AGENDA OF: June 16, 1999 Application complete date: May 6, 1999 Project Planner: Van Lynch Project Engineer: Bob Wojcik SUBJECT: CDP 99-20 - PACKARD LANE PROJECT - Request for approval of a Coastal Development Permit to allow for the construction of a single family residence within the City's Coastal Zone located at 4007 Packard Lane within Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4582 APPROVTNG Coastal Development Permit CDP 99-20 based upon the findings and subject to the conditions contained therein. II.INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single family home within the City's Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with LCP policies and implementation. There are no unresolved issues. The recommendation of approval with conditions is supported by the analysis as follows. III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: The .34 acre subject site is an infill lot located on Packard Lane at the eastern terminus of Alder Avenue as shown on the attached location map. The Coastal Development Permit being processed for the construction of a single family dwelling is accompanied by a minor Planned Unit Development Permit (PUD 50(A)). The PUD amendment is an administratively approved application for a minor property line adjustment on the existing four-lot development. The amendment will revise property lines to create a slightly larger lot for the proposed residence. The PUD amendment will be acted upon by the Planning Director and City Engineer pending Planning Commission's action on the Coastal Development Permit. Proposed Residential Construction: New residential structure totaling 3658 square feet. The proposed home is a single story unit with a three car garage. Proposed Grading: The project site is relatively flat and no grading is proposed with this project and a grading permit will not be required for this project. ANALYSIS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 4582. Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the Mello II Local Coastal Program Segment. The project proposes the construction of a single family residence in an area designated for single family development. The LCP Land Use Plan designates the subject site for residential Low-Medium density development. 2. Conformance with public access and recreation policies of Chapter 3 of the Coastal Act. The project site is not located in an area that would preclude coastal access or recreational opportunities. 3. Coastal Overlay Zones. The subject site is located in the Coastal Resource Protection Overlay Zone, however, due to its location and the absence of slopes steeper than 25% inclination and/or native vegetation, additional submittals, standards or requirements do not apply. V.ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemptions listed below: CDP 99-20 - PACKARD LANE PROJECT June 16, 1999 PAGE 3 (1) Section 15304 of CEQA exemptions (Class 4) exempts minor alterations to land including grading on land with a slope of less than 10% from environmental review. (2) Section 15303 of CEQA exemptions (Class 3) exempts the construction of single family residences in urbanized areas from environmental review.
