WHEREAS, on July 17, 1991 the Carlsbad Planning
commission held a duly noticed public hearing to consider a
proposed Conditional Negative Declaration, Tentative Subdivision
Map CT 91-2, Local Facilities Manage111ent Plan LFMP 87-24(A),
Hillside Development Permit HDP 91-2 and Special Uae Permit SUP 91-
1 for a 32 lot project and adopted Resolutions Nos. 3270, 3282,
3271 and 3272 respectively, recommending to the City council that
the conditional Negative Declaration, Tentative Subdivision Map CT
91-2, Local Facilities Management Plan LFMP 87-24 (A), Hillside
Development Permit HOP 91-2 and Special Use Permit SUP 91-1 be
approved; and
WHEREAS, the City Council of the City of Carlsbad, on
17 1991 held a public hearing to consider the Si!ptember ,
recommendations and heard all persons interested in er opposed to
CT 91-2, LFMP 87-24(A), HOP 91-2 and SUP 91-1: and
WHEREAS, a Conditional Negative Declaration was issued on
24 January 3, 1991 and submitted to the state Clearinghouse for a 30
25 day review period. All comments received from that review period

are fully incorporated into the conditions of approval for the
tentative map·and other project approvals. These conditions will
be reviewed through a monitoring program s•t up tor th• project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Carlsbad, California, as follows:
l. That the above recitations are tru• and correct.
2. That the conditional negative declaration on the
above referenced project is approved and that the findings and
conditions of the Planning Commission contained in Resolution No.
3268 on file with the city Clerk and incorporated by reference
herein are the findings and conditions of the City Council.
3. That the tentative subdivision map of this project
(CT 91-2) is approved and that the findings and conditions of the
Planning Commission contained in Resolution No. 3270 en file with
the City Clerk and incorporated by reference herein are the
findings and conditions cf the City Council.
4. Local Facilities Management Plan LFMP 87-24 (A) is
approved and that tha findings and conditions of the Planning
Commission~contained in Resolution No. 3282 on file with the City

RESIDENTIAL LOTS WITH A MINIMUM LOT AREA OF 7,500 SQUARE
FEET AND 3 OPEN SPACE LOTS ON A 14.54 ACRE SITE.

WHEREAS, the Planning Commission did on the 17th day of July, 1991, hold a
duly noticed public hearing as prescribed by law to consider said request, and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, examining the initial study, analyzing the information submitted by staff, and
considering any_ written comments received, the Planning Commission considered all
factors relating to the Conditional Negative Declaration.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as
follows:

Commission hereby recommends APPROVAL of the Conditional Negative

on the environment, however there will not be a significant impact in this case

Portions • of the site have been previously graded pursuant to an earlitr
environmental analysis and the site was disced at one rime to allow for the
planting of the existing eucalyptus grove.
The streets are adequate in size to handle traffic generated by the proposed project
provided that mitigating conditions of approval are c_omplied with and that traffic
improvements specified in the Zone 24 Local Fac1!11les Management Plan art
developed.
There are no sensitive resources located onsite or located so as to be significantly
impacted by this project provided that mitigating conditions of approval are
complied with.

Submittal of a final Landscape and Irrigation Plan in substantial
conformance with the conceptual Landscape Pl.an/Hillside mitigation Plan
for the Planning Director's approval is required prior to the issuance of a
grading penni I.
Prior to issuance of a grading permit, the applicant shall deposit at a
financial institution subject to regulation by ~e state or fed~
government, a certificate of deposit or letter of credit ma.de out t~ the Cit_y
of Carlsbad or such other security which is acceptable to the City. Tlus
document shall be for at least twice the estimated cast of the proposed
mitigation landscaping. If thi°p~posed mitigation landscaping is not
installed in a timely manner, in accordance with the approved plans, the
Planning Di.rector may authorize the utilization of these funds _10 do ~e
necessary remedial work. Any fwlds remaining after rhe camplenon of this
work shall be returned to the applicant.
In addition to erosion control measures, the required. landscaping and
irrigation systems shown on the approved I.andscal"." ~d ~~tion ~Ian
shall be completed prior to the occupancy of any llilll Wlthin this project.
The project shall adhere to all requirements in the proposed Master ~ge Plan
revision and the National Pollutant discharge elimination system pemut pur.ruant

in effect at the time of final map.

