After careful consideration of the request, the City Planner has determined that the request meets all of the findings below and APPROVES this request. The proposed project includes the renovation of an existing pedestrian plaza, remodel of the fa~ade of several inline shops, and the addition of fenced outdoor dining areas for existing tenants located on the upper level of the Plaza Paseo Real shopping center at 6951 El Camino Real {APN 215-050-76). Specifically, the remodel includes the following improvements: • Removal o'f an existing stucco canopy attached to the inline shops and replacement with a new steel shade structure which complements the Spanish/Mediterranean design of the shopping center, specifically the attached Cinepolis building and the proposed remodel to the upper level pedestrian plaza. • Addition of new lighting fixtures to the in line shops. • Addition of defined outdoor dining areas to the existing inline tenants adjacent to Cinepolis. As the individual outdoor dining areas will not exceed 400 square feet per tenant, no additional parking is required. • Update to the existing planters located in the upper pedestrian plaza, including the addition of xeriscape landscaping. • Addition of a shade canopy, new furniture, decorative metal screens/lighting, and two areas of artificial turf to the upper-level pedestrian plaza. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1} No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the renovation to the upper- /eve/ pedestrian plaza and inline shops adjacent to Cinepolis in the Plaza Paseo Real shopping center are consistent with SDP 86-ll{A) and the El Camino Real Corridor Guidelines, which require a color palette and materials that complement a Spanish or Mediterranean architectural theme. 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that the remodel to the plaza includes an updated design which complements the Plaza Paseo Real shopping center, including the adjacent Cinepolis building and a previous remodel to the lower-level pedestrian plaza. Community Development Department Planning Division I 1635 Faraday Avenue Carlsbad, CA 92008-7314 I 442-339-2600 www.carlsbadca.gov CD 2022-0005 (DEV2017-0162)-PLAZA PASEO REAL January 16, 2023 Page 2 3) The proposed revision does not change the density or boundary of the subject property. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit in that the project entails a remodel to an existing shopping center approved pursuant to SDP 86-11{A). 5) The proposed revision does not rearrange the major land uses within the development. 6) The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code in that no building additions are proposed and the new individual outdoor dining areas are less than 400 square feet; therefore, no additional parking is required. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation. 8) The proposed change would not result in any health, safety or welfare impacts. 9} There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10) The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved in that the remodel to the upper pedestrian plaza and inline shops complements the design of the shopping center and is consistent with SDP 86-11(A) and the El Camino Real Corridor Guidelines. After careful consideration of the circumstances surrounding this request, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35.
