ANNOUNCEMENT OF CONCURRENT MEETINGS: Mayor Hall announced that the City Council is serving as the Carlsbad Municipal Water District Board of Directors on Consent Calendar Item No. 3. PLEDGE OF ALLEGIANCE: Mayor Pro Tem Blackburn led the Pledge of Allegiance. INVOCATION: None. PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: City Attorney Cindie McMahon announced that there was no reportable action. In response to the comments being made, City Manager Scott Chadwick provided an update on the city’s current priorities regarding traffic safety. Mayor Hall declared a recess at 5:36 p.m. Mayor Hall reconvened the meeting at 5:43 p.m. CONSENT CALENDAR: Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to approve Consent Calendar Item Nos. 1 through 7. Motion carried unanimously, 5/0. 1. REPORT ON CITY INVESTMENTS AS OF JUNE 30, 2022 – Accept and file Report on City Investments as of June 30, 2022. (Staff contact: Craig Lindholm and Laura Rocha, Administrative Services Department) 2. SIDE LETTER WITH CARLSBAD CITY EMPLOYEES’ ASSOCIATION AND CARLSBAD FIREFIGHTERS’ ASSOCIATION, INC. AMENDING THE FLEXIBLE BENEFITS PROGRAM – Adoption of Resolution No. 2022-201 approving side letter agreements with the Carlsbad City Employees’ Association and Carlsbad Firefighters’ Association, Inc. and approving revisions to the Emergency Medical Technician Employment, Compensation and Benefits Plan. AUTHORIZATION FOR USE OF ADDITIONAL SAN DIEGO COUNTY WATER AUTHORITY REFUNDS – Adoption of a Carlsbad Municipal Water District Board of Directors Resolution No. 1681 authorizing use of two additional refunds from the San Diego County Water Authority to offset the rates the Carlsbad Municipal Water District pays the San Diego Water Authority for water supply. SUBMITTAL OF A REQUEST TO THE CALIFORNIA DEPARTMENT OF TRANSPORTATION TO CHANGE THE FUNCTIONAL CLASSIFICATION OF A PORTION OF PARK DRIVE – Adoption of Resolution No. 2022-202 approving the submission of a request to the California Department of Transportation to change the functional classification of Park Drive between Monroe Street and Hillside Drive and authorizing the City Manager or designee to submit the request. AMENDMENT TO THE RETAIL LEASE AGREEMENT WITH HOUSE MARTEL, LLC FOR THE CHAPTERS CAFÉ AT THE CARLSBAD CITY LIBRARY – Adoption of Resolution No. 2022-203 approving the fourth amendment to the retail lease agreement with House Martel, LLC to modify base rent and percentage rent obligations and to continue to defer payment of deferred rent until April 29, 2024 for the Chapters Café at the Carlsbad City Library on Dove Lane and authorizing the City Manager to execute the amendment for the Chapters Café located at the Carlsbad City Library at 1775 Dove Lane. AMENDMENT NO. 1 TO CLEAN ENERGY ALLIANCE JOINT POWERS AGREEMENT – Adoption of Resolution No. 2022-204 approving and authorizing the execution of the amended and restated Amendment No. 1 to the Clean Energy Alliance Joint Powers Agreement. (Staff contact: Jason Haber, City Manager’s Department) Council Member Acosta expressed her support for Clean Energy Alliance and the success and growth that the JPA has experienced. 7. DESIGNATION OF VOTING DELEGATE AND ALTERNATE FOR THE LEAGUE OF CALIFORNIA CITIES ANNUAL CONFERENCE – Adoption of Resolution No. 2022-205 designating City Council Member Teresa Acosta the Voting Delegate and City Council Member Priya Bhat-Patel the Alternate Voting Delegate for the League of California Cities Annual Conference to be held in Long Beach on September 7-9, 2022. (Staff contact: Faviola Medina, City Clerk’s Department) ORDINANCES FOR INTRODUCTION: None. ORDINANCES FOR ADOPTION: 8. ORDINANCE NO. CS-429 – BENEFITS FOR ELECTED OFFICIALS – Adoption of Ordinance No. CS- 429 amending Carlsbad Municipal Code Chapter 2.04 by adding section 2.04.025 regarding benefits for elected officials. (Staff contact: Ana Alarcon, City Clerk’s Department) City Manager’s Recommendation: Adopt Ordinance No. CS-429. City Attorney McMahon titled the ordinance. STATUS UPDATE PRESENTATION ON A NEW CITY HALL/CIVIC CENTER – Receive a status update on the city’s efforts to plan and develop a new City Hall/Civic Center and provide direction to staff as appropriate. (Staff contact: Gary Barberio and Curtis Jackson, Community Services Department) City Manager’s Recommendation: Receive the update and provide direction to staff. Deputy City Manager Community Services Gary Barberio and Real Estate Manager Curtis Jackson presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Gary Nessim expressed his support for a Civic Center at the current City Hall site. Robert Wilkinson expressed his support for a Civic Center at the current City Hall site. Don Christiansen expressed his support for a Civic Center at the current City Hall site. In response to an inquiry from Council Member Norby, Real Estate Manager Jackson confirmed that construction costs are continuing to rise, and the value of city owned assets are not growing at the same rate. Deputy City Manager Community Services Barberio added that both the increasing cost of construction and the difference of price per square foot is responsible for the increase in construction cost estimate. In response to an inquiry from Council Member Norby, City Manager Chadwick explained that Emergency Operations Center (EOC) is currently located at the Police and Fire Safety Center and that future plans include a reconfiguration of the EOC at that location. In response to an inquiry from Council Member Norby, Real Estate Manager Jackson acknowledged that having a vacant commercial building is not the best use of the asset and while it is not being occupied, it is also not on the tax roll. In response to an inquiry from Council Member Acosta, Deputy City Manager Community Services Barberio explained that two surveys were conducted for feedback from the community regarding the City Hall/Civic Center project. Community Engagement Director Kristina Ray added that the data is not scientific, and the results showed a split in responses for the desired location between the current City Hall location and the Farmers Building location. In response to an inquiry from Council Member