Prior to issuance of a grading or building permit, whichever comes first, a s01'l,
report shall be prepared and submitted ta the City of Carlsbad. If the soils report
indicates the presence of potential fossil t,,:,.aring material then a standard three
phased program, on file in the Planning Department, shall be undertaken to avoid
pos.sible significant impacts on paleontological resources under the direction of the
Planning Department.
The area shown on the project plans as • Area of Native Plant Und=tory" shall be
preserved in its existing natural condition and be included within an open space
lot as shown on the approved exhibits as lot 30.
The Final Map, lmprnvement Plans, and Landscape Plan shall be in substantia1
conformance with the Tentative Map design which preserves portions of the
existing eucalyptus grovi, and the conceptual Landscape Plan which indicates areas
of the site ta be revegerated with eucalyptus species so as to provide long term
roosting areas for the monarch butterfly and numerous bird species.
6. The proposed noise mitigation measures recommended in the study titled, ''Report
on an Acoustical Srudy, Eagle Canyon, El Camino Real at Camino Hills Drive,
Carlsbad, California", dated May 1, 1990 prepared by Jam.es C. Berry and th~
addendt11ll dated July 10, 1990 shall be completed at rhe time specified in each
measure. The required mitigation measures are as follows:
a) Grading plans shall nor be approved unless they show that noise
attenuation for lot 22 shall be achieved by constructing a three foot high
supplementary benn along the top of the proposed slope adjacent to El
Camino Real. stretching the length of the lot 22 boundary line so as to
maintain a 25 foot height differential between the road grade and the rop
of the barrier.
b) No upstairs balcony facing El Camino Real shall be allo'Wl!d on the two
story house planned for lot 23. This shall be verified at the time building
plans are submitted for approval.
c) Prior to recordation of rhe final tract map or issuance of building p,,rmits,
whichev<er is firs~e owner shall prepare and record a notice that this
property may be subject to impacts from the El Camino Real Transportation
Corridor in a manner meeting the approval of the Planning Director and
City Attorney (Noise, Form #1).

building permits, whichever is first, the owner of record of the property
within the boundaries of this tentative tract/parcel map sh.all prepare and
record a notice (Noise, Fonn #2) that this property is subject to overflighte,

WHEREAS, a verified application for certain property to wit:
A portion of Lot F of Rancho Agua Hedionda according to Map
No. 823, in the City of Carlsbad, County of San Diego, State of
California, filed in the Office of the County Recorder on
November 16, 1896

Findings:
1. The project is consistent with the City's General Plan since the proposed density of
3.2 du's/acre is within the density range of 0-4 du's/acre specified for the site as
indicated on the Land Use Element of the General Plan, and is at or below the
growth control point of 3.2.
2. The sire is physically suitable for the type and density of the development since the
site is adequate in size and shape to accommodate residential development ar the
densiry proposed.
3. The Planning Commission has, by inclusion of an appropriate condition to this
project, ensured building permits will not be issued for the project unless the City
Engineer determines that sewer service is available, and building cannot occur
within the project unless sewer service remains available, and the Planning
Commission is satisfied that the requirements of the Public Facilities Element of the
General Plan have been met insofar as they apply to sewer service for this project.

concurrent with need as required by the General Plan.
The proposed project is compatible with the surrounding future land uses since
surrounding properties are designated for residential development on the General
Plan.
This project will not cause any significant environmental. impacts and a Conditional
Negative Declaration has been issued by the Planning D1rector on January 3, 1991
and recommended for approval by the Planning Commission on July 17, 1991. ln
approving this Conditional Negativ1e Declaration the Planning Commission has
considered the initial study, the staff analysis, all required mitigation measures and
any written comments received regarding the significant effects this project could
have on the environment .

