Additionally, this memorandum provides information regarding a request from the City of Encinitas for a potential partnership to establish Quiet Zones. Background The Council Memorandum dated March 19, 2019, provided background information on the four at-grade railroad crossings within the city, which are located at Cannon Road, Tamarack Avenue, Carlsbad Village Drive and Grand Avenue. It also provided information regarding the City Council's legislative platform and goal on double-tracking in the city and lowering the railroad tracks in a trench through the Village as well as the North County Transit District (NCTD) Board of Directors-adopted resolution on revised train horn protocols at pedestrian crossings. Additionally, Attachment A provided information on the steps needed and a preliminary cost estimate to implement a Quiet Zone at the four at-grade railroad crossings as well as the additional liabilities that the city would assume should the city establish a Quiet Zone at the city's railroad crossings. Since the NCTD has updated their train horn protocols, which require all trains to sound their horn when approaching pedestrian crossings, cities impacted by these new protocols have looked further into establishing Quiet Zones. For example, the City of Oceanside recently established a Quiet Zone at all their city's at-grade crossings. In addition, the City of Encinitas completed a Quiet Zone Feasibility Analysis in 2019 (Attachment B). Discussion Recently, the City of Encinitas staff reached out to NCTD staff to determine design and coordination costs associated with establishing a Quiet Zone at all their at-grade crossings. As stated in the City of Encinitas Quiet Zone Feasibility Analysis, the City of Encinitas is interested in establishing a Quiet Zone at the Cannon Road crossing, which is in the City of Carlsbad. To create an effective Quiet Zone throughout Encinitas, the segment of rail corridor north of Leucadia Boulevard must be "bookended" by a second at-grade railroad crossing with Quiet Zone status. The nearest at-grade crossing to the north of Leucadia Boulevard is at Cannon Road. Public Works Branch Transportation Department 1635 Faraday Avenue I Carlsbad, CA 92008 I 442-339-2730 t Council Memo -Train Horn Use and Quiet Zones Update (Districts 1 & 2) February 16, 2023 Page 2 Without Quiet Zone establishment at the Cannon Road crossing, any future at-grade pedestrian crossing north of Leucadia Boulevard would be outside of the Quiet Zone limits, thereby requiring train horns to be sounded as explained in further detail in Attachment B. Most recently, the City of Encinitas staff reached out to the City of Carlsbad staff to suggest executing a Memorandum of Understanding (MOU) with the NCTD, seeking reimbursement from the City of Carlsbad for the design cost and ultimately the construction cost of establishing a Quiet Zone at the Cannon Road crossing. A draft MOU between the NCTD and the Cities of Encinitas and Carlsbad regarding establishing a Quiet Zone is provided (Attachment C). The estimated cost to design a Quiet Zone at Cannon Road is approximately $150,000 with an unknown construction cost. In 2006, staff presented to the City Council that the preliminary cost estimate to implement a Quiet Zone in Carlsbad at the four at-grade railroad locations was $2.7 million, with the expected range to be between $2 million and $2.7 million. Currently, there is neither a project in the city's Capital Improvement Program (CIP) nor any funding allocated for staff to work on establishing a Quiet Zone at any of the crossings within the city, including at Cannon Road. Furthermore, as stated in Attachment A, establishment of a Quiet Zone at any ofthe at-grade crossings throughout the city may shift liability from the NCTD to the city in any potential resulting litigation. Additionally, due to the -absence of a warning horn sound, a Quiet Zone may increase the likelihood of collisions depending on the adequacy of any supplementary safety measures installed at the at-grade crossings. An increased number of collisions would potentially increase the number of prospective lawsuits and the city's potential exposure to liability. Next Steps As indicated above, there is no CIP project or funding available for staff to work on establishing a Quiet Zone. To discuss the funding required for establishing a Quiet Zone within the city, the City Council would need to provide direction to put this item on the agenda for a future City Council meeting. This may be initiated by a Council Member request to the City Manager under Carlsbad Municipal Code Section 1.20.060(C), or by a motion during the portion of the City Council meeting agenda reserved for "Council Commentary and Requests for Consideration of Matters." On Nov: 25, 2014 und~r Resolution No. 2014-268, ~he -Carlsbad City Council updated the city's legislative platform regarding double-tracking in the city and appropriated funds to be used in the city's "efforts related to the Carlsbad ViUage Double Track Project." The funds were used to study trenching the. railroad tracks in an area encompassing the rail corridor segment just north of Pine Avenue, through the Carlsbad Village Coaster station, to a point just south of Eaton Street in Oceanside. In 2016, City Council adopted the following City Council Goal: "Lower the railroad trncks in a trench through the Village to improve safety, community connectivity, quality of life an,d - economic value." San Diego Association of Governments (SAN DAG), in partnership with the city, completed the Carlsbad Village Double Track -Railroad Trench Alternative Economic Analysis and Feasibility Study in January 2017. · : . In 2018, the City Council goc1I was amended to: "By 2023, break ground on lowering the railroad tracks in