HomeMy WebLinkAbout2023-03-14; City Council; Resolution 2023-077RESOLUTION NO. 2023-077 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE PLANS, SPECIFICATIONS AND CONTRACT DOCUMENTS AND AUTHORIZING THE CITY CLERK TO ADVERTISE FOR BIDS FOR SEGMENT 2 OF THE AVENIDA ENCINAS COASTAL RAIL TRAIL AND PEDESTRIAN IMPROVEMENTS PROJECT AND APPROVING A ROADWAY RECONFIGURATION RESULTING IN LEVEL OF SERVICE 'D' FOR ONE SEGMENT OF AVENIDA ENCINAS FROM POINSETTIA LANE TO WINDROSE CIRCLE IN BOTH SOUTHBOUND AND NORTHBOUND DIRECTIONS WHEREAS, the City Council of the City of Carlsbad, California has determined that it is necessary and in the public interest to construct Segment 2 of the Avenida Encinas Coastal Rail Trail and Pedestrian Improvements, Capital Improvement Program Project No. 6004, or Project; and WHEREAS, the plans, specifications, and contract documents for Segment 2 of the Project have been prepared, are on file at the City Clerk's office and are incorporated herein by reference; and WHEREAS, the City of Carlsbad General Plan Mobility Element 3-P.15 states that the City Council shall have the sole discretion to approve reconfigured vehicle lanes or vehicle traffic calming improvements that would reduce vehicle capacity at or below a level of service of 'D'; and WHEREAS, based on the performed level of service analysis, Avenida Encinas from Poinsettia Lane to Windrose Circle in both southbound and northbound directions would degrade to level of service 'D' from a level of service 'C' because of the proposed lane reduction; and WHEREAS, based on staff's analysis, these propose d improvements will not cause additional congestion on the street; and WHEREAS, Carlsbad Municipal Code Section 3.28.080(E) requires the City Council to approve plans and specifications for all con struction projects that are to be formally bid upon when the value exceeds $200,000; and WHEREAS, the cost of the Project is estimated to be $2,657,140, which does not include a construction contingency or construction management and inspection costs; and WHEREAS, sufficient funding is available in the project account to complete the Project, which is to be funded with traffic impact fees and the Active Transportation Program grant funding; and WHEREAS, the City Planner has determined that the Project is categorically exempt from the California Environmental Quality Act, or CEQA, pursuant to CEQA Guidelines Section 15301(c), minor alteration of existing facilities including streets, sidewalks and similar facilities involving negligible or no expansion. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the plans, specifications and contract documents for Segment 2 of the Avenida Encinas Coastal Rail Trail and Pedestrian Improvements Project, CIP Project No. 6004, are hereby approved. 3. That the roadway reconfiguration of Avenida Encinas from Poinsettia Lane to Wind rose Circle in both southbound and northbound directions is approved. 4. That the City Clerk is authorized and directed to publish in accordance with state law, a Notice to Contractors Inviting Bids for construction of the Project, in accordance with the plans, specifications and contract documents referred to herein. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 14th day of March, 2023, by the following vote, to wit: AYES: NAYS: ABSTAIN: ABSENT: Blackburn, Bhat-Patel, Acosta, Burkholder, Luna.
