PLEDGE OF ALLEGIANCE: Commissioner Sabellico led the Pledge of Allegiance. APPROVAL OF MINUTES: None. PUBLIC COMMENT: None. PUBLIC HEARINGS: None. MATTERS NOT REQUIRING A NOTICE PUBLIC HEARING: 1. PCD2022-0003 (DEV2022-0168) -STRAWBERRY FIELD OUTDOOR ENTERTAINMENT USE Confirmation of appeal and adoption of Resolution No. 7467 to complete the appeal process to allow various uses and related outdoor activities as accessory to "crop production" or allowed by-right as "recreational facilities" within the Public Utility (P-U) Zone, which was already voted on by the Planning Commission at the September 21, 2022 hearing. ACTION TYPE: Quasi -judicial STAFF RECOMMENDATION: PLANNER: Kyle Van Leeuwen Approval ENGINEER: N/A Assistant Community Development Director Mike Strong introduced the item and Associate Planner Kyle Van Leeuwen provided a PowerPoint presentation (on file in the Office of the City Clerk). Commissioner Luna expressed that staff should take into consideration the discussion commissioners have had regarding the other uses. In response to Commissioner Sabellico's inquiry, Senior Assistant City Attorney Ronald Kemp explained that there was not a need to provide their Ex Parte disclosures again because this item is not a public hearing. Motion by Commissioner Luna, seconded by Commissioner Meenes, to adopt Resolution No. 7467 to complete the appeal process to allow various uses and related outdoor activities as accessory to "crop production" or allowed by-right as "recreational facilities" within the Public Utility (P-U) Zone, which was already voted on by the Planning Commission at the September 21, 2022 hearing. DISCUSSION ABOUT THE LAYOUT OF PLANNING COMMISSION STAFF REPORTS ACTION TYPE: Discussion STAFF RECOMMENDATION: Receive report and provide direction PLANNER: Jeff Murphy ENGINEER: N/A Assistant Community Development Director Mike Strong introduced the item and Community Development Director Jeff Murphy provided a PowerPoint presentation {on file in the Office of the City Clerk). Community Development Director Murphy provided an overview of the item and facilitated the discussion on the three options for a new Planning Commission staff report template for the Commissions' consideration. Motion by Commissioner Sabellico, seconded by Commissioner Merz, to have staff further develop Option 3, with the aerial exhibits to include the general plan designation and exhibits like used in the City of Encinitas that would be relevant to the City of Carlsbad and zoning exhibits to include the inclusionary housing and design review exhibits. Motion carried unanimously, 7 /0. 3. DISCUSSION ON AGENDA SETTING AND PACKET DISTRIBUTION ACTION TYPE: Discussion STAFF RECOMMENDATION: Receive report and provide direction PLANNER: Mike Strong ENGINEER: N/A Assistant Community Development Director Mike Strong introduced the item and provided a brief overview of the report to include the agenda setting as well as the Commissioners' preference as to how they would like to receive their agenda packets, distributed either as hard copies or in an electronic format. Assistant Community Development Director Strong explained that an item on the agenda that is routine in nature and does not require a staff presentation or discussion can be moved into the Consent Calendar category. He further explained that these items would still be required to allow for public comment and if the Commission wished to pull an item from the Consent Calendar for discussion, they would still be able to do so as well. Senior Assistant City Attorney Kemp explained that the City Clerk's Office informed him that former City Attorney Celia Brewer had advised that the City Council not to bring personal electronic devices to the meetings. He further explained that if the Commissioners were to receive the Planning Commission packet electronically, he would need to discuss with the current City Attorney and see if her advice would still be the same. Commissioner Kamenjarin expressed his support for the addition of Consent Calendar items on the agenda and requested that as much as feasibly possible, the Planning Commission packets be delivered more than 96 to 72 hours in advance. Oct. 19, 2022 Planning Commission Regular Meeting Page 3 Commissioner discussion ensued regarding the format preference for the distribution of the agenda packet. In response to Senior Assistant City Attorney Kemp's inquiry of how many Commissioners refer to their Planning Commission packets during meetings, all seven commissioners raised their hands, with six commissioners indicating that they prefer to continue with the distribution of the agenda packets as a paper copy and Commissioner Sabellico indicating that he would prefer the agenda packet in an electronic format. PLANNING COMMISSION REPORTS/COMMENTS: Commissioner Lafferty reported the Objective Design Standard Committee will meet on Oct. 25, 2022, and the next Historic Preservation meeting is scheduled for Nov. 14, 2022. Chair Stine reported the next Growth Management Committee meeting will be held on Nov. 30, 2022, and the Committee is now beginning to provide direction and make decisions. CITY PLANNER REPORTS: Assistant Community Development Director Strong announced that the Boards and Commission Appreciation event will be held on Oct. 25, 2022. He also announced that the Special Planning Commission meeting to be held on Oct. 27, 2022, at 1 p.m. and a staff report will be forthcoming. Assistant Community Development Director Strong also reported that at the last City Council meeting, the City Council adopted two ordinances. He explained that the first ordinance was in regards to the California Building Standards Code, which will be effective Jan. 1, 2023. He added that the second ordinance was an amendment to Title 22, which is a Historic Preservation Ordinance and includes new benefit and incentive to Historic Preservation called the Mills Act program.