a trench through the Village to improve safety, community con·nectivity, quality of life and economic value." City Council appropriated $2 million in the Fiscal Year 2018-19 Capital Improvement Program budge~ for the railroad double-tracking project. On ,Nov. 27, 2018, City Council approved the next step in advancing the project under Resolution No. 2018-202, aut.horizing th~ city manager to negotiate. and execute a Memorandum of Understanding with SAN DAG to complete an Alternatives Analysis and Preliminary Engineering for a Carlsbad Village Railroad Trench in ·an amount not to exceed $375,000. The North County Transit D.istrict (NCTD) Board of Directors adopted a Resol.ution on Dec. 20, 2018 approving the NCTD Integrated Safety Management System Plan, which included a discussion of revised train horn protocols. NCTD sent a letter to the city on Dec. 21, 2018, _ describing the newly adopted changes (Attachment A). It stated, "Effective immediately, based on direction received from the Federal Railroad Administration (FRA), aHtrains -commuter and freight -must sound their horn in accordance with the California Public Utilities (CPUC) regulation Pubiic Utility Code 7604 when approaching pedestrian crossings." The purpose of the regulation is to support the safety of pedestrians near the tracks. The letter indicated that all . Coaster stations, such as the Carlsbad Village station, would be impacted by this change unless grade separated. Discussion A Quiet Zone is defined as a section of a rail line at least one-half mile in length that contains one or more consecutive public highway-rail g~ade crossings at which locomotive horns are not routinely sounded when trains are approaching the crossings. Cities may establish a Quiet Zone under a process described in the Code of Federal Regulations, Title 49 Part 222 (49 CFR Part 222). Acting as the lead agency pursuing a Quiet Zone, the city would be required to enter into a Construction and Maintenance Agreement with_NCTD, per NCTD Board Policy No. 18. In addition, the Quiet Zone is -established by installing supplemental safety measures (SSMs) at the railroad crossing. A partial list of SSMs that might be required include: · • Quad gates • Automatic gate arms specifically for pedestrians • Upgrades to existing crossing arms with additional lights and electronic bells • Railroad signalizing equipment • Pre-emption features at nearby traffic signals .• Traffic signal detection system for railroad gate operations • Signs and road striping • Other infrastructure needs, such as roadway and sidewalk improvements, channelization to ensure that pedestrians do not circu·mvent the gate arms, bollards and fencing along the railroad track On Oct. 10, 2006, Agenda Bill# 18;757 (Attachment B) was presented to City Council to determine if the process to establish railrnad crossing Quiet Zones should be initiated. City Council directed staff to ri;!search the financial impact of establishing a Quiet Zone. The Agenda Bill stated that the preliminary cost estimate to implement a Quiet Zone in Carlsbad at the four at-grade railroad stations would be $2.;7 million. Using historical cost indices and an estimated index for January 2019 provided by RSMeans, today's estimate would be $3.8 million. With a Memorandum of Understanding, NCTD would design, construct and maintain railroad improvements associated with a Quiet Zone. All costs associated with these activities would be reimbursed to NCTD by the city prior to expenditures ~ccurring. An update on establishment of Quiet Zones was presented to City Council on Aug. 27, 2013 with Agenda Bill# 21,350 (Attachment C}. Establishing a Quiet Zone locally would require the city to assum~ additional liabilities. The additional liabilities under a Construction and Maintenance Agreement with NCTD include: (1) broadly indemnifying NCTD for all claims related to the city's failure to comply with 49 CFR Part 222 and any negligent acts or omissions of the city in connection with any work, authority or Ho_norable Mayor Hall and Members of the City Council March 19, 2019 Page 3 jurisdiction of the city as required by 49 CFR Part 222 and related to establishment and operation of a Quiet Zone; and (2) obtaining insurance coverage for any city construction activities within the railroad crossing(s) that are performed under the Construction and Maintenance Agreement. Establishment of a Quiet Zone may also shift liability from a train operator to ~he city in any resulting litigation. Per 49 CFR Part 222, the regulation expressly exempts a train engineer from liability if they do not sound the train horn in. a Quiet Zone and an accident results. Although the FRA's stated intent was to extend the same protection to local authorities, there is no express languag_e to that effect in 49 CFR Part 222, and a court has not yet weighed in on this issue. Lastly, due to the absence of a warning horn sound, a Quiet Zone may increase the likelihood of collisions depending on the adequacy of any supplementary safety measures installed at the at- grade crossing. RECOMMENDED ACTION: Receive report and determine if the process to establish railroad crossing Quiet Zones should be initiated. ITEM EXPLANATION: The Federal Railroad Administration (FRA) published the Final Rule on the Use of Locomotive Horns at Highway Rail Grade Crossings on April 27, 2005 i'n response to a legislative mandate. The Final Rule became effective on June 24, 2005 and it requires that locomotive horns be sounded at all public at-grade crossings (49 CFR Part 222) as a warning to highway users. The locomotive horn must be sounded 15-20 seconds before entering the at-grade crossing, but no more than one- quarter of a mile in advance of the at-grade crossing. In Carlsbad, the four at-grade railroad