The applicant is by condition, required to pay any increase in"public fa~ility fee, or
new construction tax, or development fees, and has agreed to abide by any
additional requirements established by a Local Facilities Management Plan prepared
pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This ~ll. ensure
continued availability of public facilities and will mitigate any cumulative impacts
created by the project,
This project is consistent with the City's Growth Management Ordinance as it has
been conditioned to comply with any requirement approved as part of the Local
Facilities Management Plan for Zone 24.
This project was subject to Chapter 21.95 of the Carlsbad Municipal Code (Hillside
Ordinance) and meets all the requirements of that Chapter to ensure the sensmve
treatment of the City's hillside resources.

The developer shall provide the City with a reproducible 24" x 36", mylar_ copy of
the Tentative Map as approved by the Planning Commission. The Tentanve Map
shall reflect the conditions of approval by the City. The Map copy shall be
submitted to the City Engineer prior to issuance of building permits or improvement
plan submittal, whichever occurs first.
A 500' scale map of the subdivision shall be submitted re the Planning Director fri?r
to the recordation of the final map. Said map shall show all lots and streets within
and adjacent to the project.
This project is approved upon the express condition that building pe~ts wiJ! not
be issued for development of the subject property. unless the_ C1.ty Enl,lileer
determines that sewer facilities are available at the ttme of appllcat1on for such
sewer permits and will continue to be available until time of occupancy. This note

This project is also approved under the express condition that the applicant pay the
public facilities fee adopted by the City Council on July_ 28, 1987 and ~s amended
from time to rime, and any development fees established by the City Council
pursuant to Chapter 21.90 of the Carlsbad Municipal C~e-or oth~r ordinance
adopted to implement a growth management system or facilities and improvement
plan and to fulfill the subdividet's. agreement to pay the public facilities fee date_d
February 28, 1990, a copy of which is on file with the City Clerk and 1s
incorporated by this reference. If the fees are nor paid this application will not be
consistent wfrh the General Plan and approval for this project will be void.
The applicant shall pay park-in-lieu foes to the City, prior r? !he approval of the
final map as required by Chapter 20.44 of the Carlsbad Murucipal Code.
The applicant shall provide school fees to mitigate conditions of overcrowding as
part of building permit application. These fees shall be, based on the fee schedule
in effect at the time of building permit application,
Water shall be provided to this project pursuant to the Water Servic" agreement
between the City of Carlsbad and the Carlsbad Municipal Water District, dated
May 25, 1983.
This project shall comply with all conditions and mitigation measures which may
be required as part of the Zone 24 Local :acilities Man~g:ment Pl~n and any
amendments made to that Plan prior to the issuance of bu1ldmg pemuts.
If any condition for construction of. any public improv.-ments ~r facilities, or the
payment of any fees in lieu thereof, imposed by this approval or unposed by, law ~n

and final mylar of this development submitted to the City:
'"Chapter 21.90 of the Carlsbad Municipal Code establishes a Growth Management
Control Point for each Ge°"ra! Plan land use designation. Development cannot
exceed the Growth Control Point except as provided by Chapter 21. 90. The land
use designation for this development is RLM. The Growth Control Point for this
designation is 3.2 dwelling units per nonconstrained acre.
Parcels 1 through 30 were used to calculate the intensity of development under the
General Plan and Chapter 21.90. Subsequent redevelopment or resubdivision of any
one of these parcels must also include parcels 1 through 30 under the General Plan
and Chapter 21.90 of the Carlsbad Municipal Code."
The applicant shall establish a homeowner's association and COIT.,Sponding
covenants, conditions and restrictions. Said CC&R's shall be submitted to and
approved by the Planning Director prior to final map approval. The following items
shall be included in the CC&R's:
a) Common ownership of Open Space Lots 30, 31 and 32 by th" individual
owners of Residential Lots 1 through 29.
b) Maintenance responsibility for Lots 30, 31 and 32.

