AGENDA OF: April 1, 1998 Application complete date: February 10, 1998 Project Planner: Jeff Gibson Project Engineer: Kelly Weaver SUBJECT: CDP 98-07 - VISTA/CARLSBAD INTERCEPTOR SEWER REPLACE- MENT REACHES VC5B - VC9 - Request for approval of a Negative Declaration and Coastal Development Permit to allow for the replacement of the Vista/Carlsbad interceptor gravity sewer pipeline along Jefferson Street between Las Flores Drive and Oak Avenue, a portion of which is in the Coastal Commission Appeal area, and the realignment of the gravity sewer pipeline along Carlsbad Village Drive to be realigned in Oak Avenue between Jefferson Street and the railroad right-of-way, within Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4258 APPROVING the Negative Declaration issued by the Planning Director and ADOPT Planning Commission Resolution No. 4259 APPROVING Coastal Development Permit CDP 98-07, based upon the findings and subject to the conditions contained therein. II.INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the replacement and realignment of the portion of the Carlsbad/Vista Interceptor Sewer, Reaches VC5B - VC9, within the Mello II Segment of the City's Local Coastal Program (LCP) along Jefferson Street between Las Flores Drive and Laguna Drive requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with LCP policies and implementation. There are no unresolved issues. The staffs recommendation for approval, with conditions, is supported by the analysis as follows. III. PROJECT DESCRIPTION AND BACKGROUND The proposed, three-part project consists of: (1) the replacement of an existing sewer line under the pavement in the right-of-way of Jefferson Street; (2) the abandonment of a sewer line under Carlsbad Village Drive (CVD); and, (3) the realignment and construction of the CVD portion of the sewer under the pavement in the right-of-way of Oak Avenue. The project would replace an existing and deteriorating sewer facility. All trenching and other miscellaneous construction work would take place within either the existing paved street or the disturbed portion of the railroad right-of-way directly west of Oak Avenue. The sewer pipes would be up-sized from CDP 98-07 - VISTA/CARLSBAD INTERCEPTOR SEWER REPLACEMENT REACHES VC5B - VC9 April 1, 1998 Page 2 27-inch to 36-inch and 36-inch to 42-inch to return the existing over-capacity sewer pipeline system to normal flow depths. IV. ANALYSIS The proposed project is a maintenance and repair effort for the long-term upkeep of the sewer system. Since a portion of the project (within Jefferson Street between Las Flores Drive and Laguna Drive) is in the Mello II Segment of the Local Coastal Program, a Coastal Development Permit is required. The portion of the project located within the City's Redevelopment Area is exempted from the requirements of a Redevelopment Permit and a Coastal Development Permit by the Carlsbad Village Redevelopment Master Plan and Design Manual, which serves as the implementation ordinance for this portion of the Coastal Zone. The project fullfills a public utility infrastructure need in support of demand generated by existing and proposed land uses established by the Land Use Element and is, therefore, consistent with the General Plan. It was included in the approved Planning Commission Determination of General Plan Consistency for the 1996-1997 Capital Improvement Plan Buildout (PCD/GP96-01). Review of Required Coastal Findings 1. Conformance with the Certified Local Coastal Program and all applicable policies. A portion of the project is located in the Mello II Local Coastal Program Segment. The project proposes the repair and replacement of an existing sewer pipeline system within an existing public street. The LCP Land Use Plan designates the subject site for transportation and public utility uses. 2. Conformance with public access policies of Chapter 3 of the Coastal Act. The replacement of the underground pipeline would not permanently impact traffic circulation and patterns. However, short-term pipeline construction impacts would temporarily change local traffic patterns in the area. Local ordinance requires that all construction operations located within the public right-of-way must have a Traffic Control Plan approved by the City's Engineering Department Traffic Division before construction commences. The approved Traffic Control Plan would incorporate the necessary traffic safety control measures such as signs, lane and construction barricades, designation of work zones, and phasing to ensure that traffic and pedestrian safety and emergency access is maintained. In addition, when a street or portions of a street are closed due to paving or construction, substantial advanced notification is given to businesses and residents living in the area so they can plan accordingly and do not block construction access by parking vehicles in the street. Some of the construction (Portions of Jefferson Street and all of Oak Avenue) would take place in areas where the street system is comprised of a rectangular grid system. The grid layout of the streets would help to minimize traffic congestion and restricted access by allowing more convenient alternative routes around the streets being impacted by the project's construction. The planned construction would take place within an existing public street, therefore, project construction will not impact coastal resources such as coastal bluffs, steep slopes, or native coastal vegetation. V. ENVIRONMENTAL REVIEW The Initial Study prepared in conjunction with this project determined that the environmental effects which are peculiar to the project are not considered significant effects. The project would replace an existing and deteriorating sewer facility and all trenching and other miscellaneous construction work would take place within either the existing paved street or the disturbed portion of the railroad right-of-way. In consideration of the foregoing, on February 13, 1998, the Planning Director issued a Negative Declaration for the proposed project. No comments were received.
