HomeMy WebLinkAbout2022-11-15; City Council; Resolution 2022-262RESOLUTION NO. 2022-262 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS RECEIVED, AWARDING A CONTRACT TO ASTER CONSTRUCTION SERVICES, INC. FOR THE CARLSBAD BOULEVARD PEDESTRIAN IMPROVEMENTS PROJECT, AND AUTHORIZING AN ADDITIONAL APPROPRIATION IN AN AMOUNT OF $833,788 WHEREAS, the City Council of the City of Carlsbad, California, has determined it necessary, desirable and in the public interest to construct the Carlsbad Boulevard Pedestrian Improvements Project, Capital Improvement Program, or CIP, Project No. 6097, or Project; and WHEREAS, on Dec. 7, 2021, the City Council adopted Resolution No. 2021-265, approving the plans and specifications and authorizing the advertising for bids for construction of the Project; and WHEREAS, on Sept. 15, 2022, staff received one bid for construction of the Project, which considerably exceeded the engineer's estimate; and WHEREAS, on Sept. 27, 2022, City Council adopted Resolution No. 2022-224, rejecting the bid received from the first bid solicitation and authorizing the City Clerk to re-advertise for bids, with a solicitation period of at least 30 days, for the Project; and WHEREAS, on Nov. 1, 2022, staff received five construction bids; and WHEREAS, staff determined that Aster Construction Services, Inc. submitted the lowest responsive and responsible bid, in an amount of $1,246,567; and WHEREAS, Carlsbad Municipal Code Sections 3.28.080(() and 3.28.080(1)(6), which cover purchasing in construction contracts, require the City Council to award all formally bid contracts when the value exceeds $200,000, as this contract does; and WHEREAS, additional appropriation in the amount of $833,788 is required for construction of the Project; and WHEREAS, sufficient funding is available in the Gas Tax Fund; and WHEREAS, Carlsbad Municipal Code Sections 3.28.040(C)(5) and 3.28.090(8) authorize the City Manager or designee to approve change orders in an amount equal to the contingency set at the time of project award, which is $250,000 for the Project; and WHEREAS, the City Planner has determined that the Project is exempt from the California Environmental Quality Act, or CEQA, per State CEQA Guidelines Section 15301(c) -minor alteration of existing facilities including streets, sidewalks, gutters and similar facilities, including pedestrian crossings, involving negligiele or no expansion, and that no exception to the exemption as set forth in CEQA Guidelines section 15300.2 applies. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1.That the above recitations are true and correct. 2.That the bid of $1,246,567 submitted by Aster Construction Services, Inc for construction of the Carlsbad Boulevard Pedestrian Improvements Project, CIP Project No. 6097, is accepted and the Mayor is hereby authorized to execute a contract for the Project. 3.That the City Manager or designee is hereby authorized to approve construction change orders up to $250,000. 4.That the Deputy City Manager, Administrative Services, is hereby authorized to appropriate an additional $833,788 of Gas Tax Fund to the Carlsbad Boulevard Pedestrian Improvements Project, CIP Project No. 6097. 5.That the award of this contract is contingent upon Aster Construction Services, Inc. executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within 20 days of adoption of this Resolution. The City Manager may grant reasonable extensions of time to execute the contract and assemble the required bonds and insurance policies. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 15th day of November, 2022, by the following vote, to wit: AYES: NAYS: ABSENT: Hall, Blackburn, Bhat-Patel, Acosta, Norby.