Prohibit development on or alteration of Open Space Lots 30, 31 and 32
except upon the written order of the Carlsbad Fire Department for fire
prevention purposes or upon approval of the Planning director based upon
a request from the Homeowners Association accompanied by a ~rt from

and/or plants because of disease or impending danger to adjacent habitabl"

17. A master plan of the existing onsite trees shall be provided to the Planning Director
as part of the final grading plan 10 determine which trees shall be required to be
preserved prior to the issuance of a grading permit or a building permit, whichever
occurs first.
18. All landscaped areas shall be maintained in a healthy and thriving condition, free
from weeds, trash, and debris. _

19. Existing onsite trees shall be retained wherever possible and shall be trimmed
and/or topped. Dead, decaying or potentially dangerous trees shall be approved for
removal at the discretion of the Planning Department during the review of a Master
Plan submined showing existing onsite trees. Those trees which are approved for
removal shall be replaced on a tree-for-tree basis as required by the Planning
Department.
20. The developer shall install street trees at the equivalent of 40-foot intervals along
all public street frontages in conformance with City of Carlsbad standards. The
trees shall be of a variety selected from the approved Street Tree List.
21. All landscape plans shall be prepared to conform with the Landscape Manual and
submitted per the landscape plan check procedures on file in the Planning
Depan:ment.
22. Landscape plans shall be designed to minimize water use. Lawn and other zone 1
plants (see Landscape Manual) shall be limited to areas of special visual importance
or high use. Mulches shall be used and irrigation equipment and design shall
promote water conservation.
23. Prior to final occupancy, a letter from a California licensed landscape architect shall
be submitted to the Planning Director certifying that all landscaping has been
installed as shown on the approved landscape plans.
24. All herbicides shall be applied by applicators licensed by the State of California.
25. The applicant shall pay a landscape plan check and inspection fee as required by
Section 20.08.050 of the Carlsbad Municipal Code.
26. The first set oflandscape and irrigation plans submitted shall include building plans,
improvement plans and grading plans.
27. All landscape and irrigation plans shall show existing and proposed contours and
shall match the grading plans in terms of scale and location of improvements.

1) Submittal of a final Landscape and Irrigation Plan in substantial
conformance with the conceptual Landscape Plan/Hillside Mitigation
Plan for the Plarutlng Director's approval is required prior to the
issuance of a grading permit.
2) Prior to issuance of a grading permit, the applicant shall deposit at a
financial institution subject to regulation by the state or federal
government, a certificate of deposit or lener of credit made out to the
City of Carlsbad or such other security which is acceptable to the City.
This document shall be for a least twice the estimated cost of the
proposed. mitigation landscaping. [f the proposed mitigation
landscaping is not installed in a timely manner, in accordance with
the approved plans, the Planning Director may authorize the
utilization of these funds to do the necessa:y remedial work. Any
fund remaining after the completion of this work shall be returned to
the applicant.
3) In addition to erosion control measures, the required landscaping and
irrigation systems shown on the approved Landscape and rrrigation
Plan shall be completed prior to the occupancy of any unit within this
project.
The project shall adhere to all ffi1lJll=lents in the proposed Master Draina8'!
Plan revision and the National Pollutant discharge elimination system perm.it
pursuant to San Diego Region Water Quality Control Boan! Order No. 90-42
which may be in effect at the time of final map.
Prior to issuance of a grading or building perm.it, whichever comes first, a
soils n!p<lrt shall be prepared and submitted to the City of Carlsbad. If the
soils n!p<llt indicates the presence of potential fossil bearing material then a
standan! three phased program, on file in the Planning Department, shall be
undertaken to avoid possible significant impacts on paleontological resources
under the direction of the Planning Department.
The area shown on the project plans as • Area of Native Plant Understory"
shall be preserved in its existing natural condition and be included within an
open space lot as shown on the approved exhibits as Lot 30.

