AGENDA OF: August 17, 2022 Project Planner: Esteban Danna Project Engineer: Emad Elias SUBJECT: CDP 2021-0021 (DEV2021-0082) – CAMPBELL RESIDENCE - Request for approval of a Coastal Development Permit to allow for the addition and remodel of an existing single- family residence within the West Batiquitos/Sammis Properties Segment of the city’s Local Coastal Program located at 501 Stern Way within Local Facilities Management Zone 9. The project site is within the appealable area of the California Coastal Commission. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15301(e) for additions to a single-family residence of the state CEQA Guidelines. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 7462 APPROVING Coastal Development Permit CDP 2021-0021 based upon the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: The 0.21-acre (9,333 square feet) project site is located at 501 Stern Way as shown on the attached location map. The topography of the site is generally flat with an approximate 40% slope at the rear yard setback (southernmost portion of the lot). The property is developed with an existing single-family residence. Table “A” below includes the General Plan designations, zoning and current land uses of the project site and surrounding properties. The project consists of the construction of a 751-square- 4 0 CDP 2021-0021 (DEV2021-0082) – CAMPBELL RESIDENCE August 17, 2022 Page 2 foot interior addition to the main residence, a 152-square-foot addition to the existing two-car garage and a new 344-square-foot second-floor deck. The existing structure is a two-story, 3,717-square-foot single- family residence with an attached two-car, 418 square-foot garage and a 246-square-foot second-story deck. The proposed single-family home will total 4,468 square feet after construction. The remodeled residence will continue to be two stories with 4:12 pitched roof elements. The maximum height of the residence is not proposed to change and will remain at 27’-4”. The architectural design of the proposed residence is contemporary and typical of southern California coastal communities. Building materials used for the exterior are a combination of stucco, wood siding, stone veneer, and a concrete tile roof. Proposed Grading: The project does not propose grading. A grading permit will not be required for this project. III. ANALYSIS The project is subject to the following regulations and requirements: A. R-8 Residential General Plan Designation; B. Master Plan MP 175(G) – Poinsettia Shores Master Plan and Planned Community (P-C) Residential Zone; C. Coastal Development Regulations for the West Batiquitos/Sammis Properties Segment of the Local Coastal Program (CMC Chapter 21.201) and the Costal Resource Protection Overlay Zone (CMC Chapter 21.203).; D. Growth Management (CMC Chapter 21.90). The recommendation for approval of this project was developed by analyzing the project’s consistency with the applicable city regulations and policies. The project’s compliance with each of the above regulations is discussed in detail in the sections below. A. R-8 Residential General Plan Land Use Designation The project site has a General Plan Land Use designation of R-8 Residential which allows for the development of single-family residences at a density of 4-8 dwelling units per acre (du/ac) with a Growth Management Control Point (GMCP) of 6 du/ac. The project proposes an addition and remodel to an existing residence. Per Land Use Element Policy 2-P.7 one single-family dwelling is permitted to be constructed on a legal lot that existed as of October 28, 2004. The subject lot was legally created on July 31, 1998. Therefore, the existing single-family residence is consistent with the Elements of the city’s General Plan. B. Master Plan MP 175(G) – Poinsettia Shores Master Plan and Planned Community (P-C) Residential Zone The subject property is located within the Planned Community (P-C) Residential Zone zoning district. Development standards for the subject property are governed by the Poinsettia Shores Master Plan (MP 175(G)). The subject property is located within the Planning Area A-4 of the master plan and the project’s compliance with the development standards specific to the Planning Area A-4, as well as the area-wide standards within MP 175(G), are provided in Table B below. The proposed project meets or exceeds all applicable requirements of the P-C zone and MP 175(G). Coastal Development Regulations for the West Batiquitos/Sammis Properties Segment of the Local Coastal Program (CMC Chapter 21.201) and the Costal Resource Protection Overlay Zone (CMC Chapter 21.203). The project site is located within the West Batiquitos/Sammis Properties Segment of the Local Coastal Program and is in the appeal jurisdiction. The site is also located within and subject to the Costal Resource Protection Overlay Zone. The project’s compliance with each of these programs and ordinances is discussed below: 1. West Batiquitos/Sammis Properties Segment of the Certified Local Coastal Program and all applicable policies. The subject site has an LCP Land Use Plan designation of R-8 Residential, which allows for a density of 4-8 