AGENDA OF: August 19,1998 Application complete date: March 5,1998 Project Planner: Brian Hunter Project Engineer: Michele Masterson SUBJECT: CDF 98-24 - BERRY RESIDENCE - Request for approval of a Coastal Development Permit to allow for the construction of a single family residence within the City's Coastal Zone located on the eastern side of Surfside Lane within the La Costa Downs subdivision within Local Facilities Management Zone 22. Assessor's Parcel Numbers: 214-022-08 and 32 I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4317 APPROVING Coastal Development Permit CDP 98-24 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION This project involves the construction of a single family residence in the City's Coastal Zone and, therefore, requires a Coastal Development Permit (CDP). Prior to the City being granted coastal permit authority by the Coastal Commission in October 1996, an applicant was required to obtain coastal permit approval from the Coastal Commission before building permit issuance by the City. Now the City processes coastal development permits approved by the Planning Commission for new single family construction, prior to building permit issuance. The CDP application was reviewed for consistency with the Local Coastal Program policies and implementation. There are no unresolved issues. The staff recommended approval with conditions is supported by the analysis as follows: III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: Infill lot located on the east side of Surfside Lane adjacent to the initiation of an existing cul-de-sac as shown on the attached Location Map. The lot area is .1 acres. The lot presently has two tax identification numbers and shall be consolidated into one assessor parcel number as it is one legal lot. Proposed Residential Construction: New residential structure totaling 2370 square feet. Proposed Grading: No grading is proposed which would require a grading permit. ANALYSIS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 4317. Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the Mello II Local Coastal Program Segment. The project proposes the construction of a single family residence in an area designated for single family development. The LCP Land Use Plan designates the subject site for RLM (Residential Low-Medium) density development. 2. Coastal Overlay Zones. The subject site is located in the Coastal Resource Protection Overlay Zone, however, due to its location and the absence of slopes steeper than 25% inclination and/or native vegetation, additional submittals, standards or requirements do not apply. V. ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemptions listed below: (1) Section 15304 of CEQA exemptions (Class 4) exempts minor alterations to land including grading on land with a slope of less than 10% from environmental review. (2) Section 15303 of CEQA exemptions (Class 3) exempts the construction of single family residences in urbanized areas from environmental review.
