ANNOUNCEMENT OF CONCURRENT MEETINGS: None. INVOCATION: None. PLEDGE OF ALLEGIANCE: Mayor Pro Tem Blackburn led the Pledge of Allegiance. APPROVAL OF MINUTES: None. PUBLIC COMMENT: Mike Borrello expressed his concerns regarding election machine certification. Glenn Bernard spoke regarding Juneteenth. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: None. CONSENT CALENDAR: Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to approve Consent Calendar Item Nos. 1 through 6. Motion carried unanimously, 5/0. 1. ADVERTISE FOR BIDS FOR THE TEMPORARY FIRE STATION 7 CONSTRUCTION PROJECT (CIP PROJECT NO. 4091) – Adoption of Resolution No. 2022-188 authorizing the City Manager, or designee, to execute all documents required to purchase, register and transfer title for two modular residential buildings to the City of Carlsbad, and approving the plans, specifications and contract documents, and authorizing the City Clerk to advertise for bids for construction of a temporary garage for the Temporary Fire Station 7 Project. AGREEMENT WITH DAY WIRELESS SYSTEMS FOR COMMUNICATIONS EQUIPMENT AND INSTALLATION SERVICES FOR IN-CAR VIDEO SYSTEM – Adoption of Resolution No. 2022-189 authorizing the City Manager to execute an agreement for police in-car video equipment purchase and implementation services from Day Wireless Systems in an amount not to exceed $282,232. PURCHASE OF EXCESS WORKERS’ COMPENSATION COVERAGE FOR POLICY YEAR 2022-2023 Adoption of Resolution No. 2022-190 approving the purchase of excess workers’ compensation coverage through Safety National Casualty Corporation for Fiscal Year 2022- 2023 in an amount of $271,000. PARTICIPATION IN FELLOWSHIP PROGRAMS – Adoption of Resolution No. 2022-191 establishing authority to participate in fellowship programs and giving authority to City Manager or designee to execute related agreements. AMENDMENT AND RESTATEMENT OF THE 401(A) GOVERNMENTAL MONEY PURCHASE PLAN FOR THE CHIEF OPERATIONS OFFICER POSITION – Adoption of Resolution No. 2022-192 authorizing the City Manager or designee to execute an amendment and restatement of the 401(a) Governmental Money Purchase Plan for the Chief Operations Officer position and to execute the necessary documents to terminate the plan once it has been amended and restated. (Staff contact: Lori Shonley and Sandra Smith, Administrative Services Department) Glenn Bernard expressed his concerns regarding management positions in local government. 6. CITY ATTORNEY EMPLOYMENT AGREEMENT – Adoption of Resolution No. 2022-193 approving the City Attorney Employment Agreement between the City of Carlsbad and Cindie K. McMahon, and making corresponding amendments to the appointed officials salary schedule. (Staff contact: Judy von Kalinowski, Administrative Services Department) PRESENTATIONS: Proclamation in recognition of the retirement of City Attorney Celia Brewer Mayor Hall read the proclamation and presented it to Ms. Brewer. The Council Members all expressed their thanks and appreciation. Ms. Brewer said a few words and thanked everyone. City Manager Chadwick declared a recess at 5:25 p.m. Mayor Hall reconvened the meeting at 5:30 p.m. Oath of Office for New City Attorney Cindie McMahon City Clerk Services Manager Faviola Medina gave the Oath of Office to City Attorney McMahon. City Attorney McMahon thanked everyone and said a few words. ORDINANCES FOR INTRODUCTION: 7. REVISIONS TO THE MANAGEMENT COMPENSATION AND BENEFITS PLAN – 1) Adoption of Resolution No. 2022-194 approving revisions to the Management Compensation and Benefits Plan; and 2) Introduction of Ordinance No. CS-429 amending Carlsbad Municipal Code Chapter 2.04 by adding section 2.04.025 regarding benefits for elected officials. (Staff contact: Debbie Porter and Judy von Kalinowski, Administrative Services Department) City Manager’s Recommendation: Adopt the resolution and introduce the ordinance. City Attorney Cindie McMahon, Human Resources Director Judy von Kalinowski and Senior Management Analyst Debbie Porter reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2022-194 and introduce Ordinance No. CS-429. Motion carried, 5/0. ORDINANCES FOR ADOPTION: None. PUBLIC HEARING: 8. 