du/acre and 6 du/acre at the Growth Management Control Point (GMCP). The project density of 4.76 du/ac is consistent with the R-8 General Plan Land Use designation as discussed in Section A above. Therefore, the project is consistent with the West Batiquitos/Sammis Properties Segment of the LCP. The project consists of an addition and remodel of an existing single-family residence and attached garage. The two-story structure is compatible with the surrounding development of one and two-story single- family structures. The larger remodeled residence and garage will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the previously developed site, nor are there any sensitive resources located on the site. The residence is not located in an area of known geologic instability or flood hazard. Since the site does not have frontage along the coastline, no public opportunities for coastal shoreline access are available from the subject site. Public opportunities for coastal shoreline access are available via the public trail along Batiquitos Lagoon located between the lagoon shore and the subject site. Furthermore, the residentially designated site is not suited for water-oriented recreation activities. 2. Coastal Resource Protection Overlay Zone The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (CMC Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the city’s Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, BMP Design Manual and Jurisdictional Runoff Management Program (JRMP) to avoid increased urban run-off, pollutants and soil erosion. No development is proposed in areas of steep slopes (equal to or greater than 25% gradient) and none of the native vegetation located on the subject property will be disturbed. In addition, the site is not located in an area prone to landslides, or susceptible to accelerated erosion, floods or liquefaction. Growth Management (CMC Chapter 21.90) The proposed project is located within Local Facilities Management Zone 9 in the northwest quadrant of the city. There will be no impact to public facilities because the project will not increase the number of units on the property. IV. ENVIRONMENTAL REVIEW The California Environmental Quality Act (“CEQA”), and its implementing regulations (“CEQA Guidelines”) adopted by the Secretary of the California Natural Resources Agency, list classes of projects that have been determined not to have a significant effect on the environment and as a result are exempt from further environmental review under CEQA. City staff completed a review of the project and potential environmental impacts associated with the project pursuant to CEQA and concluded that the project qualified for an exemption pursuant to CEQA Guidelines section 15301(e) (Existing Facilities), which includes additions to existing structures. A notice of intended decision regarding the environmental determination was advertised on July 18, 2022 and posted on the city’s website. The notice included a general description of the project, the proposed environmental findings, and a general explanation of the matter to be considered. The findings and determination contained in that notice was declared as final on the date of the noticed decision, unless appealed as provided by the procedures commencing in Chapter 21.54 (Procedures, Hearings, Notices, and Fees) of the Zoning Ordinance. During the 10-day public review period, the city received no comment letters from the public regarding the prospective environmental determination. Since no appeal was filed and no substantial evidence was submitted that would support a finding that the exemption requirements would not be satisfied, the project was determined by the city planner to not have a significant effect on the environment. The CEQA Determination letter is attached to this staff report as Exhibit 4 and demonstrates that the project is categorically exempt from further environmental review. The city planner’s written decision is final and the CEQA determination is not within the Planning Commission’s purview. With the appropriate environmental clearances in place, all of the city’s procedural requirements and relevant aspects of CEQA have been satisfied. In making this determination, the City Planner has found that none of the exceptions listed in Section 15300.2 of the CEQA Guidelines and CMC Chapter 19.04 apply to this project. EXHIBITS: 1. The remodeling plans were later expanded to a massive two story footprint expansion bringing the structure farther out to the street, making it wider, and raising the roofline higher than the blueprints of the original builder. Not only contrary to the architecture of the neighborhood, but also eclipsing a good portion of several neighbors ocean view. We were informed originally, that would not, and could not happen. Prior to purchase we were told by the homeowners representatives, as well as the sales office representatives, that no homeowner would be able to alter the front elevation, in the future, from the blue print of the original builder. On behalf of several impacted neighbors, I respectfully request that this project will not be approved by the Architectural Board.
