A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD
MUNICIPAL WATER DISTRICT (CMWD BOARD) OF THE CITY OF CARLSBAD,
CALIFORNIA, CONTINUING THE DECLARATION FOR LOCAL EMERGENCY
WHICH WAS ISSUED ON DEC. 11, 2019, AND CONFIRMED ON DEC. 17, 2019
WHEREAS, on Dec. 11, 2019, the executive manager declared a local emergency under Public
Contract Code Section 22035 and 22050 and Carlsbad Municipal Code Sections 3.28.ll0(A) and
3.28.120 to facilitate the immediate repair of a potable water main located in the North County Transit
District (NCTD) railroad right of way; and
WHEREAS, on Dec. 17, 2019, the CMWD Board confirmed the Declaration of Local Emergency
with a unanimous vote of 4-0; and
WHEREAS, on Jan. 14, 2020, the CMWD Board confirmed the Declaration of Local Emergency
with a unanimous vote of 4-0; and
WHEREAS, the pipeline repair is not yet complete and staff recommends continuing the
Declaration for Local Emergency until it is no longer needed.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal Water
District of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Declaration for a Local Emergency for repair of a potable water main located in
the North County Transit District railroad right of way is continued.
PASSED, APPROVED AND ADOPTED at a Special Meeting of the Carlsbad Municipal Water
District of the City of Carlsbad on the 21st day of January 2020, by the following vote, to wit:
AYES: Hall, Blackburn, Bhat-Patel, Schumacher.
NAYS: None.
ABSENT: None.