2022 HAZARD REDUCTION COST REPORT – Adoption of Resolution No. 2022-195 accepting the 2022 Hazard Reduction Cost Report and directing the City Clerk to file a certified copy of the resolution and report with the San Diego County Auditor. (Staff contact: Randy Metz, Fire) City Manager’s Recommendation: Take public input, close the public hearing, and adopt the resolution. The City Council received the report. Council Member Norby left the dais at 5:40 p.m. Mayor Hall opened the duly noticed public hearing at 5:40 p.m. Hearing no one wishing to speak, Mayor Hall closed the duly noticed public hearing at 5:41 p.m. Council Member Norby returned to the dais at 5:41 p.m. Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2022-195. Motion carried, 5/0. 9. FINAL VETERANS MEMORIAL PARK MASTER PLAN – PARKS PERFORMANCE STANDARD – Adoption of Resolution No. 2022-196 adopting the final Veterans Memorial Park Master Plan and making a finding of compliance with the Growth Management Plan/Citywide Facilities and Improvements Plan Parks Performance Standard, and adopting the related California Environmental Quality Act findings. (Staff contact: Kyle Lancaster, Parks & Recreation) City Manager’s Recommendation: Take public input, close the public hearing, and adopt the resolution. Parks & Recreation Director Kyle Lancaster reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Mayor Hall opened the duly noticed public hearing at 5:58 p.m. Michael McMahon expressed his concern regarding vehicle miles traveled and greenhouse gas impact of the project. Diane Nygaard expressed her concern around greenhouse gas impacts from the project. July 26, 2022 Carlsbad City Council Regular Meeting Page 4 Trails Coordinator of the San Diego Mountain Biking Association Ben Stone expressed his approval of the project. Executive Director of the San Diego Mountain Biking Association Susie Murphy appreciated the prior public input meetings and expressed her approval of the project. Representing the League of Fathers William Allen spoke regarding the Back to School Book Bag event and suggested it be held at Veterans Park in the future. Hearing no one wishing to speak, Mayor Hall closed the duly noticed public hearing at 6:09 p.m. In response to Council Member Bhat-Patel’s inquiry, City Planner Eric Lardy explained the study performed around vehicle miles traveled. Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2022-196. Motion carried unanimously, 5/0. Mayor Hall declared a recess at 6:27 p.m. Mayor Hall readjourned the meeting at 6:31 p.m. DEPARTMENTAL AND CITY MANAGER REPORTS: 10. FINAL DESIGN CONCEPT FOR THE PERMANENT PUBLIC ART AT FIRE STATION 2 (CIP PROJECT NO. 4060) – Adoption of Resolution No. 2022-197 approving the final design concept by artist Mary Carter Taub for permanent public art at Fire Station 2, Capital Improvement Program Project No. 4060. (Staff contact: Richard Schultz and Tonya Rodzach, Library & Cultural Arts) City Manager’s Recommendation: Adopt the resolution. Library & Cultural Arts Director Suzanne Smithson and Cultural Arts Manager Richard Schultz reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2022-197. Motion carried unanimously, 5/0. 11. STATUS OF NEGOTIATIONS TO RELOCATE SAN DIEGO GAS & ELECTRIC’S NORTH COAST SERVICE CENTER TO THE CITY-OWNED PARKING LOT PROPERTIES AT THE SHOPPES AT CARLSBAD SHOPPING CENTER – Receive a status update from San Diego Gas & Electric representatives and provide direction on negotiations to relocate SDG&E’s North Coast Service Center to the city-owned parking lot properties at The Shoppes at Carlsbad shopping center. (Staff contact: Gary Barberio, Community Services and Celia Brewer, City Attorney’s Department) City Manager’s Recommendation: Receive the update. Council Member Norby left the dais at 6:52 p.m. due to a potential conflict of interest. July 26, 2022 Carlsbad City Council Regular Meeting Page 5 Deputy City Manager of Community Services Gary Barberio reviewed a PowerPoint presentation (on file in the Office of the City Clerk). SDG&E’s Public Affairs Manager for the North County Coastal Communities Joe Gabaldon gave a brief presentation. In response to Mayor Pro Tem Blackburn’s inquiry, SDG&E’s Public Affairs Manager Gabaldon explained that SDG&E has three sites in mind to propose