PLANNING COMMISSION RESOLUTION NO. 2871
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A
TENTAllVE TRACT ON PROPERTY GrnERALLY LOCATED AT THE
SOUTHERN TERMINUS OF JAMES DRIV E, BETWEEN HILLSIDE AND
PARK DRIVE.

WHEREAS, a verified application for certai n property to wit:
Lot s 16 and 17 in Block G of Bellavi sla in the City of
Carlsbad, County of San Diego , State of California
according to Map thereof No . 2152 filed in the office of
the County Re~order March 7, 1929. Also, that portion of
Lot 18 and said Block G of Bellavi sta lying northerly of
the easterly prolongation of the northerly line of the
southerly 5 feet of Lot 1 in Block E of Bellavi sta .
ha s been filed with the City of Carl sbad and referred to the Planni ng
Commi s sion; and
WHEREAS, said verified application const i tute s a request as provided
by Title 21 of the Carlsbad Muni c ipal Code; and
WHEREAS, the Planning Commi ss ion did, on the 7th day of June, 1989 ,
hold a duly noticed publi c hearing as pre scribed by law to cons ider said
request; and
WHEREA S, at s aid public hearing , up on hearing and considering all
testimony and arguments , if any , of all perso ns des iring to be heard, said
Commi ssion considered all factors relating to the Tentative Tract Map and
Planned Unit Development .
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Convnis s ion as
follows:
A) That the above rec itations are true and correc t .
BJ That based on the evidence presented at the publi c hearing, the Commi ssion
recommends APPROVAL of CT 88 -5, ba sed on the following finding s an d
subJect to the following conditions :
Ffn ding s:
1. The project is consistent with the City's General Plan since the project
proposes de velopment of single family detached hon~s within the density
range of O to 4 dwelling units per acre as specified on the site as
indicated by land use on the General Plan. The project is proposed to be
developed above_ the Gro wth Control Point of 3.2 dwelling units per net
acre for the site. This is Justified given the signiriL~nl drainage
improvements on site which will improve drainage facilities for Zone I
along with aiding in maintaining the Agua llcdionda . There is sufficient
developments within Zone 1 that have been developed below this Growth
Control Point to allow this project to exceed by 2 dwellings the Growth .
Control Point intensity for the site.
2. W~th ~he cor~ection of existing drainage and geotechnical situations, the
site is physi_cally suitable for the type and density of the development
s rnce the s 1 te 1 s adequate in size and shape to accorrmodate the
residential development and the density proposed.
3. All necessary public improvements required by this project shall be
constructed or guaranteed to be constructed concurrently with the need for
them created by this development and in cumpl iance with adopted City
standards.
4. The Planning Commission has, by inclus i on of an appropriate conditi on to
this proJect, ~nsured that the final map will not be approved unless the
City Council finds that sewer service is available to serve the projec t .
In addition, the Planning Commi ssion has added a condition that a note
shall be placed on the final map that building permits may not be Is sued
for the project unless the City Engineer determine s that sewer service Is
available , and bui]ding cannot occ ur within the project unless sewer
service remains available, and the Planning Commission Is satisfied that
the requirements of the Public Facilities Element of the General Plan have
been met insofar as they apply to sewer service for thi s project.
5. School fee s will be paid to ensure the availabil i ty of school facilit i es
in the Carlsbad School District.
6. Park-in-lieu fees are required as a condition of approval .
7. All necessary public improvements have been provided or will be required
as conditions of approval .
8. The applicant has agreed and is required by the inclusion of an
appropriate condition to pay a public facilities fee . Performance of that
contract and payment of _the fee will enable this body to find that publi c
facilities will be available concurrent with need as required by the
General Plan.

The proposed project is compatible with the surrounding future land uses
since surrounding properties are designated for residential low medium
single ·family detached development on the General Plan.
This project will not cause any significant environmental impacts and•
Negative Oeclaration has been Issued by the Planning Director on March
29, 1989 and approved by the Planning Commi_ssion on J.une 7, 1989 . In
approving this Negative Declaration the Planning Commission has considered
the initial study, the staff analysis, all required mitigation measures
and any written conm,ents received regarding the significant effects this
project could have on the environment.