Acosta, City Manager Chadwick explained that 43% of respondents from the latest survey were from the 92008 zip code. August 16, 2022 Carlsbad City Council Regular Meeting Page 5 In response to an inquiry from Council Member Acosta, Deputy City Manager Community Services Barberio explained there are not any public transportation options in close proximity to the Faraday Administration Center. In response to an inquiry from Council Member Acosta, Deputy City Manager Community Services Barberio explained that a majority of the daily operations at each of the existing facilities would remain the same under the new hybrid option. In response to an inquiry from Council Member Acosta, Deputy City Manager Community Services Barberio explained that staff’s recommendation does not include details of the remodel of Cole Library. Real Estate Manager Jackson added that the $50-60 million budget estimate for the new City Hall does not include any work at the Faraday Administration Center. In response to an inquiry from Council Member Bhat-Patel, Deputy City Manager Community Services Barberio explained that if the Farmers Administration Center is not selected as the City Hall site, it will need to be sold and the revenue gained will be put back into Community Facility District (CFD) No. 1. In response to an inquiry from Council Member Bhat-Patel, Deputy City Manager Community Services Barberio explained that the configuration of the Faraday Administration Center and current parking situation does not allow for much room to consider the addition of any community spaces at that site. In response to an inquiry from Council Member Bhat-Patel, Deputy City Manager Community Services Barberio explained that the hybrid option being presented was not included in the community survey. Community Engagement Director Ray added that the survey participants were notified that this hybrid option would be discussed at this City Council meeting and that there would be an opportunity for input. In response to an inquiry from Mayor Pro Tem Blackburn, Deputy City Manager Community Services Barberio explained that if the Farmers Building is not selected as the new City Hall location, it is estimated to sell for approximately $40 million. In response to an inquiry from Mayor Pro Tem Blackburn, Real Estate Manager Jason explained that in 2017, the Faraday Administration Center was estimated to sell for approximately $4-6.7 million, and today they would estimate it would sell for approximately $9-11.7 million. In response to an inquiry from Mayor Pro Tem Blackburn, Real Estate Manager Jason explained that there are potential revenue opportunities with the current City Hall location since it was not purchased with CFD funds, there are no restrictions on revenue opportunities. Deputy City Manager Community Services Barberio added that the same applies to the Faraday Administration Center. August 16, 2022 Carlsbad City Council Regular Meeting Page 6 In response to an inquiry from Mayor Hall, Real Estate Manager Jason explained that in 2017, the estimated cost to renovate the Farmers Building was approximately between $12-14 million and demolition of the building was estimated around $2 million. Council received the update. Motion by Council Member Bhat-Patel, seconded by Mayor Pro Tem Blackburn to approve staff’s three recommendations as follows: • Eliminate the Faraday Administration Center site, • Pursue 5th hybrid site option (existing City Hall/Faraday Administration Center), and • Pursue the sale of the Farmers Property in a fiduciarily responsible timeframe. Motion carried unanimously, 5/0. 10. TRAFFIC AND MOBILITY COMMISSION WORK PLAN FOR FISCAL YEAR 2022-23 – Adopt Resolution No. 2022-206 approving the Traffic and Mobility Commission Work Plan for fiscal year 2022-23. (Staff contact: Nathan Schmidt, Public Works) City Manager’s Recommendation: Adopt a resolution. Traffic and Mobility Manager Nathan Schmidt and Traffic and Mobility Commission Chair Brandon Perez presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt Resolution No. 2022-206. Motion carried unanimously, 5/0. Mayor Hall declared a recess at 7:35 p.m. Mayor Hall reconvened the meeting at 7:40 p.m. 11. UPDATE ON CRIME STATISTICS AND POLICE DEPARTMENT’S RESPONSE TO CRIME TRENDS – Receive an update from the Police Department regarding crime statistics, crime trends and enforcement strategies. (Staff contact: Cindy Anderson, Police Department) City Manager’s Recommendation: Receive the update. Police Chief Mickey Williams and Senior Management Analyst Cindy Anderson presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). In a response to an inquiry from Council Member Bhat-Patel, Police Chief Williams explained that the city has had a significant decline in the crime trend over the last 5 years. In a response to an inquiry from Council Member Bhat-Patel, Police Chief Williams explained that the Carlsbad crime rates are below the county average, with violent crime being significantly below the average and property crime being just about at the county average. August 16, 2022 Carlsbad City Council Regular Meeting Page 7 In response to an inquiry from Mayor Hall, Police Chief Williams explained that the Police Department works with other agencies such as the Department of Motor Vehicles to try to limit the crime involving catalytic converters. In response to an inquiry from Mayor Hall, Police Chief Williams explained that educating new drivers of the rules of the road and safe routes, in addition to eliminating distracted driving would be beneficial in reducing accidents. Council received the update. 12. FISCAL YEAR 2022-23 INTERNAL AUDIT PLAN AND UPDATE ON AUDIT ACTIVITIES – 1) Receive the report on the results of internal audit activities and the annual audit plan for fiscal year 2021-22; and 2) Adoption of Resolution No. 2022-207 approving the fiscal year 2022-23 Internal Audit Plan. (Staff contact: Robert Threatt and Laura Rocha, Administrative Services Department) City Manager’s Recommendation: Receive the report and adopt the resolution. Internal Audit Manager Robert Threatt presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Council received the report.