crossings are located at Cannon Road, Tamarack Avenue, Carlsbad Village Drive, and Grand Avenue. The pattern for blowing the horn remains two long, one short, and one long sounding that is to be repeated as necessary until the locomotive clears the crossings. Authority remains for the locomotive engineer to vary this pattern as necessary for crossings that are in close proximity or in emergency situations. An important aspect of the Final Rule is that it pre-empts any state or local laws regarding the use of a train horn at public crossings. For several years, the City Council and staff have received citizen concerns regarding the blowing of locomotive horns and a desire to minimize or silence the horn blowing. The Final Rule provides the opportunity to mitigate the effects of the train horn noise and stipulates that only public authorities (PA) have the option to establish quiet zones, provided that certain supplemental or alternative safety measures are in place at the railroad crossing and that the crossing accident rate meets FRA standards. In Carlsbad, the pursuit of a Quiet Zone could be considered in the category of Full and Potential New Quiet Zones. A Full Quiet Zone are zones where the horn is silenced 24 hours per day. Partial Quiet Zones silence the horn only a portion of the day, typically between the hours of 10:00 p.m. and 7:00 a.m. Cities or counties are the only public authorities that can seek to establish Quiet Zones.' The railroad agency cannot. North County Transit District (NCTD} is the owner of and maintenance agency for the railroad facility and right-of-way through Carlsbad and for the entire railroad facility from the Orange/San Diego County boundary to the Del Mar/San Diego City boundary. The Board of Directors for NCTD have indicated a willingness to cooperate with cities to pursue and establish Quiet Zones under the new federal regulation. FOR CITY CLERKS USE ONLY. Carlsbad is the public authority seeking to establish the Quiet Zone and will act as the lead agency. 2. The development and application process to establish one or more Quiet Zones in Carlsbad must be cost-neutral to NCTD. 3. If the City Council determines that design of a Quiet Zone will proceed, Carlsbad must enter into a contract with NCTD for the design of all railroad improvements necessary and Carlsbad would be required to reimburse NCTD for these costs. NCTD is imposing this requirement in order to preserve their control of the consistency of design changes necessary to the railroad safety equipment at the at-grade crossing. 4. Should Carlsbad decide to pursue the construction of improvements to establish a Quiet Zone, a contract with NCTD would be necessary utilizing a Combined License, Cost and Maintenance Agreement for such construction. Carlsbad would reimburse NCTD for all construction-related costs for the railroad improvements to preserve NCTD control of changes to the railroad and for safety and coordination reasons. 5. After implementation of the Quiet Zone, any net increase in NCTD annual maintenance costs at a crossing resulting from the Quiet Zone implementation would be reimbursed to NCTD by Carlsbad as part of a contract agreement. 6. NCTD will obtain insurance coverage for the Quiet Zone liability and name Carlsbad as additional insured on NCTD's insurance policy. Carlsbad will be responsible to reimburse NCTD for the incremental increase in insurance costs for such coverage, proportional to the total number of Quiet Zone grade crossings in each jurisdiction having a Quiet Zone. In addition to the administrative actions, the Quiet Zone is established by installing supplemental safety measures (SSM's) at the railroad crossing. A partial list of SSM's that might be required include quad gates, automatic gate arms specifically for pedestrians, upgrades to existing crossing arms by the addition of additional lights and electronic bells, railroad signalizing equipment, pre-emption features at nearby traffic signals, traffic signal detection system for railroad gate operations, signs and striping, and other infrastructure needs such as roadway and sidewalk improvements, channelization to ensure that pedestrians do not circumvent the gate arms, bollards, and fencing along the railroad track. The attached Exhibit 2 contains Exhibit "A", a 19-step outline prepared by NCTD staff as a summary of the process the public authority (PA) would follow to establish a Quiet Zone. The detailed requirements are contained in the federal regulations. Although Carlsbad would be responsible to establish the Quiet Zone, there would be significant coordination with NCTD. Through a Memorandum of Understanding (MOU), NCTD will design, construct, and maintain the railroad improvements associated with the Quiet Zone. All costs associated with these activities will be reimbursed to NCTD by Carlsbad prior to expenditures occurring. Page3 ENVIRONMENTAL REVIEW: This informal action before the City Council has been determined to be statutorily exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15262, Feasibility and Planning Studies, of the State CEQA Guidelines and will not have any adverse significant impact on the environment. FISCAL IMPACT: An informal, preliminary meeting was recently held with representatives from NCTD and the California Public Utilities Commission to determine a rough order of magnitude cost to implement the four Quiet Zones in Carlsbad. The rough estimate developed by NCTD staff for the railroad signal warning devices costs are in the range of $2.2 million with an expected additional cost of $250,000 for NCTD support design consultants, construction support, and contract signal maintainers. Roadway improvements and other infrastructure needs could add an additional $250,000 or more. Thus, the preliminary cost estimate to implement a Quiet Zone in Carlsbad at the four at-grade railroad locations is $2.7 million, with the expected range to be between $2,000,000 and $2,700,000. At this time, there are no federal or state funds known to be available to implement a Quiet Zone. The PA shall comply with the requirements set forth in the federal regulation for the creation of a Quiet Zone, 49 CFR Part 222. 