side of El Camino Real. III. PROJECT DESCRIPTION AND BACKGROUND The project is located in the northwestern part of the City as shown on the attached location map. Residential and commercial development abuts the project site on the west side of El Camino Real. Most of this area is disturbed. A small area at the north end of the project site abuts a drainage with natural vegetation. The southern portion of the project area includes a vertically cut bank. El Camino Real is classified as a Prime Arterial in the City’s Circulation Element. Currently it is a four-lane roadway between Kelly Drive and Crestview Drive. The proposal is to widen this segment to its full width of 3 southbound lanes. Roadway Improvements The proposed roadway improvements would result in a total width of 126 feet including: 8-foot-wide bike lane Three southbound lanes, 12 feet wide each An 18-foot-wide landscaped median island 5-foot-wide sidewalk Relocation of existing overhead utilities to underground Storm Drain Improvements The project includes the placement of erosion protection at a storm drain outlet. A brow ditch is proposed along the top of the retaining wall to prevent storm water from flowing over the wall. Grading/ Retaining Wall Minor grading would occur along the west side of El Camino Real requiring the construction of a retaining wall. The height of the retaining wall would vary from 5-feet to a maximum of 8-feet 4-inches high. The wall is proposed to be constructed with a boulderscape architectural treatment. See attached exhibit “Boulderscape” for an example of the treatment. The wall will be located at the south end of the project area, adjacent to the right-of-way of the road. Additional minor grading behind and at the top of the retaining wall would occur to construct a brow ditch. Landscaping/ Irrigation Minimal landscaping is proposed along the western edge of the El Camino Real right-of-way. The primary purpose of the proposed landscape is for erosion control. As properties develop along the El Camino Real street frontage, permanent landscape and irrigation will become a part of those projects. Lighting Overhead lighting is proposed as part of the project. The light fixtures will be bell shaped and match the existing light fixtures on El Camino Real. IV. ANALYSIS The proposed project is subject to the following regulations: A. General Plan Circulation Element; B. Coastal Development Permit Regulations for the Mello II Local Coastal Program (LCP) Segment and the Coastal Resource Protection Overlay Zone (Chapters 21.201 and 21.203 of the Zoning Ordinance); C. Hillside Development Ordinance (Chapter 21.95 of the Carlsbad Municipal Code); D. Special Use Permit - Scenic Preservation Overlay Zone regulations (Chapter 21.40 of the Carlsbad Municipal Code and the El Camino Real Corridor Development Standards); and E. Habitat Management Plan (Chapter 21.210 of the Carlsbad Municipal Code). The recommendation for approval for this project was developed by analyzing the project’s consistency with the applicable City regulations and policies. The project’s compliance with each of the above regulations is discussed in detail in the sections below. A. General Plan Circulation Element Widening and improving El Camino Real to a six-lane, prime arterial standard is anticipated by the General Plan. This project would implement improvements to El Camino Real consistent with the General Plan. Further, the General Plan contains goals and policies on enhancing the City’s image, beautifying the El Camino Real corridor, and improving automobile and pedestrian circulation in Carlsbad. Compliance with some of these standards of the General Plan is outlined in Table A below: TABLE A: GENERAL PLAN COMPLIANCE ELEMENT STANDARD PROJECT COMPLIANCE? Mello II LCP Segment The project site is located within the Mello II Segment of the Local Coastal Program. The site is also located within and subject to the Coastal Resource Protection Overlay Zone (Chapter 21.203) of the Carlsbad Municipal Code. The proposed street improvements will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the site. The proposed construction is not located in an area of known geologic instability or flood hazard. Since the site is not located in close proximity to the coast, no public opportunities for coastal shoreline access are available from the subject site. Coastal Resource Protection Overlay Zone The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the City's Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water Mitigation Plan (SUSMP) and Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased urban run-off, pollutants and soil erosion. The Coastal Resource Protection Overlay Zone is intended to protect sensitive resources. It requires preservation of steep slopes with vegetation (dual-criteria slopes) with some exceptions. There is a limited area of disturbance to steep slopes, however they are not dual-criteria vegetated slopes with protected biological species. The impact to this area is specifically required to widen the southbound lane of El Camino Real and construct the retaining wall. The retaining wall is necessary because the widening of the roadway cuts into the existing slope, much of which is bare due to the steepness of the slope. Additional grading behind and at the top of the retaining wall would occur to construct a brow ditch. The proposed grading at the top of the wall would be very minor and would blend into the natural look of the existing terrain. There are no prime agricultural lands near the site but there are sensitive vegetation communities and there will be some unavoidable impact to biological resources. Specifically, the area of impact will be on the west side of El Camino Real in the area where the storm drain outlet is located. Storm water from the storm drains currently outlets at erosive velocities into a ditch west of the roadway. Within the area of the storm drain outlet is where the impacts to sensitive habitat will occur. However, to reduce these potentially significant impacts to a less than significant level, mitigation measures contained in the project’s Mitigation Monitoring and Reporting Program (MMRP), are required. Given the above, the project is consistent with the Mello II land use policies. C. Hillside Development Ordinance (Chapter 21.95 of the Carlsbad Municipal Code) The key purpose and intent of the Hillside Development Ordinance is to assure hillside conditions are properly identified and incorporated into the planning process, and to preserve and/or enhance the aesthetic qualities of natural hillsides and manufactured slopes of the land, minimizing the amount of project grading, especially in highly visible public places. The project is subject to this ordinance due to its proposed grading and construction of a retaining wall along the southwestern edge of the project area. The southwestern portion of the project area has a slope with gradients over forty percent, a slope height that exceeds fifteen feet, and is