This memorandum provides information regarding the intended reinstallation of signage
indicating, "No Parking 11:00 p.m. to 5:00 a.m.," at Holiday Park.
Background
Several members of the community who reside in the area of Holiday Park have expressed
concerns of on-going criminal and transient activity in and around Holiday Park, 3333 Eureka
Place. The Police Department responded to two City Council inquiries in August 2022 (C001596-
082522 -11950 and C001588-081122 -11872) regarding Holiday Park. Residents have also
expressed concerns about homelessness at the park and specifically, people living out of their
vehicles near the park. Currently, the Police Department cannot enforce nighttime parking at
Holiday Park due to no signs being posted indicating, "No Parking 11:00 p.m. to 5:00 a.m.".
In July 2021, there was a homicide that occurred at Holiday Park at 11:00 p.m. In this case, the
victims went to the park to purchase illegal drugs and approached the wrong vehicle that was
parked at the park. The suspects in the vehicle, who were homeless, fled the area while shooting
at the victims, injuring one and killing the other.
The Police Department has conducted extra patrols of the park in the evenings and have
contacted homeless persons living out of their vehicles.
Carlsbad Municipal Code Section 11.32.030 (13) states that it is unlawful "To park or stand any
vehicle or trailer in any public park in the city between the hours of 11:00 p.m. and 5:00 a.m.
daily, except as permitted by the city manager or designee." Pursuant to California Vehicle Code
Section 22507(a), signs are required to enforce the parking restriction.
Several years ago, these no parking signs were posted at Holiday Park. At that time, community
members who reside in the area attended a City Council Meeting and asked the city to remove
the signs so residents could park in the stalls overnight. The signs were removed by the Parks &
Recreation Department at the direction of a prior City Manager.

Discussion
The Police Department contacted the residents in the area of Holiday Park to address their
concerns. One concern raised by the residents was persons parking at the park after the park's
standard operating hours. The parking stalls of concern are across the street from residential
housing on Eureka Place and on Pine Avenue. Some residents feel unsafe when those persons
who do not live in the area park in these stalls late at night.
The Police Department recommends reinstalling the no parking signs at Holiday Park. Reinstalling
the sign age would provide the Police Department the ability to issue citations to vehicles parked
after hours at the park. This ability to issue citations is expected to significantly reduce activity at
Holiday Park during nighttime hours. The reduction in activity at the park during nighttime hours
is expected to provide the neighboring community a sense of safety.
The Police Department conducted outreach with the surrounding community by use of the Next-
Door application in August 2022. The Police Department also created a brochure on department
letterhead, which provided information regarding the reinstallation of the no parking signs, as
well as the intent to conduct enforcement. The Police Department distributed these brochures
on January 9, 2023, to community members who reside in the area of Holiday Park, specifically in
housing on Pine Avenue and on Eureka Place. Brochures were left in mailboxes for the residents
that were not home. Property management for one of the apartment complexes on Eureka Place
distributed the brochures to their tenants via e-mail in January and also communicated the
intent to reinstall the sign age. Residents with concerns related to the reinstallation of the no
parking signs were advised to contact the Police Department. As of January25, 2023, the Police
Department has not received any objections regarding the reinstallation of the no parking signs.
Cost
The city's Transportation Department conducted an assessment on Pine Avenue and on Eureka
Place where the no parking signs would be posted. Based on the assessment, 23 signs and 18
posts are needed, at an approximate cost of $2,186. The cost of the signs and posts can be
absorbed within the Police Department budget.
Next Steps
Once the signs are installed by the Transportation Department, the Police Department will
conduct education regarding the parking restriction and begin enforcing the municipal code with
parking citations.