2. The PA shall submit all docmnentation to NCTD that is submitted to the Federal Railroad Administration (FRA) and California Public Utilities Commission (CPUC). 3. It is the responsibility of the PA to adhere to this policy's requirements and those set forth in the federal regulation for the establishment of a Quiet Zone. 4. The PA shall submit to NCTD a Notice of Intent (NOi) to create a Quiet Zone. 5. The PA shall invite all railroad operators affected by the proposed Quiet Zone, as well as the Federal Railroad Administration (FRA) and the California Public Utilities Commission (CPUC), to a Field Diagnostic Review Meeting. All requirements stemming from the Field Diagnostic Review Meeting shall be implemented in the establishment of the Quiet Zone. Said invited parties will include NCTD, Amtrak, and BNSF, and will also include Metrolink for the City of Oceanside, and MTS for the City of San Diego. The Field Diagnostic Review Meeting shall also address pedestrian-and bicycle-related issues. 6. The PA shall enter into a Memorandum of Understanding (MOU) with NCTD for all work described in this Phase I, after the Field Diagnostic Review Meeting . . 7. For each crossing that is located within the proposed Quiet Zone, the PA shall conduct a traffic and queuing study, as well as a separate pedestrian study that includes in its evaluation the impacts pedestrians may have on railroad operations. All such studies and reports shall be promptly provided to NCTD and the CPUC for review. 8. The PA shall update the National Grade Crossing Inventory data with the FRA and CPUC. In doing so, the PA shall use data gathered from each operator and NCTD, together with the data from the traffic study. The PA shall apply this updated information to the FRA Risk Calculator for the proposed Quiet Zone. 9. The PA shall provide NCTD, all rail operators, and the CPUC with preliminary drawings of each crossing within the proposed Quiet Zone. Such preliminary drawings will show all improvements as delineated from the Field Diagnostic Review Meeting, as well as all subsequent requirements submitted to the PA. A California Professional Engineer registered in the field of civil engineering shall · prepare such preliminary drawings. 5 10. Based upon the preliminary drawings, NCTD shall provide the PA with an order of magnitude cost estimate for the design, construction, and maintenance for the required railroad improvements and related itei:ns necessary for the establishment of the Quiet Zone. Phase II: Design, Construction, and Maintenance Agreement to Implement Quiet Zone 11 . The PA shall execute a Design, Construction, and Maintenance agreement with NCTD for all railroad related work as described above. Such Design, Construction, and Maintenance Agreement shall be a NCTD standard agreement. 12. NCTD shall perform the railroad related designs including but not limited to, new and upgraded warning devices, gates, power out indicators, wayside horns, Quiet Zone confirmation signals, exit management systems, grade crossing panels, signal system modification, addition and alternations of signal housing, pedestrian control devices, third-party utility connections, relocations, or modifications, in- pavement loop detectors, and other necessary signal requirements. 13. The PA shall submit any required applications to the CPUC for the approval of any changes to any crossing within the Quiet Zone. 14. NCTD shall submit a revised cost estimate to the PA after the completion of the design and prior to NCTD's development of an Invitation for Bid (IFB). The PA shall provide in writing their acceptance of the revised estimate prior to.NCTD's preparation of the IFB. 15. The construction schedule for railroad related improvements shall be established by NCTD for minimal disruption to ongoing railroad operations. This may require significant off-hours and "night work." The PA shall coordinate the construction of non-railroad related improvements with NCTD. 16. Prior to NCTD issuance of an Invitation for Bid (IFB), the PA shall submit a Letter of Acceptance to NCTD for the final construction and maintenance costs, schedule, and requirements to NCTD. 17. NCTD shall procure and construct the required railroad-related improvements at PA's cost and will notify the PA when all work has been completed and accepted byNCTD. 18. The PA shall notify NCTD in writing that all requirements for the establishment of the Quiet Zone have been met. · 19. After completion of the construction and the establishment of the Quiet Zone, the PA shall conduct a periodic review. These reviews will be conducted in the field and will consider any changes, together with any future improvements or developments that may have or will affect the qualification of the Quiet Zone. As residents of the Village by the Sea condos we are well aware of the horn blowing all times of the day. We feel that since this intersection already has crossing gates and signals there is rio reason for this horn blowing. While some conductors seen to appreciate the fact that people are sleeping -there are some that seem to feel that since they are up -we all should be awake. They not only blow their horns as they approach the intersection but continue all the way through and beyond. In the event of unsafe conditions, Quiet Zones do not apply and train conductors may sound their horns. The recommended