ANNOUNCEMENT OF CONCURRENT MEETINGS: Mayor Hall announced that the City Council will be serving as the Carlsbad Municipal Water District Board of Directors on Consent Calendar Item Nos. 6 through 8. He added that he has a conflict with Item No. 7 and would not be voting on that item. PLEDGE OF ALLEGIANCE: Mayor Pro Tem Blackburn led the Pledge of Allegiance. INVOCATION: None. PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: Assistant City Attorney Cindie McMahon announced that there was no reportable action. APPROVAL OF MINUTES: None. PRESENTATIONS: Donation from Friends of the Arts Library and Cultural Arts Director Suzanne Smithson shared a few words. Board Member Amanda Ecoff provided information about the donation. PUBLIC COMMENT: Glen Bernard expressed his point of view with current events. Aaron Cuker expressed his support for Police Department presence at Carlsbad schools. Katie Taylor expressed her support for enforcing illegal parking in the city. CONSENT CALENDAR: Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to approve Consent Calendar Item Nos. 1 through 10. Motion carried unanimously, 5/0, with the exception of Item No. 7, 4/0/1 (Hall – Abstain) due to a conflict regarding ownership of property within the noticed area. 1. PURCHASE OF $100 MILLION OF PROPERTY INSURANCE COVERAGE THROUGH AON FOR FISCAL YEAR 2022-23 FOR AN AMOUNT NOT TO EXCEED $490,000 – Adoption of a Resolution No. 2022-144 approving the purchase of $100 million of property insurance coverage through Aon for fiscal year 2022-2023 for an amount not to exceed $490,000. PURCHASE OF EXCESS LIABILITY COVERAGE NOT TO EXCEED $43 MILLION THROUGH CALIFORNIA INSURANCE POOL AUTHORITY FOR FISCAL YEAR 2022-23 FOR AN AMOUNT NOT TO EXCEED $930,000 – Adoption of Resolution No. 2022-145 approving the purchase of excess liability coverage not to exceed $43 million through California Insurance Pool Authority for fiscal year 2022-2023 for an amount not to exceed $930,000. FOR ENGINEERING PLAN CHECK SERVICES – Adoption of Resolution No. 2022-146 approving Amendment No. 1 to the agreement with Michael Baker International, Inc. for professional engineering plan check services. AGREEMENT WITH INTERFAITH COMMUNITY SERVICES TO OPERATE AND MANAGE THE CITY OF CARLSBAD HIRING CENTER – Adoption of Resolution No. 2022-148 awarding a professional services agreement in the amount of $204,217 per year with Interfaith Community Services to operate and manage the City of Carlsbad Hiring Center located at 5731 Palmer Way. (Staff contact: Mandy Mills, Housing & Homeless Services) 6. 2022 ANNUAL WATER SHORTAGE ASSESSMENT REPORT – Adoption of Carlsbad Municipal Water District Resolution No. 1676 approving the 2022 Annual Water Shortage Assessment Report, authorizing submittal of the assessment to the California Department of Water Resources and granting authority to the Executive Manager to incorporate requested revisions, if any, made by the Carlsbad Municipal Water District Board of Directors into the report prior to submitting to the Department of Water Resources. ADVERTISE FOR BIDS FOR THE DOWNTOWN AND TERRAMAR WATER MAIN REPLACEMENT PROJECT (CIP PROJECT NO. 3904-C) – Adoption of Carlsbad Municipal Water District Board of Directors Resolution No. 1677 approving plans, specifications and contract documents and authorizing the Secretary of the Board of Directors to advertise for bids for the Downtown and Terramar Water Main Replacement Project. ADVERTISE FOR BIDS FOR THE PALOMAR AIRPORT WATERLINE REALIGNMENT PROJECT (CIP PROJECT NO. 5055) – Adoption of Carlsbad Municipal Water District Resolution No. 1678 approving plans, specifications and contract documents and authorizing the Secretary of the Board of Directors to advertise for bids for the Palomar Airport Waterline Realignment Project. AGREEMENT FOR PARKS MAINTENANCE SERVICES WORK CATEGORIES E & F TO NISSHO OF CALIFORNIA – Adoption of Resolution No. 2022-149 awarding an agreement for Parks Maintenance Services Work Category E – streetscapes, medians and parkways, and Work Category F – undeveloped parks, urban forests and trailheads/planters, to Nissho of California, in an amount not to exceed $1,152,016 per year during the initial two-year term of the agreement. LICENSE AGREEMENT WITH CABRILLO POWER I LLC (NRG) FOR USE OF THE ENCINA POWER STATION PROPERTY AS THE TEMPORARY LOCATION FOR FIRE STATION 7 – Adoption of Resolution No. 2022-150 authorizing the City Manager to execute a license agreement with Cabrillo Power I, LLC (NRG) for use of the Encina Power Station property as the temporary location for Fire Station No. 7. LEVY OF ANNUAL ASSESSMENT FOR CARLSBAD TOURISM BUSINESS IMPROVEMENT DISTRICT FOR FISCAL YEAR 2022-2023 – Adoption of Resolution No. 2022-151 confirming the Advisory Board’s report and levying an assessment for fiscal year 2022-23 for the Carlsbad Tourism Business Improvement District. (Staff contact: Matt Sanford, Administrative Services Department) City Manager’s Recommendation: Take public input, close the public hearing, and adopt the resolution. Finance Director Zach Korach presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Mayor Hall opened the duly noticed Public Hearing at 5:19 p.m. Seeing no one wishing to speak, Mayor Hall closed the duly noticed Public Hearing at 5:19 p.m. Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2022-151. Motion carried unanimously, 5/0. 