The Marja Acres project, approved by the City Council on November 3, 2020, includes 248 townhomes, 46 affordable senior apartments, and 10,000 square feet of specialty commercial uses on 20.65 acres at 4901 El Camino Real. The subject Consistency Determination entails a request to replace an active community recreational space consisting of a 15, 724-square-foot (SF) grassy play area located in "Community Rec Area 1,", with a new pool, spa, and restroom/equipment building. The overall size of "Community Rec Area 1," 25,300 SF, as well as the location will not be impacted. After careful consideration of the request, the City Planner has determined that the request meets all of the findings below and APPROVES this request. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the proposal to replace the 15,724-square-foot grassy play area located within "Community Rec Area 1" with a pool, spa and equipment building are both considered active community recreational uses pursuant to Carlsbad Municipal Code Section 21.45.060.C.9. 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that the addition of a pool, spa and restroom are compatible and desirable community recreational uses in multi-family communities. 3) The proposed revision does not change the density or boundary of the subject property in that no additional residential units are proposed, and the boundaries of the project will remain the same. In addition, the overall size of "Community Rec Area 1," 25,300 SF, as well as the location will not be impacted. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit in that the proposed pool, spa and associated restroom/equipment room are also Community Development Department 7 ) Planning Division j 1635 Faraday Avenue Carlsbad, CA 92008-7314 j 442-339-2600 www.carlsbadca.gov CD 2022-0016 (DEV16038) -MARJA ACRES August 4, 2022 Page 2 considered active recreation uses pursuant to CMC Section 21.45.060.C.9. No new land uses are proposed. 5) The proposed revision does not rearrange the major land uses within the development in that the major land uses approved in conjunction with the Marja Acres project, specifically the townhomes, senior apartments and the commercial uses, remain as part of the project and the location is not changing. In addition, the location of "Community Rec Area 1" will remain the same. The proposed pool and spa will be centrally located in the Marja Acres townhome community. 6) The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code in that the approved size of "Community Rec Area 1 ", 25,300 SF, will remain the same. As such, the overall size of the active and passive recreation areas provided in the community, 49,425 SF, will also remain the same and will comply with recreational area requirements of the Planned Development Ordinance. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation in that the changes are minor in nature and are located within the approved development footprint, as analyzed pursuant to EIR 2017-0001. 8) The proposed change would not result in any health, safety or welfare impacts. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10) The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved in that the pool, spa and restroom are located in an area approved for an active community recreational area. The approved size of "Community Rec Area 1," 25,300 SF, will remain the same. After careful consideration of the circumstances surrounding this request, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35.