upgrades at each crossing are known as Supplemental Safety Measures (SSMs), which are federally defined infrastructure improvements that include pedestrian gates, auto gates, fencing, audible warning systems, and other elements. The project area to create a comprehensive Quiet Zone spans four at-grade crossings of the rail corridor within the City: Leucadia Boulevard, Encinitas Station, D Street, and E Street (Figure 1). Improvements at these four locations would build upon the recently established Quiet Zone at Chesterfield Drive—the southernmost vehicular crossing in the City—to create a citywide Quiet Zone. REPORT ORGANIZATION This report evaluates and recommends SSMs for each of the four studied locations, and is divided into the following sections: — Section 2: Quiet Zone General Requirements is a basic primer on Quiet Zone regulations and requirements. — Section 3: Implementation Next Steps summarizes the next steps for project implementation, including a sample schedule and environmental considerations. — Section 4: Project Descriptions & Costs describes the proposed SSMs at each location and their estimated total costs. — The appendices contain additional technical details: — Appendix A: Concept design plans. — Appendix B: Detailed cost estimates. — Appendix C: Results of the Federal Railroad Administration (FRA) Quiet Zone Calculator. — Appendix D: Evaluation of improvements proposed in the initial site diagnostic meeting with stakeholders. BACKGROUND: RAIL CORRIDOR VISION STUDY The Encinitas Rail Corridor Vision Study (RCVS) was a comprehensive, stakeholder-driven effort to examine mobility issues and opportunities in the Encinitas coastal rail corridor. Completed in 2018, the RCVS took a broad perspective, coordinating multiple infrastructure elements to create a unified vision for the rail corridor with both near-term and long-term objectives. A key element of the RCVS recommendations was achieving a quieter rail corridor by implementing a citywide Quiet Zone for trains. That recommendation set the stage for this analysis, which assesses the feasibility of a citywide Quiet Zone, estimates the costs of improvements, and outlines a potential implementation process. WSP July 2019 Page 2 CITY OF ENCINITAS QUIET ZONE FEASIBILITY ANALYSIS “BOOKEND” REQUIREMENT AT CANNON ROAD TO ESTABLISH PERMANENT QUIET ZONE To create a permanent, effective Quiet Zone throughout Encinitas—including any future at-grade crossings that may be constructed in the future—the segment of rail corridor north of Leucadia Boulevard must be “bookended” by a second at-grade roadway crossing with Quiet Zone status. The nearest at-grade crossing to the north is at Cannon Road in the City of Carlsbad, approximately five miles from Leucadia Boulevard. Without Quiet Zone establishment at this location, any future at-grade pedestrian crossings north of Leucadia Boulevard would be outside the Quiet Zone limits, requiring train horns to be sounded. However, this “bookend” requirement for Cannon Road only applies if a new at-grade pedestrian crossing is constructed north of Leucadia Boulevard. If this does not occur, improvements at Cannon Road would not be necessary to create an effective Quiet Zone throughout Encinitas. RAIL CORRIDOR CONTEXT & GROWTH The Encinitas coast is a resource enjoyed by many, populated with unique residential communities, business districts, and beaches. Paralleling the coast just 1,000-1,500 feet inland, the Los Angeles-San Diego-San Luis Obispo (LOSSAN) Corridor is a significant heavy railroad corridor traversed by over 60 daily trains in its San Diego County section, including Amtrak and COASTER passenger services as well as freight operations. It is the nation’s second-busiest intercity passenger rail corridor and rapidly growing. With several double-tracking projects in progress to meet growing demand, the LOSSAN Corridor continues to accommodate more trains, with long-term plans to serve up to 101 daily trains by 2030 (Table 1). In Encinitas, double-tracking is complete south of G Street, and two additional projects to double-track the rest of the city are currently in development. The sound of train noise is a nuisance to many, diminishing quality of life through undesirable psychological effects—including stress and annoyance—as well as physiological health effects such as hearing impairments and sleep disturbance. The ability to cross the railroad corridor safely is another concern of the residents. Implementing a citywide Quiet Zone in Encinitas can greatly improve quality of life for residents, visitors, business owners and employees’ alike. The result will be less noise on their properties as well as improved safety for pedestrians, cyclists, and motorists moving about the coastal corridor. The federal Train Horn Rule (49 CFR Part 222) requires trains to sound their horns when approaching at-grade crossings to let people know the train is approaching and to stay clear. The Federal Railroad Administration (FRA) regulates roadway-rail grade crossings with the aim of reducing collisions between trains and autos/pedestrians/bicyclists. Train operators are required to sound their horns for 15-20 seconds and no more than one-quarter mile in advance of a roadway-rail grade crossing. WHAT IS A QUIET ZONE? A Quiet Zone is a section of a rail line at least one-half mile long with one or more vehicular at-grade rail crossings in which horns on heavy rail trains (e.g. COASTER, Amtrak and freight) are not routinely sounded when approaching at-grade crossings. Quiet Zones may be established at any roadway-rail grade crossing that meets federal requirements. The aim of a Quiet Zone is to reduce noise around roadway-rail grade crossings for nearby residents and businesses. However, because train horns may still be