The Final Map, Improvement Plans, and Landscape Plan shall be in
substantial conformance with the Tentative Map design which preserves
~o~ o! the existing eucalyptus grove and the Conceptual Landscape Plan
which indicates areas of the site to be revegetated with eucalyptus species so
as to provide long term roosting areas for the monarclt butterfly and
numerous bird species.
The proposed noise mitigation measures recommended in the study titled
"Report on an Acoustical Study, Eagle Canyon, El Camino Real at Carnin~
Hills Drive, Cru-lsbad, California", dated May 1, 1990 prepared by James c.
Berry and the addendum dated July 10, 1990 shall be completed at the time
specified in each measure. The required mitigation measures are as follows:
1) Grading plans shall· not be approved unless they show that noise
attenuation for Lot 22 shall be achieved by constructing a three foot
height supplementary berm along the top of the proposed slope
adjacent to El Camino Real, stretching the length of the Lot 22
boundary line so as to maintain a 25 foot hcight differential between
the road grade and the top of the barrier.
2) No upstairs balcony facing El Camino Real shall be allowed on the
two story house planned for Lot 23. This shall be verified at the time
building plans are submirred for approval.
3) Prior to recordation of the fin.al tract map or issuance of building
permits, whichever is first, the owner shall prepare and record a
notice that this property may be subject to impacts from the El
Camino Real Transportation Corridor in a manner meeting the
approval of the Planning Director and City Anomey (Noise, Form
#1).
4) Prior to reeordation of the fin.al tract map or the issuance of
residential bullding perm.its, whichever is first, the owner of record of
the property within the boundaries of this tentative tract/parcel map
sh.all prepare and record a notice (Noise, Form #2) that this property
is subject to overllight, sight, and sound of aircraft operating from
Palomar Airport in a manner meeting the approval of the Planning
Director and the City Attorney.
5) The applicant shall post aircraft noise notification signs in !ales
and/ or rental offices associated with the new development. The
number and locations of said signs shall be approved by the Planning
Director (Noise, Form #3).

Street to bring it into conformance with City standards for a four-way
intersection.
36. The developer •hall submit a plan showing the fence design and proposed location
for Planning Director approval prior to grading plan approval. A uniform fence
design shall be utilized for all residential !ors within the project. The fencing shown
on the plan for individual residential lots shall be installed prior to the issuance of
an occupancy permit for each respective unit.
37. 11tls project is approved upon the express condition that building permits will not
be issued for development of the subject property unless the water district serving
the development detennines that adequate water and service is available at the time
of application for water service and will continue to be available until time of
occupancy.
38. Prior to the issuance of grading plans, the project applicant shall receive a Coastal
Development Permit from the California Coastal Commission that approves
development that is in substantial conformance with the City approval. Evidence
that the permit has been received shall be submitted to both the Planning and
Engineering Departments.
39. Prior to grading plan approval areas of the eucalyptus grove to be preserved shall
be dearly demarcated on the grading plan to the satisfaction of the City Engineer
and Planning Director. These areas shall. be staked in the field by a qualified '
biologist prior to the issuance of a grading permit.
Engineering Conditions:
40. Unless a standard variance has been issued, no variance from City Standards is
authorized by virtue of approval of this tentative map.
41. The dev.-loper shall comply with all the rules, regulations and design requirements
of the respective sewer and water agencies regarding services to the projeci.
42. The developer shall be responsible for coordination with S.D.G.&E., Pacific
Telephone, and Cable TV authorities.
43. This project is approved specifically as 1 (single) phase.

