Executive Summary California’s Permanent Local Housing Allocation Program was established in 2017 to provide funding for affordable housing. It is funded by a $75 fee levied on certain real-estate transactions and is expected to generate an ongoing revenue source for jurisdictions throughout the state. The City of Carlsbad is expected to receive an estimated $1.6 million in funds from the program for the five-year period from 2019 to 2023. Staff are proposing that the money go toward the city’s efforts to combat homelessness. To access the funds, applicants must meet several eligibility thresholds, including having a compliant housing element, the part of a general plan that is focused on housing, and a five- year plan identifying the intended use of funds. The public must be given an opportunity to comment on the five-year plan, which requires the approval by resolution of the City Council. In addition to the review and adoption of the five-year plan, the City Council is also being asked to authorize the city to submit an application for $1,162,504 from the program funding for the 2019, 2020, and 2021 allocation years. Discussion The California Housing and Community Development Department announced in August 2022 that funding from the Permanent Local Housing Allocation Program was available for the years 2019, 2020, and 2021. Oct. 18, 2022 Item #10 Page 1 of 16 The program’s guidelines offer flexibility on when jurisdictions apply for funding, and those that have not yet applied during the first two application periods can do so before Nov. 30, 2022, and be eligible to receive the 2019 allocation. The intended use of the funds for each of the five years must be identified in the plan. For Carlsbad, this means that the draft funding plan prepared by staff (Exhibit 1, Attachment A) includes the city’s actual allocations for years 2019, 2020, and 2021, and estimates for the remaining two years, for a total of $1,635,492 over the five-year period. The funds must be spent by specified deadlines, as shown in the table below. The program’s guidelines allow a maximum of 5% of the total award to be used for administrative costs, which is estimated at $81,774 for years 2019-2023. Based upon the priority that the City Council has placed on addressing homelessness as a City Council goal, as well as in the Community Development Block Grant 2020-2025 Consolidated Plan, city staff recommend all of the program funding be allocated to the eligible activity of assisting persons who are experiencing homelessness or at-risk of becoming homeless. The Permanent Local Housing Allocation program guidelines do not require jurisdictions to identify specific programs or projects to be funded, only identification of the eligible activity. A list of eligible activities is included as Exhibit 2. The City of Carlsbad developed a Homelessness Response Plan in 2017 which has since been supplemented with additional initiatives approved by the City Council in early 2021. City staff will be bringing an updated plan to the City Council for review and approval by the end of 2022. It is anticipated that the funding allocations and budget appropriations necessary in carrying out the Homelessness Response Plan’s goals will be approved at the time the updated plan is approved. The Permanent Local Housing Allocation funds offer the city an ongoing revenue source for its efforts to combat homelessness outside of its General Fund. Once the 2019-2023 Permanent Local Housing Allocation plan is approved by the City Council and California Housing and Community Development Department, city staff are responsible for the administration of the grant, including submitting an annual progress report and cost reimbursement request for eligible activities. The plan covers the city’s intended use for the first five years and the initial grant agreement will cover 2019-2021 funding. Staff will submit streamlined applications for 2022 funds and 2023 funds as they become available. Those applications do not require further public review or City Council action. Oct. 18, 2022 Item #10 Page 2 of 16 Should the City Council wish to make significant changes to the draft 2019-2023 Permanent Local Housing Allocation plan, it may do so prior to its adoption. However, should the City Council wish to make significant changes to the draft 2019-2023 plan after its adoption, an amendment would be required, which includes additional public review and approval in a public hearing. In both instances, a significant change is defined as a change that will result in more than 10% of the funding allocation to change from one activity to another or a complete change in the activities being funded. A new funding plan must be developed and approved – including a new public review process – every five years. The next five-year plan is estimated to be developed and approved in 2023 and will cover 2024-2028. Options Staff provides the following options for the City Council’s consideration: 1. Approve the funding plan and authorize the application for Permanent Local Housing Allocation Program funding for the 2019, 2020, and 2021 allocation years as presented Pros • Provides a continual funding stream to support programs and projects that provide housing and homeless services Cons • None identified 2. Revise the funding plan. Do not approve the funding plan or authorize the application for Permanent Local Housing Allocation funding as presented Pros • None identified Cons • The city will not be eligible to receive Permanent Local Housing Allocation funding for the 2019 allocation ($272,582) because approval of the funding plan and application submission for 2019 is due by Nov. 30, 2022 Staff recommend that the City Council select Option 1. Fiscal Analysis Carlsbad’s estimated five-year (2019-2023) Permanent Local Housing Allocation funding amount is $1,635,492. Staff anticipates that using this funding for tasks identified in the City Council Homeless Goal Work Plan can decrease city General Fund contributions necessary to address homelessness. According to Housing and Community Development Department guidelines, a maximum of 5% of each grant may be allocated towards the costs of program Oct. 18, 2022 Item #10 Page 3 of 16 administration. The estimated five-year total for administration is $81,774. The city is not required to provide matching funds. Next Steps Staff will proceed with filing the application to Housing and Community Development Department prior to the Nov. 30, 2022, deadline. Announcements of awards are expected by February 2023, followed by execution of a funding agreement. Environmental Evaluation This action does not constitute a project as defined under the California Environmental Quality Act in accordance with Public Resources Code Section 21065, in that these actions may not cause a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. Public Notification This item was noticed in keeping with the