for the relocation of the service center. In response to Council Member Bhat-Patel’s inquiry, City Manager Chadwick explained that a future meeting at the 10 week mark would be Sept. 27, 2022. Council Member Bhat-Patel requested the meeting be held at an earlier date if possible. In response to Council Member Acosta’s inquiry, Deputy City Manager Barberio explained that the city has been working with SDG&E since 2014 to find a location for the service center. In response to Council Member Acosta’s inquiry, SDG&E Real Estate Portfolio Manager Adam Smith explained that parcel 11 has not been dismissed, but has challenging environmental issues and that in 2019 three alternative locations had been submitted. Mr. Smith also explained that a large amount of work has already been done and that the process would not be starting from the beginning. In response to Council Member Acosta’s inquiry, NRG Vice President of Asset Management Eric Leuze explained that discussions are moving ahead to find a solution that works for all three parties and the community. Diane Nygaard spoke regarding the potential use of the property if not used for the SDG&E service center relocation. Minute Motion by Council Member Bhat-Patel, seconded by Council Member Acosta to return to the Sept. 27, 2022 meeting with a progress report and term sheet and identify a suitable relocation site. Mayor Hall requested that the primary focus be on Lot 11. Mayor Pro Tem Blackburn requested to also hear about other locations as well. Amended Minute Motion by Council Member Bhat-Patel, seconded by Council Member Acosta, to have SDG&E representatives return at the Regular City Council Meeting of Oct. 11, 2022, with a progress report, term sheet and identify a suitable relocation site with emphasis on the Lot 11 site. Motion carried, 4/0/1 (Norby – Absent). Council Member Norby returned to the dais at 7:47 p.m. 12. SEMIANNUAL TRANSPORTATION REPORT AND OPTIONS TO REPRIORITIZE THE SUSTAINABLE MOBILITY PLAN IMPLEMENTATION PROGRAM – 1) Receive the Semiannual Transportation Report; and 2) Adoption of Resolution No. 2022-198 reprioritizing implementation of the Sustainable July 26, 2022 Carlsbad City Council Regular Meeting Page 6 Mobility Plan Program in the Capital Improvement Program. (Staff contact: Tom Frank, Public Works) City Manager’s Recommendation: Receive the report and adopt the resolution. Transportation Director Tom Frank reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Commissioner Coelho spoke on behalf of the Traffic & Mobility Commission and highlighted several upcoming projects that the commission is working on. Diane Nygaard expressed her concern regarding greenhouse gases and requested that a fee program be implemented to address all forms of transportation. In response to Mayor Hall’s inquiry, Transportation Director Frank explained that the North County Multi-Modal Corridor Plan covers the coastline along the 78 corridor towards Escondido and the city is very involved in these meetings. Transportation Director Frank added that instead of adding HOV lanes, the concentration will be on adding a major rail project. Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2022-198. Motion carried unanimously, 5/0. City Council received the report. 13. APPOINTMENT OF ONE MEMBER TO THE CARLSBAD GOLF LODGING BUSINESS IMPROVEMENT DISTRICT ADVISORY BOARD AND THE CARLSBAD TOURISM BUSINESS IMPROVEMENT DISTRICT ADVISORY BOARD – 1) Adoption of Resolution No. 2022-199 appointing one member to the Carlsbad Golf Lodging Business Improvement District Advisory Board; and 2) Adoption of Resolution No. 2022-200 appointing one member to the Carlsbad Tourism Business Improvement District Advisory Board. (Staff contact: Faviola Medina, City Clerk’s Department) City Manager’s Recommendation: Adopt the resolutions. Motion by Mayor Hall, seconded by Mayor Pro Tem Blackburn, to adopt Resolution No. 2022- 199, appointing Scott Mason to the Carlsbad Golf Lodging Business Improvement District Advisory Board. Motion carried unanimously, 5/0. Motion by Mayor Hall, Seconded by Mayor Pro Tem Blackburn, to adopt Resolution No. 2022- 200 appointing Scott Mason to the Carlsbad Tourism Business Improvement District Advisory Board.
