AGENDA OF: January 30, 2013 Project Planner: Pam Drew Project Engineers: Mark Biskup & Jeremy Riddle SUBJECT: CDP 12-25/HMP 13-01 - NORTH BATIQUITOS SEWER LIFT STATION FORCE MAIN REPAIR – Request for approval of a post-emergency Coastal Development Permit and Habitat Management Plan Permit to: 1) install approximately 65 lineal feet of 14-inch sewer force main pipe below grade; 2) install a manifold system including valves and appurtenances above grade; and 3) abandon in place approximately 50 lineal feet of 14-inch sewer force main pipe below grade at the North Batiquitos Sewer Lift Station (NBSLS), located at 7382 Gabbiano Lane, on the north side of Batiquitos Lagoon, in the East Batiquitos Lagoon/Hunt Properties Segment of the Local Coastal Program and within Local Facilities Management Zone 19. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolutions No. 6940 and 6944 APPROVING Coastal Development Permit (CDP 12-25) and Habitat Management Plan Permit (HMP 13-01) based upon the findings and subject to the conditions contained therein. II. INTRODUCTION The project is a post-emergency Coastal Development Permit (CDP) to: 1) install approximately 65 lineal feet of 14-inch sewer force main pipe below grade; 2) install a manifold system including valves and appurtenances above grade; and 3) abandon in place approximately 50 lineal feet of 14-inch sewer force main pipe below grade at the NBSLS. Because the project had temporary and permanent impacts to sensitive habitat a Habitat Management Plan Permit (HMP) will also be required. These permits would permanently authorize the improvements that were completed by the City of Carlsbad under the emergency CDP 12-22 issued by the City Planner on October 12, 2012 and to mitigate on site for the temporary and permanent impacts to sensitive habitat. The project complies with all applicable city standards and staff’s recommendation of approval with conditions is supported by the analysis as follows. III. BACKGROUND On October 7, 2012 at approximately 8:10 a.m. a sewer line was discovered leaking at the NBSLS. Staff noticed that liquid was being forced up through the pavement on the NBSLS site every time the sewer pumps were activated. The emergency response crews determined that the 14-inch ductile iron pipe (DIP) force main leaving the station had developed a leak. The 14-inch DIP force main conveys sewage from the NBSLS to the gravity sewer located along Interstate 5 2 CDP 12-25/HMP 13-01 – NORTH BATIQUITOS SEWER LIFT STATION FORCE MAIN REPAIR January 30, 2013 PAGE 2 to the Encina Water Pollution Control Facility (EWPCF). The pipe failure occurred between the dry well and the isolation valves for the two 14-inch force mains which are parallel within the NBSLS complex. Upon discovering the leak, the sewage pumps at the lift station were shut off. To minimize spillage into the Batiquitos Lagoon, six large tanker trucks, ranging in size from 3,700 to 7,000 gallons, pumped and hauled untreated sewage from the influent gravity sewer manholes to the EWPCF around the clock. However, the tanker trucks weren’t able to capture all the sewage; therefore, some sewage backed up through adjacent manholes and spilled into the Batiquitos Lagoon and within the adjacent vegetation and trail. A total volume of 1,097,100 gallons of wastewater was hauled away, and a total of 32,040 gallons of sewage was spilled into the surrounding area, including the lagoon, over the duration of the event. On October 8th, 2012 work crews were able to cap the primary sewer force main upstream of the suspected leak location. By Monday evening, crews had completed an above grade temporary sewer bypass line until the permanent below grade sewer pipeline could be installed. At this point there was no longer any danger of continued sewer overflows. Since then, the city’s contractor has installed new piping and appurtenances and abandoned in place the section of force main that was leaking. The new segment of sewer force main has been reconnected to the primary and secondary force mains to restore system redundancy. The replacement system provides improved operational advantages including the option of using either of the two downstream sewer force mains by way of the new above grade valves included in the new manifold system. The temporary bypass piping has been disconnected and removed. Paving restoration and clean-up work has been completed. Emergency Coastal Development Permit: The Acting City Manager declared a local emergency on October 9, 2012 and the City Council ratified and subsequently extended the emergency declaration on October 23, 2012 and again on November 6, 2012. The emergency declaration was terminated on November 27, 2012. City of Carlsbad Municipal Code Section 21.201.190(D)(1) and (3) authorizes the City Planner to issue an emergency coastal development permit if the City Planner finds, in part, that, “An emergency exists that requires action more quickly than permitted by the procedures for minor coastal permits or for regular permits and the work can and will be completed within thirty days unless otherwise specified by the terms of the permit,” and the proposed emergency CDP is consistent with the provisions of the city’s East Batiquitos Lagoon/Hunt Properties Segment of the Local Coastal Program (LCP). On October 12, 2012 the City Planner issued an emergency CDP (12-22) to: 1) install approximately 65 lineal feet of 14-inch polyvinyl chloride (PVC) sewer force main pipe below grade; 2) install a manifold system including valves and appurtenances above grade; and 3) abandon in place approximately 50 lineal feet of below grade 14-inch DIP sewer force main pipe, including the segment of sewer force main that was leaking. CDP 12-25/HMP 13-01 – NORTH BATIQUITOS SEWER LIFT STATION FORCE MAIN REPAIR January 30, 2013 PAGE 3 PROJECT DESCRIPTION Temporary Bypass