state's Ralph M. Brown Act and it was available for public viewing and review at least 72 hours before the scheduled meeting date. The draft 2019-2023 Permanent Local Housing Allocation Program plan was available for public review and comment for the required period of 10 days in accordance with the Permanent Local Housing Allocation guidelines. The PLHA funds will be directed to emergency shelters within the City of Carlsbad, and shelters located in adjacent communities that provide shelter and services to Carlsbad residents. Additionally, the PLHA funds will support the City's Homeless Response Plan team in carrying out outreach, case management, and housing navigation services. PLHA funds will also be allocated to rental assistance, for a period of six months, to case-managed individuals experiencing homelessness or at-risk of homelessness. Lastly, the PLHA funds are expected to support Catholic Charitie's La Posada de Guadalupe shelter expansion project. La Posada is presently the only congregate shelter facility located in the City of Carlsbad, and only offers shelter to single males. The goal of the expansion project is to increase the overall number of beds, while establishing new access for women and children. Complete the table below for each proposed Activity to be funded with 2019-2023 PLHA allocations. If a single Activity will be assisting households at more than one level of Area Median Income, please list the Activity as many times as needed to capture all of the AMI levels that will be assisted, but only show the percentage of annual funding allocated to the Activity one time (to avoid double counting). §302(c)(4)(C) Provide a description of how the Plan is consistent with the programs set forth in the Local Government’s Housing Element. The City's Housing Element contains two programs that specifically align with the application and use of PLHA funds. Program 2.13 "Housing for Persons Experiencing Homelessness" Program 3.1. "Pursue State and Federal Funding" In addition to the City's 2021-2029 Housing Element programs, the City's Community Development Block Grant Consolidated Plan, has assigned the highest priority to two activities: - Increase the supply of affordable housing units - Provide supportive services for the homeless, lower-income residents, and persons with special needs §302(c)(4) Plan Rev. 2/16/22 §302(c)(4)(A) Describe the manner in which allocated funds will be used for eligible activities. The City of Carlsbad's Inclusionary Housing policy has successfully created over 2,000 affordable homes for lower-income residents throughout the City. Additionally, the Inclusionary Housing Ordinance generates revenue, by way of development in-lieu fees, for new affordable housing activities. The City's Housing Trust Fund has been an instrumental tool in funding gaps for new housing projects, including those that set-aside units for extremely low-income households (30% AMI) and those with special needs (seniors, veterans, homeless). The City has experience in leveraging available funding, including CDBG, HOME, Housing Trust funds, and Tax-Exempt Bond Financing to support the acquisition and rehabilitation, preservation, and construction of affordable housing units. In setting this goal, the City Council directed staff to develop a work plan to achieve a set of specific objectives and committed a significant investment of over $2.6 million to fund various activities, such as outreach, housing navigation, portable toilets, motel vouchers, case management, dedicated to reducing and ending homelessness. All services must be provided within the county containing the Local government recipient. 1. The predevelopment, development, acquisition, rehabilitation, and preservation of multifamily, residential live-work, or rental housing that is Affordable to extremely low-, very low-, low-, or Moderate-income households (up to 120 percent of Area Median Income (AMI), or 150 percent of AMI in High-cost areas, see appendix B for a list of High-cost areas, including necessary Operating subsidies). Note: Predevelopment and/or acquisition must result in the development, rehabilitation, or preservation of housing, as otherwise there is no actual housing outcome of the predevelopment or acquisition assistance. 2. The predevelopment, development, acquisition, rehabilitation, and preservation of Affordable rental and ownership housing, including Accessory Dwelling Units (ADUs), that meets the needs of a growing workforce earning up to 120 percent of Area Median Income (AMI), or 150 percent of AMI in High-cost areas. ADUs shall be available for occupancy for a term of no less than 30 days. Note: Predevelopment and/or acquisition must result in the development, rehabilitation, or preservation of Affordable rental and ownership housing, as otherwise there is no actual housing outcome of the predevelopment or acquisition assistance. 3. Matching portions of funds placed into Local or Regional Housing Trust Funds. Matching funds must be utilized as required by PLHA guidelines Section 301(a). 4. Assisting persons who are experiencing or at risk of homelessness in conformance with 24 Code of Federal Regulations (CFR Section 578.3), (up to 30 percent of AMI), including a. Rapid rehousing in conformance with federal rules contained in 24 CFR Section 576.104, except for legal services; b. Rental assistance with a term of at least six (6) months (rental arrears is not eligible); c. Street outreach, and other supportive/case management services in conformance with federal rules contained in 24 CFR Section 576.101 that allow people to obtain and retain housing; Oct. 18, 2022 Item #10 Page 15 of 16 d. Operating and capital costs for navigation centers and emergency shelters, and the new construction, rehabilitation, and preservation of permanent and transitional housing. This Activity may include subawards to administrative entities as defined in HSC Section 50490(a) (1-3) that were awarded California Emergency Solutions and Housing (CESH) Program or Homeless Emergency Aid Program (HEAP) funds for rental assistance to continue assistance to these households. Applicants must provide rapid rehousing, rental assistance, navigation centers, emergency shelter, and transitional housing activities in a manner consistent with the Housing First practices described in 25 CCR, Section 8409, subdivision (b)(1)-(6) and in compliance with Welfare Institutions Code (WIC) Section 8255(b)(8). An Applicant allocated funds for the new construction, rehabilitation, and preservation of Permanent supportive housing shall incorporate the core components of Housing First, as provided in WIC Section 8255(b). 7. Accessibility modifications in Lower-income Owner- occupied housing (up to 80 percent of AMI). 8. Efforts to acquire and rehabilitate foreclosed or vacant homes and apartments (up to 120 percent of Area Median Income (AMI), or 150 percent of AMI in High-cost areas). 9.
