AGENDA OF: December 2, 1998 Application complete date: August 6, 1998 Project Planner: Van Lynch Project Engineer: David Rick SUBJECT: CDP 98-53 - DAKMIN APARTMENTS - Request for approval of a Coastal Development Permit to allow for the construction of two duplex apartment units within the City's Coastal Zone located on the north side of Laguna Drive between Jefferson Street and Kreymeyer Circle within Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4419 APPROVING Coastal Development Permit 98-53 based upon the findings and subject to the conditions contained therein. II.INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, development within the City's Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with LCP policies and implementation. There are no unresolved issues. The staff recommended approval with conditions is supported by the analysis as follows. III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: Developed infill lot located on the north side of Laguna Drive between Jefferson Street and Kremeyer Circle as shown on the attached location map. The lot area is .28 acres (12,262 square feet). There is a 768 square foot, three bedroom, one bath single family residence on the property that will be demolished. The residence was built in 1947 and does not appear on the cultural resources survey list. The surrounding uses are apartments to the north, south and west and single family residences to the east. Proposed Residential Construction: The project consists of the construction of two duplex residential structures totaling 4,688 square feet. The total floor area of each unit is 1,172 square feet; 480 square feet on the first floor and 692 square feet on the second floor. The first floor consists of a bedroom, full bathroom and laundry facilities. The second floor contains a second bedroom, full bathroom, kitchen and living room. A private outside yard (minimum of 446 square feet in area) and balcony (minimum 44 square feet) is provided per unit. There are two guest parking spaces located in the back portion of the lot. Proposed Grading: A grading permit will not be required for this project. IV. ANALYSIS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 4419. Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the Mello II Local Coastal Program Segment. The project proposes the construction of multi-family residences in an area designated for multi-family development. The LCP Land Use Plan designates the subject site for Residential High (RH) density development. The proposed density of 14.3 units per acre is below the 19 units per acre allowed by the Residential High Land Use designation. 2. Conformance with public access and recreation policies of Chapter 3 of the Coastal Act. The project site is not located between the sea and the first public road parallel to the sea and, therefore, is not subject to the provisions of the Coastal Shoreline Development Overlay Zone (Chapter 21.204 of the Zoning Ordinance). oCDP 98-53 - DAKMIN APARTMENTS December 2, 1998 Page 3 3. Coastal Overlay Zones. The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the City's Master Drainage and Storm Water Quality Management Plan and Grading Ordinance to avoid increased runoff and soil erosion, no steep slopes exist on the property and the site is not located in areas prone to landslides, susceptible or accelerated erosion, floods or liquefaction. V. ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemptions listed below: (1) Section 15304 of CEQA exemptions (Class 4) exempts minor alterations to land including grading on land with a slope of less than 10% from environmental review. (2) Section 15303 of CEQA exemptions (Class 3) exempts the construction of apartments, duplexes and similar structures, with no more than six dwelling units in urbanized areas from environmental review.
