AGENDA OF: April 19, 2000 Application complete date: November 8, 1999 Project Planner: Paul Godwin Project Engineer: David Rick SUBJECT: CDP 99-50 - LANZA RESIDENCE SOU - Request for approval of a Coastal Development Permit to allow for the construction of a detached second dwelling unit to an existing single family residence within the City's Coastal Zone located on the east side of Pio Pico Drive between Yourell Avenue and Forest Avenue within Local Facilities Management Zone 1. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4757 APPROVING Coastal Development Permit CDP 99-50 based upon the findings and subject to the conditions contained therein. II.INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a second dwelling unit within the City's Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with LCP policies and implementation. There are no unresolved issues. The staff recommended approval with conditions is supported by the analysis as follows. On March 16, 2000, the Planning Director conditionally approved the administrative permit (SOU 99-32) for the Lanza Second Dwelling Unit, subject to the approval of CDP 99-50 III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: Existing single family lot and home located on the east side of Pio Pico Drive as shown on the attached location map. The lot area is 0. 246 acres (10,710 square feet). Proposed Residential Construction: New detached second dwelling unit totaling 600 square feet on an existing single family lot and home. ANALYSIS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 4757. Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the Mello II Local Coastal Program Segment. The project proposes the construction of a detached second dwelling unit in an area designated for single family development. As discussed below, the project complies with the applicable LCP provisions. The LCP Land Use Plan designates the subject site for RLM (Residential Low-Medium) density development. Affordable Housing Policy 1-1 of the Mello II LCP allows for the development of second dwelling units subject to compliance with all applicable LCP provisions, with the exception of base density. The proposed second dwelling unit is architecturally compatible with the primary unit and is consistent with the surrounding development of one and two story structures. The one-story second dwelling unit will not obstruct views of the coastline as seen from public lands or the public right of way or otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive resources on the developed property. The second dwelling unit is not located on an area of known geologic instability or flood hazard. No public opportunities for coastal access are available from the subject site since it is not located between the first public road and the ocean, and no public access requirements are conditioned for the project. The residentially designated site is not suited for water-oriented recreation activities. 2.Coastal Overlay Zones. The subject site is located in the Coastal Resource Protection Overlay Zone, however, due to its inland location and the absence of slopes steeper than or equal to 25% CDP 99-50 - LANZA RESIDENCE SDU April 19, 2000 Page 3 inclination and/or native vegetation, additional submittals, standards or requirements do not apply. The project does not require a grading permit. Construction of the project will adhere to the City's Master Drainage and Storm Water Quality Management Plan and Grading Ordinance to avoid increased runoff and soil erosion. V. ENVIRONMENTAL REVIEW This project is exempt from CEQA per the exemptions listed below: (1) Section 15303 of CEQA exemptions exempts the construction of a second dwelling unit in a residential zone in urbanized areas from environmental review.
