The house has a maximum height of 26 feet 4 inches. The proposed residence takes on a European Beach Cottage feel with the use of six inch hardi- siding, windows with trim, a bay window on the west (front) elevation, an 8:12 roof pitch, and second-floor balconies supported by decorative wood posts and brackets. The two-car garage is not visible from Carlsbad Boulevard and is accessed from a drive that runs along the southern side of the lot. Proposed Grading: Cut: 0 CY Fill: 100 CY Import: 100 CY IV. ANALYSIS The proposed project is subject to the following ordinances, standards, and policies: A. Residential Low-Medium Density (RLM) General Plan Land Use designation; B. One-Family Residential Zone (R-1, CMC Chapter 21.10); C. Coastal Development Regulations for the Mello II Segment of the Local Coastal Program (CMC Chapter 21.201) and the Coastal Resource Protection Overlay Zone (CMC Chapter 21.203) D. Inclusionary Housing Ordinance (CMC Chapter 21.85); and E. Growth Management (CMC Chapter 21.90). The recommendation for approval of this project was developed by analyzing the project’s consistency with the applicable regulations and policies. The project’s compliance with each of the above regulations and policies is discussed in the sections below. A. General Plan The project site has a General Plan Land Use designation of RLM (Residential Low-Medium Density). The RLM Land Use designation allow for the development of single-family residences at a density of 0-4 units per acre with a Growth Management Control Point (GMCP) of 3.2 dwelling units per acre. The project’s density (6.25 du/ac) is above the range of 0-4 units per acre and 3.05 units above the GMCP. At the RLM GMCP, .51 dwelling units would be permitted on this 0.16 acre property. However, one single-family dwelling unit is guaranteed pursuant to the following General Plan Land Use provision: “Notwithstanding the density provisions and intent of each residential land use designation, a one-family dwelling shall be permitted on any legal lot that existed as of October 28, 2004.” The subject lot was legally created prior to October 28, 2004; therefore, development of a one-family dwelling is consistent with the RLM General Plan Land Use designation. CDP 13-01 – RAUSCH RESIDENCE May 1, 2013 PAGE 3 B. One-Family Residential Zone (R-1 CMC Chapter 21.10) The zoning designation for the property is One-Family Residential (R-1). The proposed project meets or exceeds all applicable requirements of the R-1 zone as demonstrated in Table A below. Mello II Segment of the Local Coastal Program (CMC Chapter 21.201) and the Coastal Resource Protection Overlay Zone (CMC Chapter 21.03) The project site is located within the Mello II Segment of the Local Coastal Program (LCP). The site is also located within and subject to the Coastal Resource Protection Overlay Zone (CMC Chapter 21.203). The project’s compliance with each of these programs and ordinances is discussed below: 1. Mello II Segment of the Local Coastal Program The project consists of the construction of a new 3,063 square foot single-family residence on a lot designated as Residential, Low-Medium Density (RLM), by the Mello II Land Use designation. The proposed two-story home will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive resources located on the property. In addition, the proposed single-family residence is not located in an area of known geologic instability or flood hazards. Since the site does not have frontage along the coastline, no public opportunities for coastal shoreline access are available from the subject site. Further, the residentially-designated site is not suited for water-oriented recreation activities. 2. Coastal Resource Protection Overlay Zone The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (CMC Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the City’s Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water Mitigation Plan (SUSMP) and Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased urban run-off, pollutants and soil erosion. No development is proposed in areas of steep slopes (> 25% gradient) and no native vegetation is located on the subject property. In addition, the site is not located in an area prone to landslides, or susceptible to accelerated erosion, floods or liquefaction. CDP 13-01 – RAUSCH RESIDENCE May 1, 2013 PAGE 4 D. Inclusionary Housing Ordinance Pursuant to CMC Chapter 21.85.030 (D.3), a project may be exempt from the inclusionary housing requirement if the construction of a new residential structure replaces a residential structure that was demolished within two years prior to the application for a building permit for the new residential structure, provided that the number of residential units is not increased from the number of residential units of the previously demolished residential structure. Since there will not be an increase in the number of units on the property, the project will be exempt from the inclusionary housing requirement if building permits are issued within two years. E. Growth Management The proposed project is located within Local Facilities Management Zone 3 in the northwest quadrant of the city. However, there will be no impact to public facilities because the new single- family residence will be replacing an existing single-family residence that will be demolished. V. ENVIRONMENTAL REVIEW The project qualifies as a CEQA Guidelines Section 15332 (In-Fill Development Projects) Class 32 Categorical Exemption. The project is consistent with the General Plan as well as with the Zoning Ordinance, the project site is within the city limits, is less than 5 acres in size, and is surrounded by urban uses; there is no evidence that the site has value as habitat for endangered, rare, or threatened species; approval of the project will not result in significant effects relating to traffic, noise, air quality, or water quality; and the site can be adequately served by all required utilities and public services. The project is exempt from further environmental documentation pursuant to Section 15332 of the State CEQA guidelines.
