After careful consideration of the circumstances surrounding this request, the City Planner has determined that the four findings required for granting an Administrative Variance to park a boat on a trailer in the front yard, within the private property can be made and therefore, APPROVES this request based on the following findings and conditions. Findings: 1. That parking in, or access to, the side or rear yard will require structural alteration to the existing residence in that requiring the boat-on-trailer to be parked in a side or rear yard {CMC Section 21.44.060 Table E) is infeasible as it would require significant structural alterations to the existing single-family residence. The dimensions of the trailer are 7'-6" {width) by 20'-0" {length}. The existing northerly side yard setback is 6'-0" {exclusive of roof eaves). The southerly side yard setback measures 7'-0" {exclusive of roof eaves). 2. That parking in, or access to, the side or rear yard would require extensive grading to the side or rear yard. It is infeasible to fit the 7'-6" wide trailer along either the 6'-0" or 7'-0" wide side yards given the limited space between the existing single-family residence and side property lines or under the roof eaves due to limited clearances. Significant structural alterations would be required to the existing single-family residence to fit the vehicle along the side yard. Therefore, it is infeasible to locate the boat-on-trailer along either side yard without significant structural and/or grading alterations. 3. That parking the recreational vehicle in the front yard will not interfere with visibility to or from Laredo Street in that the subject property's physical characteristics do not create inherent sight distance issues along the street. Additionally, the subject property's existing flat area within the property can adequately accommodate the 7'-6" {width) by 20'-0" {length) trailer without encroaching into the sidewalk and/or public right-of-way. 4. That the recreational vehicle in the front yard will not interfere with traffic on the street or sidewalk, or encroach into the street and utility right-of-way in that the proposed boat-on-trailer parking area is fully within the private property and is of an adequate depth and length to park the 7'-6" {width) Community Development Department Planning Division I 1635 Faraday Avenue Carlsbad, CA 92008-7314 I 442-339-2600 www.carlsbadca.gov V 2022-0008 (DEV2022-0197} -3606 LAREDO STREET RV January 24, 2023 Page 2 by 20'-0" (length} boat-on-trailer. Therefore, the trailer will not encroach into the sidewalk or public right-of-way, thus allowing for street and sidewalk traffic to proceed unobstructed. 5. That the City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15061(b}(3} of the State CEQA Guidelines -Common-Sense Exemption. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. Conditions: 1. The boat shall be on the trailer and parked on the northerly portion of the driveway and remain completely out of the public right-of-way at all times when on-site. 2. The boat-on-trailer is not considered a habitable structure when parked on the property and shall not be used in such a manner. 3. When parked on the property, all "slide-outs," "pop-ups," awnings or similar features shall not be deployed and shall be kept in the "in" or "down" position in order to minimize the mass of the vehicle when parked on the property. 4. Approval is granted for V 2022-0008 as shown on Exhibit "A", dated March 14, 2023, on file in the Planning Division and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. This decision may be appealed by you or any member of the public to the Planning Commission within ten days of receipt of this letter. Appeals must be submitted in writing to the Planning Commission at 1635 Faraday Avenue in Carlsbad, along with a payment of $847.00. The filing of such appeal within such time limit shall stay the effective date of the order of the City Planner until such time as a final decision on the appeal is reached.
