AGENDA OF: September 17,1997 Project Planner: Adrienne Landers SUBJECT: CDP 97-30 - HEERS ADDITION - Request for approval of a Coastal Development Permit to allow the construction of a single family residence and a garage addition on a lot with an existing single family dwelling located at 2499 Jefferson, in the R-3 Zone, in the Coastal Zone and Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 41 73 APPROVING Coastal Development Permit CDP 97-30 based upon the findings and subject to the conditions contained therein. 11. INTRODUCTION This project involves the construction of a single family residence and garage addition on a site with an existing single family dwelling with attached garage. The property owner initiated construction of the additional unit and expanded garage without benefit of City approvals and is now seeking authorization to continue development of his property. The proposed project complies with all regulations and policies including the City’s Local Coastal Program. 111. PROJECT DESCRIPTION AND BACKGROUND The applicant is proposing to legitimize the construction of a single family home and garage addition on a 1.0 acre, level parcel located on the south side of Buena Vista Lagoon. An existing home and garage are situated at the far west end of the site between 25’ and 40’ from a gradual bluff above the lagoon and from 275’ and 352’ to the wetlands of the lagoon. The applicant is proposing to expand the existing garage by 816 square feet and to also build a new 560 square foot home on land between the existing house and Jefferson Street. The requested density of 2 ddac is consistent with the density allowed under the R-3 zoning designation and the Residential Low Medium general plan designation (RLM, 0-4, growth control point of 3.2 ddac. Prior to the City being granted coastal permit authority by the Coastal Commission in October 1996, an applicant was required to obtain coastal permit approval from the Coastal Commission before building permit issuance by the City. Now, coastal development permits for new single family homes are reviewed by the Planning Commission prior to building permit issuance. The subject site is located within the Mello 11 Segment of the City’s Local Coastal Program and as one of the first row of lots located adjacent to Buena Vista Lagoon it is also within the Coastal Resource Protection Overlay Zone and the Coastal Shoreline Development Overlay Zone. For these 7- CDP 97-30 - HEERS ADD1 I ION SEPTEMBER 17,1997 PAGE 2 reasons, the applicant is required to address the issues of encroachment into wetlands, vegetation, and slopes over 25 percent. 111. COMPLIANCE WITH COASTAL REGULATIONS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. The LCP Land Use Plan designates the subject site for RLM (Residential Low-Medium) density development. A field visit and ortho-photo surveys by staff indicated that no impacts to coastal resources will occur because the new construction will not require any grading, will be located behind the stringline of the existing home and will be situated more than 275’ from Buena Vista Lagoon wetlands. For these reasons, topographic and vegetation mapping and analyses were not required to locate the boundaries of wetland areas and/or slopes in excess of 25%. Staff has conditioned the project to provide this data and analysis should future development be proposed on the west side of the existing home. ENVIRONMENTAL REVIEW The Planning Director has determined that the project is exempt from the requirements of the California Environmental Quality Act (CEQA) per the exemptions listed below: (1) Section 15304 of CEQA exemptions (Class 4) exempts minor alterations to land.