sounded in unsafe conditions as determined by the train operator—and because Quiet Zones do not eliminate bells located at the crossings themselves—Quiet Zones may be more accurately described as “reduced noise zones.” A Quiet Zone can be active 24 hours a day, or during part of the day (e.g. at night). WHAT CONDITIONS ARE REQUIRED TO CREATE A QUIET ZONE? Because the absence of train horns increases the risk of a crossing collision, Quiet Zones require additional safety features to be installed. These supplementary safety measures (SSMs) are defined in the federal Train Horn Rule, and include: — Four-quadrant gates that fully block vehicular traffic from entering the crossing — Gates with raised medians or other channelization devices (e.g. fencing) — Wayside horns directed toward the crossing roadway — Other infrastructure elements In some cases, some or all SSMs may already be in place while in other situations, installation of some SSMs may be necessary prior to Quiet Zone establishment. HOW ARE THE REQUIRED SUPPLEMENTARY SAFETY MEASURES DETERMINED? The FRA offers a free, online Quiet Zone Calculator to assist local jurisdictions in assessing Quiet Zone eligibility and identifying specific SSMs that may be required. The calculator considers many characteristics including existing infrastructure, the number of passing trains per day, the speed of passing trains, the size of the roadway crossing, the volume of traffic on the roadway crossing, and historical safety data. The output is a Quiet Zone Risk Index score for each studied crossing. CITY OF ENCINITAS QUIET ZONE FEASIBILITY ANALYSIS WSP July 2019 Page 5 The Quiet Zone Calculator allows the local jurisdiction to consider a variety of options in determining which SSMs make the most sense. Implementing agencies should first assess the level of risk at each crossing under existing conditions, and then reassess the crossings with one or more SSMs installed, to determine the change in the Quiet Zone Risk Index that would result from the improvements. DO QUIET ZONES REQUIRE APPROVAL? The FRA has established an automatic approval process known as Public Authority Designation to streamline Quiet Zone establishment for crossings with sufficiently low risk factors. Proposed Quiet Zones may qualify for this process if their Quiet Zone Risk Index, as calculated by the FRA Quiet Zone Calculator, is below the following standards: — Risk Index with Horns: The level of risk that would exist if train horns were sounded at every public crossing in the proposed Quiet Zone. — Nationwide Significant Risk Threshold: The average of the calculated risk at all public at-grade rail crossings where train horns are routinely sounded. Updated annually by the FRA. At many crossings—including all studied crossings in Encinitas—installation of one or more SSMs will be sufficient to lower the risk index to qualify for automatic approval via Public Authority Designation. If the local jurisdiction opts not to install any of the SSMs defined in the Train Horn Rule— due to feasibility constraints or other local concerns—it may also consider the use of Alternative Safety Measures (ASMs) to achieve Quiet Zone status. ASMs include SSMs that have been modified to address unique local conditions, other infrastructure improvements that are not specific SSMs defined in the Train Horn Rule, and non-engineering methods such as education and enforcement. However, any use of ASMs renders the proposed Quiet Zone ineligible for automatic approval via Public Authority Designation, and instead requires formal application approval by the FRA, as well as continual monitoring and analysis to ensure the risk continues to be reduced. WHO CAN ESTABLISH A QUIET ZONE IN ENCINITAS? The City of Encinitas may implement Quiet Zones within city limits as the local public authority responsible for traffic control and law enforcement of at-grade crossings. HOW MUCH DOES A QUIET ZONE COST TO IMPLEMENT AND WHO PAYS? Costs will vary depending on the number of crossings being improved and the types of SSMs required. Section 4 includes descriptions and estimated costs for the proposed improvements at the four studied locations, and Appendix B contains more detailed cost estimates. The implementing agency would be responsible for funding all costs associated with implementation, including construction of the required supplemental safety measures. The project is estimated to take approximately three years, from the identification of project funding to ultimate activation of the Quiet Zone. Within this timeframe, final design and regulatory approvals are estimated to take a minimum of 18 months, selection of a construction contractor a minimum of three months, and actual construction a minimum of 12 months. The FRA Quiet Zone Calculator results (Appendix C) indicate that installation of the SSMs described in Section 4 could reduce the risk index at all four locations to levels sufficient to qualify the proposed Quiet Zone for FRA’s automatic approval process via Public Authority Designation. Automatic Approval therefore is assumed in Table 2, which would save up to 6-12 months compared to the FRA’s formal application-based approval process. See Section 2 for more details on the FRA Quiet Zone Calculator and approval processes. Any modifications to at-grade crossings—including SSMs intended to establish a Quiet Zone—must be approved by CPUC in accordance with its General Order 88-B process. Additionally, while Quiet Zones themselves do not require state approval, the CPUC’s Rail Crossings and Engineering Branch is required to evaluate and provide written comments on all Quiet Zone notices of intent, establishment, or continuation. CPUC staff also must be included in site diagnostic meetings to review proposed improvements