AGENDA OF: March 4,1998 Application complete date: February 1 1, 1998 Project Planner: Eric Munoz Project Engineer: Doug Helming SUBJECT: CDP 97-50(A) - BEACH ACCESS RECONSTRUCTION - Request by the City’s Public Works Division for approval of a Coastal Development Permit Amendment to modify one existing condition of approval to extend the required completion date from May 31 to July 3, 1998 for the reconstruction of two existing beach access locations within the City’s Coastal Zone, within the Coastal Commission Appeal area, located at the northern terminus of Ocean Street and at Cherry Avenue within Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4245 APPROVING Coastal Development Permit Amendment CDP 97-50(A) based upon the findings and subject to the conditions contained therein. 11. INTRODUCTION Pursuant to Section 21.201.070(A)(l)(d) of the Carlsbad Municipal Code, the City’s Public Works Division applied for and received approval of a Coastal Development Permit (CDP). That CDP was conditioned to require completion of construction prior to May 31, 1998. Due to unforseen circumstances described below, construction has been delayed. Public Works is requesting to extend the completion date to July 3, 1998. The CDP amendment application was reviewed for consistency with LCP policies and implementation. There are no unresolved issues. The staff is recommending approval with conditions which are supported by the analysis as follows. 111. PROJECT DESCRIPTION AND BACKGROUND On December 17, 1997 the Planning Commission approved CDP 97-50 which allowed for the reconstruction of two beach access stairways in the City. Condition No. 3 of approving Planning Commission Resolution No. 42 1 1, requires that the reconstruction work be completed by May 31, 1998. Awarding the contract took longer than anticipated. Therefore, the Public Works Division has filed a request to extend the completion date until July 3, 1998. This will allow the stairways to be fully rehabilitated to current safety standards for the summer season of 1998. CDP 97-50(A) - BEACH ALCESS RECONSTRUCTION MARCH 4,1998 IV. ANALYSIS This project is a maintenance and repair effort for the long term upkeep of the two stairways involved. Extending the required completion date from May 31 to July 3 will impact the beach users who utilize these stairways. However, the short timeframe involved, combined with the long term maintenance benefits of this project, override any short term beach access impacts. In addition, alternate beach access locations are located near each of the two project sites which can be used by beach users during the construction period. A new condition of approval for this project will be the posting of signs, to the satisfaction of the Planning Director, indicating to the public where alternate beach access can be found. Attached is an Engineering Department Memo dated February 10, 1998 which outlines the revised milestone dates for initiating the reconstruction work. The revised schedule anticipates a start date for construction in early May which will accommodate job completion by July 3, 1998. V. ENVIRONMENTAL REVIEW The project was found to be exempt from CEQA per the exemption listed below: (1) Section 1530 1 of CEQA exemptions (Class 1 (d)) exempts the restorationhehabilitation of deteriorated or damaged structures to meet current standards of health, safety and welfare. The Planning Director has determined that the proposed amendment is within the scope of the CEQA exemption as conditioned. ATTACHMENTS: I. 2. Location Map 3. NO. 351 1 We are requesting an extension of time for the Coastal Development Permit to complete the project. The Coastal Development Permit had a condition that the project be completed by the Memorial Day weekend. The current schedule to complete the Beach Access Stair Reconstruction project puts the end of construction beyond that date. The project is currently scheduled to go to City Council on March 3, 1998 for authorization to advertise for bid. Bids are scheduled to be opened on April 9, 1998. After review of the bids received we then need to take the recommended bid to City Council for approval. This is anticipated to take place on May 5, 1998. Upon approval of the contract by City Council there is a week for the contractor to mobilize and a six week construction schedule. Allowing a week for unforeseen delays and we are looking at completion prior to the July 4th weekend. We propose to place signs at the Ocean Street stairs and the Cherry Avenue stairs directing the public to the nearest open beach access stair locations. This is the best schedule of events I can provide at this time.