+4. All concrece terrace draiilll shall be maintained by the homeowner's association (if
on commonly owned property) or the individual property owner (if on an
individually owned lot). An appropriately worded statement clearly identifying the
responsibility shall be placed in the CC&R's.
45. Approval of this tentative tract map shall expire twenty-four (24) months &om the
date of Planning Commission approval unless a final map is recorded. An extension
may be requested by the applicant. Said extension shall be approved or denied at
the discretion of the Planning Commission. ln approving an extension, the Planning
Commission may impose new conditions and may revise existing conditions
pursuant to Section 20.12.l 10(a)(2) Carlsbad Municipal Code.
46. The developer shall pay the current local drainage area fee prior to approval of the
final map for this project or shall construct drainage systems in conformance with
Master Drainage Plan and City of Carlsbad Standards as required by the City
Engineer.
4 7. Prior to approval of the final map the developer shall enter into an agreement with
the City to pay any drainage area fees established as a result of the forthcoming
Master Drainage Plan Update.
48. The owner of the subject property shall execute a Hold Harmless Agreement
regarding drainage across the adjacent property prior to approval of the final map
for this project.
49. No grading perm.its shall be issued for this subdivision prior to recordation of the
final map.
50. Based upon a review of the proposed grading and the grading quantities shown on
the tentative map, a grading permit for this project is required. Prior to issuance
of a building perm.it for the project, the applicant must submit and receive approval
for grading plans in accordance with City codes and standards, be issued a grading
perm.it and complete the grading work in substantial conformance with the
approved grading plans.
51. The developer shall obtain a grading permit prior to the commencement of any
clearing or grading of the site.
52. No grading shall occur outside the limits of the subdivision unless a grading or slope
easement is obtained from the owners of the affected properties. If the developer
is unable to obtain the grading or slope easement, he must either amend the
tentative map or change the slope so grading will not occur outside the project sire
in a manner which substantially conforms to the approved tentative map as
determined by the City Engineer and Planning Director.

54. Prior ro hauling dirt or construction materials to any proposed construction site
within this project the developer shall submit to and receive approval from the City
Engineer for the proposed haul route. The developer shall comply with all
conditions and requirements the City Engineer may impose with regards to the
hauling operation.

55. The developer shall exercise special care during the construction phase of this
project to prevent offsite siltation. Planting and erosion control shall be provided
in accordance with the Carlsbad Municipal Code and the City Engineer. Reference
Chap. 11.06.
56. Additional drainage easements and drainage structures shall be provided or installed
prior to the issuance of grading or building permit as may be required by the City
Engineer. .
57. The developer shall make an offer of dedication to the City for all public streets and
easements required by these conditions or shown on the tentative map. The offer
shall be made by a certificate on the final map for this project. All land so offered
shall be granted to the City free and clear of all liens and encumbrances and without
cost to the City. Streets that are already public are not required to be rededicated.
58. El Camino Real shall be dedicated by the developer along the project frontage based
on a cenier line to right-of-way width of 63 feet and in conformance with City of
Carlsbad standards prior to approval of final map.
59. Direct access rights for all lots abutting El Camino Real shall be waived on the final
map.
60. Some improvements shown the tentative map and/or required by these conditions
are located offsite on property which neither the City nor the subdivider has
sufficient title or interest to perm.it the improvements to be made without
acquisition of title or interest. The Developer shall conform to Section 20.16.095
of the Carlsbad Municipal Code.
61. Prior to approval of any grading or building permits for this project, the owner shall
give wrirren consent to the annexation of the area shown within the boundaries of
the site plan into the existing City of Carlsbad Street Lighting and Landscaping
District No. 1. The form shall be provided by the City during the improvement
plancheck process.

62. Plans, specifications, and supporting documents for all improvements shall be
prepared to the satisfaction of the City Engineer. Prior to approval of the final map
in accordance, with City Standards the Developer shall install, or agree to install
and secure with appropriate security as provided by law, improvements shown on
the tentative map and the following improvements:
A. Full half-street improvements to El Camino Real along the project frontage
including the entire 18 foot wide median and required transitions to join the
existing pavement to the satisfaction of the City Engineer.
B. Modifications and upgrades to the existing traffic signal at the intersection
of El Camino Real, Rancho Carl, bad Drive and "A" Street to accommodate a
four legged intersection including appropriate traffic signing and striping.
C. Full half-street improvements to Camino Hills Drive along the properties
easterly frontage including required transitions to join the existing pavement

63. Improvements listed above shall be constructed within 18 months of final map
approval and/or improvement plan approval, whichever occurs first.
64. Lots 30, 31 and 32 (open space lots) shall be owned "in common" by the owner.;
of the 29 single family home properties, not the Homeowners As.soc:iation. The
developer shall provide an acceptable means for maintaining these common area lots
and to distribute the cost of such maintenance in an equitable manner among the
owners of the units within the Subdivision. Adequate provision for such
maintenance shall be included within the CC&R's subject to the approval of the City
Engineer.
65. The owner shall make an offer of dedication to the City of Carlsbad for an Open
Space Easement over Lots 30, 31 and 32. The offer shall be made by a certificate
on the final map.
66. The applicant shall comply with the requirements of the National PollutantS
Discl!arge Elimination SY!ltem (NPDES) permit. The applicant shall provide best
management practices to reduce surface pollutants to an acceptable level prior to
discharge to sensitive areas. Plans for such improvement shall be approved by the

