AGENDA OF: December 17,1997 A REPORT TO THE PLANNING COMMISSION Application complete date: November 10, 1997 Project Planner: Eric Munoz Project Engineer: Frank Jimeno Single Family Coastal Development Permit SUBJECT: CDP 97-42 - EATON RESIDENCE - Request for approval of a Coastal Development Permit to allow for the expansion of a single family residence within the City’s Coastal Zone, located on a blufftop lot on the west side of Tierra Del Oro, north of Cannon Road on Assessor’s Parcel No. 210-020-12 within Local Facilities Management Zone 2. The project site is located in the Appeal area of the Coastal Zone and may be subject to an appeal by the Coastal Commission. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4210 APPROVING Coastal Development Permit CDP 97-42 based upon the findings and subject to the conditions contained therein. 11. INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single family home within the City’s Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with LCP policies and implementation. There are no unresolved issues. The staff recommended approval with conditions is supported by the analysis as follows. 111. PROJECT DESCRIPTION AND BACKGROUND Proiect Site/Setting: Single family lot located on a blufftop site; single family residence of 1,777 square feet currently exists onsite. Project site is located as shown on the attached Location Map. The lot area is 14,652 square feet. Proposed Residential Construction: New residential construction totaling 1,623 square feet is proposed in the form of additions to the existing residence. Also proposed: 484 square feet of deck area; and 630 square feet of covered patio area. ANALYSIS STANDARD Front Yard Setback Side/Rear Yard Setback Max Building Height As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 4210, and after the Coastal Commission appeal period has ended, pursuant to State established timelines. REQUIRED/ALLOWED PROPOSED 20 Feet 10’ garage/20’ residence 5/10 S/stringline from blufftop 24 Feet for less than 3/12 pitch 21’6’’ Specific to this project site is the approval of Administrative Variance (AV) 96-07. Currently the garage is located within the 20 foot front yard setback and the residence maintains side yard setbacks of 5 feet. This site has a lot width of 60 feet so technically needs a 6 foot side yard setback. The garage encroachment into the front yard setback area and substandard side yard setback qualified the structure as a non-conforming structure with a limitation of 40% expansion of the original house size. The approval of AV 96-07 removed the non-conforming status and legally sanctioned the existing improvements through the processing of the administrative variance. Therefore, this proposal implements AV 96-07 and complies with all other related development standards. Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the Mello I1 Local Coastal Program Segment. The project proposes the construction of a single family residence in an area designated for single family development. The LCP Land Use Plan designates the subject site for Residential-Low Medium (RLM) densitykingle family development. 2. Conformance with public access and recreation Dolicies of Chapter 3 of the Coastal Act. Two access points currently exist in the project area. One is at the northern terminus of Tierra del Or0 on adjacent State lands down the bluff. The other is at the southern n CDP 97-42 EATON RESILLNCE December 17,1997 Page 3 terminus of Shore Drive where property owner, Mr. Jensen, is constructing a permanent concrete stairway beach access. No further access provisions are required of this project. 3. Coastal Overlay Zones. The subject site is located in the Coastal Resource Protection Overlav Zone (applies to all project sites in the City’s coastal zone that contain steep slopes over 25% and/or native vegetation). Due to the presence of a slope steeper than 25% inclination (coastal bluff) additional submittals were required in the form of geotechnical studies designed to protect the bluff as well as the proposed improvements. Further requirements of the Coastal Shoreline DeveloDment Overlav Zone (applies to project sites located between the sea and the first public road in the Mello I1 LCP segment) relied on geotechnical reports and Engineering Department review to determine the acceptability of the proposed improvements and additions to the existing residence. V. ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemption listed below: (1) Section 15301(e)(2) of CEQA (Class 1) exempts the addition of up to 10,000 square feet to an existing structure since all public services and facilities are available for this development which complies with the General Plan; and since the project is not located in an environmentally sensitive area, from environmental review. A Notice of Exemption will be filed by the Planning Director upon project approval. ATTACHMENTS: 1. 2. Location Map 3.