Pipeline: The initial approach to correct the pipe failure was to excavate to the force main immediately adjacent to the NBSLS concrete pad to locate the point of the break in the force main, and concurrently pump out the incoming wastewater to the NBSLS through the use of pumper trucks at the upstream manhole. This process was continued until the force main was reached at the excavation point. At this location no failure of the force main was observed. However, due to the extreme depth (approximately 15-feet in depth), and safety concerns for the contractors, the decision was made to abandon the investigation of the failure point, and to install a temporary bypass pipeline above ground from an existing bypass connection on the pump discharge manifold to the original 14-inch DIP force main in order to bypass the area of suspected break and prevent further spillage. The bypass line allowed the city to maintain the integrity of the NBSLS and convey all wastewater through a force main rather than pumping wastewater out of the incoming manhole and trucking the wastewater to the treatment facility. This approach allowed staff more time to locate the break point in the force main. The hole in the abandoned section of force main was discovered through video inspection of the pipeline. Sewer Force Main and Appurtenances: The contractors installed approximately 65 lineal feet of 14-inch sewer force main pipe below grade to bypass the pipe that had a hole in it. An above grade manifold system, including valves and appurtenances, were installed adjacent to the NBSLS to allow easier access to shut-off valves in case of any future emergency. Furthermore, approximately 50 lineal feet of 14-inch sewer force main pipe was abandoned in place, including the section of pipe that had a hole in it. Top Soil: City staff removed and hauled away contaminated soil located on the trail and imported sand and decomposed granite to replace approximately 1- to 2-inches of removed contaminated soil (approximately five cubic yards). Water Quality: A total of 27 water samples were collected by Weston Solutions, Inc. at nine locations over a period of six days after the sewage spill. The last water sample was collected on October 12, 2012. The results of the bacteriological assessment indicate that concentrations of all three indicator bacteria (coliforms concentrations, fecal coliforms concentrations, and Enterococci concentrations) were greater than the state water quality objectives (WQOs) at sites A and B closest to the location of the sewage spill on the first day of monitoring. Concentrations at these sites generally decreased over time, but remained above the WQOs at Site B for total coliform and fecal coliforms on October 9, 2012 and October 10, 2012, respectively. Enterococcus concentrations were greater than the WQOs on the last day of monitoring at sites A and B, but total and fecal coliform concentrations were below their respective WQOs by this time. During the water sampling, total and fecal coliform concentrations were below WQOs at all sites other than sites A and B closest to the site of the spill. These results suggest that the spill may not have influenced water quality in areas outside of the immediate spill area. Enterococcus concentrations did exceed the WQOs at sites C (I-5 bridge) and D (Highway 101 and the jetty) on October 8, 2012 one day after the spill, but not on subsequent sampling days. As a precaution, CDP 12-25/HMP 13-01 – NORTH BATIQUITOS SEWER LIFT STATION FORCE MAIN REPAIR January 30, 2013 PAGE 4 Ponto Beaches were posted with signs warning beachgoers of the possible contamination in the water, north and south of the jetty, for seven days. IV. ANALYSIS The proposed project is subject to the following regulations: A. General Plan Land Use Element; B. Coastal Development Permit Regulations for the East Batiquitos Lagoon/Hunt Properties Local Coastal Program (LCP) Segment and the Coastal Resource Protection Overlay Zone (Chapters 21.201 and 21.203 of the Zoning Ordinance); and C. HMP and the Habitat Preservation and Management Requirements (Chapter 21.210 of the Zoning Ordinance). The recommendation for approval for this project was developed by analyzing the project’s consistency with the applicable city regulations and policies. The project’s compliance with each of the above regulations is discussed in detail in the sections below. A. General Plan Land Use Element The project is located in the Residential Low-Medium Density (RLM) Land Use designation. The General Plan contains goals, policies, and programs for the protection of environmental resources; to ensure adequate public facilities; and to ensure the proper disposal of solid and liquid waste. The project complies with these standards of the General Plan as outlined in Table A below: TABLE A: GENERAL PLAN COMPLIANCE ELEMENT STANDARD PROJECT COMPLIANCE? Land Use Preserve Buena Vista Lagoon and Batiquitos Lagoon as visual resources and wildlife preserves (Environmental – Implementing Policies and Action Program C.1). The new segment of sewer force main has been reconnected to the primary and secondary force mains to restore system redundancy. Furthermore, the project includes above grade valves and appurtenances to allow easy access to shut-off valves in case of an emergency. This will help prevent any future sewer spills into the lagoon and will protect the wildlife preserve. East Batiquitos Lagoon/Hunt Properties Local Coastal Program (LCP) Segment The project site is located entirely within the East Batiquitos Lagoon/Hunt Properties Segment of the LCP but is within the California Coastal Commission appeal jurisdiction. The site is also CDP 12-25/HMP 13-01 – NORTH BATIQUITOS SEWER LIFT STATION FORCE MAIN REPAIR January 30, 2013 PAGE 6 located within and subject to the Coastal Resource Protection Overlay Zone (Chapter 