AGENDA OF: OCTOBER 15, 1997 Single Family Coastal Development Permit Application complete date: September 26, 1997 Project Planner: Eric Munoz Project Engineer: Frank Jimeno SUBJECT: CDP 97-37 - SHORES RESIDENCE - Request for approval of a Coastal Development Permit to allow for the construction of a single family residence within the City’s Coastal Zone located on Lot 7 on Fransican Road within Local Facilities Management Zone 22. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4 192 APPROVING Coastal Development Permit CDP 97-37 based upon the findings and subject to the conditions contained therein. 11. INTRODUCTION This project involves the construction of a single family residence in the City’s Coastal Zone and, therefore, requires a Coastal Development Permit. Prior to the City being granted coastal permit authority by the Coastal Commission in October 1996, an applicant was required to obtain coastal permit approval from the Coastal Commission before building permit issuance by the City. Now the City processes coastal development permits approved by the Planning Commission for new single family construction, prior to building permit issuance. 111. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: Vacant lot located on Lot 7 on Fransican Road, east of Carlsbad Boulevard and south of Island Way as shown on the attached Location Map. The lot area is 5,357 square feet. Proposed Residential Construction: New residential structure totaling 2,48 1 square feet. Proposed Grading: A grading permit will not be required for this project. IV. ANALYSIS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 4192. n LCP Land Use Plan General Plan Zoning. Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the Mello I1 Local Coastal Program Segment. The project proposes the construction of a single family residence in an area designated for single family development. The LCP Land Use Plan designates the subject site for Residential Medium (RM) density development. 2. Conformance with public access and recreation policies of Chapter 3 of the Coastal Act. Not applicable. (For Development located between the nearest public road and the sea or shoreline body of water within the Coastal Zone) 3. Coastal Overlav Zones. The subject site is located in the Coastal Resource Protection Overlay Zone, however, due to its location and the absence of slopes steeper than 25% inclination and/or native vegetation, additional submittals, standards or requirements do not apply. V. ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemptions listed below: (1) Section 15303 of CEQA exemptions (Class 3) exempts the construction of single family residences in urbanized areas from environmental review.
