Euclid Ave., Ste. 550 Pasadena, CA 91101 8 FILE COPY SUBJECT: CD 2021-0004 (DEV00107) -SHELL HYDROGEN STATION {'city of Carlsbad The City Planner has completed a review of your application for a Consistency Determination, CD 2021- 0004, (APN: 214-430-23~00) which is a modification to Site Development Plan SOP 82-03 (related permits include CUP 99-15), a request to install new hydrogen fuel dispensers and associated site improvements. After careful consideration of the request, the City Planner has determined that the request meets all of the findings below and APPROVES this request. The proposed modifications include: • Installation of two new hydrogen fuel dispensers, one max chiller unit, one max compression system and one GH2 storage • Landscaping modifications • Restriping of existing parking stalls • Relocation of a trash enclosure • Addition of a new transformer, switchgear, and other associated equipment. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the proposed hydrogen fuel dispensers and associated site improvements are essential to the site operations and complies with the original approval of SOP 82-03. 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that the architectural design of the proposed equipment enclosures complement the existing building design. 3) The proposed revision does not change the density or boundary of the subject property. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit in that the addition of equipment enclosures and hydrogen fuel stations is consistent with the allowed use of the site and does not require any modifications to the land use. Community Development Department Planning Division \ 1635 Faraday Avenue Carlsbad, CA 92008-7314 \ 442-339-2600 www.carlsbadca.gov CD 2021-0004 (DEV00107) -SHELL HYDROGEN STATION December 22, 2022 Pa e 2 5) The proposed revision does not rearrange the major land uses within the development in that no additional uses are proposed and the project remains consistent with the original fuel station approved under Site Development Plan, SDP 82-03. 6} The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code in that the minor site changes to accommodate the equipment remains consistent with development standards. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation in that the proposed hydrogen fuel dispensers and associated site improvements are negligible changes to the approved project. The proposed revision will not result in any additional impacts to noise, air quality, average daily traffic or water quality and the site can be adequately served by all utilities and public services. 8) The proposed change would not result in any health, safety or welfare impacts. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10} The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved as the hydrogen fuel dispensers, equipment enclosures and associated site improvements complement the architectural design of the existing building. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35.