This project is consistent with the City 's Growth Management Ordinance as
it has been conditioned to comply with any requirement approved as part
of the Local Facilities Management Plan for Zone I.
This project was subject to Chapter 21 .95 of the Carlsbad Municipal Code
(llillside Ordinance) and meets all the . re,uirements of that Chapter to
ensure the sensitive treatment of the City s hillside resources.

MAP MAJOR SUBDIVISION CT-
Conditions :
I. Approval is granted for CT 88-5/HDP 89 -1, as shown on Exhibits "A"-"J",
dated June 7, 1989, incorporated by reference and on file In the Planning
Department. Development shall occur substantially as shown unless
otherwise noted In these conditions.
2. The developer shall provide the City with a reproducible 24' x 36', 100
scale mylar copy of the Tentative Map as approved by the Planning
Con~,; ss ion. The Tentative Map sha 11 reflect the conditions of approval
by the City. The map copy sha 11 be submitted to the City Eng I neer prior
to Issuance of building permits or improvement plan submittal, whichever
occurs first.
3. A 500' scale map of the subdivision shall be submitted to the Planning
Director prior to the recordation of the final map . Said map shall show
all lots and streets within and adjacent to the project.
. 4. lhis project is approved upon the express condition that the final map
shall not be approved unless the City Council finds as of the time of such
approval that sewer service is available to serve the subdivision .
5. This project is approved upon the express condition that building permits
will not be Issued for development of the subject property unless the City
Engineer ,determines that sewer facilities are available at the time of
application for such sewer permits and will continue to be available until
time of occupancy . This note shall be placed on the final map.
6. This project js also approved under the express condition that the
applicant pay the pub l i c faci l it i es fee adopted by the City Counc 11 on
July 28, 1987 and as amended from time to time, and any development fees
established by the City Council pursuant to Chapter 21.90 of the Carlsbad
Municipal Code or other ordinance adopted to implement a growth management
system or facilities and improvement plan and to fulfill the subdlvider's
agreement to pay the public facilities fee dated August 15, 1988, • copy
of which is on file with the City Clerk and is incorporated by this
reference . If the fees are not paid this application will not be
consi s tent with the General Plan and approval for this project will be
void .
7. The applicant shall pay park-in -lieu fees to the City, prior to the
approval of the final map as required by Chapter 20.44 of the Carlsbad
Municipal Code.
8. The applicant shall provide school fee s to mitigate conditions of
overcrowding as part of building permit application. These fees shall be
based on th e fee schedule in effect at the time of building permit
application .
9. Water shall be provided to this project pursuant to the Water Service
agreement between the City of Carlsbad and the Co s ta Real Water District,
dated May 25, 1983.
JO . Thi s project shall comply with all cond i tions and mitigation required by
the Zone I Local Facilities Management Plan approved by the City Council
on September I, 1987, incorporated herein and on file in the Planning
Department and any future amendments to the Pl an made prior to the
issuan ce of building permits.
12. If any condition for construction of any public improvements or
facilitie s, or the payment of any fees in lieu thereof, imposed by this
approval or imposed by law on this project are challenged this approval
shall be suspended as provided in Government Code Section 65913.5. If
any su ch condition is determined to be invalid this approval shall be
invalid unle ss the City Council determines that the project without the
condition complies with all requirements of law.
13. Approval of this request shall not excu se compliance with all sections of
the Zoning Ordinance and all other applicable City ordinances In effect
at time of building permit Issuance .
14 . Approval of CT 88-5 is granted subject to the approval of HOP 89-1 .
15. All roof appurtenances, including air conditioners, shall be
architecturally integrated and concealed from view and the sound buffered
from adjacent properties and streets, purs uant to Building Department
Policy. No. 80-6, to the satisfaction of the Directors of Planning and
Building .