The owner shall provide a one foot wide "blocker strip" along the subdivision
boundary at the intersection of "A" Street to deny access to the adjoining property
as shown on the tentative map. This one foot ''blocker strip" shall also be offered
for dedication on the final map and the offer rejected by City Clerk and shall
therefore become an irrevocable offer of dedication.
Within 90 days after tentative map approval for this subdivision, the owner shall
dedicate to the City of Carlsbad a temporary slope and grading easement. Said
easement shall enable the City to regrade the slope adjacent to El Camino Real to
provide for vehicular sight distance. The description of the easement shall be
approved by the City Engineer.
The existing intersection of Camino Hills Drive at El Camino Real is to be closed and
vacated in the future and Camino Hills Drive is to be cul-de-saced when extended
to the south to connect with Faraday Avenue. Therefore, prior to final map
approval, the applicant shall provide a surety agreement in an amount and of a type
required by Carlsbad Municipal Code to guarantee the ultimate demolition of these
portions of Camino Hills Drive adjacent to the properties easterly boundary as
shown on the tentative map.
A deed notice shall appear on all grant deeds transferring ownership for all
properties within the subdivisions informing buyers of the future closing of Camino
Hills Drive at El Camino Real. A note to this effect shall be placed on the final map.
This approval is subject to all conditions of approval of Zone 24 Local Facility
Management Plan and any amendments thereto.

project, ensured building permits will not be issued for the project unless the City
Engineer determines that sewer service is available, and building cannot occur
within the project unless sewer service remains available, and the Planning
Commission is satisfied that the requirements of the Public Facilities Element of
the General Plan have been met insofar as they apply to sewer service for this
project.
10. School fees will be paid to ensure the avai,lability of school facilities in the
Carlsbad Unified School District.
11. Park-in-lieu fees are required as a condition of approval.
12. All necessary public improvements have been provided or will be required as
conditions of approval.
13. The applicant has agreed and is required by the inclusion of an appropriate
condition to pay a public facilities fee. Performance of that contract and payment
of the fee will enable this body to find that public facilities will be available
concurrent with need as required by the General Plan.
14. The proposed project is compatible with the surrounding future land uses since
surrounding properties are designated for residential development on the General
Plan.
15. This project will not cause any significant environmental impacts and a Conditional
Negative Declaration has been issued by the Planning Director on January 3, 1991 i ·
and recommended for approval by the Planning Commission on July 17, 1991. In
approving this Conditional Negative Declaration the Planning Commission has
considered the initial study, the staff analysis, all required mitigation measures and
any written comments received regarding the significant effects this project could
have on the environment.

additional requirements established by a Local Facilities Management Plan
prepared pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This will

17. This project is consistent with the City's Growth Management Ordinance as it has
been conditioned to comply with any requirement approved as part of the Local
Facilities Management Plan for Zone 24.
18. This project was subject to Chapter 21.95 of the Carlsbad Municipal Code (Hillside
Ordinance) and meets all the requirements of that Chapter to ensure the sensitive
treatment of the City's hillside resources.
Conditions:
1. Approval is granted for HDP 91-2, as shown on Exhibit(s) "A" . "X", dared
July 17, 1991, incorporated by reference and on file in the Planning Department.
Development shall occur substantially as shown unless otherwise noted in these
conditions.
2. The developer shall provide the City with a reproducible 24" x 36", mylar copy of
the Site Plan as approved by the Planning Commission. The Site Plan shall reflect
the conditions of approval by the City. The Plan copy shall be submitted to the
City Engineer prior to issuance of building permits or improvement plan submittal,