at any at-grade crossings. ENVIRONMENTAL CLEARANCE Projects to install SSMs and other infrastructure at railroad crossings are subject to applicable federal, state, and local environmental regulations and guidelines. Generally, locally funded and state-funded projects are subject to the California Environmental Quality Act (CEQA). Federally funded projects or projects that require permits or approvals from federal agencies are subject to the National Environmental Policy Act (NEPA) and the regulations applicable to those agencies. Several jurisdictions that implemented Quiet Zones determined Quiet Zone SSMs to be categorically exempt from CEQA as improvements to existing facilities (CEQA Guidelines Section 15301(c)) and similarly exempt from NEPA if using federal funds or requiring federal approvals/permits. However, as lead agency for CEQA, each jurisdiction should evaluate the potential impacts of the specific SSMs proposed at each location— considering effects including, but not limited to, noise, visual resources, and traffic operations/circulation—to make its own determination regarding environmental review. If it is unclear whether SSMs could result in significant impacts under CEQA, an Initial Study could be prepared. WSP July 2019 Page 8 CITY OF ENCINITAS QUIET ZONE FEASIBILITY ANALYSIS 4 PROJECT DESCRIPTIONS & COSTS The following sections describe the recommended improvements at each of the four project locations: — Table 3 shows the estimated cost of improvements all crossing locations. — Sections 4.1 through 4.4 summarize the improvements at each location. — Appendix A contains detailed concept plans for each location. — Appendix B contains detailed cost estimates for each location. — Appendix C contains the results of the FRA Quiet Zone Calculator for all locations. — Appendix D lists all additional scope items suggested by stakeholder agencies at a site diagnostic meeting held on January 24, 2018. The initial basis for design is the analysis conducted with the FRA Quiet Zone Calculator (Appendix C), which identified SSMs sufficient to lower the risk index below the required thresholds. As described in Appendix D, the recommended improvements also include additional scope items suggested by stakeholder agencies at a site diagnostic meeting held on January 24, 2018. Participants included the Federal Railroad Administration (FRA), California Public Utilities Commission (CPUC), and North County Transit District (NCTD). The Cannon Road crossing (City of Carlsbad) is included in Table 3 since this roadway at-grade crossing is necessary to create a “bookend” for the Quiet Zone to cover any future at-grade crossings north of Leucadia Boulevard (see Section 1). There currently are two gate arms, one on the east and west sides of the tracks, plus bell and warning lights. There is sidewalk on the north side of Leucadia Boulevard with an ADA ramp on the western portion to accommodate the steep grade. RECOMMENDED SUPPLEMENTAL SAFETY MEASURES The recommended SSMs that would allow for Quiet Zone establishment at Leucadia Boulevard are: — Four quadrant gate system — Pedestrian gate arms — Pedestrian swing gates — Fencing — Sidewalk widening — Detectable warning panels on pedestrian approaches — Signage — Pavement markings — Potential timing modification to existing traffic signal at Leucadia Boulevard/North Coast Highway 101/Vulcan Avenue (requires coordination with adjacent 101 Streetscape and Coastal Rail Trail projects). Figure 2 is a high-level conceptual exhibit. Appendix A contains more detailed engineering concept design plans. The approximate cost is $2.66 million which includes design, permitting, construction, and associated costs. Appendix B contains a detailed project cost estimate. The original Project Cost Opinion was issued in February 2018. It has been updated as a result of the project team’s review and analysis of additional scope items suggested by stakeholder agencies at a site diagnostic meeting held on January 24, 2018. This site diagnostic meeting evaluated at-grade crossings at Leucadia Boulevard, D Street, E Street, Encinitas Station, and Chesterfield Drive. Chesterfield Drive costs are not included in this memo as these improvements are already constructed. Stakeholders included the Federal Railroad Administration (FRA), California Public Utilities Commission (CPUC) and North County Transit District (NCTD). This revision also reflects current unit prices and soft costs for each improvement location. The attached worksheets contain separate Project Cost Opinions for each improvement location, with the totals summarized in the table below. The Cannon Road crossing (City of Carlsbad) is included because this vehicular at-grade crossing is necessary to create a “bookend” for the quiet zone to cover any future at-grade crossings north of Leucadia Boulevard. Without improvements at Cannon Road, any future at-grade crossings north of Leucadia Boulevard would be outside the quiet zone limits, requiring train horns to be sounded. RECITALS The following recitals are a substantive part of this Agreement: WHEREAS, the purpose of this MOU is to document the Parties' understanding and responsibilities with respect to the design of improvements for the following at-grade rail crossings: • Encinitas: o E Street (MP 237.95) o D Street (MP 237.90) o Encinitas Station Pedestrian Crossing (MP 237.80) o Leucadia Blvd (MP 236.50) • Carlsbad: o Cannon Road (MP 231 .40) WHEREAS, said work shall be in support of the potential establishment of a Quiet Zone (QZ and/or PROJECT) by Encinitas and Carlsbad (collectively CITIES). Pursuant to NCTD Board Policy No. 18 -Railroad Safety and Community Enhancement Projects, the Parties agree that the CITIES are acting as the lead agencies on this project. WHEREAS, the