The Marja Acres project, approved by the City Council on November 3, 2020, includes 248 townhomes, 46 senior apartments, and 10,000 square feet of specialty commercial uses on 20.65 acres at 4901 El Camino Real. The subject Consistency Determination entails a request to eliminate 12 out of a total of 38 carports for the placement of an underground stormwater retention vault in the parking lot for the senior apartments. The total number of parking spaces for the senior apartments {47 spaces assigned spaces plus 9 guest spaces), will not be impacted. After careful consideration of the request, the City Planner has determined that the request meets all of the findings below and APPROVES this request. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the elimination of 12 out of 38 carports in the senior apartments' parking lot allows for the placement of an underground water retention vault, a required stormwater facility. Pursuant to the staff report for CT 16-07, as the project included a density bonus request, pursuant to Government Code Section 65915(p}{1}, no covered parking spaces were required. Therefore, the elimination of 12 carports remains consistent with the approved project. The total number of parking spaces for the senior apartments (47 spaces assigned spaces plus 9 guest spaces), will not be impacted. 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that no parking spaces will be eliminated. 3) The proposed revision does not change the density or boundary of the subject property in that no additional residential units are proposed, and the boundaries of the project will remain the same. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit in that the land uses will remain as approved pursuant to CT 16-07. Community Development Department Planning Division j 1635 Faraday Avenue Carlsbad, CA 92008-7314 f 442-339-2600 www.carlsbadca.gov CD 2022-0026 (DEV16038) -MARJA ACRES September 29, 2022 Page 2 5) The proposed revision does not rearrange the major land uses within the development in that the location of the parking spaces will remain the same. 6) The proposed revision does not create changes of greater than ten percent provided that compliance wl/1 be maintained with the applicable development standards of the Carlsbad Municipal Code in that while 38 covered parking spaces were approved pursuant to CT 16-07, no covered parking spaces are required for density bonus projects pursuant to Government Code Section 65915(p){l). Therefore, the removal of 12 carports for the senior apartments remains consistent with CT 16-07. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation in that the request to eliminate 12 carports allows for the placement of an underground water retention vault, a required stormwater facility. The elimination of 12 carports will have no impact on the environment or require additional mitigation. The proposed project is consistent with EIR 2017-0001. 8) The proposed change would not result in any health, safety or welfare impacts. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10} The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved in that the mix of land uses and number of parking spaces provided for the senior apartments pursuant to CT 16-07 remains the same (47 spaces assigned spaces plus 9 guest spaces), After careful consideration of the circumstances surrounding this request, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35.