findings and subject to the following conditions:
Finding:
1. The project enhances the scenic qualities of the El Camino Real Corridor consistent
with the corridor's development standards by providing an attractive development '
which complies with the specified building heights, a minimum building setback
of 70 feet along El Camino Real, and extensive landscaping which incorporates the
theme trees for the corridor.
2. The project protects scenic views and traffic safety along El Camino Real by , •
providing attractive buildings, performing corrective grading, extensively
landscaping proposed slopes, making street improvements along the project's
frontage, and taking access off of El Camino Real at an existing signalized
intersection.
3. The following findings of Section V of the El Camino Real Corridor Development
Standards are made to allow cut or fill grading within the setback from El Camino
Real to exceed 10 feet from original grade: ~
a) The limit of 10 feet of cut or fill is¥'easible given the grading required for
the widening of El Camino Real wilh or without the project.
b) The use of setbacks, landscaping, and the creation of 2 to 1 slopes will not
compromise the scenic qualities of the corridor. The existing slope is
barren, scoured and near vertical.
c)

The proposed grading is necessary to accorrunodate the widerung of a
circulation element road. All pertinent traffic standards will be met by the
project including sight distance requirements and the deviation will not
have an adverse impact on traffic safety.
The project as proposed bas been designed to meet or aceed the intent of
the remaining El Camino Real Corridor Development standards.
4. The project is consistent with the City's General Plan since the proposed density
of 3.2 du's/acre is within the density range of 0-4 du's/acre specified for the site
as indicated on the Land Use Element of the General Plan, and is at or below the
growth control point of 3.2.
5. The site is physically suitable for the type and density of the development since the
site is adequate in size and shape to accommodate residential development at the

Tlie Planning Commission has, by inclusion of an appropriate condition to this
project, ensured building pemuts will not be issued for the project unless the City
Engineer determines that sewer service is available, and building cannot occur
within the project unless sewer service remains available, and the Planning
Commission is satisfied that the requirements of the Public Facilities Element of
the General Plan have been met insofar as they apply to sewer service for this
project.
School fees will be paid ta ensure the availability of school facilities tn the
Carlsbad Unified School District.
Park-in-lieu fees are required as a condition of approval.
All necessary public improvements have been provided or will be required as
conditions of approval.
The applicant has agreed and is required by the inclusion of an appropriate
condition to pay a public facilities fee. Performance of that contract and payment
of the fee will enable this body to find that public facilities will be available
concurrent with need as required by the General Plan.
The proposed project is compatible with the surrounding future land uses since
surrounding properties are desigoated for residential developmenr on the General
Plan.
This project will not cause any significant environmental impacts and a Conditional
Negative Declaration has been issued by the Planning Director on January 3, 1991, ,
and recommended for approval on July 17, 1991. In approving chis Conditional
Negative Declaration the Planning Commission has considered the initial study, the
staff analysis, all required mitigation measures and any written comments received
regarding the significant effects this project could have on the environment.
13. The applicant is by condition, required to pay any increase in public facility fee,
or new construction tax, or development fees, and has agreed to abide by any
additional requirements established by a Local Facilities Management Plan
prepared pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This will
ensure continued availability of public facilities and will mitigate any cumulative
impacts created by the project.
14. This project is consistent with the City's Growth Management Ordinance as it has
been conditioned to comply with any requirement approved as part of the Local
Facilities Management Plan for Zone 24.

15. This project was subject to Chapter 21.95 of the Carlsbad Municipal Code (Hillside
Ordinance) and meets all the requirements of that Chapter to ensure the sensitive
treatment of the City's hillside resources.
Conditions:
1. Approval is granted for SUP 91-1, as shown on Exhibir(s) "A" . "X', dated
July 17, 1991, incor:porated by referenc" and on file in the Planning Department.
Development shall occur substantially as shown unless otherwise noted in these
conditions.
2. Approval of SUP 91-1 is granted subject to the approval of ZC 91-5, CT 91·2,
HDP 91-2.
3. All conditions of the Conditional Negative, Declaration, ZC 91-5, CT 91-2 and
HOP 91 •2 are incorporated by reference herein.