16 . The applicant shall prepare a detailed lands cape and irrigation plan which
shall be su~11itted to and approved by the Planning Director prior to the
issuance of grading or building permits, whichever occurs first.
17 . The developer shall install street trees at the equivalent of 40 -foot
intervals along all public street frontages in conformance with City of
Carlsbad standards. The trees shall be of a variety selected from the
approved Street Tree List .
18 . Building identification and/or addresses shall be placed on all new and
existing buildings so as to be plainly visible from the street or access
road; color of identification and/or addresses shall contrast to their
background color.
19 . The developer shall provide a minimum of 25 percent of the lots with
adequate sideyard area for Recreational Vehicle storage pursuant to City
Standards.
20. Prior to i ss uance of a grading or building permit, whichever comes first,
a soils report shall be prepared and submitted to the City of Carlsbad.
If the soil s report indicates the presence of potential fossil bearing
material then a standard two phased program, on file in the Planning
Department, shall be undertaken to avoid possible s ignificant impacts on
paleontologi cal resources under the direction of the Planning Department.
21. The developer shall display a current Zoning and Land Use Map in the sales
office at all times , or suitable alternative to the satisfaction of the
Planning Director. ·
22 . All s ales maps that are distributed or made available to the public shall
include but not be limited to trails, future and existing schools, parks,
and streets.
23. Prior to issuance of a building permit the applicant shall sublllft a
unified fencing plan for the perimeter of the project, subject to the
satisfaction of the Planning Director. This fence shall be installed
prior to occupancy of any units.

No grading permit s shall be issued for this subdivision prior to
recordation of the final map.
The developer shall obtain a grading permit prior to the commencement of
any clearing or grading of the site.
The grading for this project is defined as "controlled grading" by Section
11.06 . 170(a) of the Carlsbad Municipal Code. Grading shall be performed
under the observation of a ci~il engineer whose responsibility it shall
be to coordinate site inspection and testing to ensure compliance of the
work with the appr_oved gradrng plan, submit required reports to the City
Engineer and verify compliance with Chapter Jl.06 of the Carlsbad
Municipal Code .
Upon completion of grading, t_he developer shall ensure that an "as -graded"
geologic plan shall be submitted to the City Engineer. The plan shall
clearly show an the geology as exposed by the grading operation, all
geolog1c correct1ve measures as actually constructed and must be based on
a contour map whl_ch represents both the pre and post site grading. This
plan shall be signed by both the soils engineer and the engineering
geologist. The plan shall be prepared on a mylar or similar drafting film
and shall become a permanent record.
28. No grading shall occur outside the limits of the subdivision unless a
letter of permission is obtained from the owners of the affected
properties.
29. A separate grading plan shall be submitted and approved and a separate
grading permit issued for the borrow or disposal site if located within
the city limits.
JO . All slopes within this project shall be no steeper than 2:1.
JI . Prior to hauling dirt or con struction materials to any proposed
construction site within this project the developer shall submit to and
receive approvaf from the City Engineer for the proposed haul route. The
developer shall comply with all conditions and requirements the City
Engineer may impose with regards to the hauling operation.
32. The developer shall exercise special care during the construction phase
of this project to prevent any offsite siltation. The developer shall
provide eros ion control measures and shall construct temporary
desiltation/detention basins of type, size and location as approved by
the City Engineer. The basins and erosion control measures shall be shown
and specified on the grading plan and shall be constructed to the
satisfaction of the City Engineer prior to the start of any other grading
operations. Prior to the removal of any basins or facilities so
constructed the area served shall be protected by additional drainage
facilities, slope erosion control measures and other methods requlred or
approved by the City Engineer. The developer shall maintain the temporary
basins and erosion control mea sures for a period of time sati sfactory to
the City Engineer and shall guarantee their maintenance and satisfactory
performan ce through cash deposit and bonding in amounts and types suitable
to the City Engineer .
33. Additional drainage easement s and drainage structures shall be provided
or ins talled as may be required by the City Engineer.
