HomeMy WebLinkAboutCD 2022-0027; ACTIVE MOTIF; Admin Decision LetterSeptember 29, 2022 BEN SIEDSCHLAG 1914 PALOMAR OAKS WAY CARLSBAD, CA 92008 I"'"' '- 8fllE COPY dlartG-1) uJ 11)9/}Y SUBJECT: CD 2022-0027 (DEV2022-0172)-ACTIVE MOTIF Dear Mr. Siedschlag, Ccityof Carlsbad The City Planner has completed a review of your application for Consistency Determination, CD 2022- 0027, which is a modification to Planned Industrial Permit, PIP 97-06, and a Non-Residential Planned Development Permit, PUD 97-16, allowing for the development of an industrial building with shared parking (204 parking spaces provided) located at 1914 Palomar Oaks Way (APN 212-092-34-00 and 212- 092-35-00) within the Carlsbad Airport Centre Specific Plan (SP 181(H)). After careful consideration of the request, the City Planner has determined that the request meets all the findings below and APPROVES this request. The proposed modifications include: • The addition of a mechanical equipment enclosure (approximately 322 square feet) for the installation of a new power generator (7-foot-tall) surrounded by a 9-foot-6-inch-tall masonry screen wall and steel gates finished to inatch the existing building. The proposed generator and enclosure will occupy an area of existing paving adjacent to the industrial building and shared parking lot. No parking spaces or landscape is proposed to be removed. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function. 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood, in that the proposed screen walls associated with the mechanical equipment enclosure utilize building materials that are architecturally compatible with the existing building and are of a height that wi/1 adequately screen the proposed equipment contained within. 3) The proposed revision does not change the density or boundary of the subject property. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit. 5) The proposed revision does not rearrange the major land uses within the development, in that no additional building floor area or other uses are proposed beyond the scope of what was Community Development Department Planning Division \ 1635 Faraday Avenue Carlsbad, CA 92008-7314 \ 442-339-2600 www.carlsbadca.gov CD 2022-0027 (DEV2022-0172)-ACTIVE MOTIF September 29, 2022 Page 2 approved under the original Planned Industrial Permit, application no. PIP 97-06, or that are anticipated within the Planned-Industrial (P-M) loneJ 6) The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code, in that no addition of internal floor area or building height is proposed. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation, in that the proposed improvement does not create any inconsistencies or new impacts relative to the environmental review process associated with the original project's approval. 8) The proposed change would not result in any health, safety or welfare impacts. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change, in that the proposed mechanical equipment enclosure utilizes building materials for the enclosure that maintain the general design, quality and function of the original project. 10) The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved, in that the proposed mechanical equipment enclosure utilizes building materials for the enclosure that maintain the general design, quality and function of the original project. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35.