12. LEVY OF ANNUAL ASSESSMENT FOR CARLSBAD GOLF LODGING BUSINESS IMPROVEMENT DISTRICT FOR FISCAL YEAR 2022-23 – Adoption of Resolution No. 2022-152 confirming the Advisory Board’s report and levying an assessment for fiscal year 2022-23 for the Carlsbad Golf Lodging Business Improvement District. Motion carried unanimously, 5/0. DEPARTMENTAL AND CITY MANAGER REPORTS: 13. CALLING THE NOV. 8, 2022, GENERAL MUNICIPAL ELECTION AND CONSIDER PLACING A MEASURE ON THE BALLOT FOR THE REFURBISHMENT OF THE MONROE STREET POOL – 1) Adoption of Resolution No. 2022-153 calling for and giving notice of the General Municipal Election to be held on Tues., Nov. 8, 2022, for the purpose of electing a Mayor, City Council Member District 1, City Council Member District 3, City Treasurer and City Clerk for terms ending in November 2026; and 2) Adoption of Resolution No. 2022-154 requesting that the San Diego County Board of Supervisors consolidate the city’s General Municipal Election with the statewide election to be held on Nov. 8, 2022; and 3) Adoption of Resolution No. 2022-155 approving regulations for candidates for elective office pertaining to candidates’ statements submitted to the voters at the General Municipal Election to be held in the City of Carlsbad on Tues., Nov. 8, 2022; and 4) Adoption of Resolution No. 2022-156 calling a Municipal Election to submit a ballot measure to the voters to approve expending more than $1 million for the Monroe Street Pool renovation/replacement project, specifically “Do the voters of the City of Carlsbad approve spending existing city funds from various sources, including the General Fund, in an amount to exceed $1 million for the Monroe Street Pool Renovation/Replacement Project located at 3401 Monroe Street for an estimated cost of $22 million - $24 million?”, requesting consolidation services from the San Diego County Board of Supervisors, directing the preparation of an impartial analysis, and establishing procedures for ballot arguments and rebuttals. Legislative and Constituent Services Director Sheila Cobian and Parks and Recreation Director Kyle Lancaster presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). June 21, 2022 Carlsbad City Council Regular Meeting Page 5 In response to an inquiry from Council Member Bhat-Patel, City Manager Chadwick explained that the initial estimate does not include design work and including the escalator phrase in the ballot measure would allow staff flexibility with pricing changes associated with inflation. In response to an inquiry from Council Member Acosta, Assistant City Attorney McMahon explained that the language in the escalator phrase was drafted in response to inquiries staff received regarding current inflation rates. Finance Director Korach added that the reason for adding the additional language was to provide transparency to the voters. In response to an inquiry from Council Member Norby, Parks and Recreation Director Lancaster explained that the price estimate was completed in April of 2022. In response to an inquiry from Council Member Norby, Deputy City Manager Public Works Paz Gomez explained that the Engineering News Record has two regions in California and Los Angeles is the closest region to Carlsbad. In response to an inquiry from Mayor Pro Tem Blackburn, Parks and Recreation Director Lancaster explained that the estimated cost includes approximately a 15% contingency. He added that the estimate was originally developed by the engineering consultant on conceptual designs prior to the Jan. 26, 2021, staff report provided to the City Council on this topic. In response to any inquiry from Mayor Hall, Parks and Recreation Director Lancaster explained that staff will return to the City Council at a minimum of two additional times to request further direction on this project if the ballot measure passes. He added that the projected completion date for the project is in 2026. Motion by Council Member Bhat-Patel, seconded by Council Member Acosta, to adopt Resolution No. 2022-156, amending the ballot question language to read as follows: “Do the voters of the City of Carlsbad approve spending existing city funds from various sources, including the General Fund, in an amount to exceed $1 million for the Monroe Street Pool Renovation/Replacement project located at 3401 Monroe Street for an estimated cost range of $22 million up to $24 million, adjusted annually by the percentage increase in the regional construction cost index?” and amending the ballot measure text language to read as follows: “The city is approved to expend more than $1 million dollars and up to $24 million in city funds, adjusted annually by the percentage increase in the regional construction cost index, for the Monroe Street Pool Renovation/Replacement Project.”– 3/2 (Hall, Blackburn – No). Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2022-153, Resolution No. 2022-154 and Resolution No. 2022-155 – 4/1 (Hall – No). 14. MAYORAL APPOINTMENT OF ONE MEMBER TO THE LIBRARY BOARD OF TRUSTEES – Adoption of Resolution No. 2022-157 appointing one member to the Library Board of Trustees. Laurel Moran introduced herself to the City Council and spoke regarding her qualifications. Motion by Mayor Hall, seconded by Mayor Pro Tem Blackburn, to adopt Resolution No. 2022- 157 appointing Michael Laurel Moran to the Library Board of Trustees. Motion carried unanimously, 5/0. 15. MAYORAL APPOINTMENT OF TWO MEMBERS TO THE BEACH PRESERVATION COMMISSION – 1) Adoption of Resolution 2022-158 appointing one member to the Beach Preservation Commission; and 2) Adoption of Resolution No. 2022-159 appointing one member to the Beach Preservation Commission. Motion by Mayor Hall, seconded by Mayor Pro Tem Blackburn, to adopt Resolution No. 2022- 158 appointing Michael Corrigan to the Beach Preservation Commission. Motion carried unanimously, 5/0. Motion by Mayor Hall, seconded by Mayor Pro Tem Blackburn, to adopt Resolution No. 2022- 159 appointing Kevin Shotas to the Beach Preservation Commission. Motion carried unanimously, 5/0.
