Harbor Drive, Ste. 201 San Diego, CA 92106 8FILE COPY {'city of Carlsbad- SUBJECT: CD 2022-0033 (DEV2022-0211} -CARLSBAD SEAPOINTE RESORT REPAIRS The City Planner has completed a review of your application for a Consistency Determination, CD 2022- 0033, which is a modification to the Site Development Plan for Carlsbad Seapointe Resort, application No. SDP 94-04(B), to update the color palette and remodel the facade of the existing clubhouse and timeshare buildings. No interior W':)rk or additions to the buildings are proposed. The new color palette and structural repairs will complement the existing architectural style. The project site is located at 6400 Surfside Lane, APN 214-010-94. After careful consideration of the request, the City Planner has determined that the request meets all of the findings below and APPROVES this request. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the proposal to update the color palette and refurbish the fa~ades of the clubhouse and timeshare buildings will enhance the appearance of the community as the structural elements are in need of repair. The proposed color palette maintains the overall design, quality and function of the project. No changes to the site plan are proposed. 2} The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that the updated color palette and fa~ade remodel complement the existing coastal architectural design exhibited throughout the timeshare community. 3) The proposed revision does not change the density or boundary of the subject property. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit. 5) The proposed revision does not rearrange the major land uses within the development in that no additional buildings or uses are proposed beyond the scope of what was approved for the Site Development Plan, SDP 94..:04{8}. Community Development Department Planning Division I 1635 Faraday Avenue Carlsbad, CA 92008-7314 I 442-339-2600 www.carlsbadca.gov CD 2022-0033 (DEV2022-0211) -CARLSBAD SEAPOINTE RESORT REPAIRS January 9, 2023 Pa e 2 6) The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code in that no additions are proposed and there are no changes to parking, landscaping, setbacks, or lot coverage. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation in that the proposed improvements do not create any inconsistencies or new impacts relative to the environmental review process associated with the original project's approval. 8) The proposed change would not result in any health, safety or welfare impacts in that the proposed refurbishment will replace building elements which are in need of repair. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10) The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved in that the fafade remodel will complement the existing architectural style throughout the development. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35.