over 10,000 square feet in area. These characteristics would preclude development of the slope per the Hillside Ordinance. However, slope development required for a Circulation Element Roadways is not required to comply with the volume of grading and slope height requirements per Section 21.95.130 of the Carlsbad Municipal Code. In addition, grading of slopes greater than 25% is permitted within the Coastal Zone for slopes that are directly associated with circulation element roadways. The existing steep slope on the west side of El Camino Real, is to be cut back to allow this section of roadway to be increased to three southbound lanes and include a sidewalk and bike lane. A retaining wall is required and will be about 265 linear feet long with a height ranging CDP 11-10/HDP 11-02/SUP 11-03/HMP 11-04 – EL CAMINO REAL SOUTHBOUND WIDENING October 17, 2012 Page 6 from 5 feet to a maximum height of 8 feet 4 inches. The facade of the walls will have a similar boulderscape design and color to other walls on El Camino Real. A sidewalk will be constructed in front of the wall. The sidewalk will connect with existing sidewalks on the north and south ends of the wall. Drought resistant landscaping will also be planted in front of the wall to soften the mass of the wall. The proposed retaining wall would be constructed with a naturalized boulderscape architectural treatment that would look similar to existing conditions, and over time, the proposed drought resistant landscaping would mature and further soften the visual appearance of the retaining walls. Special Use Permit (Chapter 21.40 of the Carlsbad Municipal Code and the El Camino Real Corridor Development Standards) A Special Use Permit is required for development within the El Camino Real Scenic Corridor Overlay Zone. The purpose of the overlay is to preserve the scenic qualities and maintain and enhance the appearance of the roadway through design concepts and development standards. This section of El Camino Real is defined as Area 2, located from Chestnut Avenue south to the Country Store and Area 3 south of the Country Store. The Corridor Development Standards identifies these areas as dominated by residential uses. Many of the standards discussed in the regulations pertain to such details as signage, setback from roadway, and building height, which do not apply to the proposed project. The project would incorporate other design features such as sidewalks and would not modify the existing identified design theme of suburban residential. Overall, the project would not conflict with the El Camino Real Corridor Development Standards. Table D explains how the project is consistent with the intent and applicable standards. The following findings can be made for those elements of the project design which are not in compliance with the El Camino Real Corridor Development Standards: 1) Compliance with the non-contiguous sidewalk and double distance street light spacing standards are infeasible for this project since a street adjacent sidewalk in some instances is necessary to accommodate bus passengers and to reduce open space encroachment and the City standard street light spacing provides better traffic and pedestrian safety. 2) That the scenic qualities of the corridor will continue to be maintained with a contiguous sidewalk and standard street light spacing since these elements are lesser components of a whole that creates the corridor’s scenic quality and their absence will not adversely affect the whole. 3) That the project will not have an adverse impact on traffic safety in that complying with the City standard street light spacing and construction of a contiguous sidewalk provides better traffic and pedestrian safety. 4) That the project is generally designed so as to meet the intent of the scenic preservation overlay zone through the use of landscape and grading design adjacent to El Camino Real. E. Habitat Management Plan (Chapter 21.210 of the Carlsbad Municipal Code) The project area is mostly adjacent to residential and commercial development. Above ground utilities exist along the length of the project area. There is a limited area of wetlands from the drainage associated with a culvert under El Camino Real. The project includes the placement of erosion protection (rip rap) in the drainage to prevent erosion at the culvert outlet. All impacts to sensitive vegetation communities (0.14 acre of riparian scrub) would occur in this area due to the repair work to the outlet and the installation of the rip rap, according to a Biological Resources Technical Report (Planning Systems May 2011) that was prepared for the project. The report states that implementation of the proposed project would potentially result in the direct permanent loss of the vegetation community and non-natural land, which would directly impact sensitive wildlife species that depend on the native vegetation. Direct permanent impacts to vegetation communities listed as Habitat Management Plan (HMP) habitats in the City’s HMP would be considered significant. The project’s Mitigated Negative Declaration, discussed below, CDP 11-10/HDP 11-02/SUP 11-03/HMP 11-04 – EL CAMINO REAL SOUTHBOUND WIDENING October 17, 2012 Page 10 includes mitigation measures to reduce potential impacts to less than significant. Therefore, the proposed project would comply with the HMP guidelines and requirements and would be consistent with the Carlsbad HMP. V. ENVIRONMENTAL REVIEW Staff conducted an environmental impact assessment to determine if the project could have a potentially significant effect on the environment pursuant to CEQA Guidelines and the Environmental Protection Ordinance (Title 19) of the Carlsbad Municipal Code. The assessment determined the project has potentially significant impacts in the areas of biological resources, cultural resources, geology/soils, hazards/hazardous materials, and hydrology/water quality. To reduce these potentially significant impacts to a less than significant level, compliance with the recommended mitigation measures is necessary. Based on the above, the City Planner issued a Notice of Intent to adopt a Mitigated Negative Declaration (MND) for the project on July 3, 2012. A standard comment letter was received during the 30-day public review (July 3, 2012 – August 2, 2012) from the Native American Heritage Commission. Staff also received comment from the U.S. Fish and Wildlife Service requesting that construction work within 500 feet of the riparian area near Kelly Drive should occur outside the least Bell's vireo breeding season (March 15 to September 15). The minor changes to the EIA Part II do not require recirculation of the Mitigated Negative Declaration since the changes are consistent with the description of “new information” in CEQA Section 15073.5(c)(4), which states recirculation is not required if “new information is added to the negative declaration which merely clarifies, amplifies, or makes insignificant modifications to the negative declaration.” ATTACHMENTS: 1.