21.203) of the Carlsbad Municipal Code. The replacement of a segment of sewer force main and above- ground structures are located away from the lagoon and will not obstruct views of the coastline or Batiquitos Lagoon as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. Therefore, the visual beauty and coastal resources within the coastal zone will not diminish with the proposed sewer force main repair project. Furthermore, the majority of the 1.8 mile trail, along the north shore of Batiquitos Lagoon, remained open to the public during the sewage repair work. However, out of concern for public safety, a small section of the westernmost trail was closed briefly to the public while heavy equipment was brought in to stop the sewage spill. The entire length of trail has since been reopened for pedestrian use and no structures were installed that would block or impede public access. No agricultural uses currently exist on the site or within the area. The proposed project is not located in an area of known geologic instability. The project will not place any new above ground structures within the limits of the identified 100-year flood hazard areas. Construction of the project will not place equipment, structures or other materials in areas which could impede flows of the 100-year flood. Thus no impediment to flood flows will result from implementation of the project. 2. Coastal Resource Protection Overlay Zone The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the City's Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water Mitigation Plan (SUSMP) and Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased urban run-off, pollutants and soil erosion. The zone is intended to protect sensitive resources. It requires preservation of steep slopes with vegetation (dual-criteria slopes) with some exceptions. No development is proposed in areas of steep coastal bluffs. Furthermore, the project will help reduce the likelihood spills will occur in the future by providing redundancy and flexibility to the operation of the station. The new above ground pipeline manifold provides the option to pump into either of the two force mains and also provides above ground bypass connections which would allow for installation and operation of portable temporary pump system for emergency and maintenance applications. The underground ductile iron pipeline which failed was replaced with polyvinyl chloride (PVC) pipeline. PVC pipeline has superior resistance to the corrosive environment of wastewater and local soils. Although there were temporary and permanent impacts to sensitive habitat from the emergency repair work, staff is working with the Aviara Master Association, Batiquitos Lagoon Foundation, and California Department of Fish and Wildlife on a restoration plan to mitigate on site for the impacts, pursuant to the city’s HMP, dated November 2004. Mitigation of these impacts is included as a condition of the CDP. Construction of the project did not directly or indirectly impact local wildlife movement or migratory fish or wildlife movement because the project is mostly underground and within the NBSLS boundaries. C. HMP and the Habitat Preservation and Management Requirements (Chapter 21.210 of the Zoning Ordinance) Temporary impacts to upper coastal salt marsh vegetation were necessary to provide direct access to various manholes and for staging of vehicles and equipment during emergency response efforts. The city is proposing permanent impacts to accommodate future access to a manhole that was previously surrounded by dense vegetation. Emergency response efforts resulted in temporary impacts to upper coastal salt march (0.026 acre) and coyote brush scrub (0.030 acre) and approximately 0.003 acre of proposed permanent impacts to coyote brush scrub vegetation. Temporary impacts will be mitigated in kind at 1:1 for the 0.026 acre of upper coastal salt marsh. The replacement will be in situ, with the exception of one area (0.008 acre) where the affected habitat is isolated from nearby habitat by an unauthorized section of trail. In the case of the isolated area, the restoration will be implemented within the unauthorized trail. Temporary impacts to coyote brush scrub (0.030 acre) will be mitigated in situ by restoration of like habitat. Permanent impacts to coyote brush scrub (0.003 acre) will be mitigated at 2:1 ratio, pursuant to the city’s Habitat Management Plan (HMP), dated November 2004, with the restoration of 0.006 acre of coastal sage scrub at an unauthorized trail head southeast of the pump station on the northeastern edge of the trail. A formal restoration plan will be submitted to the California Department of Fish and Wildlife for their review and approval. The restored area will be monitored for five years with annual reports to assure that the vegetation is successfully established. Therefore, the proposed project would comply with the HMP guidelines and requirements and would be consistent with the Carlsbad HMP. V. ENVIRONMENTAL REVIEW The issuance of an emergency CDP for the project is exempt from California Environmental Quality Act (CEQA) review. CEQA does not apply to actions necessary to prevent or mitigate an emergency. Per CEQA Section 15269 “emergency” includes such occurrences as fire, flood, earthquake, or other soil or geologic movements. The repair and replacement work completed due to a broken sewer line adjacent to the Batiquitos Lagoon constituted an emergency. The city filed a Notice of Exemption for the emergency CDP project with the County of San Diego on October 12, 2012. The issuance of a follow-up regular CDP for the sewer repair work, as required by the emergency CDP, is exempt from CEQA per CEQA Guidelines Section 15302(c) - replacement or reconstruction of an existing utility system on the same site involving negligible or no expansion of capacity.