Parties wish to memorialize their agreement in this MOU to carry out the purposes set forth above. AGREEMENT NOW THEREFORE, in consideration of the mutual promises set forth herein, the Parties agree as follows: EACH PARTY AGREES AS FOLLOWS: 1. The execution of this MOU is for the design phase only. Should the CITIES desire to continue past this phase, a new MOU will be executed prior to commencement of any _additional work that is related to the work shown on attached Exhibit "A". NCTD SHALL PERFORM THE FOLLOWING TASKS: 1. · NCTD shall execute an agreement with a consultant through its Rail and Transit Engineering Services on-call bench to provide support' for the application process, diagnostic evaluation, risk assessment, design, and cost estimate for construction. Additionally, NCTD shall execute a Task Order with Pacific Rail Enterprises (PRE) under Agreement No. 17000, On-Call Signal Engineering Design , to modify the signal DRAFT equipment design under the Signal Optimization project to meet QZ requirements. These agreements will include development of railroad related engineering designs including but not limited to, new and upgraded warning devices, gates, power out indicators, wayside horns, Quiet Zone confirmation signals, exit management systems, grade crossing panels, signal system modification, addition and alternations of signal housing, pedestrian control devices, roadway curb and gutter, pedestrian and Americans with Disabilities Act (ADA) path of travel, third-party utility ·connections, relocations, or modifications, in-pavement loop detectors, and other necessary signal requirements. 2. NCTD shall coordinate with the Federal Railroad Administration (FRA) for the QZ application process. 3. NCTD shall arrange for official site diagnostic meeting(s) to be held at the crossing that will include but not be limited to the California Public Utilities Commission (CPUC), FRA, CITIES, NCTD, BNSF Railway, and Amtrak. 4. NCTD shall update the National Grade Crossing Inventory data with the FRA and CPUC. In doing so, NCTD shall use data gathered from each operator and the CITIES. NCTD shall apply this updated information to the FRA Risk Calculator for the proposed Quiet Zone. 5. NCTD shall prepare any required CPUC General Order 88B applications related to modifications to crossings necessary for QZ establishment 6. The estimated cost for NCTD staff and consultants for these tasks is $XXX,XXX for the Encinitas crossings and $XXX,XXX for the Carlsbad crossings. NCTD shall receive full cost recovery from the CITIES for the tasks it agrees to perform under this MOU. 7. NCTD shall provide deposit reconciliation to CITIES on a quarterly basis. Such reconciliation shall include the hours and rates for staff and consultant personnel that have performed services, plus the actual cost of the items charged. There shall be no mark-up applied to any charge or cost. THE CITIES SHALL PERFORM THE FOLLOWING TASKS: 1. For services provided by NCTD's staff and consultants under this MOU, the CITIES shall provide NCTD with full cost recovery and shall provide an initial deposit for services in the amount of $XXXXX for Encinitas and $XXXX for Carlsbad within thirty (30) days of execution of this MOU. Services shall not commence until receipt of the deposit. NCTD shall draw against such deposit for staff and consultant services. In the event the deposit is depleted, NCTD shall notify the respective city, provide a reconciliation and request for additional deposit. Such additional deposit request shall include an estimate for the additional services to be provided. The respective city shall provide NCTD with the additional .deposit within thirty (30) days of notice. If such deposit is not provided by the city, services shall cease until receipt by NCTD. 2. Comply with the requirements set forth in the federal regulation for the creation of a QZ as provided in 49 CFR Part 222. 3. For each crossing that is located within the proposed QZ, the CITIES shall conduct a traffic and queuing study, as well as a separate pedestrian study that includes in its evaluation the impacts pedestrians may have on railroad operations. All such studies and reports shall be promptly provided to NCTD and the CPUC for review. 4. The CITIES shall provide timely review and feedback of QZ design and other supporting documents provided by NCTD and its consultants. 5. The CITIES shall submit any required applications to the CPUC for the approval of any changes to any crossing within the QZ. · DRAFT THE PARTIES MUTUALLY AGREE AS FOLLOWS: 1. All terms, conditions, and provisions hereof shall inure to and shall bind each of the Parties hereto, and each of their respective heirs, executors, administrators, successors, and assigns. 6. INDEMNITY: Neither Party nor any officer thereof is responsible for any damage or liability occurring by reason of anything done or omitted to be done by the other Party under or in connection with any work, authority or jurisdiction delegated thereto under this Agreement. It is understood and agreed that, pursuant to Government Code section 895.4, the Parties shall mutually defend, indemnify and save harmless one another, including all officers and employees from all claims, suits or actions of every name, kind and description brought for or on account of injury (as defined in Government Code section 810.8) occurring by reason of anything done or omitted to be done by either Party under or in connection with any work, authority or jurisdiction delegated thereto under this Agreement. 7. The indemnification provisions of this MOU shall survive termination of the MOU. 8, For purposes of this MOU, the relationship of the Parties is that of independent entities and not as agents of each other or as joint ventures or partners.