34 . The developer shall pay the current local drainage area fee prior to
approval of the final map for this project or shall construct drainage
systems in conformance with the Ma ster Drainage Plan and City of Carlsbad
Standards as required by the City Engineer.
35 . The owner of the subject property shall execute a hold harmless ·agreement
regarding drainage across the adjacent property prior to the ·approval of
final map for this project .
36 . The developer shall make an offer of dedication to the City for all public
streets and easements required by these conditions or shown on the
Tentative Map. The offer shall be made by a certificate on the final map
for this project. All l and so offered shall be granted to the City free
and clear of all liens and encumbrances and without cost to the City.
Streets that are already public are not required to be rededicated.
37. Hill side Drive shall be dedicated by the developer along t he subdivision
frontage based on a center. line to right-of-way width of 34 feet and in
confonnance with City of Carlsbad Standards prior to occupancy of any
buiMings.
38 . Direct access rights for all lots abutting Hillside Dri ve shall be wai ved
on the final 01ap.
39. Plans, specifications , and supporting document s for all improvements shall
be prepared to the satisfact i on of the City Engineer. Prior to approval
of the final map, the Subdivider shall install, or agree to install and
secure with appropriate security as provided by law, improvements shown
on the tentative map and the following improvements to City Standards to
the satisfaction of the City Engineer:
a. One-half street improvements to liillside Drive including
offsite transitions along the boundary of the subdivision.
This shall include full replacement of the existing structurol
section to the centerline of Hillside Drive.
b. Full width improvements to James Drive onsite and offsite to
its existing terminus.
c. "A" Street as shown on the tentative map .
d. All sewer, water, and storm drain improvements necessary to
serve this subdivision as shown on the tentative map.
e. Undergrounding of overhead utilities adjacent to this
subdivision.
40. Improvements listed above shall be con structed within 12 months of final
map approval and/or improvement plan approval, whichever occurs first.
41 . Unless a standard variance has been issued, no variance from City
Standard s is authorized by virtue of approval of this Tentative Map.
42. The developer shall comply with all the rules , regulations and design
requirements of the respective sewer and water agencies regarding services
to' the project.

The Subdivider shall provide separate sewer , water, gas, and electric
services with meters to each of the units.
46. The developer shall be responsible for coordination with S.D.G.&E.,
Pacific Telephone , and Cable TV authorities .
47. Some improvements shown on the Tentative Map and/or required by these
conditions are located offsite on property which neither the City nor the
subdivider has sufficient title or interest to permit the improvements to
be made without acquisition of title or interest . The subdivider shall
conform to Section 20.16.095 of the Carlsbad Municipal Code .
48. Approval of this tentative tract map shall expire twenty -four months from
the date of City Council approval unless a final map Is recorded. An
extension may be requested by the applicant. Said extension shall be
approved or denied at the discretion of the City Council . In approving
an extension, the City Council may impose new conditions and may revise
existing conditions .
49 . Prior to final map approval the applicant shall file an adjustment plat
for that portion of James Dri ve at the northeast boundary of t his
subdivision, to be deeded to adjacent owner(s) as shown on t he Tent ati ve
Hap.
Fire Department Conditions
50 . Additional public and/or onsite fire hydrant s shall be provided if deemed
necessary by the Fire Marshal.
51 . The applicant shall submit two (2) copies of a s ite plan showing locations
of existing and proposed fire hydrants and onsite roads and drives to the
Fire Marshal for approval .
52. An all-weather access road shall be maintained throughout construction .
53. All required fire hydrants, water mains and appurtenances shall be
operational prior to combustible building materials being located on the
project site.
54 . Fire retardant roofs shall be required on all structures .
55 . Brush clearance shall be maintained according lo the specifications
contained in the City of Carlsbad Landscape Guidelines Manual.
56 . AH fire alarm systems, fire hydrants, extingui shing systems, automatic
sprinklers, and other systems pertinent to the project shall be submitted
to the Fire Department for approval prior to construction.
57 . Prior to issuance of a building permit, the applicant shall sublll it • 400
scale map of the project subject to the approval of the Fire Mar shal.
